RECOMMENDATONS: A. THAT frst readng be gven to Offcal Communty Plan Amendment Bylaw No B. THAT Bylaw No be confrmed as beng consstent wth the Current Fnancal Plan and the Lqud and Sold Waste Management Plans, as requred by the Local Government Act. C. THAT second readng be gven to Bylaw No D. THAT frst and second readngs be gven to Zonng Amendment Bylaw No E. THAT the applcaton for Development Varance Permt LU be receved. F. THAT Bylaws No and 7133 and Development Varance Permt LU be referred to a Publc Hearng. G. THAT the owners satsfy the followng requrements as a condton of fnal consderaton and adopton: 1. Provde a 1.14 m road dedcaton along the 47 A Avenue frontage and a 3 m x 3 m corner truncaton at the ntersecton of 47A Avenue and 47A Street; 2. Provde a 0.85 m wde statutory rght-of-way for utltes along 47A Avenue; 3. Provde a 2.75 m wde statutory rght -of-way for lane access at the rear of each lot; 4. Enter nto a Secton 219 Restrctve Covenant for buldng desgn, landscapng and flood proofng to the satsfacton of the Drector of Communty Plannng & Development; and 5. Provde a securty n the amount of $3,000 for tree replacement. H. THAT the owners be requred to provde a water meter for each lot at the buldng permt stage.

PURPOSE: The purpose of ths report s to present for Councl's consderaton Offcal Communty Plan Amendment Bylaw No (Attachment A) and Zonng Amendment Bylaw No (Attachment B). Bylaws No and 7133 would allow subdvson of the property at A Avenue nto three lots and develop them together wth the lots at 4784,4790 and A Avenue as a comprehensvely planned sngle famly nfll (coach house) subdvson wth rear lane vehcular access. A locaton map s provded n Attachment C and project data tables are ncluded n Attachment D. BACKGROUND: On Aprl 23, 2012, Councl adopted Offcal Communty Plan Amendment Bylaw No and Zonng Amendment Bylaw No. 6964, and approved Development Varance Permt No. LU to allow a subdvson whch created three new sngle famly nfll (coach house) resdental lots at 4784,4790 and A Avenue wth vehcular access from 47 A Avenue. The owners of the new lots have subsequently purchased the adjacent lot to the west at A Avenue and have submtted an applcaton to subdvde t nto three sngle famly nfll (coach house) resdental lots wth rear lane vehcular access. The owners also propose to extend the lane to provde rear lane vehcular access to the three exstng lots whch wll elmnate three drveways from 47AAvenue. Ste Descrpton and Context: The ste at A Avenue s 1,167 m 2 (12,561 ft2) n area, 28.9 m (95 ft) wde, zoned RM1 Multple Famly (Duplex) Resdental and contans a one-storey sngle famly dwellng that would be demolshed. The stes at 4784,4790 and A Avenue are each zoned RS9 Sngle Famly (330 m 2 ) nfll Resdental, 405 m 2 (4,359 ft2) n area, 10.4 m (34 ft) wde and are vacant. To the east s a 4.5 m (15 ft) wde Delta-owned parcel whch accommodates a storm dran, and further east are sngle famly dwellngs on 10.4 m (34 ft) wde lots. To the north, south and west are sngle famly dwellngs on varyng szed lots wth frontages rangng from 15 m to 29 m (49 ft to 95 ft). To the northeast on the opposte sde of 47A Avenue are nne sngle famly dwellngs wth coach houses on 10m (33 ft) wde lots. Councl Polcy: The subject propertes are desgnated One and Two Unt Resdental n Schedule A of the Offcal Communty Plan. The property at A Avenue s desgnated nfll Sngle Famly Resdental and the propertes at 4784,4790 and A Avenue are desgnated Ground-Orented Resdental n Schedule B.3 (Ladner Area Plan) of the Offcal Communty Plan. The nfll Sngle Famly Resdental desgnaton s ntended for ndvdual ground-orented sngle famly unts at a densty range of 8 to 27 unts per hectare (3 to 11 unts per acre). The Ground-Orented Resdental desgnaton s ntended for sngle famly, duplex and multple famly resdental unts at a densty range of 17 to 62 unts per hectare (7 to 25 unts per acre). The followng Ladner Area Plan polces apply to ths applcaton: Polcy D.1 Encourage nfll Housng to Renew and Upgrade Neghbourhoods

