Kinsella to approve the minutes of the Municipal Planning Commission meeting of December 22, 1998, as circulated. 4.0 BUSINESS FROM THE MINUTES 4.1 Dan O Connor & Debbie Gallant Lot 1, Block 1, Plan RR#4, LCD 1 NW Red Deer, AB 2.99Acres m/l T4N 5E4 Requesting approval of a 33.8-metre (110 ) setback relaxation as it applies to the location of an existing drainage dugout at the above site. The application was tabled December 22, 1998, in order that the Development Department could complete a site inspection and provide information on safety measures that may be relevant. MPC Moved by G.W. Gehrke to lift this application from the table. The property is located approximately 7 miles west of Red Deer. The bylaw requires that a setback of 46 metres (150 ) be provided to the property line adjacent to the County road. A site inspection has revealed that the dugout is actually located approximately 10 feet from the property line. The location will not allow for construction of a berm; however, posts could be placed on the north, west, and south sides of the dugout. The adjacent road (Rge Rd 10) is metres (100 ) in width. Persons present who spoke to this application: Debbie Gallant, applicant. MPC Moved by G.W. Gehrke to approve the application of Dan O Connor and Debbie Gallant for a 33.8-metre (110 ) setback relaxation as it applies to the location of an existing drainage dugout at Lot 1, Block 1, Plan , NW , subject to the following conditions: 1. The installation of a guard rail adjacent to the west property line to the satisfaction of the County Operations Department or the relocation of the dugout to comply with the bylaw requirements on or before June 30, All costs for same shall be the responsibility of the property owner. 2. 2 Minutes of the Municipal Planning Commission, January 19, 1999 Page 2 NEW BUSINESS 5.1 John and Janet Dyer Lot 1, Block 1, Plan Box 11, Site 6, RR#3 NW Innisfail, AB 4.89 Acres T4G 1T8 Country Residence District B Requesting approval of setback relaxations of 33.2 meters (108 ) east and 16.2 metres (52.3 ) west as they apply to the location of an existing dwelling and the proposed relocation of a shop on the above site. The bylaw requires that a setback of 46 metres (150 ) be provided to the property line adjacent to a County road. The property is located approximately 2 miles west of Innisfail. The west property line is bounded by an undeveloped road allowance while the east property line is adjacent to Road Plan 3335 CL. The applicant is proposing to locate the shop in line with the residence 12.8 metres from the east property line. The shop will be located approximately 29.8 metres from the property line adjacent to the undeveloped road allowance while the residence is located 42.2 metres from same. MPC Moved by E.R. Kinsella to approve the application of John and Janet Dyer for setback relaxations of 33.2 metres (108 ) east and 16.2 metres (52.3 ) west as they apply to the location of an existing dwelling and the proposed relocation of a shop on Lot 1, Block 1, Plan , NW , subject to the following conditions: 1. The applicant providing confirmation from a qualified surveyor that the building has been relocated in accordance with the approved plan. 2. The decision being advertised in a local newspaper and no appeal against said 5.2 Wayne Building Products Ltd. Lot 16, Block 2, Plan Street SW Edmonton, AB 0.84 Acres T5L 0H9 Industrial District B Requesting approval on behalf of John Murphy of a 3-metre (10 ) side yard setback relaxation in connection with the location of an existing temporary storage building (tent) on the above site. The bylaw requires that a side yard setback of 6 metres (20 ) be provided to the property line, and all temporary buildings are considered discretionary and require the approval of the Municipal Planning Commission. The property is located within the Petrolia Park subdivision south of Red Deer. The County Fire Department has indicated that the owner must provide access for fire fighting as per the Alberta Building Code. MPC Moved by P.T. Archibald to approve that application by Wayne Building Products Ltd. on behalf of John Murphy for a 3-metre (10 ) side yard setback relaxation in connection with the location of an existing temporary storage building (tent) on Lot 16, Block 2, Plan , SW , subject to the following conditions: 1. Annual Review 2. Approval to be obtained from the County Fire Department.

