4 Summary f the Annexatin Prcess A petitin fr annexatin and assciated materials (see annexatin checklist) are submitted t the City Secretary by the applicant in accrdance with the City s Annexatin Schedule. A petitin fr annexatin and assciated materials (see annexatin checklist) are reviewed by the City staff. Any additinal r revised infrmatin is submitted t City staff by the applicant. After receiving a recmmendatin frm the Planning & Zning Cmmissin, the City Cuncil will cnsider acceptance f the petitin and an rdinance t annex the prperty (see Sectin f the Lcal Gvernment Cde). 4

5 Summary f the Zning Prcess Zning applicatins and assciated materials (see zning checklist) are submitted t City Hall by the applicant in accrdance with the City s Zning and Develpment Schedule. (The applicant is encuraged t meet with the City Manager prir t submitting a zning applicatin.) In accrdance with the City s Zning and Develpment Schedule, the zning request is reviewed by City staff, cmments regarding the zning request are made available t the applicant, and the applicant addresses the cmments and returns the assciated materials. Written ntice f the Public Hearing befre the Planning & Zning Cmmissin is mailed by the City t each prperty wner within tw hundred feet (200 ) f the prperty n which the zning is being requested (500 feet when the applicatin invlves a platted single-family lt with zning that specifies a minimum lt size f ne acre r greater), as indicated by the mst recently apprved municipal tax rll. (Ntices are t be pstmarked a minimum f ten (10) days befre the hearing). A Public Hearing is held by the Planning & Zning Cmmissin t cnsider and act upn the zning request. The Planning & Zning Cmmissin may apprve, deny, r table the request. Publicatin f Ntice f the Public Hearing befre the City Cuncil in the Little Elm Jurnal by the City. (The ntice is t be published n less than fifteen (15) days prir t the Public Hearing). After a zning request is apprved r if a request denied by the Planning & Zning Cmmissin is appealed, a Public Hearing is held by the City Cuncil t cnsider and act upn the zning request. The City Cuncil may apprve, deny, r table the request. If the zning request is apprved, an rdinance t enact the zning will generally be cnsidered by the City Cuncil at their next meeting. 5

