1 ORDINANCE NO AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, ESTABLISHING THE ORANGE BLOSSOM GROVES COMMUNITY DEVELOPMENT DISTRICT LOCATED IN UNINCORPORATED COLLIER COUNTY AND CONTAINING APPROXIMATELY ACRES; PROVIDING FOR THE AUTHORITY OF THE ORDINANCE; PROVIDING FOR THE ESTABLISHMENT OF THE BOUNDARIES FOR THE ORANGE BLOSSOM GROVES COMMUNITY DEVELOPMENT DISTRICT; PROVIDING FOR THE DESIGNATION OF THE INITIAL BOARD MEMBERS; PROVIDING FOR THE DISTRICT NAME; PROVIDING FOR STATUTORY PROVISIONS GOVERNING THE DISTRICT; PROVIDING FOR CONSENT TO SPECIAL POWERS; PROVIDING FOR PETITIONER' S COMMITMENTS; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, RP Orange Blossom Owner, LLC, a Delaware lmted lablty company has pettoned the Board of County Commssoners ( Board) of Coller County, Florda, a poltcal subdvson of the State of Florda, to establsh the ORANGE BLOSSOM GROVES COMMUNITY DEVELOPMENT DISTRICT( Dstrct); and WHEREAS, the Board of County Commssoners, after proper publshed notce has conducted a publc hearng on the petton and determned the followng wth respect to the factors to be consdered n Secton ( 1)( e) Florda Statutes, as requred by Secton ( 2)( c), Florda Statutes: 1. The petton s complete and meets the requrements of Secton , Florda Statutes, and all statements contaned wthn the petton are true and correct. 2. Establshment of the proposed Dstrct s not nconsstent wth any applcable element or porton of the local comprehensve plan of Coller County, known as the Coller County Growth Management Plan, or the State Comprehensve Plan. 3. The area of land wthn the proposed Dstrct s of suffcent sze, s suffcently compact, and s suffcently contguous to be developable as one functonal nterrelated communty. 4. The Dstrct s the best alternatve avalable for delverng communty development servces and facltes to the area that wll be servced by the Dstrct. 5. The communty development servces and facltes of the Dstrct wll not be ncompatble wth the capacty and uses of exstng local and regonal communty development servces and facltes. 16- CPS-01592/ / 1 1

2 6. The area that wll be served by the Dstrct s amenable to separate specal-dstrct government. WHEREAS, t s the polcy of ths State, as provded for n Secton (2)( c), Florda Statutes, that the exercse by any ndependent dstrct of ts powers as set forth by unform general law comply wth all applcable governmental laws, rules, regulatons, and polces governng plannng and permttng of the development to be servced by the dstrct, to ensure that nether the establshment nor operaton of such dstrct s a development order under Chapter 380, Florda Statutes, and that the dstrct so establshed does not have any zonng or permttng powers governng development; and WHEREAS, Secton ( 3), Florda Statutes, provdes that all governmental plannng, envronmental, and land development laws, regulatons, and ordnances apply to all development of the land wthn a communty development dstrct. Communty development dstrcts do not have the power of a local government to adopt a comprehensve plan, buldng code, or land development code, as those terms are defned n the Local Government Comprehensve Plannng and Land Development Regulaton Act. A dstrct shall take no acton whch s nconsstent wth applcable comprehensve plans, ordnances, or regulatons of the applcable local general- purpose government. WHEREAS, pursuant to Secton ( 2)( d), Florda Statutes, upon the establshment of the proposed communty development dstrct, the Dstrct Board of Supervsors have sought consent from Coller County for the grant of authorty to exercse specal powers wthout queston as to the contnued rght, authorty and power to exercse ts lmted powers as establshed by ths Ordnance. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION ONE: AUTHORITY FOR ORDINANCE Ths Ordnance s adopted pursuant to Secton ( 2), Florda Statutes, and other applcable provsons of law governng county ordnances. 16-CPS / / 1 2

3 SECTION TWO: ESTABLISHMENT OF THE ORANGE BLOSSOM GROVES COMMUNITY DEVELOPMENT DISTRICT The Orange Blossom Groves Communty Development Dstrct s hereby establshed wthn the boundares of the real property descrbed n Exhbt "A" attached hereto and ncorporated by reference heren. SECTION THREE: DESIGNATION OF INITIAL BOARD MEMBERS of Supervsors: The followng fve persons are herewth desgnated to be the ntal members of the Board 1. Mark Taylor 2. SECTION FIVE: STATUTORY PROVISIONS GOVERNING THE DISTRICT The Orange Blossom Groves Communty Development Dstrct shall be governed by the provsons of Chapter 190, Florda Statutes, and all other applcable general and local law. 16- CPS-01592/

4 SECTION SIX: CONSENT TO SPECIAL POWERS Upon the effectve date of ths Ordnance, the Orange Blossom Groves Communty Development Dstrct wll be duly and legally authorzed to exst and exercse all of ts powers as set forth n Secton ( 1), Florda Statutes, and as otherwse provded by law. The Board hereby consents to the exercse by the Board of Supervsors of the Dstrct of the specal powers set forth n Secton ( 2)( d), Florda Statutes, to plan, establsh, acqure, construct or reconstruct, enlarge or extend, equp, operate, and mantan addtonal systems and facltes for Securty, ncludng, but not lmted to, guardhouses, fences and gates, electronc ntruson-detecton systems, and patrol cars, when authorzed by proper governmental agences; except that the dstrct may not exercse any polce power, but may contract wth the approprate local general- purpose government agences for an ncreased level of such servces wthn the Dstrct boundares. SECTION SEVEN: PETITIONER' S COMMITMENTS The adopton of ths Ordnance s predcated upon the materal nducements contaned n the foregong rectals settng forth Pettoner' s Commtments, re- stated as follows: ( 1) elect one resdent of the Dstrct to the fve member Board of Supervsors at such tme as resdents begn occupyng homes n the Dstrct, and ( 2) record a Notce of Assessments contanng the specfc terms and condtons of any specal assessments mposed to secure bonds ssued by the Dstrct, whch notce shall be recorded mmedately after any such bond ssuance. The Board shall retan any and all rghts and remedes avalable at law and n equty to enforce Pettoner' s Commtments aganst Pettoner, ts successors and assgns. SECTION EIGHT: CONFLICT AND SEVERABILITY In the event ths Ordnance conflcts wth any other ordnance of Coller County or other applcable law, the more restrctve shall apply. If any phrase or porton of ths Ordnance s held nvald or unconsttutonal by any court of competent jursdcton, such porton shall be deemed a separate, dstnct, and ndependent provson and such holdng shall not affect the valdty of the remanng porton. 16- CPS / / 1 4

5 SECTION NINE: INCLUSION IN CODE OF LAWS AND ORDINANCES The provsons of ths Ordnance shall become and be made a part of the Code of Laws and Ordnances of Coller County, Florda. The sectons of the Ordnances may be renumbered or relettered to accomplsh such, and the word " ordnance" may be changed to " secton," artcle," or any other approprate word. SECTION TEN: EFFECTIVE DATE Ths Ordnance shall become effectve upon flng wth the Florda Department of State.
