3 Minutes of a Regular Meeting of County Council RED DEER COUNTY August 7, CALL TO ORDER The regular meeting of Red Deer County Council was held in the Council Chambers of the Red Deer County Centre located at Rge Rd 275, Red Deer County, Alberta, and was called to order by Mayor J.J. Wood at 10:16 a.m. PRESENT: ABSENT: Mayor J.J. Wood, Deputy Mayor G.W. Gehrke, Councillors P.T. Archibald, R.R. Lorenz, P.J.R. Massier and D.H. Nesbitt. Councillor D.G. Hoar. Archibald to accept the 2012 Budget Variance Report and the Capital Variance Report as of June 30, 2012, as information. 6.2 Budget Adjustment, Rge Rd 271 Project consideration to extend the budget for the construction of an adequate storm water outlet to the Blindman River in conjunction with the Rge Rd 271 upgrade and base/pave project. CC Moved by Councillor G.W. Gehrke to approve an amendment to the 2012 Capital Budget for Rge Rd 271 in the sum of $272,000 to include the construction of an adequate storm water outlet to the Blindman River with MINUTES of the regular County Council meeting held Page 3 of 24

4 County Council Minutes of August 7, the extra funds for this work to come from the contingency budget. 6.3 Pine Lake Restoration Society consideration of a request for funding to assist with the costs of the annual maintenance, operation and monitoring of the Pine Lake Hypolimnetic Withdrawal System. Persons present who spoke to this item: Ed Lawrence, President, and Patti Belbin, Secretary, Pine Lake Restoration Society. CC Moved by Councillor P.J.R. Massier to approve the request from the Pine Lake Restoration Society for funding support for 2012 up to the projected budget amount of $9,180 with payment to be processed upon receipt of invoices from the Pine Lake Restoration Society and to approve an amendment to the 2012 budget to provide for this payment from the contingency budget. Consideration of continued funding to the Pine Lake Restoration Society for the Operation and Maintenance of the Pine Lake Hypolimnetic Withdrawal System to be given during the 2013 budget discussions. 6.4 Twp Rd 390 (Former Hwy 11A) West of Sylvan Lake consideration of a request to reduce the speed limit for a 400-metre portion of this road directly adjacent to the Town of Sylvan Lake. Bylaw No. 2012/23 a bylaw to amend Schedule B of the Road Protection and Traffic Control Bylaw No. 2011/38, to decrease the speed limit on Twp Rd 390 (Hwy 11A) from the Town of Sylvan Lake limits (Rge Rd 15) for a distance of 400 metres to 60 km/h. Boomer reported on the recommendation to give second and third readings to the bylaw to close and consolidate a portion of Road Plans and 5613MC, located at Sandy Cove Resort within the N ½ , in exchange for a portion of Lot 1, Block 1, Plan , N ½ CC CC Moved by Councillor D.H. Nesbitt that Bylaw No. 2012/13 be given second reading. Moved by Councillor G.W. Gehrke that Bylaw No. 2012/13 be given third and final reading. 6.6 Road Closure, Road Plan 24AG, SE (Division 1) Assessment Services Manager B. Massier to give first reading to a bylaw to provide for the closure and sale of Road Plan 24AG located within SE MOTION DEFEATED Councillor Massier in favor Mayor Wood, Councillors Archibald, Gehrke, Lorenz and Nesbitt opposed 7.0 SUBDIVISION APPLICATIONS Councillor Gehrke declared a conflict of interest with regard Agenda Item No. 7.1 and excused himself from Council Chambers, Time: 11:04 a.m. 7.1 East ½ (Division 6) application for a one-year time extension for a conditionally approved subdivision on hectares (61.02 acres) to create 69 residential lots within the SE 15 (Hidden Springs). CC Moved by Councillor D.H. Nesbitt to approve the application for a one-year time extension for the conditionally approved subdivision of hectares (61.02 acres) within SE in order to create 69 residential lots, with the new expiry date to be June 21, Councillor Gehrke did not vote on this motion Councillor Gehrke returned to the meeting at this time, 11:10 a.m. 7.2 NW (Division 5) application to subdivide a 1.67-hectare (4.13-acre) bare agricultural parcel. CC Moved by Councillor R.R. Lorenz that, in considering this application, it is deemed that the subdivision as proposed complies with the Municipal Government Act, the Municipal Development Plan and the Land Use Bylaw; that it is suitable for the intended purposes and that it will not negatively impact adjacent land uses. Consideration has been given to topography, soil characteristics, access, the use of adjacent lands and the availability and adequacy of water supply, sewage disposal, solid waste disposal and storm water management. Therefore, the application to subdivide 1.67 hectares (4.13 acres) from NW is approved, subject to the following conditions: 1. Subdivision to be effected by Plan of Survey or Descriptive Plan; 2. The applicant to provide proof of a