DEVELOPMENT POTENTIAL AND CLAWBACK The land immediately to the south of the farm adjoining the village of Metheringham is allocated in the Central Lincolnshire Local plan for residential development potentially for 276 dwellings. As part of Waneham Farm adjoining this area could in the future have potential for residential development the vendors will retain a share of the future development proceeds by imposing a development clawback on part of their land as shown edged green on the holding plan. In the event that planning consent is granted for residential development or that the land is developed for housing in the next 50 years the purchaser(s) and their successors in title will pay the sellers and their successors in title 35 % of the increase in the value of the land with the benefit of consent for residential use over its existing use value. The seller has consent under Class Q of the Town and Country Planning (General Permitted Development) (England) Order 2015 to convert 2 of the farm buildings into 2 dwellings. This consent will be invalidated if permitted development rights are used to erect any new agricultural building, or subsequently alter these under Class A(a) or B(a) of the Town and Country Planning (General Permitted Development) (England) Order 2015.Therefore if the farmland is sold separately from the farm yard the use of permitted development rights to erect, or alter, agricultural buildings on the land included in this sale under Classes A(a), B(a) or Q will be prohibited for a period of 10 years. The buyer is at liberty to erect new farm buildings provided that they obtain full planning permission. NEW ACCESS Planning Permission was granted 3 April 2017 reference 16/1635 for construction of a new farm access on to Sleaford road and the first 25 metres of the access to the south of Waneham Farm.
