Rbisn suggested that members review the summary f citizen cmments frm the February 4, 2010 cmmittee minutes prir t the next cmmittee meeting. Bck wants t revisit the level f plan detail. He believes Chatham Cunty citizens are cncerned with Cary s level f input int the Chatham Cunty plan. He thinks a jint plan is in Chatham s best interest, and he wuld like a less detailed, mre flexible plan. Rbinsn sees tw different ptential prcesses: (1) a prcess that requires bth gverning bdies t apprve a change t the plan, r (2) a prcess in which requested plan changes are submitted t the Twn f Cary, and Cary slicits cmments frm Chatham Cunty (like we currently d fr annexatins), with Cary having apprval authrity. Chatham Cunty Planner Hwell suggested if the cmmittee cncurs with a mre water clr plan with less specificity, then there may be less need t change the plan in the future. He believes it is imprtant t have a jint plan that requires the apprval f bth elected bdies. Bck des nt want t be in the predicament f needing Cary s apprval t build a schl in the Chatham Cunty plan area (as an example). Cary Planning Directr Ulma suggested that these types f issues be handled by having brad definitins f land uses that are allwed within the varius zning districts. Prtman stated municipal bundaries change ver time as citizens request municipal services, but cunty lines d nt change. He believes there will be future develpment pressures in this area because f I-540 and the desirability f the area. He als believes Cary has a respnsibility t plan hw t serve this grwth area. Prtman stated the cmmittee can agree t a true jint plan that requires the apprval f bth bards t change the plan, r Cary and Chatham Cunty can each have their wn separate plans. He thinks the jint plan is ideal. He believes separate plans culd wrk, but he thinks it wuld mean the cmmittee effrt failed. Stewart suggested that the first pint f cntact t seek an amendment t a jint plan be Chatham Cunty, since the land is in Chatham Cunty. She understands that state law gives landwners the right t initially apprach the municipality. Cary Twn Manager Shivar understands the attentin this jint planning effrt has received. He thinks this plan shuld be cnsistent with ther planning effrts acrss the state. He stated Cary Chatham Cunty/Cary Cmmittee Meeting January 13, 2011 Page 2

3 is n different than any ther NC municipality within a cunty (i.e., Cary in Wake Cunty, etc.), and he believes this prcess shuld be cnsistent with ther prcesses acrss the state. Chatham Cunty Manager Hrne stated a plan line creates a plitical bundary. Hwell added municipalities typically have extra-territrial jurisdictins (ETJ) and have planning authrity ver these areas. He added that municipalities nrmally d nt annex utside their ETJs. He stated Cary des nt have ETJ in Chatham Cunty. He stated peple bught land in Chatham Cunty understanding it was rural and nt expecting Cary t have any authrity ver them. He stated prperty wners ver the years have requested annexatin int Cary, resulting in Cary grwing int Chatham Cunty. He thinks this is ne f the main reasns the jint planning effrt began. Prtman stated in effect a jint plan wuld serve as ETJ. Prtman stated the rural vs. urban cnflict is natural, because sme citizens are against it while thers want t be annexed int Cary. Rbinsn stated the rural buffer line wuld actually be the ETJ. She stated bth bards culd agree that Chatham Cunty apprval wuld be sught any time Cary wanted t change the rural buffer line. Other than that situatin, Chatham Cunty apprval wuld nt be necessary. Prtman stated this prcess culd be used if the gverning bards d nt adpt a jint plan. He thinks a jint plan is mre advantageus because it allws shared visin. Members unanimusly agreed t prceed with the cmmittee s jint planning effrts. They individually prvided the fllwing cmments: Petty wuld like the plan t be brad enugh t address Chatham Cunty s cncerns and prtect areas in the plan, but flexible enugh t allw Cary t expand int Chatham Cunty if warranted by a citizen request. He des nt think sme peple understand that develpment that has ccurred has been at the request f land wners. He stated grwth will ccur, and the best tl is t manage it. Rbinsn suggested using Plan 5 (the plan bth bards supprted at the jint meeting f the gverning bdies in 2009) at the next meeting. She als suggested that staff make available t cmmittee members the list f citizen cmments, and she urged the cmmittee members t review them prir t the next cmmittee meeting. She wuld like staff t bradly g ver the citizen cmments at the next meeting. She supprts jintly devising a plan and thinks it will be imprtant fr the cmmittee t decide hw t manage the plan ver time. Bck thinks it is in everyne s best interest t have a jint plan. Prtman supprts ging back t Plan 5 and fcusing the cmmittee s effrts n adpting a land use plan. Stewart wants t review what has happened with the planning prcess t-date. She thinks it is imprtant t educate citizens. She supprts mving frward with develping a jint plan.
