RATIONALE Providing firs reading o Developmen Cos Charge (DCC) Bylaw is he firs sep in he DCC bylaw approval sraegy recommended by he Province and suppored by Council a he June 3, 2015 meeing. LEG ISLAÏIVE REQU I REMENTS: Council has he auhoriy under Secions of he Local Governmen Ac o impose DCC hrough he creaion and adopion of a DCC Bylaw. BACKGROUND: The Ciy of Wes Kelowna is nearing compleion of a comprehensive DCC Review. Neilson- Welch Consuling and Lefside Parners were hired o underake his review. Council provided direcion o he consulan on June 18, 2013, January 28, 2014, June 24, 2014 and again on June 3, A ha ime, Council direced saff o draf a DCC Bylaw for firs reading. The DCC raes uilized in he draf bylaw reflechose provided o Council on June 3'd,2Ol5forhe purpose of public consulaion. The draf Waer Uiliy Maser Plan was brough forh o Council on July 22,2014, a which ime i was adoped and Council provided direcion on how o calculae he corresponding DCC raes. 2 Secion and 943 of he Local Governmen Ac provides he framework for implemenaion of a new DCC Bylaw for in-sream applicaions for rezoning, developmen permis, building permis and subdivision. ln general erms, he legislaion provides one year from he dae of adopion of he bylaw o come ino effec unless he applican agrees in wriing ha he bylaw should have effec. Applicans would prefer he new bylaw o be in effec if raes are reduced. Bvlaw Developmen The DCC bylaw was developed wih a horough review of comparable bylaws, as well as a legal review. The bylaw was drafed in collaboraion wih he municipal soliciors. During he developmen of he bylaw i came o saff's aenion ha he Office of he lnspecor of Municipaliies has recenly changed heir posiion on he inerpreaion of Local Governmen Ac Secion 933 (4.1). l has been common pracice for many municipaliies o exemp charging DCCs for he consrucion of single family houses in exising subdivisions ha were approved prior o DCCs being in effec and no exemping duplexes and riplexes. The lnspecor of Municipaliies has hisorically approved DCC Bylaws wih his provision; however, i appears as hough heir posiion has changed and he curren inerpreaion is ha he LGA allows local governmens o remove he less han four uni DCC exempion, bu i does no allow he municipaliy o se any erms, condiions or limiaions on he removal of his exempion. As such, he proposed amendmen o exemp residenial developmen conaining only one uni from paying DCCs a he ime of building permi issuance is no allowed. The draf bylaw currenly reflecs his posiion, as developing a bylaw ha does no reflec he posiion of he Province will likely face significan delays and a high likelihood of rejecion from he lnspecor of Municipaliies. l is also recommended ha saff refer he draf bylaw o Provincial saff immediaely following firs reading. During he developmen of he bylaw, hree addiional raes have been proposed o be included as par of Schedule A of he DCC Bylaw. Carriage homes have been included based on a 66 percen reducion o he aparmen rae as proposed o Council on June 3,2Q15. Proposed raes have also been esablished for campgrounds and golf courses. An addiional caegory has also been proposed for campgrounds, since he commercial DCC would apply o floor area consruced and no apply o campsies hemselves, a campground caegory is recommended. A review of oher regional bylaws deermined ha Ciy of Kelowna was he only oher jurisdicion wih a DCC rae specific o campgrounds and ha he campground rae is he same as he indusrial rae. Boh he WID and LID Capial Expendiure Charge Bylaws had charges for campgrounds a $1785 and $'1 169 per uni, respecively. The irrigaion disric charges are much less han he resuling raes should he proposed indusrial raes be applied based on he recommended average of I campground unis per acre in he Naional Recreaion & Park Associaion guidelines2. Based on he proposed indusrial waer rae of $16.34 and an average camp sie area allocaion, he resuling waer DCC would be $ As he indusrial DCC is based on parcel area and no floor area, he indusrial DCC rae is proposed as a base rae for deermining a campground DCC; however, i is recommended ha campground DCCs are se a20o/o of he indusrial rae based on he seasonal naure of campground use and resuling burden on infrasrucure. This reducion would equae o a waer DCC charge of $ for he average size camp sie. Anoher caegory ha is proposed for inclusion is golf courses. Alhough here is no new golf course developmen anicipaed in he Ciy, i is recommended ha a caegory be included in he bylaw o ensure ha appropriae DCCs are imposed should he consrucion of a golf course be approved. 