Situation and Amenities This is a first class arable farming area, around 23m above sea level. Lincoln is a cathedral city and the administrative centre of Lincolnshire with an urban population of 130,200 (mid 2014 est). It offers a good range of facilities and amenities with boutique shopping in the cathedral quarter, a good range of restaurants and pubs, sports facilities, golf courses, supermarkets, leading retailers, medical and educational facilities. 3 Method of sale The farm is offered for sale by formal tender as a whole or in 3 lots. All tenders must reach the office of JHWalter, 1 Mint Lane, Lincoln, LN1 1UD no later than 12 noon on Friday 19th May No late tenders will be considered. 2. Tenders should be submitted in writing on the prescribed form complete with the signed tender form and contract and placed within a sealed envelope marked Land at Glentham. 3. Tenders must be for a precise sum of pounds sterling. It is advised that tenders should be for an odd figure to avoid the possibility of identical bids. 4. No tender will be considered which is calculated by reference to another tender. 5. The vendor does not undertake to accept the higher or indeed any tender. 6. Full name and address of both the prospective purchaser and their solicitor should be provided with any tender. 7. All tenders must include evidence of finance for the purchase. 8. Tenders are to include a Solicitor deposit cheque of 10% payable to the vendors Solicitor. The successful purchaser should be notified via a signed contract by the vendor, no later than 5pm on 26th May 2017, at which time the sale will be exchanged. Completion will take place on 1st August Copies of supporting legal documentation referred to as a Tender Pack is available from the Selling Agents, preferably on request by the Solicitor/Agent acting for the prospective purchaser. The land The land is divided into good sized arable fields and is capable of growing good yields of combinable crops, potatoes and sugar beet. The holding benefits from an irrigation licence and reservoir which services Lot 1 and 2. There is a small area of amenity woodland on Lot 1 and Lot 2. The land is shown on the MAFF land grading plans as classified grade 3. The soil is a mix of: Aswarby - Shallow permeable calcareous fine loamy soils over limestone. Suitable for growing cereals, sugar beet and potatoes. Ruskington - Deep permeable calcareous coarse and fine loamy and sandy soils. Suitable for growing Cereals, sugar beet and potatoes; some field vegetables. Basic Payment Scheme Included in the sale are Basic Payment Entitlements relating to the eligible land which will be transferred to the purchaser after completion. The value of the entitlements will be apportioned from the sale price in the contract. The entitlements will be 170 per entitlement. 4 Mines and Minerals The mines and minerals are in hand and included in so far as they are owned. Scheduled Ancient Monument Part of Lot 3 is registered as Scheduled Ancient Monument. The monument includes the buried remains of a Neolithic D-shaped barrow and outer enclosure. Further details can be found in the tender pack. Tenure The land has been farmed by J R Green & Sons. Vacant possession will be given on completion other than on land where seasonal cropping licences have been agreed for the current growing season. Restrictions and Development clawback The vendor will not be imposing development clawback. Services There are no services to the land. Holdover After completion the purchaser will holdover on any fields not cleared of the current crop. The purchaser may take entry immediately after a field is cleared. The following licences are in place and will continue until their agreed end date: Potatoes acres in field 9025 (lot 1). Licence period ends 13th October The vendor will retain the licence fee. Reservoir and Irrigation Lot 1 includes an 8 million gallon, clay lined reservoir constructed in The land is sold with the benefit of an abstraction licence. If the lots are sold separately the benefit of the irrigation licence will pass with lot 1. The abstraction point is located on lot 2 and if the lots are sold separately the purchaser of lot 1 will have the right to use the abstraction point on lot 2. The underground main runs west from the reservoir before turning north and south, with hydrants spaced along western boundary of Lot 1. The main which heads north crosses the private road into Lot 2 where there are two hydrants. Easements, Wayleaves, Rights of Way and Other Obligations The property is sold subject to and with the benefit of all easements, wayleaves, rights of way whether public or private and liabilities and other obligations whether or not mentioned in these particulars of sale. An overhead electricity line crosses Lot 2 (field 5344) and Lot 1 (fields 9025, 9991 and 1757). Public rights of way cross the following field Drainage The land is under drained where required. Drainage works have been undertaken in the last few years. Drainage plans are available in the tender pack. Drainage rates are payable to the environment agency. VAT It is not thought that the sale will attract V.A.T. However, in the event that any of the property is sold subject to V.A.T. this will be payable in addition to the purchase price. Growing Crops and ingoing valuation It is not anticipated that there will be a claim by the vendor for growing crops or ingoing valuation. However, the vendor reserves the right to request in addition to the purchase price, the full amount of the ingoing valuation due to the outgoer. There will be no counterclaim whatsoever of any kind.
