Schonewille, Secreary/Treasurer Commiee of Adjusmen Michael Seaman, Direcor of Planning Minor Variance Applicaion, A-3118, 16 Marr Avenue, Grimsby, ON March 6,2018 Background An applicaion was submied o he Town of Grimsby o legalize he souherly inerior side yard seback of 0.38 meres and o allow an eave projecion of 0.35 meres including eave rough ino side yard seback of 0.38 meres in a Residenial RD3 Zone a #16 Marr Avenue, Grimsby. A previous minor variance applicaion (A-03/18) was approved for he subjec sie o permi a side yard seback of 0.6 meres. Do he variances mee he inen of he Official Plan? Under he Official Plan he subjec lands are designaed Low Densiy Residenial Area. Single deached dwellings are permied in his designaion. Planning saff are of he opinion ha he requesed variances mee he inen of he Official Plan. Do he variances mee he inen of he Zoning By-Law? The subjec sie is zoned Residenial Deached RD3.25 under By-Law 14-45, as amended. The previous minor variance applicaion approved a variance of 0.6 meres for he side yard seback. The subjec dwelling has been consruced 0.38 meres from he side lo line wih eaves ha encroach ono he abuing propery a 14 Marr Avenue. The proposal is o mainain he exising 0.38 mere seback o he dwelling and reduce he overhang of he eaves so ha here is a 0.35 mere eave encroachmen ino he required side yard. The inen of he side yard seback requiremen is o allow space for privacy, mainenance, and managing drainage. The subjec dwelling has a garage wih no windows ha abu he subjec side lo line and as such, here would be no impac on privacy. The locaion of he exising wall is no proposed o change and herefore approving he variance would have no impac on managing surface drainage. The proposed 0.38 mere seback leaves limied room for mainenance of he souh wall of he building wihou encroachmen ono he neighbouring propery a #14 Marr Avenue; however, he subjec wall is clad in vinyl siding and herefore would have low mainenance requiremens. The inen of he permied eave encroachmen ino he required side yard is o provide adequae space for mainaining he eaves. The proposed 0.35 mere encroachmen of he eaves ino a proposed 0.38 mere side yard leaves limied room for mainenance of he eaves from he souh wall of he building; however, he low pich of he roof would enable access from anoher poin of he roof for he purposes of mainaining he eaves. This secion of Livingson Avenue has houses ha face he side srees (i.e. Garden Drive) and as such, he re-developmen of he proposed dwelling wih he fron orienaion of he house o Garden Drive would be consisen wih he exising orienaion of houses along boh Livingson Avenue and Garden Drive.
