1 Resoluton # HLL FARM HOMEOWNERS ASSOCATON An Arzona nonproft corporaton RESOLUTON OF THE BOARD OF DRECTORS REGARDNG PERMETER EASEMENTS At a meetng of the Board of Drectors of Hll Farm Homeowners Assocaton (the "Assocaton"), an. Arzona nonproft corporaton, daly called and held on the 15th day of Aprrl, 2013, a quorum beng present and. votng, the followng resoluton was adopted: 1.. PURPOSE & DSCLAMER. Ths resoluton and the attached map contan nformaton regardng the ownershp of land surroundng Hll Farm on whch the permeter easements and cofunon areas (collectvely referred to as "easements").are located. The resoluton defnes the responsbltes of the Assocaton and of the owners of the Lots n Hll Farm that abut those easements. The nformaton was developed n conjuncton wth a real estate attorney, and from the plat maps of Hll Farm and other recorded documents pertanng to neghborng propertes. The resoluton also clarfes the Assocaton's responsbltes concernng the Prvate Dranage Ehsements descrbed n the Thrd Restated CC&Rs, Artcle X, Sec. 9.3 and n Exhbt A of the CC&R's. Ths nformaton s gztenfor getteral gudance only. n the eoent of any legal dspute, reference should be made to the orgnal recorded documents and the rccorded plat maps for Hll Earm. 2. HOWTO USE THS DOCUMENT. The rnap and the headngs of patagraphs #4 thru #9 below show the locatohs of the sx permeter easements and the abuttng lot numbers. The headngs can be searched by lot number to fnd the specfc nformaton applcable to your lot. Lots at the comers of Hll Farm may appear under more than one headng. f your lot does not abut any permeter easement, ths document does not apply to you. 3. NFORMATON APPLCABLE TO ALL LOTS. a. Walls. For the defnton of "Permeter", "Common" and "Assocaton" walls and the responsblty for ther mantencrnce, please refer to Artcle V, Sec of the Thrd Restated CC&R s. The only walls for whch the Assocaton has a mantenance oblgaton are Assocaton walls where there s no abuttng Hll Farm lot on ether sde. (Contnued)

2 Resoluton # Page2 b. Storage and Waste. Homeowners may not store any materal nor d.spose of waste of arry knd n the easements, rrespectve of easement ownershp. Ths ncludes the dscharge of water from swmmng pools. c. Trees. The Assocaton s responsble for the mantenance of trees that are growton Hll Farrr{s Common Areas and those that are located on the ndvdual lots outsde the pato walls, ncludng those n the West Permeter (see.paragraph 4 below.) All other trees growrg. easements are the responsbl$ of the respectve owner of the easement. Under Arzona law, any part of a tree that extends over an adjacent property lne (e.g., from an easement nt6 your yard) may be cut back to the property lne by the owner of the adjacent property so long as the prunng does not kll the tree. However, t s usually benefcal for both partes to agree on trm:rrng that retans the shade, shape and appearance of the tree. Where roots are clsturbng wall foundatons, root trmmng s preferable to tree removal. 4. WEST PERMETER West of Lot #s l thru 1,5 & 18. Each Owner o{ the Lot owns a 20' wde strp of land on the other sde of the west per{reter wall whch has been dedcated as a utlty easement. Ths easement s accessed by Pma County for mantanng the sewer lnes and by Tucson Electrc Power {or mantanng the overhead power lnes. For TEP, ths mantenance ncludes major tree trmmng adjacent to the power lnes, and removng other vegetaton to allow unobstructed access. Rancho Palomno Homeowners Assocaton has been gven access, nformallp through the locked securty gate to mantan the landscape on the east sde of ts permeter walls. Snce the Assocaton s solely responsble for the landscape mantenance of each lot outsde the pato walls, the Assocaton mantans the general landscapng on the utlty easement, but t $:l.t::;:1ff*tr[ff::ff,1::?:*f""fj' (Ft Lowe,, Rd ) end or the easement may be obtaned on request to the property management company. The Assocaton s only responsble for the mantenance of two sectons of Assocaton wall - at the end of Woodgate Lane between lots 15 and 18, and on Hll Farm Drve between lots 8 and NORTH PERMETER North of Lot #s'l..,77, Ths s Common Area that s owned and mantaned by the Assocaton. The Assocaton s responsble for the mantenance of the chan lnk fence at the northern and western boundares of the area, for the fre gate on Hll Farm Drve that connects wth Bosque Creek, and for mantanng the area for dranage. The actual Hll Farm property lne s approxmately 5ft north of the fence and fue gate.

3 Resoluton # Page 3 6. NORTHEAST PERMETER Northeast of Lot #s 62,65 thru76,1'1.6 &117. Ths s a 15' dranage easement n favor of the Assocaton on property owned by.the neghborng Bosque Creek Homeowners Assocaton. Owners of lots n F{ll Farm whcl abut ths easement have legal access to mantan the outsde porton of ther permeter walls and to trm any overhangng trees and shrubs that are growng n ther own yards. The Assocaton s responsble for ensurng that ths dranage easement s not obstructed, but t has no other oblgatons Trees that are growng n ths easement are the property of Bosque Creek Homeowners Assocaton. Problems wth trees or uu:ly other ssues should be reported to the Hll Farm property management company whch wll contact the property management company for Bosque Creek regardng any remedal acton. However, nether the Assocatoru nor ts property managers, has any authorty or resporlsblty to take remedal actoru and the ultmate negotaton mustbe between the lot owrrer and Bosque Creek Flomeowners Assocaton. 7. EAST PERMETER (North Secton) East of Lot #s 50,6-1,,62,11"4,115 and a Porton of Lot 1,13. Ths s an easement on land owned by the neghborng Bosque Ranch Estates Homeowners Assocaton (whch s NOT the same Assocaton as Bosque Creek), and by other ndvdual property owrrers who are not members of Hll Farm Homeowners Assocaton. Owners of lots n Hll Farm that abut ths easement have legal access to mantan the outsde porton of ther permeter walls and to trm any overhangng trees and shrubs growng n ther own yards. The Assocaton s responsble for ensurng that the dranage easement s not obstructed, ncludng the repar of any banks, but t has no other oblgatons. Trees that are growng n the easement are the responsblty of the respectve property owrlers. Problems wth trees or.any other ssues should be reported to the Hll Farm property management company whch wll contact the owners of the property on whch the easement s located regardng any necessary remedal acton. However, nether the Assocatory nor ts property managers, has any authorty or responsblty to take remedal actory and the ultmate negotaton must be between the Hll Farm lot owner and owner of the property on whch the easement s sfuated. 8. EAST PERMETER (South Secton) East of Lot #s 55,L11-,1L2, anda Porton of Lot 1L3. Ths prvate dranage easement s on Common Area that s owned and mantaned by the Assocaton. The Assocaton s also responsble for mantanng the area for dranage. The only legal access s through the gates, where they exsf n each lot's common wall. Otherwse access can be obtaned va the North Secton (see above.)

The area s mantaned by the Assocaton. The Assocaton s also responsble for the mantenance of that porton of Assocaton wall located n the Common Area between lots24 and 25.