suitable building site to the satisfaction of the County; 3. Payment of all outstanding property taxes or satisfactory arrangements to be made for payment to Red Deer County; 4. The Applicant shall ensure there is adequate physical access to the new parcel and to the balance of lands; 5. Confirmation of availability and adequacy of a suitable water supply and private sewage disposal system that complies with applicable standards and regulations; and 6. A Postponement of Mortgage may be required, applicable fee will apply. CARRIED Mayor Wood, Councillors Archibald, Gehrke, Lorenz and Nesbitt in favor Councillor Massier opposed 7.3 SW (Division 5) application to subdivide a hectare (34.76-acre) bare agricultural parcel considered by the applicant to be fragmented from the remainder of the quarter section. CC CC Moved by Councillor R.R. Lorenz to deny the application to subdivide hectares (34.76 acres) from SW as the proposed parcel is not fragmented from the balance of the quarter as there are no physical limitations in accessing one side of the quarter to the other; heavily treed areas are not considered as part of the fragment within the definition of a fragmented parcel. NO VOTE TAKEN Moved by Councillor G.W. Gehrke to refer decision on the application to subdivide hectares (34.76 acres) from SW to allow for further discussions with the applicant and administration in relation to the proposed parcel size. 7.4 NW (Division 6) - application to subdivide a 1.44-hectare (3.56-acre) parcel containing an existing farmstead. CC Moved by Councillor G.W. Gehrke that, in considering this application, it is deemed that the subdivision as proposed complies with the Municipal Government Act, the Municipal Development Plan and the Land Use Bylaw; that it is suitable for the intended purposes, and it will not negatively impact adjacent land uses. Consideration has been given to topography, soil characteristics, access, the use of adjacent lands, and the availability and adequacy of water supply, sewage disposal, solid waste disposal and storm water management. Therefore, the application to subdivide 1.44 hectares (3.56 acres) from NW is approved, subject to the following conditions: 1. Subdivision to be effected by Plan of Survey or Descriptive Plan; 2. Submission of a plan by an Alberta certified surveyor confirming the location of the buildings and water well relative to the new property lines; 3. Payment of all outstanding property taxes or satisfactory arrangements to be made for payment to Red Deer County; 4. The Applicant shall ensure there is adequate physical access to the new parcel and to the balance of lands; 5. Confirmation shall be provided by a licensed Safety Codes Officer that the existing septic system conforms to the Alberta Private Sewage Systems Standard of Practice 2009, as amended from time to time, which includes that it is fully contained within the newly created property lines; and 6. The dedication by way of an agreement registered as a caveat on the land title indicating a 5.2-metre widening along the entire west boundary of the quarter section including the proposed subdivided parcel for possible future road widening purposes in favour of Red Deer County (fees required). CC Moved by Councillor P.T. Archibald to refer decision on the application to enter into an encroachment agreement to allow a fence to remain within the County road allowance adjacent to Lot 2, Block 2, Plan , SE to allow for further discussion in relation to a possible land swap in relation to the portion of County road that is encroaching on to the said property COMMITTEE REPORTS Councillors reported on meetings they have attended on behalf of Red Deer County since July 25, ADJOURNMENT CC Moved by Councillor G.W. 8 Red Deer County 0-1-<tbEN I tl.; 10 la.j4.04k.al DPIL (A- 1C kt) FILE7- / August 21, 2012 ADMINISTRATION REPORT To: County Council From: Planning & Development Services Subject: SW Hectares (5.00 acres) / Agricultural Zoning (Ag) / Division 3 I File Number S Roll No PURPOSE: To consider subdivision of 2.02 hectares (5 acres) from 64.7 hectares (160 acres) of Agricultural District land (AG) within the SW SUMMARY: The proposed parcel is bare and would be considered the first parcel out of the quarter-section. The parcel will be serviced by private water well and septic system. Access to the proposed parcel will be provided via Township Road 374. The topography of the land is rolling with tree stands as the natural vegetation and the nature of the soil is loam like. Surrounding lands are used largely for agricultural purposes. The Red Deer County Municipal Development Plan has a goal to ensure that agriculture remains a sustainable and diversified economic activity and lifestyle in the County. The proposed subdivision conforms to the criteria set out within the Municipal