Please identify yourself when you ask your question so that you can be properly recorded in the Minutes of the Meeting. 11. CONCLUSION AND RIGHT OF APPEAL PROCESS This concludes the Public Meeting. If any member of the Public wishes to be notified of the decision of Council in respect of the applications, you must make a written request to the Planning Coordinator. Notice to appeal the decision of Council to the Ontario Municipal Board must be filed with the Planning Coordinator no later than 20 days from the date Notices are circulated. The Notice of Appeal should be sent to the attention of the Planning Coordinator and it must include the following information: The reasons for the appeal; and The fee as prescribed under the Ontario Municipal Board Act in the amount of $125 payable by certified cheque to the Minister of Finance, Page 2 of 18

THAT Report PLAN be received for information; and 2. THAT Council deems as surplus to the corporation s needs, the unopened township road allowance between Lots 12 and 13, Concession 1 South of County Road 2, North of CN/CP Railway corridor; and 3. THAT a by-law be prepared to Close and Stop up the portion of the unopened road allowance between Lots 12 and 13, Concession 1 South of County Road 2, North of CN/CP Railway corridor. 5 REPORT NO.: PLAN PAGE 2 BACKGROUND AND COMMENT Re: Application File Number: RC Road Closure filed under the provisions of By-law No , to be heard by the Council of the Township of Cramahe. Applicant: Property: John West Concession 1 Part Lot 12 (Part 2, RP 38R-2656) and Concession 1 Part Lot 13 (Part 3, RP 38R-2541) (See key map) Purpose of Application: An application has been received under By-law No to close a road allowance within the Township of Cramahe. An offer to purchase the closed road allowance has been submitted by Mr. John West. The owner of the property at Concession 1 Part Lot 12 (Part 2, RP 38R-2656) and Concession 1 Part lot 13 (Part 3, RP 38R-2541) has approached staff about the purchase of the unopened township road allowance between his properties and adjacent to County Road 2. The lands on the east and west are owned by Mr. West. He is proposing a new development on the land to the east and requires an entrance from the County Road. Previous comments from the Northumberland County Manager of Planning has asked that the entrance for the property be located at the unopened township road allowance, as indicated in the key map. The area requested to be purchased by Mr. West is approximately 776 square metres (8, square feet / Hectares). The proposed closure and conveyance would sell the northern portion of the entire road allowance to Mr. West where it abuts his properties on the east and west. Comments were received from Hydro One and it is recommended by Staff that an easement be required as a condition prior to the road closure and sale in order to protect Hydro One and Bell Canada s interest. 7 The Corporation Of The Township Of Cramahe By-Law No XX Being A By-Law To Close And Stop Up A Portion Of The Road Allowance Between Lots 12 And 13 Concession 1, Township Of Cramahe, Designated As Part 2, Plan RP 38R-2656 and Part 3, RP 38R WHEREAS pursuant to Section 34 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, Council is authorized to pass a by-law to close a highway; AND WHEREAS it is deemed expedient to close portions of the unopened road allowance located between Lots 12 and 13, Concession 1, Township of Cramahe and lying within the limits of PART 2 on Plan 38R-2656, and PART 3 on Plan 38R-2541; NOW THEREFORE the Council of the Corporation of the Township of Cramahe enacts as follows: 1. That the portion of the road allowance between Lots 12 and 13, Concession 1, Township of Cramahe, and more particularly described as being PART 2 on Plan 38R-2656, and PART 3 on Plan 38R-2541, in the Township of Cramahe is hereby closed and stopped up. 2. A certified copy of this by- law shall be registered in Land Registry Office No In accordance with Section 34(1) of the Municipal Act, this by-law shall come into full force and take effect on the day that a certified copy of this by- law is registered in the aforesaid Land Registry Office. Applicant: Jeff Jackson Property: Concession 6 Part Lot 33 (Part 2 and Part of Part 1, RP 39R-9265 ) (See key map) Purpose of Application: An application has been received under By-law No to close a road allowance within the Township of Cramahe. An offer to purchase the closed road allowance has been submitted by Mr. Jeff Jackson. The land on the west of the unopened Township road allowance is owned by Mr. Jackson. He is proposing to purchase the lands to add to his current lot. He has approached the neighbours for their endorsement of the proposal, including the neighbour on the east side of the road allowance, Wilfred and Helen Sheppard. They are all in support of Mr. Jackson s request to purchase this portion of the unopened road allowance. The lands on the east and west are owned by Mr. West. He is proposing a new development on the land to the east and requires an entrance from the County Road. Previous comments from the Northumberland County Manager of Planning has asked that the entrance for the property be located at the unopened township road allowance, as indicated in the key map. 18 THE CORPORATION OF THE TOWNSHIP OF CRAMAHE BY-LAW Being a By-law to Confirm the proceedings of the Corporation of the Township of Cramahe at a Public Meeting of Council held Tuesday, March 8, WHEREAS Subsection 5(1) of the Municipal Act, R.S.O. 2001, as amended, provided that the powers of a municipal corporation are to be exercised by its council; AND WHEREAS Subsection 5(3) of the said Municipal Act provides that the powers of every council are to be exercised by by-law; AND WHEREAS it is deemed expedient that the actions of this meeting of the Council of The Corporation of the Township of Cramahe be confirmed and adopted by By-Law; NOW THEREFORE the Council of the Corporation of the Township of Cramahe ENACTS as follows: 1) The actions of the Council of the Corporation of the Township of Cramahe in respect of: a) each recommendation in the reports of the Committees: b) each motion, resolution or other action passed, taken or adopted at this meeting is hereby adopted, ratified and confirmed as if same were expressly included in this By-Law provided that such adoption and confirmation shall not be deemed to include the final passing of a By-Law that requires the prior approval of a Minister, a Ministry, the Ontario Municipal Board or any other governmental body. 2) The Mayor and the proper officials of the Corporation of the Township of Cramahe are hereby authorized and directed to do all things necessary to give effect to the action of the Council referred to in Section 1. 3) The Mayor, or in the absence of the Mayor, the Deputy-Mayor and the Clerk, or in the absence of the Clerk, the Acting Clerk. a) are authorized and directed to execute all documents necessary to the action taken by Council as described in Section 1; and b) are authorized and directed to affix the seal of the Corporation of the Township of Cramahe to all such documents referred to in Section 1. 4) This By-Law comes into force on the day upon which it is enacted.
