The subject lands are also designated Employment Commercial Mixed-Use by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan. The Applicant has concurrently submitted Site Development File DA to permit a m 2 addition to Building G on the attached site plan. Site Development File DA is subject to review and approval by the Development Planning Department. On April 27, 2006 the Committee of Adjustment approved Minor Variance application A161/06 to permit a total of 260 parking spaces for the entire subject lands, whereas 267 spaces were required, and to permit the construction of Building G to be located outside of the of the permitted building envelope as stipulated by Schedule E-1023 in sitespecific Zoning Exception 9(938). As a result of an increase in gross floor area of Building G, the parking requirement for the subject lands has increased 6 spaces. The Owner wishes to maintain a total of 263 parking spaces. As the subject lands were previously approved for 260 parking spaces, this approval should remain valid on the entirety of the lands. As the above results in a deficiency of 3 parking spaces, the Development Planning Department has no objections to the reduction in parking. The existing building (Building G ) was previously approved to be located outside of the permitted building envelope through Minor Variance Application A161/06. Accordingly, the Development Planning Department has no objections to the location of the proposed addition. The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Comments: The Development Transportation/Engineering Department requests that prior to approval of Minor Variance Application A179/13, Site Development Application DA shall be approved by the Development Transportation/Engineering Department. The proposal is to permit minimum 263 parking spaces over the City by-law 1-88 requirement of 273 parking spaces. The deficiency is 10 parking spaces or 3.7%. Accordingly, the Development Transportation /Engineering Department has no objection with the parking supply at the above mentioned development. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream s cost for any relocation work.