3 Page 3 of ,4784,4790, and A Avenue (Chong) LU January 17, 2013 Polcy 0.8 Polcy 0.9 Polcy H.8 DSCUSSON: Encourage Compatble Housng Desgn Encourage Compatble Coach House Desgn Ensure Tree Replacement Proposal: The owners are proposng to subdvde the subject property at A Avenue nto three sngle famly nfll (coach house) resdental lots and to ncrease the maxmum allowable floor space rato for the propertes at 4784,4790 and A Avenue from 0.65 to 0.68 n order to accommodate a sngle famly dwellng and a coach house havng rear lane vehcular access for each lot (Attachment E). An Offcal Communty Plan amendment, rezonng and Development Varance Permt are requred to allow the development. Communty Consultaton: Secton 879 of the Local Government Act requres that Councl determne what organzatons and authortes mght be affected or have an nterest n an Offcal Communty Plan amendment and consult wth them accordngly. The consultaton process for ths Offcal Communty Plan amendment applcaton was endorsed by Councl at the September 17, 2012 Regular Meetng. Communty consultaton conssted of a publc notce sgn, a notfcaton letter and a Publc nformaton Meetng, whch was held on October 17, 2012 and attended by two nearby resdents. No comments were receved. Snce the Publc nformaton Meetng, a nearby property owner expressed a desre to retan the large tree at the southwest corner of the property at A Avenue. The tree would be removed and replaced wth two new trees, as t would conflct wth the buldng envelope for the coach house proposed on Lot A. Offcal Communty Plan Amendment: The land use desgnaton for the property at A Avenue n the Ladner Future Land Use Plan s nfll Sngle Famly Resdental, whch allows a maxmum densty range of 8 to 27 unts per hectare (3 to 11 unts per acre). The densty of the proposed development at A Avenue would be 51 unts per hectare (21 unts per acre). An Offcal Communty Plan amendment s requred to change the land use desgnaton of the subject property at A Avenue to Ground-Orented Resdental, whch allows a densty range of 17 to 62 unts per hectare (7 to 25 unts per acre) and would accommodate the proposed densty. The propertes to the northeast are desgnated Mxed Use (Hertage) 5 and the propertes to the north and east are desgnated Ground-Orented Resdental. The proposed Offcal Communty Plan amendment would extend the Ground-Orented Resdental land use desgnaton to nclude the property at A Avenue (Attachment F). Whle part of the ste area s dedcated for a rear lane, the proposed subdvson s generally consstent wth the exstng development pattern along 47A Avenue to the east as shown n Attachment G. However, the proposed lot areas between 337 m 2 and 342 m 2 (3,627 ft2 and 3,681 ft2) and lot wdth of 9.7 m (32 ft) for the three new lots would be smaller than the lot szes n the surroundng neghbourhood. Rezonng: The owners wsh to rezone the subject propertes to Comprehensve Development Zone No. 417 to allow for a sx-lot sngle famly nfll (coach house) resdental subdvson havng rear lane vehcular access. The Comprehensve Development Zone No. 417,

No. 417 Setbacks: Prncgal Structure Rear: 6.7 m (22 t) 18.5 m (61 t) Accessol): Structure Front: 25 m (82 t) 23 m (75 t) Rear: 1.5 m '(5 ft)' 4.2 m '(14 t) Densty for Lots A, Band C; and 0.68 for Lots D, E and F Maxmum Heght: Prncgal Structure Roof Rdge: 10.8 m (35 t) 10 m (33 t) Md Roof: 8.3 m (27 t) 8 m (26 t) Accessory Structure Roof Rdge: 9.8 m (32 t) 7.5 m (25 t) Md Roof: 7.3 m (24 t) 6.6 m (22 t) Despte a hgher floor space rato, the proposed floor area for the three exstng lots would be less than the prevously approved maxmum of 263 m 2 (2,831 ft2), gven a reduced lot area as a result of the lane dedcaton. Development Varance Permt: A Development Varance Permt to vary Secton 5.2 of "Delta Subdvson and Development Standards Bylaw No. 5100, 1994" s requested to reduce