Location The land is located to the north west of the City of Lincoln around the villages of Sturton by Stow and Marton, mainly north of Tillbridge Lane/Stow Park Road, the A1500. Situation and Amenities This is a strong arable farming area, setting high standards, with clay to sandy loam soils around 10 to 20m above sea level. The Lincolnshire Showground, home of the Lincolnshire Agricultural Society, is close by. Lincoln is a cathedral city and the administrative centre of Lincolnshire with an urban population of 130,200 (mid 2014 est.). It offers an excellent range of facilities and amenities with boutique shopping in the cathedral quarter, restaurants and pubs, sports facilities, golf course, supermarkets, leading retailers, medical and educational facilities. The University of Lincoln, which was established over 20 years ago, brings vibrancy to the life of the city. TENDER DATE: WEDNESDAY 6TH SEPTEMBER 2017 The land is to be sold by contractually binding formal tender on the following terms: 1. All tenders must reach the office of JHWalter, 1 Mint Lane, Lincoln, LN1 1UD no later than 12 noon on Wednesday 6th September No late tenders will be considered. 2. Tenders should be submitted in writing on the prescribed form, complete with the signed tender form and contract and placed within a sealed envelope marked Land at Sturton by Stow & Marton. 3. Tenders must be for a precise sum of pounds sterling. It is advised that tenders should be for an odd figure to avoid the possibility of identical bids. The tendered purchase price is to include the amount shown in the contract for each lot for Basic Payment Scheme Entitlements, which are included in the sale. 4. No tender will be considered which is calculated only by reference to another tender. 5. The seller does not undertake to accept the highest or indeed any tender. 6. Full name and address of both the prospective buyer and their solicitor should be provided with any tender. 7. All tenders must include evidence of finance for the purchase. 4 8. Tenders are to include a Solicitor s deposit cheque of 10% (or 20% if early entry is required) payable to the seller s Solicitor as agent. The successful buyer(s) should be notified via a signed contract by the seller, no later than 5pm on Tuesday 12th September, at which time the sale will be exchanged. Completion will take place on Wednesday 11th October Copies of supporting legal and other documentation referred to as the Tender Pack is available from the Selling Agent, preferably on request by the Solicitor/Agent acting for the prospective buyer. This includes; Tender Form, Conditions of Tender, Contract of Sale, Search Results, Relevant Title Documents. 10. The Selling Agent will be required to carry out identification checks for money laundering purposes on prospective buyers prior to issuing the Tender Pack. 11. It is possible to bid for a combination of lots on the following bases; (a) - The whole holding acres (b) - A single tender for more than one lot from the same Farm Holding (numeric Lot number) is permissible. For example Lot C and D of Lot 1, White House Farm, or Lot A and B of Lot 2, Village Farm or Lot A and B from Lot 3, Marton Grange. A single tender for a mix of lots across numeric Lots e.g. Whitehouse, Farm, Village Farm, Marton Grange, and others will not be accepted. Where a prospective buyer wishes to bid for lots from more than one numeric lot, they must bid separately on the Tender Form. The Land The land is divided into practical sized arable fields and is capable of growing very good yields of combinable crops and, in some fields, sugar beet. There are small areas of amenity woodland on Village Farm Lot A and Marton Grange Lot A. The land is shown on the MAFF land grading plans as classified grade 3. The 1:250,000 scale Soil Series Plan shows the soils are mainly Wickham 2 Association with some Blackwood. Wickham 2 - Slowly permeable seasonally waterlogged fine loamy over clayey, fine silty over clayey and clayey soils. Small areas of slowly permeable calcareous soils on steeper slopes. Suitable for growing cereals and grassland. Blackwood - Deep permeable sandy and coarse loamy soils. Groundwater controlled by ditches. Suitable for growing cereals, sugar beet and potatoes: some grassland and coniferous woodland. The predominant soils are Wickham 2. Land Registration Some parts of the holding are unregistered title. Basic Payment Scheme Included in the sale are Basic Payment Entitlements relating to the eligible land, which will be transferred to the buyer(s) after completion. The value of the entitlements will be apportioned from the sale price for the land in the contract. The entitlements will be transferred at the rate of 140 per entitlement. 