Development Plan The Surveyor has advised Red Deer County by on behalf of the owner that the justification for the parcel location is because the southwest corner is a slough and therefore, does not contain a suitable building site. The application was referred to internal and external agencies, as well as adjacent landowners, for comment: o Assessment Services requires a 5.2 metre road widening acquisition for the entire south (Twp Rd. 374) and west (Rge. 9 4.0 INTERDEPARTMENTAL IMPLICATIONS: None 5.0 FINANCIAL IMPLICATIONS: None 6.0 LEGAL IMPLICATIONS: None 7.0 ALTERNATIVES: 7.1 Grant approval for the subdivision, as it complies with current Red Deer County policies. In considering this application, it is deemed that the subdivision as proposed complies with the Municipal Government Act; the Municipal Development Plan and the Land Use Bylaw; that it is suitable for the intended purposes; and that it will not negatively impact adjacent land uses. Consideration has been given to topography, soil characteristics, access, the use of adjacent lands; and the availability and adequacy of water supply, sewage disposal, solid waste disposal and storm water management_ Therefore, it is recommended that this application to subdivide 5.00 acres from SW W5M containing 160 acres in order to create one (1) new lot be approved subject to the following conditions: 1. Subdivision to be effected by Plan of Survey or Descriptive Plan. 2. The applicant to provide proof of a suitable building site to the satisfaction of the County. 3. Payment of all outstanding property taxes or satisfactory arrangements to be made for payment to Red Deer County. 4. The Applicant shall ensure there is adequate physical access to the new parcel and to the balance of lands. 5. Confirmation of availability and adequacy of a suitable water supply and private sewage disposal system that complies with applicable standards and regulations. 6. The dedication, by way of an agreement for road widening or future construction, registered as a caveat on the land title, indicating a 5.2 metre widening along the entire southerly boundary westerly including the proposed subdivision and the entire westerly boundary of the quarter section for possible future road widening purposes in favour of Red Deer County. 14 Red Deer County PRESENTED TO COUNCIL DATE,a,5_,A4 at, Apra FILE?- f ADMINISTRATION REPORT Date: August 21, 2012 Memo To: County Council From: Legislative Services Subject: Bylaw No. 2012/20 Removal of Municipal Reserve Designation - Lot 1MR, Block 1, Plan , NE (A-Soo-Wuh-Um Property), Division PURPOSE to hold a public hearing for Bylaw No. 2012/20, a bylaw to remove the Municipal Reserve (MR) designation from the County-owned A-Soo-Wuh-Um property (Lot 1 MR, Block 1, Plan , NE ). 2.0 BACKGROUND / DISCUSSION Council gave first reading to Bylaw No. 2012/20 at its July 24, 2012, regular meeting setting the public hearing date for the bylaw for August 21, At the June 5, 2012, meeting, Council adopted a resolution to award the A-Soo-Wuh-Um Campground RFP 01/12 to Chris Demers and Craig Masley and to authorize County administration to negotiate and execute a long-term lease agreement for the construction and operation of the campground. When initiating the administrative review in relation to the terms of the lease agreement, it was noted that in addition to the property in question being zoned as Commercial Recreation District, it is also currently designated as a Municipal Reserve property. Pursuant to Sections 674 and 675 of the Municipal Government Act, in order to lease an MR property, a public hearing must be held and the MR designation removed. Bylaw No. 2012/20 (attached) provides for this change in designation. Pursuant to the terms of the Municipal Government Act, notice of the public hearing has been (1) advertised in the August 8 and 15, 2012, editions of the Red Deer Express, (2) posted on the County's website, (3) posted on the bulletin board in the foyer of the County office, and (4) posted on the property. 3.0 RECOMMENDATIONS dependent on the comments received at the public hearing, Council give second and third reading to Bylaw No. 2012/20, a bylaw to remove the Municipal Reserve (MR) designation from the County-owned A-Soo-Wuh-Um property (Lot 1 MR, Block 1, Plan , NE ). 