32 QP Owner QP D As the qualified person, I certify that: * A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2013/05/30, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located. As of 2013/05/30, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Compared to Standards Specified in a Risk Assessment. As of 2013/05/30, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. Site consists of grassed areas Property appears to be paved with a parking lot. Since July 13, 2005 Calloway REIT (Sevenbridge) Inc. The northern portion of the Site appears to be paved with a parking lot. The southern portion of the Site consists of grassed areas. Commercial use Based on the review of aerial photographs and Google Earth images (1988 to 2009), the Site appears to be mainly comprised of undeveloped land. The northern portion of the northern parcel of land within the Phase One Property appears to be paved with a parking lot.

48 PHASE TWO CONCEPTUAL SITE MODEL The Phase II ESA Conceptual Site Model is described below: Physical Setting The Site is approximately 0.22 acres (0.09 hectares) in size and consists of undeveloped land with mixed landscaped and asphalt paved parking areas along the north side of Apple Mill Road. The Site area slopes gently to the south, and is generally at grade with respect to the properties located adjacent to the Site. Surface water drainage at the Site appears to consist of infiltration and overland flow towards off-site catch basins. There are no subsurface structures or utilities on or under the Site that are expected to affect groundwater flow. The groundwater may be influenced by construction dewatering as discussed below. There are no planned changes to the Site and no plans for further buildings or structures. This Site is part of a road allowance and may become part of a road in the future. The Site is located in a commercial/retail area of Vaughan (Figure 1). The immediate surrounding properties include the following: North: Wal-Mart store, which included a Mr. Lube (approximately 160 m north of the Site), followed by Portage Parkway and multi-tenant commercial and industrial land uses. East: Toronto Transit Commission s Toronto-York Spadina Subway Extension and associated buildings. South: Apple Mill Road, followed by a vacant, undeveloped parcel of land and multi-tenant commercial land uses (including Home Outfitters and Future Shop). West: Commercial land uses and undeveloped land. The Site and surrounding areas are serviced with municipal water, sanitary sewers, and storm sewers. Potable water is supplied to properties in the vicinity of the Site by Municipal services. The City of Vaughan reportedly purchases Municipal water from York Region, which reportedly purchases the water from the City of Toronto. Water supply from the City of Toronto is obtained from Lake Ontario, and is treated by the City of Toronto prior to being pumped to Vaughan. Topography and Drainage The Site is generally flat but the area slopes gently to the south, and is generally at grade with respect to the properties located adjacent to the Site. Surface water drainage at the Site appears to consist of infiltration and overland flow towards off-site catch basins. No surface water bodies are present within the boundaries of the Site. The nearest surface water bodies are the east and west branches of Black Creek, located approximately 400 m east and 800 m west of the Site, respectively. Environmentally Sensitive Areas (as per section 41 of O. Reg. 153/04) The Site is not considered to be environmentally sensitive, nor is it within 30 metres of an area of natural significance. Shallow Soil Property or Water Body (as per section 43.1 of O. Reg. 154/04) Project No: (6000) June /4

49 The Site is not a shallow soil property. It does not include all or part of a water body, nor is it within 30 metres of a water body. Geological Conditions Geological mapping indicates that native overburden in the area of the Site consists predominantly of silt to silty clay matrix that is high in matrix carbonate content and clast poor Ontario Ministry of Development and Mines, Map No. 2556, Quaternary Geology of Ontario, Southern Sheet, 1991). Bedrock in the vicinity of the Site reportedly consists of Upper Ordovician shale, limestone, dolostone, and siltstone (Ontario Ministry of Development and Mines, Map No. 2544, Bedrock Geology of Ontario, Southern Sheet, 1991). Overburden soils underlying the Site, can be organized into the following layers: 1) Fill was encountered in all three boreholes advanced as part of the Phase II ESA (and 2012 Golder Geotechnical/Hydrogeological investigation). The fill ranges in thickness from about 0.76 m to 1.37 m. The fill generally varies in composition from clayey silt to sandy silt and silty sand containing trace to some gravel. Fragments of brick and asphalt were observed within the fill materials at the surface of boreholes BH13-2 and BH ) Till consisting of clayey silt with some sand was noted within borehole BH13-1 with a thickness of 1.53 m followed by sandy silt to silty sand. Till in the remaining boreholes BH13-2 and BH13-3 was predominantly comprised of sandy silt to silty sand, with layers of sand to the borehole depths. 3) Based on previous investigations conducted within the Site and the vicinity of the Site, a Lower Till Deposit that is generally comprised of clayey silt to silty clay underlies the upper till. Based on local hydrogeological studies (Golder, 2012) this till deposit is interpreted to be regionally extensive and represents an aquitard at the base of the local groundwater flow system. Bedrock was not encountered during investigations completed at the Site. Historical water well records indicate that bedrock is over 50 m below ground surface. There was no soil deposited during the course of Golder s investigation and no fill was found on-site other than that noted above. Groundwater Levels, Flow Direction, Hydraulic Gradients Groundwater elevations and depths as measured in the shallow monitoring wells installed by Golder as part of the Phase II ESA on May 30, 2013 and calculated based on the elevation survey conducted on June 13, 2013 are presented on Figure 3. A geologic cross-section of the Site is presented on Figure 4. The following observations are made: Groundwater in the shallow overburden ranged from 2.94 m to 5.19 m bgs (99.16 m asl to m asl in elevation; Groundwater was located within the native overburden; and, Groundwater elevation data was insufficient to obtain a reliable groundwater flow direction at the Site. The data collected to date indicates an easterly flow of groundwater with an approximate gradient of m/m, Project No: (6000) June /4