3 he golf course rae be esablished a 50o/o of he proposed campground roads and waer raes. The resuling rae would be in line wih he Capial Expendiure Charges previously adminisered by boh LID and WlD. Sewer and Drainage Addiional echnical review based on indusry sandard uiliy usage and vehicle rip generaion will be conduced prior o second reading of he DCC Bylaw o ensure ha he proposed campground, golf course and carriage house raes reflec he capial cos burden of he associaed servicing. Exisinq Bvlaw Amendmens Prior o he DCC Bylaw coming ino effec, oher bylaws mus be amended o ensure here is no double charging or missed fee collecion. For example, he Fees and Charges Bylaw secion peraining o performance securiy (CEC) charges for Prichard, Wes Kelowna Esaes and Sunnyside are repealed as par of he DCC Bylaw. A comprehensive review of relaed bylaws and necessary amendmens will be compleed prior o addiional readings of he DCC Bylaw. DCC Rae Comparisons The consulan's repor presened on June 3, 2015 provided several rae opions for consideraion as well as recommended raes and comparisons wih oher jurisdicions. Aachmen 2 provides a regional rae comparison of DCCs as well as a comparison char beween exising and proposed raes. The able provides a regional comparison o he recommended raes wih a 25% assis facor for parks, as well as DCCs ha illusrae a 1o/o assis for all caegories. Char 1 in Aachmen 2 illusraes he recommended DCC raes wih a Parks assis facor oí 25o/o compared o a 1% assis facor for all oher DCC caegories as well as a comparison o exising raes. RDCO regional sewer charges are included in he exising and proposed raes. Also noe ha a small lo single family DCC rae has been included as a new caegory. Los less han 550m2 are considered small lo single family. Public Consulaion The DCC Bes Pracices Guide includes a recommended Sakeholder Paricipaion Sraegy (Appendix D). Local governmens mus make allowances in he DCC calculaions of an assis facor of a leas 1 percen. The Minisry of Communiy Services' Bes Pracices Guide recommends ha he municipal assis facor be a discreionary vehicle which reflecs he communiy's financial suppor owards he financing of services for developmen. ln some communiies, he assis facor is used as a ool o achieve cerain goals such as afordable housing, land efficiency and susàinabiliy3. The Ciy's ex sing DCC raes all have an ass s facor of 1 percen. The recommended assis facor of 25 percen for parks would have financial implicaions on Ciy budges. l is recommended ha he Parks DCC assis facor be funded by ax base growh. Tax growh is esimaed a 1% annually bu varies depending on he building aciviy in he municipaliy. Currenly an amoun is idenified each fuure year as Council discreionary funds. A porion of hose funds (o be deermined annually based on he growh number) should be allocaed o funding a reserve specifically for DCC projecs. This will ensure he Ciy has funds available o fund heir porion of he DCC projecs idenified annually. This will be paricularly imporan for he parks projecs where a larger assis facor is being recommended. 10 CITY OF WEST KETOWNA BYTAW NO. 190 A Bylaw o impose developmen cos charges WHEREAS he Council of he Ciy of Wes Kelowna wishes o exercise is powers under he Local Governmen Aco impose developmen cos charges in respec of he provision of roads, sewers, drainage, waer and parks, and o impose developmen cos charges on all developmens ha impose new capial cos burdens on he Ciy, including small residenial buildings ha would oherwise be sauorily exemp from such charges; NOW THEREFORE he Council of he Ciy of Wes Kelowna, in open meeing assembled, enacs as follows: 1. This bylaw may be cied as "CITY OF WEST KELOWNA DEVELOPMENT COST CHARGE BYLAW NO. r90,2015". 2. ln his bylaw including is Schedules, "aparmen building" means (a) a residenial building conaining hree or more dwelling unis ha is no a ownhouse; (b) he residenial porion of a mixed-use building ha also conains commercial or indusrial uses, including any careaker uni; and (c) any self-conained agriculural worker dwelling uni consruced on land zoned for agriculural use. "duplex" means a residenial building ha conains wo dwelling unis, neiher of which is a secondary suie. "campground" means he parcel area used o accommodae ens and recreaion vehicles and oiles and showers for campers o use. "care faciliy" means a building used for he provision of residenial accommodaion and care for aduls and licensed under he Communiy Core ond Assised Living Ac. "carriage house" means an accessory building ha conains a secondary dwelling uni. "commercial" means a land use ha is no residenial, golf course, campground, indusrial or insiuional and includes: (a) any use of land zoned for indusrial, golf course, campground or agriculural use in which goods or services are provided direcly o consumers or he public; 48

