18 Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2015/10/06, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located. As of 2015/10/06, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment. As of 2015/10/06, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. I do not hold and have not held and my employer AIMS ENVIRONMENTAL does not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessment or risk assessment upon which this record of site condition is based To the best of my knowledge, the certifications and statements in this part of the RSC are true as of 2015/10/06. 68 Ontario Regulation 153/04 Phase Two Conceptual Site Model 9 to 25 Eldora Avenue, 26 to 28 Greenview Avenue, and 49 Hendon Avenue (designated as Lots 82, 83, 112, 113, 114, 115, 116, 117, and 118, and Part of Lots 111 and 119 of Registered Plan 2419), in Toronto, Ontario AR148A-14 The Phase Two Conceptual Site Model (CSM) has been prepared based on information and data collected to date as part of AiMS Environmental s Phase One and Phase Two Environmental Site Assessments (ESAs) conducted at the Site. The Phase Two CSM consists of this text and attached drawings. Section i. A description and assessment of, A. areas where potentially contaminating activity (PCA) has occurred, B. areas of potential environmental concern (APECs), and Phase Two Property There are seven PCAs (1, 2, 3, 4, 5, 6, and 7) on the Phase Two Property, and one PCA of note (8) within the Phase One Study Area. In addition, 12 other PCAs (9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, and 20) were identified within the Phase One Study Area but were not considered to be of concern due to location (downgradient or crossgradient from the subject site) with respect to the inferred direction of groundwater flow. No subsurface structures or utilities were identified on, in or under the Phase Two The subject property is a 0.5-hectare (1.25- acre), irregular shaped, parcel of residential land fronting Eldora, Greenview, and Hendon Avenues, in Toronto, Ontario. Please refer to Drawings 4A and 4B. 2

70 Phase Two Environmental Site Assessment AR148A-14 Eldora, Greenview & Hendon Avenues, Toronto October 2015 A. stratigraphy from ground surface to the deepest aquifer or aquitard investigated, B. hydrogeological characteristics, including aquifers, aquitards and, in each hydrostratigraphic unit where one or more contaminants is present at concentrations above the applicable site condition standards, lateral and vertical gradients, The observed soil stratigraphy generally comprised shallow topsoil and/or sandy silt fill material from ground surface to a depth of 0.76 m, which was overlying a stratum of sandy silt till (with traces of clay and gravel) encountered from 0.76 to 6.10 m. Bedrock was not encountered with the maximum depth of exploration. Please refer to Cross- Sections A-A and B-B. The results of the ground water monitoring indicated that the primary near surface water table resides within the sandy silt till stratum. The shallow ground water was screened in the field during monitoring well development and purging for gross evidence of negative environmental impact including presence of liquid petroleum hydrocarbons, sheen (iridescence), odour and colour, and no evidence of impact was noted. Furthermore, no exceedences above applicable standards were identified in any of the soil or ground water samples collected across the Phase Two Property for the following parameters tested: Petroleum Hydrocarbons (PHCs), Metals, Volatile Organic Compounds (VOCs), and Organochlorine Pesticides (OCs). Therefore, only the shallow aquifer warranted investigation. Groundwater flow is inferred in a southwestward direction across the Phase Two Please refer to Figure The average lateral hydraulic gradient is 0.04 m/m. Based on grain size analysis, the hydraulic conductivity of the sandy silt is estimated to be in the order of 10-5 m/s. 3

