3 2013 Multifamily Prgrams Prcedures Manual Intrductin t the 2013 Unifrm Multifamily Applicatin Prgrams In March 2012, the Texas Department f Husing and Cmmunity Affairs ( TDHCA r Department ) Gverning Bard adpted reslutin which acknwledged the rerganizatin f the Department and its divisins. This rerganizatin shifted prgram staff and respnsibilities t mre clsely align with the Department s missin. Under the new structure, all multifamily funding prgrams were mved under the Multifamily Finance umbrella. The multifamily cmpnents f the HOME, Neighbrhd Stabilizatin Prgram (NSP), and Husing Trust Fund (HTF) are nw administered by Multifamily Finance Divisin staff. All single-family financing fr the HOME, NSP, and HTF prgrams will be administered by their respective divisins and will nt be cvered in this manual. The prgrams administered by the Multifamily Finance Divisin include: 9% Husing Tax Credits 4% Husing Tax Credits Tax Exempt Bnds Multifamily HOME Multifamily NSP Multifamily HTF As a result f the Department s rerganizatin and the changes t the Unifrm Multifamily Rules and Qualified Allcatin Plan fr the 2013 applicatin cycle, staff als updated the Unifrm Multifamily Applicatin in rder t effectively administer the Multifamily Prgrams. New in 2013 The 2013 Unifrm Multifamily Applicatin (the Applicatin ) includes several updates and imprvements that are meant t eliminate redundancy, simplify exhibits, and streamline the review prcess fr the benefit f applicants and Department staff. The 2013 Applicatin has fully integrated each f the Multifamily Prgrams int ne cherent applicatin, realizing a gal set in mtin ver the past few applicatin cycles. The Applicatin cntains fewer tabs than previus applicatins and includes mre features intended t make the applicatin prcess mre user friendly. 3

4 2013 Multifamily Prgrams Prcedures Manual Staff began by identifying similarities in the multifamily financing prgrams and cnceptualizing an applicatin that fcused n thse similarities while distinguishing the differences within thse shared functins. The Applicatin has been divided int six (6) parts listed belw, each f which will be briefly explained in this sectin and in greater detail in later sectins f this Manual. Administrative Develpment Site Develpment Activities Finance Organizatin Third Party The Administrative sectin f the Applicatin cllects cntact infrmatin f the Applicant and includes the Applicant and Develper Certificatins as well as the self-scre frm fr cmpetitive tax credit Applicatins. The Develpment Site sectin f the Applicatin includes all f the infrmatin related t the physical lcatin f the prpsed Develpment site, such as the address, census tract number, fld zne designatin, zning, and site cntrl dcumentatin as well as infrmatin abut the schls, elected fficials, and neighbrhd rganizatins in the cmmunity. The Develpment Activities sectin f the Applicatin includes all f the infrmatin abut what activity is being prpsed, frm what is being built t the services prvided t the tenants. This sectin includes the architectural drawings and infrmatin regarding existing structures n the Develpment Site. It als includes the actual funding request as well as set-aside electins. Fr Tax- Exempt Bnd Develpments that may nt have architectural drawings and ther items required as part f this sectin ready by the applicable deadline, the infrmatin cntained in this sectin may be submitted at the time Parts 5 and 6 f the Applicatin are submitted t the Department. The Finance sectin f the Applicatin includes all f the surces f financing, the develpment cst schedule, annual perating expenses, 15-year pr-frma and rent schedule. Fr Direct Lan (such as HOME lans) Applicatins it als includes infrmatin regarding matching funds, which is required t meet federal prgram requirements. The Organizatin sectin f the Applicatin includes infrmatin abut the Applicant, Develper, and Nn-Prfit entities invlved with the Applicatin, alng with all f the wners, managers, and bard members. It includes the rganizatinal charts and evidence f experience as well as credit limit dcumentatin and previus participatin infrmatin. The Third Party sectin briefly identifies the entities used fr the Envirnmental Site Assessment, Market Analysis, Prperty Cnditin Assessment, Appraisal and the Site Design and Develpment Feasibility Reprt. Of particular interest is the fact that the Applicatin, with respect t the cmpetitive husing tax credit prgram, is n lnger separated int sectins based n threshld, eligibility, and selectin criteria. Instead, items that affect an Applicatin s scre are fund thrughut the Applicatin. Fr instance, scring criteria that are site-specific, such as Underserved Areas, are lcated in the Develpment Site prtin f the Applicatin, while ther scring criteria, such as the Cmmitment f Funding frm a Unit f General Lcal Gvernment, area fund in the Finance sectin. 4

