Pearson Street, Kleinburg Ward 1, Vicinity of Nashville Road and Islington Avenue The Owner is requesting permission to maintain an existing dwelling and construct a covered porch with the following variances: Variance Proposed Required 1 Minimum front yard setback to 6.4m 7.5m covered porch 2 Minimum interior side yard setback 1.39m 4.5m to covered porch 3 Minimum interior side yard setback to existing dwelling (where a detached dwelling is constructed without an attached garage) 1.5m 4.5m Official Plan: The subject lands are designated Kleinburg Core Area Village Residential by in-effect OPA #601 (Kleinburg- Nashville Community Plan), as amended by OPA #633. The subject lands are also designated Low-Rise Residential by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan. Comments: The Development Planning Department conducted a site visit with photo documentation on November 20, The subject lands are developed with a one-storey detached dwelling on the west side of Lester B. Pearson Street. The subject lands form part of the Kleinburg-Nashville Heritage Conservation District. The Cultural Services Department has indicated that the Applicant has received a Heritage Permit for the proposed porch. The Development Planning Department is of the opinion that the proposed porch will not significantly impact the overall streetscape of the neighbourhood. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Pearson Street, Kleinburg Part of Lot 30, Concession1, City of Vaughan Committee of Adjustment Variances Application (A369/12) Cultural Services has received the request for comments regarding the above noted Committee of Adjustment application and offers the following comments: 1. The property at 8 Lester B. Pearson Street is Designated Part V under the Ontario Heritage Act as part of the Nashville Kleinburg Heritage Conservation District. As such new construction, additions, demolitions and changes to the exterior of buildings and properties within Heritage Districts require approval of a Heritage Permit application in addition to other City permits such as Building Permits or Planning Application approvals. Proposed changes to properties designated within heritage conservation districts must be in keeping with the heritage character of the building, the historical streetscape and must be in conformance with the heritage district plan and design guidelines. 2. Heritage Permit HP has been approved and issued (dated May 29, 2012) for the proposed renovation of the existing dwelling. This permit was issued upon review of the proposal by the Heritage Vaughan Committee on their meeting of May 16, At the time of the Heritage Vaughan Review, the variances had not been identified. 3. Cultural Services supports the retention and use of existing structures at their original locations and therefore has no concerns regarding the existing interior side yard setback to the existing dwelling of 1.52 M. 4. Cultural Services has no objection to the proposed variance for the front yard setback and the interior side setback to the covered porch.
