3 THE LAND: The land comprises mixed grass and arable with most of the grass capable of mowing. The contours are undulating and the farm is best suited to livestock enterprises. The arable land is currently farmed on a rotation which includes cereals and short term leys. We are informed that some 83 acres are capable of being ploughed. The present Tenant, Lol Hodgson carries a flock of sheep and beef cattle. The land is classed as Grade 3 & 4 on the Agricultural Land Classification maps. The Soil Survey for England and Wales identifies the land as being in the Dunkeswick series and being slowly permeable seasonally waterlogged fine loamy over clayey soils, associated with similar clayey soils and is further described as being suitable for grassland in most lowlands, some arable in drier lowlands. 4 MAIN TERMS OF AGREEMENT: Term: Block 1, Low Farm and 123 acres is available to let on a Farm Business Tenancy for a term of either 5 or 10 years. Entry onto the land and the farm buildings will be allowed in October 2017, and the farmhouse will be available subject to completion of the refurbishment. Blocks 2 & 3 will be let on FBT s for 3 years initially subject to summer grazing only. Rent Payments: The rent will be payable 6 monthly in advance. Rent Review: There will be a provision in the tenancy agreement for a rent review every 3 years. Basic Payment Scheme: The land is registered with the Rural Payments Agency and has been used to claim the Basic Payment Entitlements. The Basic Payment entitlements attributable to the land, based on the outgoing 2017 claim, will be transferred to the incoming tenant to use for the duration of the Tenancy. The 2017 claim is reserved to the outgoer and the incomer will be bound to the cross compliance regulations. Prospective tenants should satisfy themselves as to the eligible areas. There will be no in-going payment for the Basic Payment Entitlements. The incoming tenant will be obliged at his cost to transfer the entitlements back to the Landlord or their nominee at the termination of the Farm Business Tenancy Agreement, for no payment. Costs of the Agreement: The successful tenant will be expected to contribute 200 plus vat towards the costs of setting up the Farm Business Tenancy Agreement and towards the cost of transferring the BPS entitlements. Repair & Maintenance: Repairing and maintenance obligations will be as set out in the Agricultural (Model Clauses for Fixed Equipment) Regulations 2015 (SI No. 950). Possession: The property will be available for possession in October Farmhouse: The Tenant must reside in the farmhouse and it must be occupied as part of the holding. Tenant s Buildings: Buildings 4, 5 and 6 will be listed as Tenants fixtures within the Farm Business Tenancy Agreement and the Tenants will take full responsibility for those buildings. No ingoing charge will be required. Other Rights: All sporting, timber and mineral rights will be retained by the Landlord. The shooting is let for the 2017/18 season to a syndicate of local farmers, who have indicated the incoming tenant would be welcome to join them. Easements, Wayleaves: The land is let subject to all easements and wayleaves whether formally mentioned in the tenancy agreement including these lettings details or not. The Landlord will reserve the right to retain the payment for all easements and wayleaves on the land. Record of Condition: A photographic record of condition will be completed at the commencement of the agreement.

5 Rights of Way: The Landlord reserves a right of way over all Farm Roads and farm tracks for both their private use, for the ongoing management of the Farm and for the shoot where appropriate. All other tracks included within the farm business tenancy will be the responsibility of the Tenant to repair and maintain. There is a public right of way, officially a footpath but also used as a bridleway, along the farm access track off Fylinghall Lane to Middlewood Lane. It is not a vehicular right of way.
