4 EXECUTIVE SUMMARY: This final plat applicatin is fr the parcels lcated at the nrth end f Annie Mrgan Curt and suth f 5 th Street. The land has recently gne thrugh the zne change and preliminary plat prcess. The purpse f this plat (and zne change) is t allw higher density residential develpment. As part f this plat, the unbuilt 4 th Street will be vacated. This prpsal is in cnfrmance with the apprved preliminary plat. The layut f the lts in the plat is unchanged. The easements n the plat have been mdified t accmmdate the request f BOPU. Further mdificatin f the easements may be required t meet the needs f Black Hills Energy. City engineering required a drainage reprt with this plat. After reviewing the drainage reprt submitted with the final plat, the Engineering Department fund n majr issues with the drainage fr the platting prject as presented. Due t meeting the review criteria set frth in Sectin d f the Cheyenne Unified Develpment Cde, staff recmmends apprval f this final plat. 3

7 FINAL PLAT: In reviewing, prviding cmments, and making recmmendatins and decisins n a prpsed final plat, the Staff, Planning Cmmissin, and City Cuncil shall use the fllwing criteria: COMPLIANCE WITH APPROVED PRELIMINARY PLAT - The layut and design f the final plat is in substantial cmpliance with the apprved preliminary plat cnsidering the number f lts r parcels, street and blck layut, and access, and any deviatins in the final plat brings the applicatin in further cmpliance with the Cmprehensive Plan. The submitted Final Plat is substantially similar t the apprved Preliminary Plat. The number f lts and the arrangement f the lts has nt been changed. The biggest change t the plat is the rearrangement f easements. Instead f ne easement fr all utilities and access running frm east t west acrss the plat, the easement has been brken dwn int smaller easements which have been specifically designated fr BOPU and fr ther utilities. A new access and utility easement has been added acrss Lt 1 cnnecting Lt 2 t Annie Mrgan Curt. CONDITIONS OF PRELIMINARY PLAT - The applicatin meets any cnditins r mdificatins f the apprved preliminary plat. There were tw cnditins n the preliminary plat as apprved: 1) Prvide a drainage reprt. 2) Prvide specific easements fr BOPU utilities. D nt verlap BOPU easements with ther utility easements (except fr at perpendicular crssing pints). The submissin f the Final Plat included a drainage reprt and prvided specific BOPU easements. Hwever, the change in easements requested by BOPU may interfere with existing infrastructure created by Black Hills Energy. Black Hills Energy created utility infrastructure within the parameters f the Suth Park Estates, 2 nd Filing s easements. STANDARDS - Divisin f land meets the purpses, intent, and all applicable standards in Article 4. Transprtatin Netwrk: The transprtatin netwrk in this area f the City is well established and n additins t the street netwrk are prpsed. The unbuilt 4 th Street is being vacated with this plat. Cmmunity Facility Fees: Bth Suth Park Estates 2 nd Filing and Rberts Place were platted fr lwer density develpment, with the zne change and increase in the number f residential units, Cmmunity Facility Fees will be required. Fr fees based n acreage, the area f the plat is pr-rated t the nearest tenth f an acre. The required fees fr the 1.8 acres in this plat are as fllws: Land Acquisitin Fee $630 ($350 per acre) Infrastructure Fee $630 ($350 per acre) Ttal Land Acquisitin & Infrastructure Fees $1,

8 Per UDC Sectin 4.2.5, Table 4-2, the Land Acquisitin & Infrastructure fees are payable at the time f the signing f the final plat. Prjected Residential Enhancement Fee $16,000 (40 anticipated units at $400 per unit) Prjected Cmmercial Enhancement Fee N/A Ttal Prjected Enhancement Fee $16, Per UDC Sectin 4.2.5, Table 4-2, Enhancement Fees are payable at the issuance f a building permit fr each dwelling structure. Ttal Prjected Park Fees = $17, Any Plat fees paid with previus plats may be credited tward the ttal fees charged with this plat. Rberts Place was riginally platted in 1889, at which time n plat fees were charged. Suth Park Estates 2 nd Filing was riginally platted in January f 2004, at which time plat fees were charged at $500 per acre. Land platted as public right-f-way were nt cunted tward the acreage included in plat fees. Therefre, apprximately 1.1 acres f this plat is assumed t have paid the apprpriate plat fees in 2004, and as such $550 will be credited tward this plat s fees. Ttal Fees DUE = $16, Ttal Prjected Park Fees DUE at the signing f the plat = $ Open Space: This divisin f land will allw future develpment t meet pen space requirements. The anticipated develpment prpses using multiple shared curtyards with amenities, maintained by an HOA. As a multi-family residential develpment, review f the specific pen space prpsal will be made during the site plan prcess. Required Imprvements: This divisin f land will allw future develpment t meet all required imprvement standards. The plat prvides sufficient easements fr the cnstructin f utilities t service all parcels. Imprvements t adjacent streets will be required with develpment. Specific review f the required imprvements will be addressed during the site plan and engineering plan review prcesses.