11 (b) any dock, wharf or enclosed srucure consruced on Okanagan Lake as par of a commercial marina use, and (c) any healh care or educaion use provided on a commercial basis' "floor area" means he sum of he floor areas of each sorey of a building measured o he ouer surface of exerior walls and includes unfinished areas, bu excludes garages and parking a reas. "golf course" means he area of a parcel used o play golf, including driving ranges and pracice faciliies bu, excludes accessory reail faciliies and resaurans ha are. "indusrial" means exracing, processing, manufacuring, fabricaing, ransporaion, disribuion and service uses no provided direcly o consumers or he public, and includes he porions of winery premises such as fermenaion and barrel rooms and wine sorage areas ha are no ordinarily accessible o he general public. "insiuional" means he provision of public healh, primary, secondary and pos-secondary educaion, or oher governmenal services o ciizens' "residenial subdivision" means a subdivision in which he areas of he los are 550 m2 and greaer. "secondary suie" means a secondary dwelling uni described in Secion 3.16 of he Zoning Bylaw. "small lo residenial subdivision" means a subdivision in which he areas of he los are less han 550 m2. "small residenial building" means a single family dwelling wih or wihou a secondary suie, a duplex or ownhouse, or a mobile home in a mobile home park. "ownhouse" means a residenial building divided ino 3 or more dwelling unis each of which shares a leas one common wall wih anoher dwelling uni and has is own exerior enrance. 3. Every person who obains approval of a subdivision of land under he Lond Tile Ac or he Sraa Propery Ac shall pay o he Ciy, a he ime he approving officer approves he subdivision or sraa plan, he developmen cos charges indicaed in Secion l- of Schedule A aached o and forming par of his bylaw in accordance wih he number of los creaed by he subdivision and he areas of he los in he subdivision. 4. Every person who obains a building permi auhorizing he consrucion of a carriage house on a parcel ha conains anoher dwelling uni, or ha will be consruced on a parcel concurrenly wih anoher dwelling uni, shall pay o he Ciy, a he ime a building official issues he building permi, he developmen cos charges indicaed in Secion 2 of Schedule A o his bylaw. 49

Every person who obains a building permi auhorizing he consrucion, aleraion or exension of a small residenial building shall pay o he Ciy, a he ime a building official issues he building permi, he developmen cos charges indicaed in Secion 2 of Schedule A o his bylaw in accordance wih he number of dwelling unis indicaed in he applicaion for he permi. 6. Every person who obains a building permi auhorizing he consrucion, aleraion or exension of an aparmen building shall pay o he Ciy, a he ime a building official issues he building permi, he developmen cos charges indicaed in Secion 2 of Schedule A o his bylaw in accordance wih he floor area of he building indicaed in he applicaion for he permi. 7. Every person who obains a building permi auhor zing he consrucion, aleraion or exension of a care faciliy shall pay o he Ciy, a he ime a building official issues he building permi, he developmen cos charges indicaed in Schedule A o his bylaw in accordance wih he number of care faciliy beds indicaed in he applicaion for he permi. 8. Every person who obains a building permi auhorizing he consrucion, aleraion or exension of a building for an indusrial use shall pay o he Ciy, a he me a building official issues he building permi, he developmen cos charges indicaed in Schedule A o his bylaw in accordance wih area of he parcel on which he indusrial use associaed wih he building will be occurring, including wihou limiaion he area covered by he building and any area used for oudoor sorage, parking or loading spaces, or landscaping. 9. Every person who obains a building permi auhorizing he insallaion of services for a campground use shall pay o he Ciy, a he ime a building official issues he building permi, he developmen cos charges indicaed in Schedule A o his bylaw in accordance wih he area of he parcel on which he campground use is occurring indicaed in he applicaion for he permi. 10. Every person who obains a building permi auhorizing he insallaion of services for a golf course use shall pay o he Ciy, a he ime a building official issues he building permi, he developmen cos charges indicaed in Schedule A o his bylaw in accordance wih he area of he parcel on which he golf course use is occurring in he applicaion for he permi. 11. Every person who obains a building permi auhorizing he consrucion, aleraion or exension of a building or srucure no described in any of Secions 4 o 10 of his bylaw shall pay o he Ciy, a he ime a building official issues he building permi, he developmen cos charges indicaed in Schedule A o his bylaw for a commercial use in accordance wih he floor area of he building or srucure indicaed in he applicaion for he permi. 12. ln he case of a building whose inended use is a combinaion of uses indicaed in Schedule A o his bylaw, he developmen cos charges applicable under his bylaw shall be calculaed for he 50

13 uses separaely on he basis of he number of dwelling unis, care faciliy beds, floor areas and parcel areas for differen uses, as he case may be. L3. A charge is no payable in respec of a building permi if he value of he work auhorized by he permi does no exceed S1OO,00O, and for his purpose he value of he work shall be he consrucion value on which he building permi fee was based or such greaer value as he building official may deermine in any case where he value indicaed on he applicaion does no, in he building official's opinion, represen he fair marke value of he work.