50 however, based on groundwater elevation data obtained in the Site and in the vicinity of the Site groundwater flows to the west. Information to calculate a vertical gradient was not obtained and this information is not warranted given the risks of contamination of and the absence of impacts. During the course of this investigation construction of the Toronto-York Spadina Subway Extension ( TYSSE ) was on-going to the southeast of the Site. Construction dewatering in support of the TYSSE began in April, The Site is likely within the dewatering zone of influence of TYSSE construction dewatering, and therefore, groundwater levels observed during this Phase II investigation are not likely to be representative normal observations. Potentially Contaminating Activities Based on the information obtained as part of this Phase I ESA, the following potentially contaminating activities were identified (Figure 1): Location Offsite Site Potentially Contaminating Activity Auto Repair Mr Lube 185m north of the Site Fuel Dispensing Shell Canada at 7800 Jane Street Importation of Fill Material of Unknown Quality Fill is reportedly present across the Site. Information Source Site Visit Ecolog Eris and Site Visit Previous reports 2011 Geotechnical Report, Site observations Status and Rationale A Mr. Lube is located approximately 185 m north of the Site. This recent development was not considered a risk of contamination to the Site based on recent construction, its distance from the Site and the relatively immobile liquids used (i.e. lubricating oils) Jane Street is a Shell Canada gas station approximately 210 m southeast of the Site. This station has been present since the mid- 1990s. This Shell Canada gas station was not considered a risk of contamination based on its location hydraulically downgradient from the Site. Fill materials were recorded in the boreholes advanced on the Phase One Property during the 2011 Geotechnical investigation. Depth to fill ranged from 0.69 m to 1.68 m across the Site and comprised of clayey silt, sand, gravel, and sandy silt. Fill materials (comprising of debris, gravel, bricks and concrete) was observed at the ground surface across the Phase One Property. Project No: (6000) June /4

51 Location Potentially Contaminating Activity Information Source Status and Rationale Former Orchard Former on-site orchard Aerial photographs, Site representatives. Based on the review of aerial photographs (1946 to 1974) the Phase One Property comprised of an orchard. According to the Site representative an apple orchard operated on the Site until approximately 20 years ago. Areas of Potential Environmental Concern and Phase II ESA Findings The Phase I ESA identified the following APECs with respect to the Site: The presence of fill materials of unknown quality across the Site; and, The presence of the former apple orchard in operation at the Site from at least 1946 to the early 1980s. To assess the APECs, three boreholes were installed and completed as groundwater monitoring wells on-site. Soil was logged and screened during drilling and selected samples analyzed for COPCs. The wells were developed and sampled and groundwater also analyzed for COPCs. Based on the findings of the Phase II ESA, no soil or groundwater sample exceedances above the 2011 MOE Table 3 Standards were identified for the parameters analysed. Summary of Contamination No soil or groundwater impacts were identified at the Site based on the locations and parameters tested as part of the Phase II ESA. As no contaminants were identified exceeding standards Golder has not provided figures, cross sections or discussion identifying impacts and their distribution or migration. Similarly we have not included a discussion of: the impacts of climatic or meteorological conditions; soil vapour risks and migration; and receptors and routes of exposure. CONCLUSIONS In conclusion, the Phase II ESA has addressed the APECs identified in the Phase I ESA as outlined in the APECs Table.