5 2013 Multifamily Prgrams Prcedures Manual Using this Manual The purpse f this manual is t prvide a brief descriptin f each tab in the Applicatin and guidance as t the Department s submissin requirements and what is acceptable supprting dcumentatin. While the Department expects that this guide may nt cntemplate all unfreseen situatins, we hpe that the infrmatin will prvide an adequate fundatin upn which yu may build yur understanding f the prgram requirements. The Department always stands ready t assist yu in understanding the tax credit prgram and ther surces f multifamily financing ffered by the Department and the means by which an Applicatin is t be presented. The Department will ffer direct assistance t any individual that requires this service in the preparatin f the multifamily Applicatin. Hwever, the Department will nt take the respnsibility f cmpleting the Applicatin package fr yu. The Department lks frward t yur cntinuing interest in the Multifamily Finance prgrams and in the creatin f decent, safe, and sanitary affrdable husing fr the citizens f the State f Texas. 5

T dwnlad any f the electrnic Applicatin files, right-click n the link at the website prvided abve, select Save Target As and chse the strage lcatin n yur cmputer. The Excel file shuld be named in the fllwing frmat -- <Applicatin #_Develpment Name>.xls (e.g _Austin_Crssing.xls). If an Applicatin number has nt been previusly assigned then the file shuld be named as fllws -- <Develpment Name>.xls (e.g. Austin_Crssing.xls). 2. Please d nt transfer tabs frm ne Excel file t anther, even if it is fr the same Applicatin. If yu plan t submit mre than ne Applicatin, please make additinal cpies f the 2013 Unifrm Multifamily Applicatin file after cmpleting prtins f the Applicatin that are cmmn t all f yur Applicatins and befre cmpleting any prtins that are nt cmmn t all f yur Applicatins. 3. Any cell that is highlighted yellw is available t be manipulated by the applicant. All ther cells (unless specifically stated) are fr Department use nly, have been pre-frmatted t autmatically calculate infrmatin prvided, and are lcked. Applicants may view any frmulas within the cells. Applicants may nt add additinal clumns r rws t the spreadsheets, unless therwise stated. 4. All questins are intended t elicit a respnse, s please d nt leave ut any requested infrmatin. If frmula references are made by the Applicant t external spreadsheets thse references must be remved prir t submissin t TDHCA as this may hamper the prper functining f internal evaluatin tls and make pertinent infrmatin unavailable t TDHCA. 6

This electrnic Applicatin has been designed s that many f the calculatins regarding develpment cst, eligible basis, and eligible pint items will autmatically cmpute nce enugh infrmatin has been entered. If yu see a #VALUE r DIV/0 in a cell, these values shuld disappear upn data entry in ther tabs. If they still exist, duble check that all required infrmatin has been input int the Applicatin. Tip Cmplete the Develpment Narrative and the Rent Schedule in the Develpment Activities and Finance Parts f the Applicatin first t take full advantage f the autmated calculatins. 6. Be sure t save the file as yu fill it ut! If yu have difficulty dwnlading the files frm the website, cntact Jasn Burr at (512) , r Jasn.burr@tdhca.state.tx.us. Instructins fr Cnverting the Excel file t PDF Once the Excel Applicatin file is cmpleted and yu are ready t cnvert the file t PDF, fllw these instructins. Tip- Be sure t check all f the page breaks in the Excel files befre yu cnvert t PDF. Excel 2007 Users: Click the Micrsft Office Buttn r XPS., pint t the arrw next t Save As, and then click PDF 1. In the File Name list, type r select a name fr the wrkbk. 2. In the Save as type list, click PDF. 3. If yu want t pen the file immediately after saving it, select the Open file after publishing check bx. This check bx is available nly if yu have a PDF reader installed n yur cmputer. 4. Next t Optimize fr, d ne f the fllwing, depending n whether file size r print quality is mre imprtant t yu: If the wrkbk requires high print quality, click Standard (publishing nline and printing). If the print quality is less imprtant than file size, click Minimum size (publishing nline). 5. Click Optins. Under Publish What select Entire Wrkbk and click OK. 6. Click Publish. Excel Users: 1. With the Excel file pen g t the Adbe PDF drp-dwn bx frm the task bar (if using Excel 2007 click n Acrbat tab in the task bar) 7

