1 NOTE TO APPLICANTS: Consent Application Form Prior to submission of an application for consent to create a new lot or an addition to a lot, the Committee of Adjustment recommends that the applicant and/or the agent contact Regional and Town Planning staff to review their proposal. Also, in situations where a watercourse or wetlands are located on or in proximity to the subject lands, please contact Halton Conservation staff prior to submission of an application. The applicant is also encouraged to communicate with neighbours with respect to this application. In this form the term subject land means the land to be severed and the land to be retained. COMPLETENESS OF APPLICATION: As of January 1st, 1999, the Town of Oakville became the approval authority for consent applications. When completing the application form please note the following: 1. Please answer all questions. Type or print clearly. 2. The Town will contact and correspond, during the processing of this application, with the APPLICANT as listed below. 3. The information in italics on this form is the prescribed information required by Ontario Regulation 197/96 Schedule 1, for submission of a consent application made under the Planning Act. 4. The application form also sets out other required information that will assist the Town of Oakville and others in their planning evaluation of the consent application. To ensure the quickest and most complete review, this information SHOULD be submitted at the time of the application. In the absence of this information, it may not be possible to do a complete review within the legislated time frame for making a decision. As a consequence, it may result in the denial of the application. 5. In order that the Building Services Department can process this application, the AUTHORIZED AGENT and the LAND OWNER must sign the attached Affidavit. 6. If the mandatory information and fee are not provided, the Town of Oakville will RETURN the application, or REFUSE to further consider the application until the information and fee have been provided. 2 Guidelines & Procedures for Consent Applications 1.1 Application Form One (1) original application (signed and witnessed by a Commissioner for taking Affidavits) and 25 (two sided) copies of pages 4 to 8 (to be used to consult with other agencies that may have an interest in the application). A completed application is required for each parcel to be severed. If the form is incomplete or inaccurate, the application will be returned for completion, correction or clarification prior to processing. 1.2 Application Fees Effective January 1, 2018 APPLICATION FEES INDIVIDUAL CHEQUES Town of Oakville Fee 8, Validation of Title 3, Region of Halton Fee - Revision Fee - Validation of Title 1, Halton Region Conservation Authority (Major) 2, (Minor) Credit Valley Conservation Authority (Major) 3, (Minor) Additional fees that may be required: Major Revision $1, Preparation of Agreement $1, Rescheduling fee deferred application $ per application Certificate of Consent or Validation $ per application 1.3 Drawing Submission Separation of units along party wall $ each additional parcel 1 full size copy of a Surveyor s Sketch with a Key Map and 25 reduced copies, showing the following Prescribed Information: the boundaries and dimensions of the subject land, the part that is to be severed and the part that is to be retained; the boundaries and dimension of any land owned by the owner of the subject land and that abuts the subject land; the distance between the subject land and the nearest township lot line or landmark, such as a railway crossing or bridge; the location of all land previously severed from the parcel originally acquired by the current owner of the subject land; the approximate location of all natural and artificial features on the subject land and adjacent lands that in the opinion of the applicant may affect the application, such as buildings, railways, roads, watercourses, drainage ditches, river or stream banks, wetlands, wooded areas, wells and septic tanks; the existing use(s) on adjacent lands; such as residential, agricultural and commercial uses; the location, width and name of any roads within or abutting the subject land, indicating whether it is an unopened road allowance, a public traveled road, a private road or a right of way; if access to the subject land is by water only, the location of the parking and boat docking facilities to be used; and the location and nature of any easement affecting the subject land. Details of easements or restrictive covenants affecting the lands to be severed should be shown on the sketch. The sketch of survey must be prepared by an Ontario Land Surveyor in metric. NOTE: Any full size maps are to be folded so as to fit into a legal sized folder

3 1.4 Owner s Authorization If using an Agent or Solicitor 1.5 Regional Municipality of Halton - Environmental site-screening Checklist * The Region of Halton Planning and Public Works Departments requires that the above noted form (attached) be completed and submitted with the consent application for NEW LOTS AND LOT ADDITIONS. 2. Procedures The procedure to process a Consent application is outlined as follows: a. Building Staff review the application for its completeness and accuracy. b. Building Staff prepare a circulation to other departments and agencies. c. A Notice of Application will be circulated (if applicable) or a Notice of Public Hearing as per the Planning Act regulations. d. A staff report will be submitted for the Director of Planning Services (if applicable) or consideration at a Committee of Adjustment meeting. e. These meetings typically take place the 2nd and 4th Tuesday of every month. f. Appeals may be made and will be forwarded to the Ontario Municipal Board and the Ontario Municipal Board may order a public hearing. 3. Signs The applicant is required to post a sign on the subject lands. The signs will be provided by the Town of Oakville and shall be placed on the subject property in a location that is visible from the public roadway. The Owner of the land should complete the required application form and, along with the necessary documents and fees, submit it to: Building Services Department Town of Oakville 1225 Trafalgar Road Oakville, ON L6H 0H3 NOTE Personal information on the following forms and any supporting documentation is collected under the authority of the Ontario Planning Act and will be used by the Building Services Department in the processing of the Committee of Adjustment application.
