8 Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 2015/01/23, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property. As of 2015/01/23, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. I do not hold and have not held and my employer PINCHIN LTD. does not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessment or risk assessment upon which this record of site condition is based To the best of my knowledge, the certifications and statements in this part of the RSC are true as of 2015/01/23. Pinchin Ltd. is filing a Record ofsite Condition ("RSC") in respect ofthe Lands registered in the name ofmattamy which are described in Schedule A hereto annexed and designated as Part 7 on reference plan of survey 20R-18294, a reduced copy ofwhich is hereto annexed as Schedule B. The TransferlDeed to Mattamy references the address as simply Milton. The property acquired by Mattamy has been split by 3 transfers since the acquisition. The current address for the Lands is 0 Louis St. Laurent Avenue, Milton as per the 2015 Interim Tax Bill received from the Town of Milton. It is probable that this is simply a holding address pending development of the Lands. The Municipal Roll # is: as per the 2015 Interim Tax Bill. The Ministry of Environment will not be able to reconcile the RSC affected lands with the registered TransferlDeed. I will set out the chronology which, hopefully, will clarify the situation. 1. The Lands affected by the RSC are registered under Property Identification Number (PIN): (LT) - a copy is attached to this letter. 1

13 2. The Lands and other lands were acquired by Mattamy pursuant to Transfer/Deed registered as number HR then recorded under PIN (LT). A copy of eaeh of the Transfer/Deed and the PIN is attached to this letter. In the Transfer/Deed to Mattamy, the lands are described as follows: PT LT 8, CON 4 TRAFALGAR NEW SURVEY BEING PT 2, 20R14054, MILTON. A copy ofplan 20R is attached to this letter. 3. At the time ofregistration ofinstrument No. HR173707, the lands therein described had been converted from governance by the Registry Act to the Land Titles Act and the Estate Qualifier was Land Titles Conversion Qualified. 4. Mattamy is a residential developer and builder and title to affected lands must be in Fee Simple Absolute Title prior to registration of a plan of subdivision. An Applieation for Absolute Title was filed; this necessitated registration of a new reference plan of survey as Plan 20R A new PIN number was allocated as well: (LT). A copy ofeach ofplan 20R and PIN (LT) is attached to this letter. 5. As a result ofthe absolute title application, the legal description ofthe lands changed to: PT LT 8, CON 4 TRAF NS, PT 2 20R14054, MILTON. 6. The Land Registry Office for the Land Titles Division ofhalton retired PIN (LT) on June 1,2007 and title was re-entered under PIN (LT). A copy of that PIN is attached to this letter. The legal description remained the same. 7. A reference plan ofsurvey was deposited as Plan 20R A copy ofthat plan is attached to this letter. 8. Mattamy agreed to sell a portion of the lands acquired to Halton District School Board, another portion to The Regional Municipality ofhalton, and to convey at no charge a further portion to The corporation ofthe Town of Milton. These transfers resulted in the PIN (LT) being split into 4 new PINs: a) (LT) being Parts 3, 4, and 5 on Plan 20R in the name of The Corporation of the Town ofmilton; b) (LT) being Part 6 on Plan 20R in the name of Halton Distrrict School Board; c) (LT) being Part 2 on Plan 20R in the name ofthe Regional Municipality ofhalton; and d) (LT) being Part 7 on Plan 20R being the balance of the lands acquired in the name of Mattamy. A copy ofeach ofthose PINs is attached to this letter. 9. The Lands affected bythe RSC are all ofthe lands remaining registered in Mattamy's name and are reeorded under PIN (LT). 2

40 Phase One Conceptual Site Model A conceptual site model (CSM) has been created to provide a summary of the findings of the Phase One Environmental Site Assessment (ESA) prepared for the property identified as Part Lot 8, Concession 4, Trafalgar NS, Part 7 plan 20R-18294, Milton, Regional Municipality of Halton (Phase One Property). The Phase One CSM is summarized in Figures 1 through Figure 3, which illustrate the following features within the Phase One Study Area, where present: Existing buildings and structures; Water bodies located in whole or in part within the Phase One Study Area; Areas of natural significance located in whole or in part within the Phase One Study Area; Drinking water wells located at the Phase One Property; Land use of adjacent properties; Roads within the Phase One Study Area; Potentially Contaminating Activities (PCAs) within the Phase One Study Area, including the locations of tanks; and Areas of Potential Environmental Concern (APECs) at the Phase One Property. The following provides a narrative summary of the Phase One CSM: The Phase One Property is an irregularly-shaped parcel of land with an area of approximately acres (10.15 hectares). The Phase One Property is located on the southeast side of Louis Saint Laurent Avenue, approximately 315 metres (m) southwest of Fourth Line. The Phase One Property is undeveloped. There is no record of industrial use or of commercial use (e.g., garage, bulk liquid dispensing facility, dry cleaner, etc.) that would require classifying the Phase One Property as an enhanced investigation property; Water bodies located within the Phase One Study Area consisted of a creek that traversed the southeast portion of the Phase One Property and a creek located approximately 210 m northeast of the Phase One Property; The elevation of the Phase One Property, based on information obtained from the Ontario Base Map series, is approximately 196 m above mean sea level (mamsl). The general topography in the local and surrounding area is generally flat with a slight grade upwards in elevation to the north and west. No bedrock outcrops were observed on-site or in the surrounding area. Based on data from the Water Well Information System 2015 Pinchin Ltd.