8 2013 Multifamily Prgrams Prcedures Manual 2. Select Cnvert t Adbe PDF frm the drp-dwn list (Excel select Create PDF ) 3. The Adbe PDFMaker bx will appear. One the left hand side f the bx all f the sheets within the Excel file will be listed and yu will be prmpted t select the sheets yu wuld like t cvert t PDF. Once the sheets yu want t cnvert are selected click n the Add Sheets buttn t mve thse sheets ver t the right-handed side f the Adbe PDFMaker bx, this will list the sheets selected t be cnverted t PDF. 4. Once all sheets yu have selected appear n the right-hand side under Sheets in PDF click n the Cnvert t PDF buttn. 5. Yu will be prmpted t create a name and save the PDF file. The PDF file shuld be named in the fllwing frmat -- <Applicatin #_Develpment Name>.pdf (e.g _Austin_Crssing.pdf). If an Applicatin number has nt been previusly assigned then the file shuld be named as fllws --<Develpment Name>.pdf (e.g. Austin_Crssing.pdf) 6. A pp-up bx will appear that asks D yu want t prceed withut creating tags? Click Yes. Remember that there are frms that require a signature. Once yu have executed all required dcuments scan them and re-insert the scanned frms back int the rder required. The Applicatin and pre-applicatin submitted shuld be the electrnic cpy created frm the Excel file, nt a scanned cpy f the Excel r PDF file. Scanned cpies f the Applicatin are difficult t read, and slw dwn the prcess fr staff and applicants and make it mre difficult fr applicants t duble check the cmpleteness f the applicatin prir t submissin. Creating Bkmarks Once the file has been cnverted t PDF and all executed frms have been re-inserted int their apprpriate lcatin within the file, yu will need t create Bkmarks. Bkmarks may r may nt have already been created as part f the cnversin prcess. Yu will need t designate r re-set the lcatins. T crrectly set the Bkmark lcatins yu must have the PDF file pen in Adbe Acrbat. Click n the Bkmark icn lcated n the left-hand side f the Adbe Acrbat screen, r g t the task bar and select these ptins in the fllwing rder: View Navigatin Panels Bkmarks. If a Bkmark has already been created fr each tab within the Excel file, simply re-set the bkmarks t the crrect lcatins. T re-set the lcatin fr the Bkmarks, g t the first page f each separately labeled frm/exhibit. Yu will then right-click n the crrespnding Bkmark fr the frm/exhibit yu are currently viewing. Select Set Destinatin and a pp-up bx will appear asking yu the fllwing: "Are yu sure yu want t set the destinatin f the selected bkmark t the current lcatin?" Select Yes. If Bkmarks were nt already created within the Excel file, then yu will need t create these Bkmarks. G t Dcument Add Bkmark. Right-click n the first Bkmark and re-name it fr the apprpriate frm r exhibit. Yu will then need t set the lcatin f the Bkmark by ging t the first page f each frm r exhibit, right click n the crrespnding Bkmark and select Set Destinatin. 8

9 2013 Multifamily Prgrams Prcedures Manual A pp-up bx will appear asking yu the fllwing: "Are yu sure yu want t set the destinatin f the selected bkmark t the current lcatin?" Select Yes. Tabs within the Excel Applicatin wrkbk have been clr cded t distinguish between Parts f the Applicatin cnsistent with this manual. Additinally, beside each bulleted item a label t use fr purpses f bkmarking the final PDF Applicatin file is included in parentheses. If after cnversin f the Excel file t PDF yu have extra blank pages f any exhibit, yu can delete thse pages in rder t limit the size f the file. T delete any extra, unnecessary pages identify the page number(s) yu want deleted. On the Adbe Acrbat Task Bar click n Dcument and select Delete Pages frm the drp dwn list. A bx will appear prmpting yu t select which page(s) yu wuld like t delete. Enter the page numbers t be deleted and hit OK. The PDF frmatted file must be checked fr the fllwing prir t submissin: All tabs and must be crrectly bkmarked Files shuld average less than 100 kilbytes per page Files must be readable with free PDF file viewers including Adbe Reader and be cmpatible with Adbe Reader 5.0 and abve Files shuld be saved s that Fast Web View (r page at a time dwnlading) is enabled Text within the PDF file shuld be searchable using the Find cmmand in the PDF viewer If yu have any questins n using r experience difficulties with the Micrsft Excel based applicatin, cntact Jean Latsha via at jean.latsha@tdhca.state.tx.us. 9

