The subject lands are designated Low Density Residential by in-effect OPA #210 (Thornhill Community Plan), as amended by OPA #589. The subject lands are also designated Low-Rise Residential by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal does not conform to the policies of OPA #589, which aims to protect the historical character of this established core residential area in the Thornhill community. In 2004, Vaughan Council directed the Development Planning Department to review the lot coverage standards in R1V Old Village Residential Zones. The Development Planning Department prepared a report comparing the lot coverage standards in Vaughan with other surrounding municipalities. Council approved an additional flexibility for dwellings which do not exceed one-storey with a loft and 7.0 m in height in order to facilitate reasonable, practical and economical redevelopment. The Development Planning Department and Committee of Adjustment have supported a maximum of 23% lot coverage for two-storey dwellings in R1V Old Village Residential Zones. The only exception where greater lot coverage has been granted is if a covered, unenclosed porch is included in the total calculation. This is to protect the historical character of this established residential area in Thornhill in accordance with OPA #589. On this basis, the Development Planning Department is of the opinion that the proposed lot coverage of 29% is not minor in nature and does not meet the intent of the Zoning By-law or Official Plan. Notwithstanding the Owner proposing a built form that is more in keeping with the character of the existing residential neighbourhood, a lot coverage of 29% would set an undesirable precedent for larger residential dwellings, thereby altering the existing character of the streetscape and surrounding neighbourhood. 18 Page 2 of 2 area, an additional 3% lot coverage for a one-storey (plus loft) dwelling with a height of 7m is considered appropriate. The intent of OPA #589 and By-law 1-88 is to encourage bungalows in this area, and 23% lot coverage is permitted asof-right. Staff is satisfied that a bungalow with 26% lot coverage will have less impact than a two-storey dwelling with 23% lot coverage, and is in keeping with the existing streetscape and neighbourhood character. Accordingly, the Development Planning Department is of the opinion that the proposal is not minor in nature, does not meet the intent of the Zoning By-law, and is not desirable for the appropriate development of the land. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established.
