3 Publc Hearng for Consent to Sever Applcaton BOl-2016 from Mora Charlotte Polltt affectng Block A, Regstered Plan 216, Part 1, Reference Plan 44R-4799, 29 Robnson Street, St. Marys. Trevor McNel of MTE/OLS Ltd. agent for the applcaton was present for the Publc Hearng. Grant Brouwer ntroduced the applcaton. The property s desgnated "Resdental" n the Town's Offcal Plan and zoned "Resdental Zone Two- R2-1" n the Zonng By-law Zl-1997, as amended. The property s the ste of a sngle-detached dwellng and the applcant s proposng to sever a strp of land wth a wdth of 4.267m located along the northerly property lne for the purpose of conveyng that porton of land to the adjacent property. Correspondence receved from the Fnance Department stated no ssues wth the applcaton wth respect to tax and water account. Correspondence receved from Upper Thames Rver Conservaton Authorty stated no ssues wth the applcaton. Trevor McNel spoke to the applcaton for Consent to Sever whch would have the effect of severng a porton of the lands from 29 Robnson Street to be conveyed to the adjacent property, beng 39 Robnson Street. The severance wll ncrease the sde yard of the adjacent property, 39 Robnson Street, and wll remove the exstngjog from the lands at 29 Robnson Street. t was the consensus of COA members that there are no concerns wth the proposed severance. The Certfcate of the Offcal must be ssued by the Secretary-Treasurer for Commttee of Adjustment wthn a perod of one year from the date of the malng of the Notce of Decson; 2. (Applcaton No. AO 1 /16) affectng a parcel of land descrbed as Part of Lot 18, Concesson 19 n the Town of St. Marys for the purpose of permttng the enlargement of a hatchery operaton, specfcally a loadng structure n the exteror sde yard at a dstance of 5.0 metres from the exteror sde yard be APPROVED as the request s desrable for the approprate development or use of the s4bject property.. BACKGROUND: Town staff has receved an applcaton submtted by the Owner of the subject property seekn,g Permsson to enlarge a legal non-conformng buldng on the lands known as Part of Lot 18, Concesson 19 at 772 Queen Street East. Ths property s currently used for ndustral purposes and s the ste of a hatchery. The Owner s seekng to erect a loadng dock at the northwest corner of the exstng buldng that wll run parallel to ndustral ROW. REPORT: The subject property s desgnated "ndustral" n the Town of St Marys Offcal Plah and s currently zoned "Hghway Commercal Zone (C3)" n the Town of St. Marys Zonng By-law, , as amended. The subject property s a rectangular shaped lot stuated at the southeast corner of Queen Street East and ndustral ROW. t has a frontage of approxmately 57.Sm akmg Queen St. E., a lot flankage of 140m along ndustral ROW and a lot area of approxmately hectares.

6 Secton 45(2)(a)() of the Plannng Act, as amended, gves the Commttee the authorty to deal wth legal non-conformng uses and ther enlargement or extenson, provded that the use has: exsted pror to the passng of the Zonng By-law; has contnued untl the date the applcaton was made; s confned wthn the lmts of the land that was owned and used on the day the By-law was passed. The Commttee should be satsfed that the applcaton meets the above-noted crtera, and s properly before the Commttee. The Owner advses that they purchased the property n 1978 for the current use and the buldng s shown on the 1978 aeral photos. Plannng Staff are aware that the use has occurred on the property snce 1988 and predates the current Zonng By-law whch was adopted on March 11, 1997 therefore; the Plannng Department consders the exstng use to be legal non-conformng. When evaluatng an applcaton for Permsson, the Commttee should consder the mpact of the proposed expanson on the surroundng propertes and the approprateness of the development. The Zonng By-law does not permt ndustral uses n the "C3" zone and t does not permt ndustral buldngs or loadng docks wthn 15 metres of the exteror sde yard. The loadng faclty at the northwest corner of the buldng s facng west such that trucks must back nto the space from ndustral ROW generatng potentally hazardous traffc movements on the street and once parked, the truck may encroach onto the travelled porton of the road. The Owner s seekng a buldng addton that wll create a loadng dock at the northwest corner of the exstng buldng that faces south. Trucks usng the loadng dock ll be parallel to ndustral ROW where they wll manoeuvre on the Owner's land, reducng potental conflcts wth truck movements and parkng on ndustral ROW. The surroundng uses are generally commercal and ndustral n nature wth the St. Marys Golf Club located on the north sde of Queen Street East. The proposed loadng dock should have no mpact on the surroundng uses. The Plannng Department s of the opnon that the subject applcaton should be supported. The physcal expanson of the buldng/use s neglgble, the proposed loadng dock s a replacement of an exstng loadng area, the exstng loadng area s currently wthn 15 metres of the exteror sde yard and the proposed re-orentaton represents an mprovement to the exstng loadng area whch should reduce traffc conflcts on ndustral ROW and have no mpact of the surroundng uses. The physcal expanson of the buldng/use s small enough that the procedures for a new/amended Ste Plan, as contaned n the Town's Ste Plan Control By-law, wll not be trggered. FNANCAL MPLCATONS: None. 2
