8 A Qualified person s statements and certifications As the qualified person, I certify that: A phase one environmental site assessment of the record of site condition property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 2015/08/13, no phase two environmental site assessment is required by the regulation for the record of site condition property and based on the phase one environmental site assessment for the record site condition property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the record of site condition property. As of 2015/08/13, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the record of site condition property that, if the record of site condition property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the record of site condition will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this record of site condition are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. 28 1.1 Phase One ESA - Conceptual Site Model A conceptual site model (CSM) has been created to provide a summary of the findings of the Phase One ESA. The Phase One CSM is summarized in Figures 1 through 4, which illustrate the following features within the Phase One study area, where present: Existing buildings and structures; Water bodies located in whole or in part within the Phase One study area; Areas of natural significance located in whole or in part within the Phase One study area; Drinking water wells located at the Phase One property; Land use of adjacent properties; Roads within the Phase One study area; PCAs within the Phase One study area, including the locations of tanks; and APECs at the Phase One property. The following provides a narrative summary of the Phase One CSM: The Phase One property is a rectangular-shaped parcel of land approximately hectares in size located at the northeast corner of the intersection of Erin Mills Parkway and Mississauga Road. The Phase One property is improved with a commercial building (Site Building) that occupies the northeastern portions of the Phase One property. The Phase One property has been used for commercial purposes since initial development in There is no record of industrial use or of a commercial use (e.g., garage, bulk liquid dispensing facility or dry cleaner) that would require classifying the Phase One property as an enhanced investigation property. Copies of pertinent maps, illustrating local topographical, hydrogeological and drainage features are provided in Appendix J. No water bodies were identified within the Phase One study area. The nearest water body is a channelized portion of Mullet Creek, which is located approximately 420 m south of the Phase One property. No areas of natural significance were identified within the Phase One study area. No drinking water wells were located on the Phase One property. A total of Six PCAs were identified within the Phase One study area, outside of the Phase One property. As shown on Figure 4, the off-site PCAs are pesticide vendors located within the Meadowvale Corporate Centre located approximately 30 m west of the Phase One property (2000 Argentia Road), historical wood treating located approximately 80 m north of the Phase One property (6557 Mississauga Road) and transformers located

29 approximately 75m to 230m up/transgradient and downgradient of the Phase One property. Groundwater flow within the Phase One study area is interpreted to be to the southeast and the off-site PCAs are inferred to be upgradient, up/transgradient and downgradient of the Phase One property. Given that these PCAs are either associated with pesticide register listings as pesticide vendors, or are located at up/transgradient and downgradient properties that are at least 80 m from the Phase One property, the off-site PCAs are not considered to result in APECs at the Phase One property. None of the PCAs identified within the Phase One study area represent APECs at the Phase One property. Figure 4 provides a detailed summary of the APECs and associated PCAs and COPCs. Underground utilities at the Phase One property provide potable water, electrical, telephone, cable and sewer services to the Site Building. These services enter the Site Building through a subsurface conduit on the east side of the Site Building. Plans were not available to confirm the depths of these utilities but they are estimated to be located approximately 2 to 3 mbgs. The depth to groundwater at the Phase One property is estimated to be approximately 1.83 mbgs. The elevation of the Phase One property, based on information obtained from the Ontario Base Map series, is approximately 174 mamsl. The general topography in the local and surrounding area is generally flat with a slight grade upwards in elevation to the north and west. No bedrock outcrops were observed on-site or in the surrounding area. Based on data from the MOECC Well Record Database, the overburden thickness (i.e., depth to bedrock) within 300 m of the Site ranges between 4.6 to 5.5 mbgs. A review of the available physiographical data indicates that the Phase One property and the surrounding properties located within the Phase One Study Area are located within Till Moraines with the primary native material consisting of clayey silt to silt deposits. Bedrock is expected to consist of shale, limestone, dolostone and siltstone of the Queenston Formation. Based on general hydrogeological principles and Pinchin s familiarity with subsurface conditions at and near the Phase One property and the surrounding properties within the Phase One study area, the unconfined groundwater beneath the Phase One property is expected to flow in a southeasterly direction. No water bodies are located within the Phase One study area, and the nearest surface water body is a channelized portion of Mullet Creek, located approximately 420 m south of the Phase One property, which is a tributary to the Credit River, located approximately 1 kilometre east of the Phase One property. The Phase One property and the surrounding properties located within the Phase One study area are located within Till Moraines with the primary native material consisting of

30 clayey silt to silt deposits. Bedrock is expected to consist of shale, limestone, dolostone and siltstone of the Queenston Formation. The Phase One property is relatively flat with little relief. The area surrounding the Phase One property slopes gradually to the southeast. Local groundwater flow is inferred to be to the southeast, based on the topography of the area surrounding the Phase One property. Regional groundwater flow is inferred to be to the south towards Lake Ontario. There were no deviations from the Phase One ESA requirements specified in O. Reg. 153/04 or absence of information that have resulted in uncertainty that would affect the validity of the Phase One CSM