41 database, the overburden thickness on-site (i.e., depth to bedrock) is between approximately 9.1 and 11.5 m below ground surface (mbgs); A review of the available physiographical data indicates that the Phase One Property and the surrounding properties located within the Phase One Study Area are located within an area of glaciofluvial deposits with the primary native material consisting of massive to laminated silt and clay. Bedrock is expected to consist of shale, limestone, dolostone and/or siltstone of the Queenston Formation. The topography is considered to be mainly flat to rolling low local relief with dry surface water drainage conditions; Based on general hydrogeological principles and Pinchin s familiarity with subsurface conditions at and near the Phase One Property and the surrounding properties within the Phase One Study Area, the unconfined groundwater beneath the Phase One Property is expected to flow in a southeasterly direction. A creek is located on the southeast portion of the Phase One Property and flows in a southwesterly to northeasterly direction, discharging into a creek located approximately 780 m east of the Phase One Property at an elevation of 193 mamsl. An additional creek is located within the Phase One Study Area, approximately 210 m northeast of the Phase One Property, and flows in a southeasterly direction to also discharge into the creek located approximately 780 m east of the Phase One Property. No additional water bodies are located within the Phase One Study Area. The nearest major water body is Sixteen Mile Creek, located approximately 1,900 m southwest of the Phase One Property at an elevation of approximately 184 mamsl; A soil berm is located on the east portion of the Phase One Property. Based on information obtained from owner of the Phase One Property, as well as the geotechnical engineering firm familiar with the Phase One Property, the soil in the berm originated from the adjoining parcel of land that is currently developed with a Halton Region public school (Craig Kielburger Secondary School located at 1151 Ferguson Drive; the School Lands ). The Phase One Property and the School Lands historically comprised one contiguous legal parcel of land until circa 2009 (as noted in the Lawyer s Letter attached to this RSC submission), at which time the School Lands were severed to facilitate the construction of the school. Prior to severance and during construction of the school, the School Lands were graded via stripping of topsoil and some surficial native soil. In addition, excavation of soil for construction of the nearby storm water management pond was undertaken at that time. The excess soil generated by the grading and excavation activities on the School Lands was subsequently placed and stockpiled on the Phase One Property, forming the soil berm. Based on the findings of Pinchin s Phase One ESA, as well as the supplemental information obtained (as outlined above), it is the QP s opinion that the soil berm present 2015 Pinchin Ltd.

42 at the Phase One Property does not constitute a potentially contaminating activity (specifically, item 30, importation of fill material of unknown quality). The information obtained indicates that the soil originated from the School Lands which (along with the Phase One Property) formed a larger parcel of land prior to being severed. As such, it is considered that the soil used to construct the berm was not imported from another property. With respect to quality, there is no reason to suspect that the soil within the berm is a media of concern. Pinchin prepared and filed an RSC for the lands located south of the Phase One Property, as well as lands to the east, and the RSCs were acknowledged by the Ontario Ministry of the Environment and Climate Change. The activities completed at these properties at the time of acknowledgement were consistent with the current activities at the Phase One Property. A sole groundwater monitoring well was identified at the Phase One Property during the Phase One ESA. There is no certainty or additional information regarding its origin. There is suspicion that it is associated with a previous hydrogeological assessment for lands situated west of James Snow Parkway. The well has no association with any previous environmental or geotechnical investigations. The well was inaccessible at the time of completing the Phase One ESA and, as such, information regarding depth to groundwater was not obtained. No areas of natural significance were identified within the Phase One Study Area and the Phase One Study Area was not located within one of Halton Region s Environmentally Sensitive Areas; No drinking water wells were located on the Phase One Property; Louis Saint Laurent Avenue and Craig Kielburger Secondary School (1151 Ferguson Drive) are located immediately northwest of the Phase One Property. Craig Kielburger Secondary School is also situated immediately northeast of the Phase One Property, as well as the property located at 1198 Fourth Line, which is occupied by the Halton Region Fourth Line Booster Station. Properties located immediately southeast and southwest of the Phase One Property are utilized for agricultural purposes; and No PCAs, APECs or contaminants of potential concern were identified within the Phase One Study Area, including the Phase One Property. There were no deviations from the Phase One ESA requirements specified in O. Reg. 153/04 or absence of information that have resulted in uncertainty that would affect the validity of the Phase One CSM. Details of the Phase One Property and Phase One Study Area are provided in Figure Pinchin Ltd.

43 Potentially Contaminating Activity Based on the results of the Phase One ESA completed by Pinchin, no PCAs were identified on the Phase One Property or within the Phase One Study Area. Based on the results of the Phase One ESA completed by Pinchin, no APECs were identified at the Phase One Property or within the Phase One Study Area. As such, no subsurface investigation work (Phase Two ESA) is recommended at this time. Site operating records were not available for the Phase One Property. The lack of site operating records does not influence the findings of the Phase One ESA. The CSM (refer to Figure 3) is based on the information collected for the Phase One ESA completed for the Phase One Property and is subject to the limitations stated in the report Pinchin Ltd.