The entire Phase Two Property is currently under construction, being redeveloped with five residential blocks comprising a total of 113 stacked townhouse units, with underground parking spaces for 124 vehicles. A single level garage for underground parking was recently completed covering the entire site from property line to property line. The layout of the residential blocks under development is shown on Drawing 4A. No contaminant exceedences were identified during this investigation. Figure 9.2.3: Ground Water Elevations Illustrates the inferred ground water flow direction based on measured ground surface and ground water elevations within the Phase Two This Conceptual Site Model is based on the following information: The Phase Two Property is a 0.5-hectare (1.25-acre), irregular shaped, parcel of residential land fronting Eldora, Greenview, and Hendon Avenues, in Toronto, Ontario. The property is currently under construction, being redeveloped with a residential lowrise development. The entire Phase Two Property was recently excavated from property line to property line down to 6.1 m below existing street level for construction of one underground parking level for 124 vehicles, underlying the foundations of five, three-storey residential blocks comprising a total of 113 stacked townhouse units. No water bodies or areas of natural significance were observed on the Phase Two Property, or in the Phase One Study Area. The closest major water body (Don River West) is located approximately 2.5 km southwest of the subject site, and flows southeastward into Lake Ontario. Lake Ontario is located approximately 18 km south of the Phase Two Historically, the Phase Two Property was first developed in the 1950s with 11 singlefamily dwellings fronting Eldora, Greenview, and Hendon Avenues. All building structures on the site were demolished in 2014 in preparation for the proposed residential redevelopment. A previous Phase I ESA of the property (Phase I Environmental Site Assessment For Proposed Townhouse Development Comprising 9-25 Eldora Avenue, Greenview Avenue, and 49 Hendon Avenue, Toronto, Ontario by Terra Firma Plus Inc. dated May 24, 2012) noted that three of the historical residences (at 26 and 28 Greenview and 25 Eldora 7

75 Phase Two Environmental Site Assessment AR148A-14 Eldora, Greenview & Hendon Avenues, Toronto October 2015 Avenues) were formerly heated using oil-fired furnaces having associated 1000-L heating oil ASTs. The ASTs at 26 Greenview Avenue and 25 Eldora Avenue were located in the basements of the dwellings, whereas the AST at 28 Greenview Avenue was located at the north exterior side of the house. In addition, an ESSO oil sticker on the furnace at 11 Eldora Avenue suggested that a basement AST had previously been associated with that residence. It was noted that no oil spills or staining were observed on the ground surface in the vicinity of the tanks, nor on the concrete floor in the basement of 11 Eldora Avenue. Nevertheless, a record in the Ontario Spills database from 1991 reported a furnace oil spill into the basement at 28 Greenview Avenue. The quantity of the historical spill was unknown, and at the time of the previous Phase I ESA site visit on April 26, 2012, no petroleum odours nor staining were noted on the concrete floor of the basement of the dwelling at 28 Greenview Avenue. At the time of building demolition activities in June 2014, a subsequent limited Phase II ESA was conducted at 28 Greenview Avenue to assess the subsurface impacts, if any, of the aforementioned fuel oil spill in the basement of the former building on the property (Limited Phase II Environmental Assessment of Remaining Soils, After Demolition of the House to Assess the Impacts of a 1991 Spill from an Aboveground Storage Tank at 28 Greenview Ave., Toronto by Terra Firma Engineering Inc. dated June 9, 2014). After removal of the building basement walls and floor, a cavity with an approximate floor area of 150 m 2 was exposed. On June 3, 2014, soil samples were collected at a frequency of every 5 m 2 from the cavity sidewalls and every 10 m 2 from the floor, and were screened using a portable organic vapour monitor. No visual or olfactory evidence of any petroleum impacts, nor any significantly elevated vapour readings were observed in any of the collected soil samples. Furthermore, the analytical results of eight worst case confirmatory soil samples (five from the sidewalls and three from the floor; SP-1 to SP-8 shown in Drawing 4A) indicated that the PHC constituent and metals concentrations in the soil samples complied with the 2011 MOE Table 3 Standards for residential land uses in a non-potable ground water condition. General observations included that no unusual colour, odour, or any sort of free hydrocarbon sheen was observed in the exposed surface while collecting soil samples, and there was no evidence of any free petroleum product in groundwater seepage noted in areas of the cavity base and walls. Based on the findings of the Phase One ESA; PCAs with the potential to cause APECs identified in connection with the Phase Two Property and/or Phase One Study Area are shown in Drawings 4 and/or 4A and are as follows: 8