The decision being advertised in a local newspaper and no appeal against said 5.3 Dave and Lynette Young SW RR#1 SE Delburne, AB T0M 0V0 Requesting approval to develop gravel pits on both the SW and the SE As the lands are designated Agricultural District B, this allows for resource extraction as a discretionary use and requires the approval of the Municipal Planning Commission. The lands are located approximately 26 km east of the City of Red Deer, 1.5 miles north of Hwy 595 and immediately south of the Red Deer River. This site borders an Environmentally Sensitive Area known as the Red Deer Canyon and is adjacent to areas with significant archeological features. The proposed pits will be operated in phases: Phase 1 (SE 9) will include 4.86 acres, Phase 2 (SE 9) will include acres, and Phase 3 (SW 10) will cover 10 acres. Persons present who spoke to this application: Dave and Jackie Hewson, adjacent landowners; Bill Edmundson, EXH Engineering, on behalf of the applicants; Don Hannaford, adjacent landowner; Andrea Fox, adjacent landowner; Candy Towers; adjacent landowner; Laura Robitaille, adjacent landowner; and Tracy Peters, adjacent landowner. MPC Moved by M.J. Lewis that the application of Dave and Lynette Young to develop gravel pits on both the SE and SW be tabled for one month to allow the County staff to meet with the owners to discuss mitigating measures and conditions that may be imposed on the proposed operation. 5.4 Darren LaGrange NW RR#2 155 Acres Red Deer, AB T4N 5E2 Requesting approval to operate a 2000-feeder piggery confined livestock operation including the construction of an 18,000 sq. ft. feeder barn and a 120 by 224 sewage lagoon. A confined livestock operation is considered a discretionary use and requires approval from the Municipal Planning Commission. The property is located 5 ½ miles east of Red Deer on Hwy 595, ½ mile north on Rge Rd 262. The application was submitted to the County on December 14, The site evaluation submitted by Alberta Agriculture indicates that the minimum distance separation required in the Code of Practice has been met. An earthen manure storage lagoon is proposed with a minimum 16-month storage capacity. There are 370 acres of land available for manure spreading, while 290 acres are required. Dead animals will be hauled to a rendering plant. The operation will require approximately 3000 to 4000 gallons of water per day. A water license will be required from Alberta Environmental Protection. Limitations to expansion would be topography of the land and proximity to neighbors.

4 Minutes of the Municipal Planning Commission, January 19, 1999 Page 4 Persons present who spoke to this application: Ken Williamson, Alberta Agriculture; Doug Horn, adjacent landowner; Anita Puzey, adjacent landowner and on behalf of Valley Centre residents; Daniel Grant, representative for the Red Deer River Naturalists; Jack Fiske, landowner located 5 miles southwest of proposed operation; Malcolm McIlroy, adjacent landowner; Vernon Puzey, adjacent landowner; Henry Reay, adjacent landowner; Darren and Adriana LaGrange, applicants; Bruce Sutherland, landowner in Valley Centre Community; Jim Gowans, Chairman of Parkland Pork; Vi Clarke, adjacent landowner; Gordon LaGrange, landowner at NW ; Colin Plamondon; adjacent landowners and members of the Valley Centre Community; and Mike Palulis; landowner at NE There was discussion among the Municipal Planning Commission members as to whether a plastic liner should be used as opposed to a clay liner, and whether the proposed new regulations of Alberta Agriculture could apply to this application. The applicant was advised that he should check into these proposed new regulations to ensure his operation will comply when the regulations are approved. MPC Moved by S.M. Bell to approve the application of Darren LaGrange for a 2000-feeder piggery confined livestock operation including the construction of an 18,000 sq. ft. feeder barn and a 120 by 224 sewage lagon at NW , subject to the following conditions: 1. A geotechnical site assessment shall be submitted to the County confirming site suitability for earthen manure storage. Confirmation of same shall be submitted to the County prior to issuance of the development permit. 2. The lagoon shall be designed and constructed to the specifications of an accredited professional. Confirmation of same shall be submitted to the County prior to operation. 3. Straw or suitable cover on the lagoon shall be provided to reduce odor. 4. Regular soil testing shall be completed to ensure the risk of phosphorus, nitrates and heavy metal build up is prevented. 5. Confirmation that the required setback has been provided shall be submitted by a qualified surveyor. 6. The applicant obtaining a water license from Alberta Environmental Protection. 7. The minimum manure storage capacity shall be 16 months. 8. The operation to comply to the Code of Practice for the Safe and Economic Handling of Animal Manures. 9. Manure application shall be direct soil injection. 10. The decision being advertised in a local newspaper and no appeal against said CARRIED Chairman Johnson and Members Archibald and Lewis opposed 5.5 Henry Reay, Jr. NE RR#2 160 Acres Red Deer, AB T4N 5E2 Requesting approval to locate a second residence (mobile home) for occupancy of a bonafide farmer on the above site. A second residence occupied by a bonafide farmer is considered a discretionary use and requires approval from the Development Authority. This application has been brought to the Municipal Planning Commission because of the previous application of Darren LaGrange s for an intensive livestock operation on the NW The property is located 6 ½ miles east of Red Deer on Hwy 595, ¾ miles north on Hwy 808. The application was submitted to the County on December 15, 1998.

