4 INTRODUCTION TO THE PROJECT In 2010 the Department of the Environment, Community and Local Government invited local authorities to submit applications for an Intensified Inspection Programme for private rented housing. The Intensified Inspection Programme will allow Dublin City Council to inspect a substantial portion of the stock of private rented properties on a systematic basis, targeting specific concentrations of rented properties which are deemed to be at risk, thus ensuring the effective enforcement of the rented housing standards legislation. Six Environmental Health Officers were recruited to undertake inspections of private rented units that are in multi unit buildings in the targeted areas. The goals of the Intensified Inspection Programme are to improve housing standards and to improve the quality of life of tenants in the private rented sector and to enhance the community and environment of the city. Methodology Applied 1. Leaflets/Survey Prior to inspections being undertaken on a street an Information Leaflet was delivered to each house on the street informing residents that inspections were planned. A copy of the Information Leaflet is included in this report. A street survey was also carried out of the number of door bells and waste bins to help identify private rented houses. 2. Cross Referencing Cross referencing was then carried out of the Private Rented Tenancies Board (PRTB) registered tenancies database. 3. Appointments Appointments letters were sent to the landlords giving three weeks notice of an inspection. 4. Inspections Inspections were undertaken of all lettings in the building. Landlords were given general advice on the provisions of the legislation that would come into effect for existing rented properties on the 1 st February In cases of non compliance an improvement letter or improvement notice was served on the landlord requiring remedial works to be undertaken within a specified time frame Re-inspections were undertaken to ensure that all required remedial works had been completed. Where remedial works were not completed further enforcement action was taken, 4

For this purpose a proper state of structural repair means sound, internally & externally, with roof, roofing tiles and slates, windows, floors, ceilings, walls, stairs, doors, skirting boards, fascia, tiles on any floor, ceiling and wall, gutters, down pipes, fittings, furnishings, gardens and common areas maintained in good condition and repair and not defective due to dampness or otherwise. Sanitary Facilities - Article 6 Within the habitable area of the house for the exclusive use of the house shall be provided: A water closet, with dedicated wash hand basin with hot & cold water A fixed bath or shower with hot & cold water These facilities shall be: Maintained in good working order Have safe and effective drainage Be properly insulated & secured Have adequate hot & cold water Be in a room separated from other rooms by a wall & a door & containing separate ventilation 5

6 Heating Facilities - Article 7 Every habitable room shall have: A permanently fixed appliance or appliances capable of providing adequate heating Adequate facilities must be provided for the removal of fumes from combustion The tenant must have independent control & management of the heating Food Preparation & Storage & Laundry - Article 8 Within the habitable area of the house for the exclusive use of the house shall be provided: A 4 ring hob with oven & grill Adequate facilities for the removal of cooking fumes by means of a cooker hood A fridge & a freezer or a fridge freezer Microwave oven Food Preparation & Storage & Laundry - Article 8 A sink with hot & cold water and an adequate draining area The cold water must be taken from a mains supply An adequate number of kitchen presses A clothes washing machine or access to a communal clothes washing machine A clothes dryer or access to a communal clothes dryer or exclusive access to a garden All facilities must be in good working order and be maintained by the landlord Ventilation Article 9 Every habitable room shall have adequate ventilation All means of ventilation shall be in good repair & in working order Adequate ventilation shall be provided for the removal of water vapour from kitchens & bathrooms Lighting - Article 10 Every habitable room shall have adequate natural lighting Every hall, stairs & landing in the house and every room in the house shall have adequate artificial lighting Every window in every room containing a bath and / or shower and a water closet shall be adequately screened Fire Safety - Article 11 Separate requirements for single rented house & rented house in multi unit buildings: Single Unit The house shall contain a mains wired smoke alarm or at least two 10 year self contained battery operated smoke alarms and a fire blanket Multi Unit Each house shall contain a mains wired smoke alarm, a fire blanket and an emergency evacuation plan. Multi Unit Emergency lighting shall be provided in all common areas Refuse Facilities - Article 12 The house shall have access to suitable and adequate pest and vermin-proof refuse storage facilities. Electricity & Gas - Article 13 Installations in the house for the supply of electricity and gas shall be maintained in good repair and safe working order with provision, where necessary, for the safe and effective removal of fumes to the external air. 6