A historical leak associated with the former AST at 28 Greenview Avenue (PCAs 3 and 4) was investigated through a soil sampling 11

Therefore, these PCAs were considered to be of low environmental concern. Nevertheless, the Phase Two ESA was conducted to assess any subsurface impacts as a result of PCAs 1, 2, 3, 4, 5, 6, 7, and 8 and their corresponding APECs. The Phase Two Property was assessed using the 2011 MOE Table 3 Standards for residential land uses in a potable ground water condition with fine-textured soils from the MOE document Soil, Ground Water and Sediment Standards for Use Under Part XV.1 of the 2011 Environmental Protection Act (EPA). Chemical analyses of soil and groundwater samples were conducted by Testmark Laboratories Ltd. of Mississauga, Ontario or Caduceon Environmental Laboratories of Richmond Hill, Ontario. The Phase Two ESA initially entailed the drilling of a total of six boreholes (BH2, BH3, BH4, BH5, BH6 and BH7) to a depth of 6.1 m below the existing grade at strategically selected locations on the Phase Two Property on June 11 and 12, 2014, as shown in Drawing 4A. All six of the boreholes were completed as ground water monitoring wells in order to permit the collection of ground water samples. At the time of installation, there was no free groundwater encountered in any of the boreholes. The monitoring well screens were therefore placed at the bottom of each well. Soil and ground water samples were selected for submission of chemical analysis of identified contaminants of concern, which included PHCs, Metals, VOCs and OCs. Between July and October 2014, all soil on the property down to 6.1 m below existing street level was excavated and disposed off-site to facilitate the construction of one underground parking level for the proposed residential development. On October 6, 2015, four shallow test pits (TP101, TP102, TP103 and TP104) were dug by Terra Firma Engineering Inc., under the supervision of AiMS Environmental, beneath the poured concrete surface of the parking garage into the native soil below the vicinity of the former basement ASTs, also shown in Drawing 4A. Soil samples from each test pit were submitted for chemical analysis of PHC parameters. The stratigraphy from ground surface to the aquifer investigated in the Phase Two Property included topsoil and sandy silt fill material (surface to 0.76 m). The native soil consisted of a stratum of sandy silt till (0.76 to 6.10 m) with traces of clay and gravel, and was encountered in all boreholes. Bedrock was not encountered within the maximum depth of exploration. 12

80 Phase Two Environmental Site Assessment AR148A-14 Eldora, Greenview & Hendon Avenues, Toronto October 2015 The shallow ground water table was measured below the Phase Two Property at depths ranging from 0.6 to 4.0 m below ground surface (geodetic elevations of to metres above sea level) on July 24, 2014, six weeks after installation. Groundwater has been interpreted to flow in a southwestward direction across the Phase Two Property, with an average lateral hydraulic gradient of 0.04 m/m. The soil and ground water samples were examined in the field for lithology as well as for aesthetic evidence of impacts (i.e. debris, staining, sheen, and/or odours). No elevated soil vapour readings were observed upon field screening of the soil samples using a portable organic vapour surveyor. No significant foreign odours or evidence of hydrocarbon staining was noted in any of the soil samples. All measurements of groundwater depth were made using an electronic interface probe, which did not reveal the presence of any non-aqueous phase liquids (NAPLs) in any of the monitoring wells. During development and purging, all of the monitoring wells were purged to waste, resulting in drawdown of the water level to within the screened interval. The purged groundwater was checked in the field for visual and olfactory evidence of negative environmental impact including presence of liquid petroleum hydrocarbons, sheen (iridescence), odour and colour, and no evidence of any impact was observed. All soil and groundwater samples collected and analyzed for PHCs, VOCs, Metals and OC Pesticides within the Phase Two Property met the applicable 2011 MOE Table 3 Standards for residential land uses. Furthermore, no exceedences (including any evidence of free product as per Subsections 49(1) and (2) of the Regulation) were noted on the RSC property. Consequently, no further assessment or remedial actions are considered warranted at this property for the proposed residential redevelopment. 13