5 Minutes of the Municipal Planning Commission, January 19, 1999 Page 5 Policy 3.7(b) of the Municipal Development Plan states that minimum distance separation guidelines will be used when considering the siting of residential developments near Intensive Livestock Operations. As an Intensive Livestock Operation has been approved for NW 2, the second dwelling must comply with the necessary minimum distance separation requirements. MPC Moved by E.R. Kinsella to approve the application of Henry Reay, Jr. to locate a second residence (mobile home) for the occupancy of a bonafide farmer on NE , subject to the following conditions: 1. The second dwelling shall be located upon the NE 2 a minimum of 1,610 feet away from the Intensive Livestock Operation located upon NW The mobile home to be removed or rendered uninhabitable to the satisfaction of the Development Officer when no longer occupied by a bonafide farmer. 3. The landowner entering into a Development Agreement to the satisfaction of the County of Red Deer. The agreement shall be registered by way of Caveat upon the Title at the full expense of the landowner. 4. The decision being advertised in a local newspaper and no appeal against said 5.6 Beca International Ltd. Lot 13, Plan Point Drive NW NE Calgary, AB 3.34 Acres T3B 4W1 Highway Commercial District Hwy C Requesting approval of site development in connection with a proposed development including a gas bar, a 140-seat restaurant (Rockin Robin s Diner), and a future restaurant on the above site. The Land Use Bylaw requires that all lands located within the Major Entry Areas are subject to landscaping requirements outlined within Section 31 of the bylaw. While it appears that all requirements have been met, Municipal Planning Commission approval is required for the overall design and plan. The lands involved were originally purchased by Alberta Transportation for realignment of the access to Gasoline Alley West. This parcel is the remainder of these lands. Access will be provided from Lantern Street. Two pylon signs are proposed for the site. The initial development requires 46 parking stalls, and the plan indicates that 110 stalls will be provided on site. MPC Moved by G.W. Gehrke to approve the application of Beca International Ltd. for site development in connection with a proposed gas bar, a 140-seat restaurant, and a future restaurant on Lot 13, Plan , NE , subject to the following conditions: 1. Storm management plan to be submitted to and approved by the County prior to any construction start. 2. Servicing shall be in accordance with the Operations Department memo dated December 21, All applicable offsite levies ($62,880) shall be paid in full prior to issuance of the development permit. 4. Approval shall be obtained from Alberta Transportation and Utilities. 5. Approval shall be obtained from the County Fire Department. 6. The applicant shall obtain an access permit from the County. 7. The applicant shall submit sign details and obtain a permit for same from the County. 8. The decision being advertised in a local newspaper and no appeal against said

6 Minutes of the Municipal Planning Commission, January 19, 1999 Page Les Sedewick NW Avenue 150 Acres Innisfail, AB T4G 1G2 Requesting approval to construct a farm shop (40 by 64 ) on the above site. An accessory building is considered a discretionary use and requires the approval of the Municipal Planning Commission when there is no residence on the property. The property is located approximately 9 miles east of Bowden and 1 ½ miles south on Hwy 791. There is an acreage (1994) which is the first parcel out of the quarter section. There are no other buildings on the quarter; however, the applicant has indicated that he is in the process of having blueprints drawn up for a dwelling. MPC Moved by P.T. Archibald to approve the application of Les Sedewick to construct a farm shop (2460 sq. ft.) as the principal building on the NW (150 Acres), subject to the decision being advertised in a local newspaper and no appeal against said 5.8 Lyle Kallis NE RR# Acres Red Deer, AB T4N 5E4 Requesting approval to land a helicopter on the above site. A private airport is considered a discretionary use and requires Municipal Planning Commission approval. In addition, the approval of and control over airports falls completely under federal jurisdiction. The property is located approximately 6 miles southwest of Red Deer on the C&E Trail. The applicant has purchased a helicopter and lands same on various areas of the above lands. MPC Moved by G.W. Gehrke to approve the application of Lyle Kallis to land a helicopter on NE (24.35 Acres), subject to the following conditions: 1. Review and approval to be obtained from Transport Canada. 2. The decision being advertised in a local newspaper and no appeal against said 7.0 ADJOURNMENT MPC Moved by E.R.
