Please noe ha faciliies canno be hired during school hours and ha school funcions will ake precedence over oher bookings. For larger funcions a parking aendan may be required a he expense of he hirer. All parking mus be in designaed car parks. The Hirer will mee repair bills o any damaged areas. Caering: There is a kichen faciliy available for self caering purposes only.

5 CONDTONS OF HRE The College agrees o hire o he Hirer (he erm Hirer will include he applican/user s organisaion) he venue/s and faciliies ogeher wih he equipmen in accordance wih hese Condiions of Hire and accompanying Booking Form. The Hirer agrees o be bound by hese Condiions of Hire and by any addiional condiions which he College may noify o he Hirer prior o he commencemen of hire. a. Tenancy: The hirer mus no assign or ransfer is righs under his agreemen (or give permission o anyone o use he venue) wihou he prior wrien consen of he College (such consen o be wihheld a he absolue discreion of he College). The righs conferred by his agreemen shall no creae or confer upon he hirer any enancy, esae or ineres in or over he venue or he grounds owned by he College. b. Deposi: A 10% deposi will be required o confirm bookings and mus be received by he College wihin wo (2) weeks of confirmaion o avoid cancellaion. Paymen of he deposi will signify accepance of he Condiions of Hire of he paricular faciliy. A Securiy Deposi/Bond may be required prior o he even and will be refunded on successful inspecion of faciliies following he even. c. Taxes: A goods and Services Tax (GST) a curren Governmen required rae will be imposed on he value of all axable supplies of our services as required by law. Paymen of he GST mus be borne by he Hirer. All prices quoed are exclusive of GST. d. Public Liabiliy nsurance Requiremen: Exernal Hirers and users of College venues mus be covered by appropriae public liabiliy insurance. The Hirer mus provide evidence of a curren Public Liabiliy insurance policy for an amoun no less han $10 million. e. Confirmaion of Bookings can only be made once Taachilla Luheran College has received a fully compleed booking form and receip of a holding deposi. Organisaions and governmen deparmens mus quoe heir ABN. f. Cancellaions received more han 60 days before he even will receive a 100% refund of he deposi. For cancellaions received less han 60 days before he even no deposi refund is possible. The Hirer shall noify he College of cancellaion no less han 14 days prior o commencemen of hire, failing which he College may impose a cancellaion fee of up o 50% of he hire fee. Wihin 48 hours of he commencemen of hire, he full hire fee plus any addiional expenses incurred may be charged, a he College s sole discreion. Noice of Cancellaion or Changes o Deails for any even mus be advised in wriing prior o he even. g. Paymen of Accoun: Full paymen mus be received prior o he even, if hire is on a casual basis. Paymen is required one monh in advance if hire is on a regular basis. Accoun faciliies for commercial and governmen cliens are available if arranged in advance. Paymen can be made by EFTPOS, EFT, Credi Card (no amex), Bank Cheque or Company Cheque. h. Emergencies: The hirer is o provide o he College prior o he commencemen of he period of use, unless oherwise saed, deails of personnel o be conaced in case of emergency or oher needs. n an emergency (as deermined by he College) he College, a is sole discreion, may close he venue and or preven he hirer from accessing he venue. Charges relaing o he involvemen of emergency services will be a he expense of he Hirer. i. Securiy Personnel: Depending on he number of persons likely o aend he Even, he College may, in is absolue discreion, appoin securiy personnel a he Hirer s expense o ensure he College s ineress are proeced. j. Responsible Officer: Unless agreed o he conrary in wriing, he Hirer mus nominae an aendan aged 18 years or older who will be presen for he duraion of he funcion and who will ake responsibiliy o ensure compliance wih sauory safey requiremens and he Condiions of Hire. k. Disinguished Visiors: The Hirer shall give he College advance noice of he aendance of any Regal, Vice-Regal or Governmen represenaives or any oher digniaries, o enable he College o ensure observance of appropriae proocols. l. Publiciy: The Hirer shall no issue any advance even publiciy before receiving from he College wrien confirmaion of he booking. The Hirer shall no make any saemen in any adverisemen which direcly or indirecly implies ha he even for which he premise is hired is conduced by or promoed by he College. The Hirer shall no issue any icke, poser, adverisemen, program or oher lieraure conaining he College logo unless he priner s or oher proof hereof has been approved in wriing by he College. The Hirer may erec a emporary even adverising poser or banner on College grounds wih advance approval. An adverisemen for he even may be placed in he College Newsleer if deemed appropriae by he Principal, or he Principal s represenaive. m. ndemniy: The Hirer shall indemnify and keep indemnified he College agains all losses, expenses, liabiliies, claims and damages incurred as a resul of or arising ou of he hire of he premises, wheher caused by an ac or omission of he Hirer, is servan s agens or inviees, or any oher person.

6 CONDTONS OF HRE CONT... n. AV Equipmen Usage: When audio-visual equipmen is confirmed for use in a faciliy, College echnical assisans will be in aendance o operae he equipmen. This cos will be added o he hire fee. o. Duies of Care: The hirer mus comply wih any direcion, insrucion, reques or command given by he College (acing reasonably) in relaion o compliance wih any relevan environmen, healh and safey regulaion, codes of pracice or any requiremens of local auhoriies and councils. The Hirer is responsible for adherence o general occupaional healh and safey sandards. The Hirer mus ensure spillage of beverages or oher liquid is immediaely cleaned up and ake any acion required o avoid injury by slipping. The College will ensure adequae cleaning implemens are on hand for poenial hazards. Areas ha canno be cleaned immediaely mus be cordoned off. The Hirer mus leave he premises clean and idy a he conclusion of he period of hire and remove all rubbish. During a pos hire inspecion, he College may carry ou a he Hirer s expense such cleaning or oher work as may be required o resore he premises o saisfacory condiions. Exceping fair wear and ear, he Hirer shall be liable for damage o premises and/or fiings, equipmen, furniure, carpes or oher propery herein, which occurs during he period of hire a any ime. p. Good Order: The College reains he righ o visi and examine he faciliies being used or hired, and if necessary, o order he cessaion of any aciviy being conduced and use of any par of he school premises. The Hirer shall be responsible for he mainenance of good order in and around he premises during he period of hire of he premises. The Hirer shall comply wih any insrucion by a College Securiy Officer or any officer of he College relaing o he mainenance of good order and compliance wih hese Condiions of Hire in and around he premises. q. Seaing and Sage Seings: Any aleraion o he normal seaing or sage seing of any premises may be made only wih he wrien consen of he College and a he Hirer s expense. Before vacaing he premises, he Hirer shall resore all furniure and equipmen o he same locaion and configuraion as i was a he commencemen of he Hirer s occupaion of he premises, failing which he College may carry ou a he Hirer s expense such work as may be required o resore he premises o a saisfacory condiion. The Hirer will be advised in wriing of venue seaing capaciy as required. The Hirer shall no admi parons o he premises in excess of he advised capaciy of he venue/s nor for a purpose no agreed o by he College. r. Liquor and Refreshmens: The Hirer shall no bring, serve or sell any liquor, beverage food or refreshmen on any par of he premises unless specifically approved by he College. The Hirer mus arrange appropriae food or liquor licensing, if required. s. No Smoking or Drugs: Taachilla Luheran College is a Smoke Free Zone and no cigarees or drugs are permied on he premises.. Misuse/Public Nuisance: Hirers who creae a public nuisance or misuse building or equipmen will be asked o leave immediaely and forfei hire fees. Charges relaing o he involvemen of emergency services will be a he expense of he Hirer. u. Suiabiliy: Taachilla Luheran College neiher makes any represenaion nor gives any warrany ha he faciliies or equipmen are suiable for he purpose of hire and he hirer acknowledges ha i has enered ino he hire agreemen afer making and relying solely on is own invesigaions and enquiries. v. Dispues: Any dispue beween he Hirer and he College arising from, or in relaion o, any hiring of he premises or from he Condiions of Hire shall be submied o arbiraion by a person appoined by he College, and he decision of he arbiraor shall be binding on he Hirer and he College. w. Enerainmen: Any enerainmen provided mus be in keeping wih he values and sandards of he College. Any music associaed wih he even mus conform o Copyrigh Laws. All programs mus be submied for approval in advance. The College may refuse permission for he hirer o conduc any aciviy included in heir program/purpose of hire. x. Keys: Keys, and securiy insrucions are o be colleced from he Faciliy Hire Coordinaor by 4pm on he day preceding a weekend booking. f he booking is for a week nigh, he key is o be colleced by 4pm on he day of hire. Keys mus be reurned o he Faciliy Hire Coordinaor on he nex business day. The responsibiliy for he keys and heir use remains wih he Hirer. Los keys will incur he cos of he replacemen of locks. y. Foowear: The correc foowear (no sileos) mus be worn in he cours area a all imes. No person is allowed on he cour wihou correc non-marking spors shoes. Shoes ha may damage he cour surface, such as sileo heels, are no accepable anywhere in he building for any spor played, a any ime. z. Terminaion of Conrac: The College may vary he condiions of his agreemen (acing reasonably) by wrien noice o he hirer and any ime. The College may a any ime erminae his agreemen.