7 Housing (Miscellaneous Provisions) Act 2009 Improvement Notice Where, in the opinion of a housing authority, a landlord is contravening or has contravened a requirement of a regulation the authority may give notice in writing to the landlord of the house concerned. A copy of the Improvement Notice must be given to the tenant of the house This is a statutory notice requiring the landlord to undertake required remedial works within a specific period of time to bring the letting into compliance with the legislation Landlord has right of objection to Local Authority 14 days to object LA decision within 14 days of receipt of objection LA can vary, withdraw, cancel or confirm the Improvement Notice Landlord can appeal LA objection decision to the District Court 14 days to appeal must notify LA of appeal & grounds of appeal Prohibition Notice Where a landlord fails to comply with an Improvement Notice the housing authority may give notice in writing (in this Act referred to as a Prohibition Notice ) to the landlord of the house concerned. The housing authority must give a copy of the Prohibition Notice to the tenant A housing authority shall, in the interests of public health and safety, make such arrangements as they consider appropriate or necessary to bring the contents of a prohibition notice to the attention of the public. Can be served where a landlord fails to comply with an Improvement Notice Landlord can appeal Prohibition Notice to District Court 14 days to appeal must notify LA of appeal & grounds of appeal It prevents the property from being re-let until the Improvement Notice has been complied with Existing tenant can remain in situ Cannot be used as a reason to evict a tenant Section 34 of the Housing (Miscellaneous Provisions) Act 1992 as amended by the Housing (Miscellaneous Provisions) Act 2009 A person who by act or omission obstructs an authorised person or contravenes a provision of or a regulation under S 17,18 or 20 or fails to comply with an improvement notice or re-lets in breach of a prohibition notice Shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding 5,000 (class A fine Fines Act 2010) or imprisonment for a term not exceeding 6 months or both If the obstruction, contravention, failure to comply or re-letting is continued after conviction the landlord shall be guilty of a further offence on every day on which the offence continues and shall be guilty on summary conviction to fine not exceeding 400 On conviction the courts shall order the person to pay costs & expenses to the housing authority in relation to the investigation, detection & prosecution of the offence 7

8 The Housing (Standards for Rented Houses) Regulations 2008 Articles 6, 7 & 8 On the 1 st of February, 2013, Articles 6, 7 and 8 of the Housing (Standards for Rented Houses) Regulations 2008 came into effect for all residential rented accommodation. This means that all rental accommodation must have its own separate sanitary facilities. In addition, updated requirements in relation to heating and facilities for cooking, food storage and laundry apply to rented accommodation. A summary of these articles requirements is set out below. Sanitary Facilities - Article 6 All rental accommodation must have a separate room, contained within the rented dwelling, with a toilet, wash basin and a fixed bath or shower with hot and cold water facilities. Heating Facilities - Article 7 All habitable rooms must contain a fixed appliance capable of providing effective heating and the tenant must be able to control the operation of such an appliance. Food Preparation and Storage and Laundry Article 8 Each rented dwelling must have adequate facilities for the hygienic storage, preparation and cooking of food and access to a washing machine and dryer. Responsibility for enforcement of these standards rests with the local authorities. The penalties for non-compliance with the Regulations is a fine of 5,000 (class A fine Fines Act 2010) or imprisonment for a term not exceeding 6 months or both, and the fine for each day of a continuing offence is 400.storage, preparation and cooking of food and access to a washing machine and dryer. On inspections undertaken prior to the 1 st February 2013 a record was taken of all rented units that may not comply with Articles 6, 7, & 8 when commenced. In these cases landlords were given general advice on the provisions of the legislation. Further inspections of these units were then scheduled for after the 1 st February Since the commencement of the Intensified Inspection Programme in March 2012 and to the end of April 2014 Environmental Health Officers inspected in the region of 4773 private rented houses. Overall officers undertook in the region of 8570 inspections of private rented houses in Dublin City. The current outcomes of this inspection programme are outlined street by street in this report. The Intensified Inspection Programme is scheduled to continue to March