the requred lane dedcaton wdth from 7.5 m (25 ft) to 3.75 m (12.3 ft). The reduced lane dedcaton would be augmented by a 2.75 m (9 ft) access statutory rghtof-way to provde for an effectve lane wdth of 6.5 m (21 ft), whch would be suffcent to accommodate vehcular access and turnng movements. The rear lane access would elmnate three drveways on 47AAvenue resultng n an unnterrupted sdewalk and a more attractve streetscape along 47A Avenue. The Engneerng Department has no objectons to the varance request. House Desgn: The proposal s for one 2 11, storey sngle famly dwellng and one two-storey coach house dwellng unt on each lot. The proposed sngle famly dwellngs at the front of each lot would be 189 m 2 (2,034 W) n area and have a maxmum roof rdge heght of 10 m (33 ft). The proposed two-storey coach house dwellng unts at the rear of each lot would be 57 m 2 (614 ft2) n area wth a maxmum roof rdge heght of 7.5 m (25 ft). The proposed buldngs would be smlar n scale and stng to the buldngs of other approved RS9 Sngle Famly (330 m2) nfll Resdental developments on the north sde of 47A Avenue to the east. The desgns would employ steep roofnes, shed dormers, roof decks and a covered entry. Fnsh materals would nclude vnyl sdng or Hard plank, gable wall shngle accents and asphalt or lamnate roof shngles. The owners have submtted desgn gudelnes, ncludng stng layout and sample desgns (Attachment H), whch would be compatble wth the vsual character of nearby housng, and be consstent wth the Ladner Area Plan Housng Gudelnes and Coach House Gudelnes. The owners would be requred to enter nto a desgn covenant. The desgn covenant would replace the exstng desgn covenant already regstered for the three exstng lots.

A tree removal and replacement plan s ncluded n Attachment. mplcatons: Fnancal mplcatons - The proposed sx-lot subdvson and development wll generate an estmated $10,000 n annual property tax revenue for Delta. nterdepartmental mplcatons - The owners would be requred to comply wth the development regulatons set out n "Delta Subdvson and Development Standards Bylaw No. 5100, 1994". They would be requred to provde a 1.14 m (3.7 ft) wde road dedcaton, a 3 m x 3 m (9.8 ft x 9.8 ft) corner truncaton, a 0.85 m (2.8 ft) wde statutory rght-of-way for utltes and a 2.75 m (9 ft) wde statutory rght-of-way for lane access. n addton to the rear lane dedcaton and rght70f-way, they would be requred to provde a water meter for each lot and enter nto a flood proofng covenant. CONCLUSON: The owners are proposng a comprehensvely planned sngle famly nfll (coach house) subdvson creatng a total of sx lots wth rear lane vehcular access for the subject propertes. t s recommended that Offcal Communty Plan Amendment Bylaw No and Zonng Amendment Bylaw No be gven frst and second readngs, and that the bylaws and Development Varance Permt LU be referred to a Publc Hearng. Lghtng: Any lghtng used to llumnate any parkng areas shall be so arranged that all drect rays of lght llumnate only the parkng areas and not any adjonng premses. Surface Fnsh: All parkng areas and drveways shall be surfaced wth an asphalt, concrete or pervous pavng so as to provde a surface that s durable and dust-free and shall be so graded and draned as to properly dsperse all surface water. 10. Land Development: Notwthstandng any other provsons of ths bylaw, the uses permtted by ths bylaw shall be condtonal upon the mmedate avalablty and adequacy of those muncpal facltes and servces herenafter set forth to serve the parcel of land and buldngs, 'Structures', and uses to be erected, placed or undertaken thereon. No use of land and no use of any buldng or 'Structure' thereon shall be deemed to be authorzed by ths bylaw and all uses otherwse permtted by ths bylaw are hereby prohbted unless and untl all of the followng servces and facltes have been provded and are mmedately avalable and are adequate therefor to the standards set out as follows:
