The purpose of this application is to request the consent of the Committee of Adjustment to convey the parcel of land for the CREATION of a NEW LOT marked "A" on the attached sketch, for industrial purposes, together with all required easements and right-of-ways, if required, and retain land marked "B" on the attached sketch for industial purposes. Currently both the subject and retained lands are vacant. There is a industrial warehouse proposed for the retained lands. Official Plan: VOP2010: "Prestige Employment", Section within Huntington Business Park Area Specific Policy, Volume 2. The Proposal conforms to the Official Plan. Comments: The Owner is requesting permission to sever the subject lands to facilitate the creation of a new lot for the construction of a warehouse on the conveyed lands. Both the conveyed and retained lands meet the minimum lot frontage and lot area requirements of Zoning By-law On this basis the Development Planning Department can support the proposal. It is noted that the City is currently processing a Site Development Application (File DA ) with regard to the retained lands for an employment building. The Owner is hereby notified that the subject property is located in a Highly Vulnerable Aquifer Area. This must be taken into consideration when a use is considered for new construction on the proposed conveyed lot. Environmental Promotion and Protection at York Region can be contacted for more information. There are no built heritage concerns for this application. However, the subject lands are identified as having high archaeological potential. Should there be any demolition or new construction proposed for the subject property, the following archaeological standards shall apply: i. Should archaeological resources be found on the property during construction activities, all work must cease and both the Ontario Ministry of Tourism, Culture and Sport and the City of Vaughan s Development Planning Department, Urban Design and Cultural Heritage Division shall be notified immediately. ii. In the event that human remains are encountered during construction activities, the proponent must immediately cease all construction activities. The proponent shall contact the York Regional Police Department, the Regional Coroner and the Registrar of the Cemeteries and Crematoriums Regulation Unit of the Ministry of Government and Consumer Services. Recommendation: The Development Planning Department recommends approval of this application. 19 COMMENTS: PowerStream has received and reviewed the proposed Consent Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established.