Applicatin and review f a land plan and ther applicable plans A Develpment Applicatin, land plan, and assciated materials (see land plan checklist) are submitted t City Hall by the applicant in accrdance with the City s Zning and Develpment Schedule. In accrdance with the City s Zning and Develpment Schedule, the applicatin and assciated plans are reviewed by City staff, cmments regarding the plans are made available t the applicant, and the applicant addresses the cmments and returns the crrected plans t the City Hall. Shuld all staff cmments nt be addressed by the applicant, the applicant will be ntified f the utstanding cmments. Crrected plans must be returned t City Hall a minimum f ten (10) days prir t the next scheduled Planning & Zning Cmmissin Meeting. Actin n the land plan by the Planning & Zning Cmmissin and City Cuncil After the review prcess is cmplete, the land plan will be scheduled fr cnsideratin by the Planning & Zning Cmmissin. The recmmendatin f the Planning & Zning Cmmissin will be frwarded t the City Cuncil wh will take final actin n the land plan. The apprval f a land plan is the City s authrizatin t submit a preliminary plat. A land plan may als require actin by the Parks and Recreatin Cmmissin (PARC). Applicatin and review f a preliminary plat and ther applicable plans A Develpment Applicatin, preliminary plat, and assciated materials (see preliminary plat checklist) are submitted t City Hall by the applicant in accrdance with the City s Zning and Develpment Schedule. In accrdance with the City s Zning and Develpment Schedule, the applicatin and assciated plans are reviewed by City staff, cmments regarding the plans are made available t the applicant, and the applicant addresses the cmments and returns the crrected plans t the City Hall. Shuld all staff cmments nt be addressed by the applicant, the applicant will be ntified f the utstanding cmments. Other applicable plans may include: Landscaping Plans Civil Engineering Plans General Tree Survey In accrdance with the City s Zning and Develpment Schedule, the applicatin and assciated plans are reviewed by City staff, cmments regarding the plans are made available t the applicant, and the applicant addresses the cmments and returns the crrected plans t City Hall. Shuld all staff cmments nt be addressed by the applicant, the applicant will be ntified f the utstanding cmments. Crrected plans must be returned t City Hall a minimum f ten (10) days prir t the next scheduled Planning & Zning Cmmissin Meeting. 7 Review f civil engineering, landscaping, and screening plans The review f civil engineering, landscaping, and screening plans cntinues after apprval f the final plat. The review f these plans must be cmplete prir t beginning grading r cnstructin. Cnstructin release Once all plans are revised t the satisfactin f all City staff and subject t meeting all apprval cnditins f the final plat, a Cnstructin Release will be authrized by the City and the prject will be eligible fr a precnstructin meeting. Precnstructin meeting A precnstructin meeting with the City Engineer may be scheduled by cntacting the City Manager at (972) Cnstructin Fllwing the precnstructin meeting, grading and site cnstructin may cmmence. Cnstructin inspectins Grading, utility, street, and ther inspectins may be scheduled by cntacting the Public Wrks Superintendent at peratins@akpinttexas.cm r (972) One (1) full business day ntice is required. Preliminary Inspectin Once cnstructin is cmplete, tw (2) sets f black line r blue line sets f preliminary as-built / recrd plans shall be submitted t City Hall. One (1) set f plans will be frwarded t the Public Wrks Department fr a preliminary inspectin where a punch list f preliminary inspectin issues will be created and frwarded t the cntractr, design engineer, and applicant. Final Inspectin Once preliminary inspectin issues have been rectified, a final inspectin may be scheduled by cntacting the Public Wrks Superintendent at peratins@akpinttexas.cm r (972) One (1) full business day ntice is required. In additin, a landscape inspectin must be scheduled by cntacting the City Hall at (972) Submittal f final acceptance materials The fllwing materials must be submitted t the City prir t acceptance f subdivisin imprvements by the City Cuncil: One (1) black line r blue line set f as-built / recrd plans One (1) mylar set f as-built / recrd plans (excluding the final plat) Three (3) CDs f the as-built / recrd plans and an address plat (include bth CAD and.pdf versins n each CD) A maintenance bnd An affidavit f cnstructin csts Final pay estimate f public imprvements Payment f inspectin fees (2% f cnstructin csts f public imprvements) Tw (2) 24x36 cpies f plat with street addresses added and tw (2) 11x17 reductins f addressed plat Cpies f the Final Plat t be filed with wner, surveyr, and ntary signatures (n street addresses) Payment f Park fees Final cst estimates f required imprvements t be cnstructed at a later date (may include sidewalks, left turn lanes, median penings, deceleratin lanes, street lights, landscaping, etc.) Escrw funds fr required imprvements t be cnstructed at a later date (may include sidewalks, left turn lanes, median penings, deceleratin lanes, street lights, landscaping, etc.) Payment fr three (3) years f street light perating csts Final acceptance f subdivisin imprvements by the City Staff After final inspectin, the City shall ntify the Subdivider in writing as t his acceptance r rejectin f the cnstructin. The City shall reject such cnstructin nly if it fails t cmply with the standards and specificatins cntained herein r therwise existing. If the City rejects such cnstructin, the City Attrney shall, n directin f the City prceed t enfrce the guarantees prvided in the Subdivisin Ordinance. If the City accepts the cnstructin, the final acceptance certificate stating that the requirement standards fr the City f Oak Pint have been met and that the public imprvements and dedicatins have been apprved, shall be given t the Subdivider. 7

8 Signature and filing f the final plat Upn final acceptance f subdivisin imprvements by the City Staff, the final plat will be signed by the City. The develper will file the plat at the Cunty and return tw (2) 24 x36 cpies f the filed plat t City Hall. Issuance f building permits Building permits may be issued fllwing the filing f the final plat, payment f any applicable fees, and apprval f a building permit.