16 Red Deer County PRESENTED TC COUNCIL DATE 71,A-c)10) FILE '7- (.9 August 21, 2012 ADMINISTRATION REPORT Date: August 9, 2012 To: County Council From: Planning & Development Services Subject: NW W4M I Lot 1, Block 2, Plan / 1.68 Hectares (4.15 Acres) / AG District / Division 2 I ASP Roll: PURPOSE: To hold a public hearing for Bylaw No. 2012/22 to identify Lot 1, Block 2, Plan , comprised of 1.68 hectares (4.15 acres) within the Divide Hills Area Structure Plan, from agricultural land to "Possible Country Residential Development"; and To consider granting second and third reading for Bylaw No. 2012/ SUMMARY: The subject property is currently zoned Agricultural District (AG) and is approximately 1.68 hectares (4.15 acres), An amendment to Figure 7 of the Divide Hills Area Structure Plan is being proposed in order to allow for the potential future rezoning of the subject property to Country Residential (R*1) and to facilitate a future proposal to subdivide the parcel. Highway 11 is located north, adjacent to the property. Access to the parcel is provided from Range Road 265. A single detached dwelling unit and agricultural operation currently exist on the easterly portion of the parcel. Surrounding parcels to the west have been identified as "Possible Country Residential Development" within the Divide Hills Area Structure Plan and those that have been developed are zoned Country Residential (R1); parcels to the north, east, and south exist as agricultural lands. Section 3.4.3(2c) of the Red Deer County & City of Red Deer Intermunicipal Development Plan states that existing Area Structure Plans may not be amended unless The County and The City agree to allow said amendment. The subject area is located directly adjacent to the southwest boundary of the Hamlet of Spruce View. Access to the proposed site will be from 20 1h Street, (Range Road 31). Through the referral process, Administration have been advised that the existing reservoir servicing in Spruce View is near its design capacity and may not be capable of supplying adequate fire flow protection to the proposed development. Red Deer County Operations Department recommended that a water servicing study be conducted to determine if Spruce View's water wells and reservoir are capable of servicing the proposed new development. The Spruce View Infrastructure Study is nearing completion and it will be used to establish a five to ten year capital plan to bring forward to Council this coming budget season. The Applicant is proposing to service the school with on site water and sewer services. It is recommended that as a condition of subdivision approval, connection to the Hamlet of Spruce View's water and sewer systems, which are currently located at the south end of 21 m Street and the south end of Dickson Road (Range Road 31), will be required. The connection to the water system will not occur until such time as capacity has been increased to accommodate the development. Sewer service capacity is not an issue, so sewer service should be connected to Spruce View sewer system at the time of development. The Red Deer County Operations Department has also advised that there is an intermittent watercourse that runs through the treed area which starts approximately two miles to the north west of this property. The lands surrounding the watercourse have periodically flooded in the past, therefore it is recommended that a flood plain assessment be conducted prior to any development commencing on this property. Alberta Transportation has indicated that a Traffic Impact Assessment (TIA) may be required which would identify whether the proposed development would impact the safe operation of the highway and if intersection improvements are necessary to accommodate the turning movement of traffic generated by the proposed development. Any improvements required to the existing intersection will be at the developer's cost. &ADEPT. 22 Although Burnt Lake Gas Co-Op had no issues with the proposed development, they are concerned with construction on this site potentially affecting their main natural gas pipeline which runs through the property. This pipeline currently serves the people located south of the Hamlet of Spruce View. Staff will bring forward a report to consider third and final reading of this zone amending bylaw, concurrently with Council's consideration of the plan of subdivision. On June 12, 2012 a referral letter was sent to both internal and external stakeholders as well as all adjacent landowners to notify them of the proposed re-designation of 8.68 hectares (21.25 acres) to facilitate a subdivision and construction of a private school, playground, church, cemetery, and parking lot. To date no letters of objection or concern have been received. 3.0 ALTERNATIVES: a) Grant second reading of Bylaw No. 2012/2.03 to re-designate 8.68 hectares (21.25 acres) of a 49.3 hectare (123.4 acre) parcel within part of the NE , from Agricultural District (AG) to Public Service District (PS). b) Postpone second reading; or c) Deny, sating reasons. 5.0 RECOMMENDATIONS: To grant second reading for Bylaw 2012/2.03 to re-designate 8.68 hectares (21.25 acres) from Agricultural District (AG) to Public Service District (PS) within part of the NE to facilitate a subdivision and development of a private school, and associated church, cemetery, playground and parking lot.
