To permit the construction of one building (Tower and Podium), as follows: 1. To permit the tower and podium in the locations shown on the attached sketch, which is partially located outside the building envelopes shown on Schedule E- 1376A. 2. To permit a building height of 20.4 metres for the 5 storey podium, as shown on the attached sketch. 3. To permit a 2.5 metre encroachment of a canopy beyond the building face (at the main entrance abutting Regional road 7), as shown on the attached sketches. 1. The subject lands are also designated Neighbourhood Precinct (N3) by the Vaughan Metropolitan Centre Secondary Plan which forms part of Volume 2 of the Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board (OMB). The proposal conforms to the policies of the Official Plans. On September 4, 2008, the OMB approved related Zoning Bylaw Amendment File Z and Draft Plan of Subdivision File 19T-00V21 to permit the development of five high-rise residential buildings (four with ground floor commercial), together with a park, buffer and road blocks. 20 Page 2 of 2 from one to five storeys and with the above-noted variances. The proposal is generally in keeping with the building envelopes and setbacks in the OMB approved Zoning By-law. Minor changes are required to facilitate a different building design than originally approved at the OMB. The increased building height for the podium facing Highway 7 and the canopy encroachment at the main entrance along Highway 7 are also considered appropriate, as they create a strong street presence along Highway 7. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.
