8 Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 2014/03/14, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property. As of 2014/03/14, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. 25 Phase One Conceptual Site Model The Phase One Property is located on the north corner of the intersection of Britannia Road East and Sixth Line in Milton, Ontario. A Key Map showing the location of the Phase One Property is provided in Figure 1. The Phase One Conceptual Site Model provides information obtained during the completion of the Phase One Environmental Site Assessment ( ESA ). The following is a summary of the information pertaining to the Phase One Property and Phase One Study Area: The Phase One Property is located within the physiographic region of Southern Ontario. The area is characterized by clay to silt till. The underlying bedrock consists of limestone, dolomite, shale, argillite, sandstone, quartzite, and/or grit. Shallow groundwater in the Phase One Study Area is expected to flow towards the southeast based on topography and proximity to the East Sixteen Mile Creek. The Phase One Property was vacant and undeveloped. Based on a title search, the Phase One Property was owned by private individuals from 1826 to 1974 and from 1986 to Ontario Housing Corporation and Ontario Land Corporation owned the Phase One Property between 1974 and Based on a review of aerial photographs, the Site was undeveloped agricultural land since at least A tributary to the East Sixteen Mile Creek is located approximately 150 m south of the Site. The East Sixteen Mile Creek is located approximately 1 km southeast of the Site and flows southeast toward Lake Ontario, located approximately 13.8 kilometres southeast of the Site. Areas of natural significant were not identified within the Phase One Study Area. The Water Well Information System database indicated that ten wells were located within the Phase One Study Area, with one located on the Phase One Property. However, no wells were observed during the Site rreconnaissance and the Site Representative indicated that no wells were present on the Phase One Property. Furthermore, the EcoLog ERIS report indicated that the margin of error for the well coordinates is 30 to 100 m. Adjacent properties consisted of agricultural and residential land to the southwest, northwest and northeast, a commercial golf course to the north and a commercial soil depot to the southeast. Details of the Phase One Property and Phase One Study Area are provided in Figures 2 and 4. Potentially Contaminating Activity Based on the results of the Phase One ESA completed by Pinchin, no potentially contaminating activities were identified the Phase One Study Area.