Landlords are legally obliged to ensure that their Private Rented Houses (which include a house, flat or apartment) are maintained in good condition and repair. Landlords are required to ensure that their lettings comply with the above legislation while let and while available for letting. NOTIFICATION OF INTENSIFIED INSPECTION PROGRAMME: It is the intention of the Environmental Health Officers to carry out an Intensified Inspection Programme of the Private Rented Houses in your area. If you are a landlord, please be advised that an appointment will be arranged with you over the coming months in order to inspect your rented accommodation. The purpose of these inspections is to ensure that rented accommodation meet the standards for private rented house. If you are not the owner of a rented property the Intensified Inspection Programme will not apply to you and this leaflet is for advisory purposes only. 10 Grove Park, Rathmines, Dublin 6 Grove Park is a 19 th Century Street, located off Rathmines Road Lower. Residents have easy access to bus routes and the Green Luas line with Grafton Street, Camden Street and St. Stephens Green just a short distance away. These factors combined with the variety of red brick houses, many of which are three storeys have made Grove Park a substantial letting location. There are a total of 107 properties on the street, 12 of these were identified as private, 3 identified as for sale and vacant, 88% of properties were found to be privately rented. 13 Sunbury Gardens, Dublin 6 Sunbury Gardens is located in Dublin 6 off Dartry Road, near to the villages of Rathmines and Rathgar. Sunbury Gardens contains 13 red brick houses, 3 of the properties were found to be separated into several units and privately rented with an average of 7 flats per building. 23% of properties were found to be privately rented. There are no amenities in Sunbury Gardens however it is within walking distance of the shops, bars, restaurants of Rathgar Village and Rathmines Road Upper. 16 Harold s Cross Road, Dublin 6 *368 to 430 Harold s Cross Road left hand side only* Harold s Cross Road is situated north of Terenure, west of Rathmines, east of Crumlin and directly south from the Grand Canal at Clanbrassil Street. There are a total of 26 properties between 368 to 430 on the left hand side of Harold s Cross Road, 17 (65 %) properties were found to be privately rented, 9 private dwellings and 1 for sale and vacant at time of inspections. Each rented property contained an average of 8 flats. The houses on Harold s Cross Road are red brick terraced and end terraced buildings. Residents that live on Harold s Cross Road are served by a variety of bus routes that stop along this road such as the 16 which runs to Dublin airport. Residents are also within walking distance of amenities that Terenure village and Harold s Cross village have to offer. These include a variety of shops, bars restaurants, schools and sports amenities. 19 Sarsfield Road, Ballyfermot, Dublin 10 Saint Michael s Villas is located off the Sarsfield Road in Ballyfermot. It is located seven kilometres west of the city centre, south of the Phoenix Park. Saint Michael s Villas consists of four terraced buildings, two of which were found to be private dwellings. 22 Sallymount Avenue / Ashbrook Terrace, Dublin 6 Sallymount Avenue is located off Ranelagh village in Dublin 6. Ashbrook Terrace comprises of a row of houses within Sallymount Avenue. Residents here have easy access to many bus routes that serve the city centre and the Green Luas line which has a stop in Ranelagh village. Residents have also access to a number of amenities in Ranelagh village such as gyms, shops, restaurants and bars. The properties on Sallymount Avenue/ Ashbrook Terrace are either 2 storeys or 3 storeys. 25 Ranelagh Road, Dublin 6 Ranelagh Road leads into Ranelagh Village from the city centre located in Dublin 6. This road is served by bus routes and two Luas stops. Residents are within walking distance of the city centre and other urban surrounding areas such as Ranelagh Village, Rathmines, Donnybrook and Portobello. Ranelagh village has a variety of retail outlets as well as restaurants, bars, schools and sports amenities on offer. The majority of the properties inspected on this road were three storeys. There were a total of 70 buildings on the section of road targeted for inspection. A total of 24 were identified as privately rented properties. 