10 2013 Multifamily Prgrams Prcedures Manual Waivers, Pre-clearance, Determinatins, and Disclsure (WPDD) Packet What yu will learn in this sectin: Overview and reasning fr the WPDD Packet Submissin timeline fr WPDD Packet Instructin fr cmpleting the WPDD Packet Overview and Reasning fr the WPDD Packet The re-structuring f the Unifrm Multifamily Rules, Qualified Allcatin Plan, and the curt rdered Remedial Plan psed several administrative challenges fr Department staff with regard t seamless implementatin thrughut the Multifamily Finance prgrams. Staff determined the timing f Applicatin materials wuld have t be altered slightly in rder t prvide as much time as pssible fr Applicants t receive guidance frm the Department. Staff recgnizes the cst assciated with preparing an Applicatin fr multifamily financing, and staff further recgnizes the value in mitigating as much risk as pssible by addressing issues f eligibility (verall and scring related) as sn as pssible. Multifamily staff created the Waivers, Pre-clearance, Determinatins, and Disclsure ( WPDD ) Packet in an effrt t frmalize the prcess by which applicants seek pre-clearance fr Cmmunity Revitalizatin Plans (Ch (d)(6)) and Undesirable Area Features (Ch (a)(4)), request staff r Bard determinatins regarding definitins r Undesirable Site Features (Ch (a)(3)), disclse pssible issues f ineligibility, and request waivers (Ch ). The Supplement cnsists f five (5) tabs identified belw. 1. Overview and Certificatin 2. Pre-Clearance Request (Cmmunity Revitalizatin and Undesirable Area Features) 3. Requests fr Department Determinatins (related t definitins and Undesirable Site Features) 4. Disclsures (related t ineligible Applicants) 5. Waiver Requests Althugh nt all the tabs in the WPDD Packet are directly related, staff determined they d share a need fr staff cnsideratin prir t submissin f a pre-applicatin and/r full Applicatin. 10

11 2013 Multifamily Prgrams Prcedures Manual Submissin timeline fr WPDD Packet The WPDD Packet may be submitted as early as December 17, 2012 fr Cmpetitive Husing Tax Credit Applicatins and prir t the pre-applicatin deadline if a pre-applicatin is submitted. If applicable, it must be submitted with the bnd pre-applicatin (if TDHCA is the Issuer) r with the full Applicatin fr all ther funding prgrams. Staff recmmends the packet be submitted as early as pssible fr Cmpetitive HTC Applicatins in rder t prvide the Department as much time as pssible t review its cntents befre making a decisin regarding pre-clearance, waivers, r determinatins. Multifamily staff, in crdinatin with the Department s executive staff, will review the WPDD Packet submissins n a first cme first served basis. Applicants are expected t cntinue t meet all ther Applicatin deadlines and submissin requirements regardless f the timing f the determinatins made as a result f the submissin f the WPDD Packet. Instructins fr Cmpleting the WPDD Packet The fllwing are instructins fr cmpleting the WPDD packet. Each bullet represents the name f each Tab. Tab 1 Overview and Certificatin Cmplete each yellw highlighted cell. Identify which Multifamily Prgram(s) fr which the Applicatin is being submitted. Sign, date, and ntarize the frm. (NOTE: this frm will need t be printed, signed, and scanned back int the riginal PDF cpy. DO NOT SCAN AND PDF THE ENTIRE WPDD PACKET) Tab 2 Pre-Clearance Requests Part 1 Cmmunity Revitalizatin Plan (Cmpetitive HTC nly) - Cmplete this sectin nly if yu are seeking pints under 11.9(d)(6)(A) r (B)(i). Pre-clearance nly applies t actual cmmunity revitalizatin plans and nt t CDBG-DR funding r rural infrastructure prjects which may als be eligible fr cmmunity revitalizatin pints. Indicate the name f the plan. This shuld be cnsistent with the supprting dcumentatin. If the cmmunity revitalizatin plan is incrprated int a larger plan such as a cnslidated r city-wide plan, this may be the name f the larger plan. Attach either a cpy f the plan r a web address where the plan can be fund. If using a web address, be certain t test the address that it links directly t the plan, r include specific instructins fr finding the plan n a website. Cmplete each yellw highlighted cell as applicable, including a page number fr specific items. (Example if yu select that the cmmunity revitalizatin plan cnsidered blighted structures as part f the revitalizatin effrt, identify where in the cmmunity revitalizatin plan that infrmatin can be fund.) Please d nt include large page ranges (e.g. between pages 5 and 15). Identify the Ttal Budget f the revitalizatin plan and/r the prjected ecnmic value f the plan. The ecnmic value shuld be the value f incentives flwing frm the city r cunty t the target area. See the Department s FAQs fr 11

