17 QP Owner QP A As the qualified person, I certify that: * A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 2012/08/14, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property. As of 2012/08/14, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. The residential properties are mostly to the north of the phase one property. The industrial/commercial complex is to the south of the phase one property and along the Queensway. The only buried services on the phase one property are the connections to the sewers and for the water service. The house that is on the property has been there since it was first developed in the 1950s. No earthworks have been done and no fill has been brought to the site. The property is not located within an area that is deemed environmentally sensitive or designated as an area of natural significance. The closest bodies of water are the Mimico Creek to the east and Lake Ontario to the South. Both of these are in excess of

29 1.4kms away. Accordingly groundwater flow will be to the south predominantly, with some influences to the east. The geotechnical investigation boreholes revealed the soil profile to be uniform in the three locations and it was taken to the same across the entire property. Three boreholes have been drilled on the property. The soil stratigraphy that was revealed is comprised of Topsoil or pavement m Brown to grey sandy silt m Grey weathered shale 2.4m-4.5m Grey intact shale 4.5m end of borehole These findings confirm that the property is not a shallow soil property. No ground water was encountered within the explored depths. The Queensway is a main arterial road forming the south boundary of the phase one property. There are 300mm diameter trunk sewers located below this roadway (est. 5.5mbeg) as well as water supply mains. These buried services will effective prevent north-south transport of fluid-borne contamination. Therefore, this factor in addition to the natural groundwater flow direction to the south will prevent any such contamination generated to the south of the phase one property from having any impact on it. Potentially Contaminating Activities These data have also revealed that no potentially contaminating activities has ever been carried out at the phase one property. Areas of Potential Environmental Concern There are three areas of potential environmental concern that have been identified within the phase one study area. These are all located on the south side of The Queensway, south of the subject property. These are The Queensway where there is a gas station, tire repair and oil change enterprise as well as a car wash. The gas station has double-walled fiberglass tanks that were installed in There are small storage tanks on site for the storage of waste PHC liquid. 929 the Queensway houses a Stephenson Rental outlet where there are two storage tanks to store fuel that is used in the rental equipment. Both of these tanks are above ground tanks There is a commercial printing operation at 20 Plastics Avenue that generates VOCs as a waste and also discharges it into the air based on the NPRI.

30 The information that has been summarized here has been collated based on documents obtained from the EcoLog ERIS report contained in the previous phase one ESA report and also based on observations made during a reconnaissance of the properties within the phase one study area by Candec personnel. They are considered worthy of note given their proximity to the phase one property and the nature of the waste that are generated and or the hazardous materials that are used or stored on one or the other of the listed properties. Given that these properties are all located on the south side of The Queensway and the groundwater flow is predominantly to the south there is a low probability that subsurface impacts on these properties will migrate northward, under the Queensway, past the east-west aligned buried services, and on the phase one property. The likelihood of this occurring is further reduced by the fact that the underground fuel storage tanks are made of fiberglass and are double-walled. On this basis, these properties have been deemed unlikely to impact the phase one property.
