1 ORDNANCE NO AN ORDNANCE OF THE CTY COUNCL OF THE CTY OF MURPHY, COLLN COUNTY, TEXAS, AMENDNG TS COMPREHENSVE ZONNG ORDNANCE AND MAP, CHAPTER 86 OF THE CTY OF MURPHY CODE OF ORDNANCES BY CHANGNG THE ZONNG CLASSFCATON ON APPROXMATELY ACRES OUT OF THE MARY SCOTT SURVEY, ABSTRACT NO. 859, LOCATED N THE CTY OF MURPHY, COLLN COUNTY, TEXAS AND MORE PARTCULARLY DESCRBED ON EXHBT "A" ATTACHED HERETO AND NCORPORATED HEREN BY REFERENCE FOR ALL PURPOSES, FROM SF-20 (SNGLE FAMLY RESDENTAL) DSTRCT TO PD (PLANNED DEVELOPMENT) DSTRCT FOR OFFCE USES WTH CONDTONS HERETO DESCRBED AS EXHBT "B"; PROVDNG A SEVERABLTY CLAUSE, PROVDNG A PENATLY CLAUSE, AND PROVDNG AN EFFECTVE DATE. WHEREAS, the Plannng and Zonng Commsson of the Cty of Murphy and the Cty Councl of the Cty of Murphy, n complance wth the laws of the State of Texas, have gven the requste notces by publcaton and otherwse, and have held due hearngs and afforded a full and far hearng to all property owners generally and to all persons nterested, and the Cty Councl of the Cty of Murphy s of the opnon and fnds that sad changes should be granted and that the Comprehensve Zonng Ordnance should be amended; NOW, THEREFORE, BE T ORDANED BY THE CTY COUNCL OF THE CTY OF MURPHY, TEXAS, AS FOLLOWS: Secton 1. That the Comprehensve Zonng Ordnance and Map of the Cty of Murphy, Texas, be, and the same are hereby, amended so as to grant a Planned Development Dstrct for Offce Uses for the property descrbed as acres, more or less, n the Mary Scott Survey, Abstract No. 859, n the Cty of Murphy, Colln County, Texas, and more partcularly descrbed n Exhbt "A" attached hereto and made part hereof for all purposes. Secton 2. That the development standards for ths Planned Development Dstrct are attached hereto as Exhbt "B'', and the same are hereby approved for sad Planned Development Dstrct as requred by Secton , of the Cty of Murphy, Texas Code of Ordnances.
2 Secton 3. That Chapter 86 of the Cty of Murphy Code of Ordnances, as amended, shall be and reman n full force and effect save and except as amended by ths Ordnance. Secton 4. f any word, secton, artcle, phrase, paragraph, sentence, clause or porton of ths Ordnance s held to be nvald or unconsttutonal by a court of competent jursdcton, such holdng shall not affect, for any reason, the valdty of the remanng portons of the Comprehensve Zonng Ordnance, Chapter 86 of the Cty of Murphy Code of Ordnances, and the remanng portons shall reman n full force and effect. Secton 5. Any person, frm or corporaton volatng any of the prov1s1ons of ths ordnance shall be deemed gulty of a msdemeanor and, upon convcton, n the muncpal court of the Cty of Murphy, Texas, shall be punshed by a fne not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each and every day any such volaton shall contnue shall be deemed to consttute a separate offense. Secton 6. Ths Ordnance shall take effect mmedately from and after ts passage and the publcaton of the capton, as the law and Charter n such cases provde. Landscape Plan: Development shall be n general conformance wth the approved landscape plan set forth n Exhbt D; however, n the event of conflct between the landscape plan and the condtons, the condtons shall preval. Exteror Elevaton Plan: Development shall be n general conformance wth the approved exteror elevatons as set forth n Exhbt E; however, n the event of conflct between the exteror elevatons and the condtons, the condtons shall preval. Parkng Regulatons: Parkng shall be at a rato of one (1) parkng space for every 200 square feet of gross floor area for all tenants (current and future). D. Heght Regulatons: The maxmum heght shall be one (1) story or twenty-fve (25) feet. E. Screenng: Screenng between the north property lne and the sngle famly subdvson to the north shall be accomplshed va the constructon of an eght (8) foot hgh board-on-board fence at grade on Lot 10, Block K; Lot 11, Block K and Lot 12, Block K - Wndy Hll Farms No. 1. No screenng wall shall be requred along the west property lne. F. Lghtng: No exteror lghtng shall be allowed to be placed on the outsde permeter on offce buldngs facng adjacent resdental propertes to the north. No lght standards shall be placed n parkng areas adjacent to resdentally zoned property that are hgher than four (4) feet. All lght standards shall have sheldng to prevent lght polluton. G.
