1 LIVESTOCK FARM TO LET IN POWYS ON THE INSTRUCTION OF THE DINAM ESTATE A hectare ( acre) residential livestock Holding available as a Whole To be let by tender on a fifteen year Farm Business Tenancy commencing October 2017 Lower Gwerneirin, Llandinam, Powys, SY17 5DD Tenders to be submitted to: Balfours LLP, New Windsor House, Oxon Business Park, Shrewsbury, SY3 5HJ By no later than noon on Friday, 15 th September 2017

2 Introduction Lower Gwerneirin Farm forms part of the Dinam Estate and lies close to the west of Llandinam. A location plan is attached at Annex A. The Holding has been farmed continuously for 48 years by the Brown family and Balfours LLP are instructed to offer the farm for letting on a Farm Business Tenancy. The Farm is offered as a Whole to include the farmhouse, buildings and land. A plan and schedule of the farm can be found at Annex B, C and D. Access is shown by a blue line. Description of the Holding The Land The Holding is in two blocks. The main block is 92.12ha ( acres) surrounding the farmstead. This is all laid down to permanent pasture of variable quality ranging between higher ground to the north west sloping steeply down to the flood plain either side of the River Severn. The second block is an area of ha ( acres) of hill land approximately three miles to the south east. The Holding is generally south east facing. The eastern boundary of the farm follows the River Severn. Some of these fields flood regularly and the River Severn has been known to alter its route sometimes at short notice. Buildings The buildings are to the north of the farmhouse and contain a number of useful traditional and modern buildings. These are identified on the plan at Annex E which also includes photographs and a schedule of measurements. Most of the buildings already belong to the Landlord and the intention is to acquire any existing Tenants buildings. Tenders should be on the basis that the Tenant will not be expected to purchase any buildings upon entering the Holding. The Farmhouse There is a traditional brick farmhouse with slate roof. The accommodation comprises; Ground Floor: Sitting room, dining room, further living room, kitchen, office, utility/boot room, walk in pantry First Floor: 2 bedrooms with en-suite shower room and W.C., three further bedrooms, two bathrooms, large landing Below Ground: Two cellars The house is generally in good condition. Heating is oil fired central heating with additional stoves in the two sitting rooms. It is expected all existing fixtures will remain in the property including carpets but not curtains. Curtains will be available to purchase by negotiation with the outgoing Tenant. Tenders should be on this basis. The previous Tenant ran a Bed and Breakfast enterprise from the farmhouse and the Landlord would be willing to consider this again.

3 Services Water There is mains water to the house and buildings and surrounding land. The top field (SO ) is spring fed and on the lower fields water is available from the River Severn. Most fields have a water supply either natural or mains. Some tanking is necessary in dry conditions. Electricity There is a single phase electricity supply which serves the farmhouse and buildings. Drainage The farmhouse is served by a private septic tank. Tenancy Agreement General The Holding is to be offered on an initial 15 year Farm Business Tenancy (FBT). A draft of the tenancy agreement will be available for inspection on the viewing days or can be ed to potential applicants on demand. Stamp Duty Land Tax The successful tenant will be responsible for any Stamp Duty Land Tax arising from the tenancy and the registration of the tenancy with the Land Registry. Term The initial term will commence on a date in October 2017 to 25 th March 2018, and will then run until the 24 th March Rent The rent is to be paid half yearly, in advance, by standing order. The rent days will be 25 th March and 29 th September. A pro rata rent will be payable from the commencement date to 24 th March Rent reviews will be subject to the statutory provisions of the Agricultural Tenancies Act 1995, and accordingly the first review will be no earlier than 25 th March Occupation of the Farmhouse The Tenant would be expected to personally reside in the Farmhouse, occupation by a farm employee might be considered by agreement Additional Rights The sporting rights, rights to game, timber and minerals, are reserved by the Landlord. There is an active shoot and the incoming Tenant will be expected to co-operate with the Shooting Tenant. In particular, the shoot access woods through the farm on a regular basis. The Landlord will also reserve the right to take up to two acres of hill land for a pheasant release pen. There will be a proportional reduction in rent.

4 General Matters Affecting the Holding Basic Payment Scheme There are currently no entitlements available with the Holding, though the land has previously been used to claim BPS. A Tenant wishing to access BPS payments will have to purchase entitlements for the Holding. The outgoing Tenant has agreed to offer his entitlements for sale by negotiation. Tenant Right There will be no Tenant right or dilapidation claim at the end of the current tenancy. So no incoming to pay. The incoming Tenant will be expected to take the Holding as seen. The outgoing Tenants are holding a farm sale on 30 th September and will be allowed reasonable time to remove equipment thereafter. Public Rights of Way, Wayleaves, Easements and Restrictions The property is let subject to all of the existing public rights of way, wayleaves, easements and restrictions, payments for which are reserved to the Landlord. Annual Fair Field SO is used for the David Davies Hunt Country Show usually in April/May. The incoming Tenant will be expected to cooperate with the organising committee to allow this to continue without compensation. Local Authority The local authority is Powys County Council, Spa Road East, Llandrindod Wells, Powys, LD1 5LG. Council Tax The farmhouse is Band G. The council tax for the year starting 1 st April 2017 is 2, per annum. Ancient Monument SO is the site of Cefn Carnedd Camp, a scheduled monument (MG016). This will restrict activities on this field. Repairing Obligations The repairing obligations will be as per the Statutory Instruments Agriculture (Maintenance, Repair and Insurance of Fixed Equipment) Regulations 1973 (as amended). These are the model clauses which remain in force in Wales. Any applicant should ensure they are fully aware of the statutory instrument before applying for the tenancy. The full obligations can be found at: Environmental Schemes There are no Environmental Schemes currently on the Holding. There are no objections in principle to the incoming Tenant entering a scheme.

5 Viewing Days Interested parties may view the farm on Wednesday 23 rd August 2017, between am and 3.00 pm. The Agents, outgoing Tenant and Landlord will be on hand to answer questions and discuss any matters arising. Viewing at any other time is not permitted except by prior appointment. Directions Take the A470 to Llandinam. In Llandinam, there is a bridge crossing the River Severn by a large statue. Cross the bridge and after approximately ¾ miles, turn right past the Severn Trent Water works. The farm is at the end of the lane.
