Our May sales follow hot on the heels from the success of our April auction in Leeds where 70% of the lots sold generating sales in the region of 3.6m, with many properties selling for well in excess of the guide prices. These results help to demonstrate how our auctions are an effective and efficient means of disposal for assets across all sectors even in a difficult market. Some April highlights included: Midgley Water Tower Near Wakefield a sale on behalf of Yorkshire Water which sold for 110,000. The George and Mead Hall, Cleckheaton a former public house in the centre of Cleckheaton which sold for 214,000. Duke Street, Doncaster a vacant retail unit and office accommodation above with planning to convert to residential which sold for 137,000. GUIDE AND RESERVE PRICE DEFINITIONS This catalogue contains details about properties being sold at auction. Those details are subject to change up to and including the day of the auction. GUIDE PRICE An indication of the seller s current minimum acceptable price at auction. The guide price or range of guide prices is given to assist consumers in deciding whether or not to pursue a purchase. It is usual, but not always the case, that a provisional reserve range is agreed between the seller and the auctioneer at the start of marketing. As the reserve is not fixed at this stage and can be adjusted by the seller at any time up to the day of the auction in the light of interest shown during the marketing period, a guide price is issued. This guide price can be shown in the form of a minimum and maximum price range within which an acceptable sale price (reserve) would fall, or as a single price figure within 10% of which the minimum acceptable price (reserve) would fall. BIDDING REMOTELY We strongly recommend that you make every effort to attend the auction to bid in person. THE SALE The auctioneer will not describe each individual property in detail or elaborate on its features or finer points. The auctioneer will merely state the address, lot number and a very brief description. The auctioneer will not answer questions whilst the auction is proceeding. Unless stated otherwise, all lots offered will be subject to a reserve price, which is confidential to the auctioneers and vendor only and which may differ from the published guide price. On the fall of the auctioneer s hammer, the successful bidder will be in a binding contract of sale. At this point, an auction runner will come to you to take the details of the buyer and the buyer s solicitor. You will then be taken to the contracts desk where contracts will be signed. You must sign the auction memorandum of sale prior to leaving the auction room. Failure to do so may result in the lot being re-offered for sale. You should then pass your copy of the contract on to your solicitors. BIDDING The onus is on the bidder to attract the auctioneer s attention. The auctioneer reserves the right to regulate the bidding and refuse any bid without being required to explain why. On properties where there is a reserve price, we retain the right to bid on behalf of the vendor or the vendor s agent. We recommend that you do not leave making your bid until the last moment. PROOF OF IDENTITY In order to comply with HM Government Anti Money Laundering (AML) Regulations, we require all bidders to provide us with proof of their identity by supplying each of the following: Proof of name a photographic ID, such as current passport or new style UK driving licence Proof of address a utility bill, bank or building society statement, or credit card bill issued within the previous three months, providing evidence of residency at the correspondence address. Part of our process may involve electronic identification verification using the services of Tracesmart Limited. This may involve a full electoral roll search which will place a search footprint on your credit file. This will not affect your credit rating. DEPOSIT A successful bidder will be required to provide a deposit in the sum of 10% of the purchase price or 2,000, whichever is the greater. This will be in the form of either a personal cheque, company cheque or banker s draft. These must be drawn on a UK registered bank and are accepted on the basis that there are adequate funds in the account on which the cheque is drawn. All cheques/bankers drafts will be banked immediate after the auction and we reserve the right to take any appropriate action against a purchaser whose cheque is not honoured on first presentation. Please note that cash is not accepted as a form of payment for the deposit. Debit card payments are acceptable. A separate cheque will be required for each lot purchased. ADMINISTRATION CHARGE The successful buyer will be required to pay Eddisons a buyer s administration charge of 850 including VAT. This is payable by cheque and can be paid either separately or added to the deposit cheque. AFTER THE AUCTION COMPLETION Completion will normally be 28 days from exchange of contracts, unless stated differently in the Special Conditions of Sale. ACCESS Access to the property or the release of keys will not be granted until completion has taken place. 67 COMMON AUCTION CONDITIONS Common Auction Conditions (3rd Edition August 2009 reproduced with the consent of the RICS). The general conditions (including any extra general conditions) apply to the contract except to the extent that they are varied by special conditions or by an addendum. INTRODUCTION The Common Auction Conditions have been produced for real estate auctions in England and Wales to set a common standard across the industry. They are in three sections: 1. Glossary The glossary gives special meanings to certain words used in both sets of conditions. 2. Auction Conduct Conditions The Auction Conduct Conditions govern the relationship between the auctioneer and anyone who has a catalogue, or who attends or bids at the auction. They cannot be changed without the auctioneer s agreement. We recommend that these conditions are set out in a two-part notice to bidders in the auction catalogue, part one containing advisory material which auctioneers can tailor to their needs and part two the auction conduct conditions. 3. Sale Conditions The Sale Conditions govern the agreement between each seller and buyer. They include general conditions of sale and template forms of special conditions of sale, tenancy and arrears schedules and a sale memorandum. Approved financial institution Any bank or building society that has signed up to the Banking Code or Business Banking Code or is otherwise acceptable to the AUCTIONEERS. Arrears Arrears of rent and other sums due under the TENANCIES and still outstanding on the ACTUAL COMPLETION DATE. Arrears schedule The arrears schedule (if any) forming part of the SPECIAL CONDITIONS. Auction The AUCTION advertised in the CATALOGUE. Price The price that the BUYER agrees to pay for the LOT. Ready to complete Ready, willing and able to complete: if COMPLETION would enable the SELLER to discharge all FINANCIAL CHARGES secured on the LOT that have to be discharged by COMPLETION, then those outstanding FINANCIAL CHARGES do not prevent the SELLER from being READY TO COMPLETE. Sale conditions The GENERAL CONDITIONS as varied by any SPECIAL CONDITIONS or ADDENDUM. Sale memorandum The form so headed (whether or not set out in the CATALOGUE) in which the terms of the CONTRACT for the sale of the LOT are recorded. Seller The person selling the LOT. If two or more are jointly the SELLER their obligations can be enforced against them jointly or against each of them separately. Special conditions Those of the SALE CONDITIONS so headed that relate to the LOT. Tenancies Tenancies, leases, licences to occupy and agreements for lease and any documents varying or supplemental to them. Tenancy schedule The tenancy schedule (if any) forming part of the SPECIAL CONDITIONS. Transfer Transfer includes a conveyance or assignment (and to transfer includes to convey or to assign ). A3.5 Where there is a reserve price the SELLER may bid (or ask US or another agent to bid on the SELLER S behalf) up to the reserve price but may not make a bid equal to or exceeding the reserve price.