7 Sporting Rights The sporting rights are in hand and included in the sale, in so far as they are owned. Mines and Minerals The mines and mineral rights are included in the sale, in so far as they are owned. In particular, there are some exclusions on the land at Marton. Tenure Vacant possession will be given on completion, subject to the reserved rights of holdover. Restrictions and Development Clawback The seller will not be retaining any development clawback, or overage. Services There is an electricity supply to the yard in Village Farm, Lot A. There is an electricity supply to the grain store at Marton Grange Lot A. Farm Buildings Lot 2 - Village Farm Lot A - Grain Store (24m x 19.4m) - a clear span steel portal frame building with steel grain walling to 2.85m. Central wind tunnel. Below floor laterals. Fan house with fan and diesel generator. Approximate capacity for 950 tonnes of grain. Implements Store (6.1m x 24m) - 5 bay open fronted building with earth floor. General Purpose Building (24m x 35m) - 7 bay steel frame building with lean-tos, open fronted with hard core floor. Attached Livestock Building and Store (6.3m x 12m). The fertiliser tank presently on site is not included in the sale. Lot 3 - Marton Grange Lot A - Grain Store (18.3m x 27.6m) - 6 bay twin span portal frame building with steel and concrete frames. Steel grain walling to 2.25m. Central grain tunnel. Concrete floor with below floor laterals. Fan house with electric 75 horse power fan. Capacity for around 800 tonnes of grain. Please note that a notice relating to this building was received on 10/7/17 from WLDC. Further information is in the Tender Pack. The fertiliser tank presently on site is not included in the sale. Telecom Mast Site The Telecom mast site behind the grain store at Village Farm, Lot A is excluded from the sale. The mast is contained in a secure compound measuring 7.3m x 12m. A right of way from the A1500 through the farm to the mast compound is reserved for the freeholder and leaseholder. Holdover After completion, the seller will holdover on any fields not cleared of the current crop. There are 50 acres of sugar beet on Whitehouse Farm, Lot A and spring beans on land off Mill Lane, Sturton by Stow and on Marton Grange, Lot A. There is a longstop hold over date for land growing spring beans until 30 November 2017 and for land growing sugar beet, a longstop date until 31 January It is anticipated that the sugar beet will be harvested before Christmas. OSR and grain harvested this summer will be stored in the two grain stores at Village Farm, Lot A and at Marton Grange, Lot A with a holdover longstop date until 31 March Early Entry Early entry prior to completion is available, immediately after a crop has been harvested and straw removed, by paying a 20% deposit. Easements, Wayleaves and Rights of Way The property is sold subject to and with the benefit of all easements, wayleaves and rights of way whether public or private and whether or not mentioned in these particulars of sale. Overhead electricity lines cross Village Farm, Lot A, (field 5905) and Village Farm, Lot B (field 4837). Underground electricity cables cross Village Farm, Lot A (field 6377) and Village Farm, Lot B (field 4837). Underground gas/fuel pipelines cross all fields at Marton Grange, Lots A and B except field 8708 in Lot A. Underground fuel/gas pipelines cross the following fields at Sturton by Stow - Village Farm, Lot A (fields 2901;5517 and 5905); White House Farm, Lot A (fields 4536, 6802 and 6372); Lot C, (fields 3153 and 3636); and Lot D, (field 0964). The right of way and easement for services reserved to the telecoms mast site on Village Farm, Lot A is shown in green (dashed). There is a right of access shown in green (dashed) to the sewage works adjoining White House Farm, Lot A. The accesses coloured brown have been used for accessing adjoining land for many years. Drainage Much of the land is under drained. Some drainage works have been undertaken in recent years and the drainage system has been regularly maintained. The available drainage plans are included in the Tender Pack. Drainage Rates Drainage rates are payable for land at Marton to the Trent Valley Internal Drainage Board and for land at Sturton to the Upper Witham Internal Drainage Board. Copies of the most recent invoices are in the Tender Pack. VAT It is not thought that the sale will attract VAT. However, in the event that any of the property is sold subject to VAT, this will be payable in addition to the purchase price. Growing Crops and ingoing valuation It is intended that the seller will harvest the growing crops and undertake post-harvest cultivations as well as establishing oilseed rape, where appropriate. The buyer will be required to pay to the seller the full amount of the Ingoing Valuation due to the outgoer in accordance with the prices and recommendations of the Central Association for Agricultural Valuers. The Ingoing Valuation will be calculated by JHWalter and will be payable on completion. There will be no counterclaim of any kind. Town and Country Planning The land is within West Lindsey District.