28 South Circular Road, Dublin 8 * (35 properties identified as privately rented) *1-112 (51 Properties identified as privately rented) South Circular Road is one of the longest roads in the city. It runs from Kilmainham in the west of the city, through Rialto and Dolphin's Barn to Portobello near the centre. As it runs mainly through residential areas, it is used by numerous bus routes. This road is a mix of privately owned and rented. The majority of the properties on this road comprise of two storeys. The road is served by a number of pubs, restaurants that are located in sections along the road. The road is also home to Griffith College Dublin and the National Boxing Stadium. 31 Harrington Street, Dublin 8 Harrington Street is located on the south side of Dublin City. The street falls within the Dublin 8 postal district. 71 North Circular Road, Dublin 7 The North Circular Road was first laid out in the 1760s as a fashionable thoroughfare at the edge of the city built up area, leading to the Phoenix Park. The total length of the North Circular Road from the Phoenix Park to Summerhill Parade is about 3.5km. The proximity of the houses to the city centre and transport links contributed significantly to the growth of private rented accommodation along the North Circular Road. The proportion of multi occupancy units on North Circular Road is very high. It was found that over 69% of buildings on the portion of North Circular Road between the Infirmary Road Junction and the Oxmantown Road Junction were in multiple occupation. These buildings ranged from consisting of two units to over twenty units. There is no clear pattern to the sub division of buildings on the street and each building inspected varied greatly in composition ranging from bedsit accommodation to three and four bedroom apartments. The compositions of the buildings in other areas of North Circular Road are equally as varied and as such it makes it a challenging area to inspect. In addition the differing building styles suit differing people and their needs. There are single unit properties ideal for families and high density studio accommodation for low income single tenants. Resident s are within easy walking access to the vibrant shops, restaurants and public transport routes of O Connell Street and the surrounding areas. At the top end of Blessington Street lies the Blessington Street Basin. The basin was constructed as the Royal George Reservoir in The Basin was completely refurbished in 1993/94 and is now a popular public park with a fountain and a bird sanctuary on its central island. The park has been described as a quiet haven in a bustling metropolis providing a secret garden for local residents and visitors alike. These factors combined with size of the properties, many of which are three storeys have made Blessington Street a substantial letting location. 83 Belvedere Place, Dublin 1 Belvedere Place connects Mountjoy Square one of five Georgian squares in Dublin and at the other end lies North Circular Road on the north side of Dublin City. The street is in a very enviable area with good transport links to other areas of the city centre. Belvedere Place is now a mix of commercial and residential units. The private residential units are heavily divided into flats due to the size of the buildings. The buildings are typically three floors over basement with the average number of units per building being 7. In addition there are a number of vacant buildings. To date we have inspected 18 buildings on Belvedere Place with a total of 130 units being inspected within these building. 86 Belvidere Road, Dublin 1 Belvidere Road connects North Circular Road and Dorset Street on the north side of the City. It is in close proximity to Mountjoy Square, Drumcondra and Croke Park. The road is composed of much smaller buildings than its neighbouring streets of Belvedere Place and Sherrard Street. There is a mix of commercial use properties, with both owner occupied and rented both single unit properties and multi unit. To date we have inspected 18 buildings on Belvidere Road with a total of 77 units being inspected within these building. 89 Charles Street Great, Dublin 1 Charles Street Great is located to the east of Mountjoy Square. On the north side of Charles Street Great there is a terrace of Georgian style cottages split by Emmet Street. On the south side of Charles Street Great there is traditional large three story over basement Georgian buildings. The houses were built in the 19 th Century and are a combination of two and three storey buildings. The convenient location, combined with easy access to city centre has led to the conversion of larger building into flats and studio apartments.