12 2013 Multifamily Prgrams Prcedures Manual mre infrmatin regarding hw staff will determine prjected ecnmic value (FAQs may be frthcming). Include a certificatin frm an apprpriate lcal fficial regarding the adptin and funding fr the plan. The last checkbx allws the applicant t cnfirm that the revitalizatin plan being used fr pints des nt meet all f the requirements f the QAP, but that they wuld like the Executive Directr and/r Gverning Bard t determine whether r nt the plan meets the intent f the rule in accrdance with Chapter (d)(6)(A)(iv). Part 2 Undesirable Area Features Cmplete this sectin if yu are seeking preclearance fr a Develpment Site that is within 1,000 feet f an undesirable area feature pursuant t (a)(4) f the Unifrm Multifamily Rules. This applies t all Applicatins fr multifamily financing, nt just cmpetitive HTC Applicatins. Include a map indicating the lcatin f the prpsed Site as well as the lcatin f the undesirable area feature(s). Include any relevant infrmatin regarding the feature. Belw are examples f pssible evidence but in n way is a cmplete r cmprehensive list f the type f dcumentatin that will be accepted. Other dcumentatin prviding a cmparable amunt f relevant infrmatin may als be submitted. Histry f significant r recurring flding: evidence f previus r nging disaster declaratins related t flding, FEMA maps that indicate the surrunding area is in a fld zne, news reprts f flding in the area. Significant presence f blighted structures: pictures f structures in the area. Fire hazards: evidence f previus r nging disaster declaratins related t fire hazards; statement frm the lcal fire marshal; news reprts f fires in the area; estimates frm insurance cmpanies indicating higher rates than therwise similar dcumentatin. Presence f criminal activity: statement frm lcal law enfrcement agency; lists f plice reprts alng with a cmparisn f number f reprts in ther areas; infrmatin frm crime statistics websites. Hazardus waste site: pictures f site, infrmatin frm website, third party reprts Active railways: pictures and/r maps f the railways. Landing strips r heliprts: pictures and/r maps f the landing strips. Include infrmatin that may be relevant fr staff reviewing whether the undesirable area features are f a nature that wuld r wuld nt be typical f higher incme lwer pverty areas within the same city, cunty, r metr area. The last bx shuld be marked if the Develpment Site is eligible fr pints under 11.9(2)(4) f the Qualified Allcatin Plan, related t Opprtunity Index. NOTE: While eligibility fr Opprtunity Index pints may be a cmpnent f the decisin t grant pre-clearance, it des nt exempt an Applicant frm prviding disclsure f any undesirable area features. Tab 3 Requests fr Department Determinatins Part 1 Staff Determinatins Regarding Definitins - Applicants seeking clarificatin regarding hw the Department will classify develpments with respect t cnstructin type, Develpment Site and/r Target Ppulatin shuld cmplete this sectin f the 12

Fr example, if a Develpment Site straddles the bundary f tw census tracts, the applicant may wish t request a determinatin regarding hw staff will deal with the situatin under certain rules. Mark the bx and prvide an explanatin f the circumstances surrunding the Develpment. Yu may r may nt include a prpsed interpretatin fr cnsideratin by staff. Nte that determinatins by staff can be appealed t the Bard, but determinatins may nt be challenged. Part 2 Undesirable Site Features Applicants seeking clarificatin regarding whether r nt a feature that is within 300 feet f the prpsed Develpment Site wuld be cnsidered an undesirable site feature shuld cmplete this sectin. Fr example, if a Site is lcated within 300 feet f a facility that may r may nt be cnsidered a heavy industrial use, the Applicant can request such clarificatin if they are uncertain f hw staff may categrize such use. Als, if a Site is lcated within 300 feet f a feature that may r may nt be cnsidered unacceptable pursuant t (a)(3)(H), Applicants can als request clarificatin. Bth bxes must be marked. Nte that the secnd bx explains the appeal prcess regarding such determinatins. Include a map indicating the lcatin f the prpsed Site and the subject feature as well as infrmatin regarding the feature, which may be in the frm f Third Party pinins, infrmatin frm websites, pictures, etc. Tab 4 Disclsures (related t Ineligible Applicants) Mark bxes as necessary and identify any participant in the Develpment Team r rganizatin structure wh may have an issue f ineligibility. List each persn fr which yu are seeking Department apprval. (Lines are hidden and available shuld additinal Develpment Team members lines be needed.) Attach an explanatin fr each Develpment Team member listed explaining why they may be ineligible t participate as well as justificatin fr why they shuld be allwed t participate in Multifamily Financing prgram(s). Tab 5 Waiver Requests Applicants seeking a waiver f a specific rule r rules shuld cmplete this sectin. NOTE: This is nt a request fr pre-clearance r a staff determinatin. This is intended fr Applicants wh are prpsing a Develpment that, withut a waiver, will vilate ne r mre f the rules in subchapters (B), (C), (E) r (G) f the Unifrm Multifamily Rules and/r the QAP.
