1 The Council of the Municipal District of Foothills No. 31 met at the Foothills Administration Building, High River, Alberta, for a meeting on January 24, 2018 at 9:00 a.m. Present were Reeve L. Spilak, Deputy Reeve D. Miller, Councillors J. Parker, S. Oel, A. Alger, R.D. McHugh and R. Siewert, Municipal Manager H. Riva Cambrin, Director of Planning H. Hemingway and Recording Secretary S. Barrett. Reeve Spilak called the meeting to order at 9:04 a.m. The M.D. s Deputy CAO and Director of Community Services R. Payne, Public Works Supervisor of Support Services L. Armstrong, Supervisor of Infrastructure J. Edgington, and Manager of Agricultural Services, Parks and Recreation J. Porter were in attendance for a discussion period with Council. COUNCIL AGENDA Moved that Council approve the agenda for the Council meeting of January 24, ADDITIONS TO COUNCIL AGENDA Moved that Council approve the additions to the agenda for the Council meeting of January 24, CAPITAL EQUIPMENT PURCHASE ASB TRACTOR WITH BRUSHER Moved that Council approve the capital equipment purchase of one John Deere 6110M Cab Tractor and one Alamo Maverick II Brush Mower from Martin Deerline for a total amount not to exceed $212,016.21, and installation of window tinting, 2-way radio and M.D. GPS system (cal amp/plm) for an additional cost not to exceed $5,000, all plus applicable taxes. UTV PROPOSAL 2018 Moved that Council accept the proposal as presented for the donation of $30,000 to be used to purchase and fit out one Utility Terrain Vehicle (UTV) from the Spruce Meadows Leg Up Foundation to the M.D. of Foothills for use by the Foothills Fire Department. EMERGENCY LIVESTOCK HANDLING EQUIPMENT PROPOSAL Moved that Council accept the proposal as presented for the donation of an Emergency Livestock Handling Equipment Trailer and related equipment from The Alberta Equestrian Federation (AEF) for use by the Foothills Fire Department and Emergency Management Agency of the M.D. of Foothills. EY CYCLE EVENT Moved that Council authorize use of Municipal Roads for the EY Cycle Event scheduled for June 14, 2018, subject to standard municipal conditions and any further requirements as set forth by the Public Works and Bylaw Enforcement Departments of the M.D. of Foothills. WORLD S LARGEST TRUCK CONVOY ROUTE 2017 Moved that Council authorize use of Municipal Roads during the World s Largest Truck Convoy scheduled for September 22, 2018, subject to standard municipal conditions and any further requirements as set forth by the Public Works and Bylaw Enforcement Departments of the M.D. of Foothills. Further, Council has no objection to use of Provincial Highways within the M.D. of Foothills for this event. OKOTOKS AG SOCIETY NW W4M DEVELOPMENT PERMIT 17D 205 D. Thomson and D. Mitchell were in attendance for the public meeting in connection to the application for Development Permit 17D 205 in order to bring the existing operation of the Okotoks Agricultural Society into compliance with the new Direct Control District #32 land use rules within the /- portion of Plan , Block 11, Lot 1; Ptn. NW W4M. Also in attendance were K. and T. Arsenault. The new Land Use Bylaw 60/2014 saw the elimination of the Commercial Rural District land use zoning and the creation of the current Direct Control District #32 to allow the operation of agricultural societies, and accessory community recreational facilities providing services and facilities for the agricultural related, recreational, tourism, or social needs of the community. Operations of the Okotoks Ag Society would include a variety of agricultural events, boarding services, public recreation and social events, public markets,

2 auction sales, event camping, operation of a restaurant and bar, retail sales and a single family dwelling for rent. Contemplated uses within this application also include outdoor storage of RVs and equipment in addition to a 100 stall barn that is proposed to replace the Hebson Arena. D. Thomson submitted that the additional events and the potential restaurant, RV and equipment storage are being considered to maximize income, offset recent decreases to Provincial grant funding and ensure the viability of the facility moving forward. The public meeting was closed. HIGH RIVER AG SOCIETY NE W4M DEVELOPMENT PERMIT 17D 264 D. Atterbury and K. Miller were in attendance for the public meeting in connection to the application for Development Permit 17D 264 in order to bring the existing operation of the High River Agricultural Society into compliance with the new Direct Control District #32 land use rules within the /- acre portion of Plan on NE W4M. The new Land Use Bylaw 60/2014 saw the elimination of the Commercial Rural District land use zoning and the creation of the current Direct Control District #32 to allow the operation of agricultural societies, and accessory community recreational facilities providing services and facilities for the agricultural related, recreational, tourism, or social needs of the community. Operations of the High River Ag Society would include a variety of agricultural events, boarding services, public recreation and social events, public markets, auction sales, event camping, concession services and retail sales. The application also proposes a 30 x 40 (1,200 sq. ft.) office trailer to be located on the north side of the arena and a 14 x 30 (420 sq. ft.) shed to be located on the south side of the tractor museum. The public meeting was closed. Moved that Development Permit 17D 264 for operation of the High River Agricultural Society under the Direct Control District #32 land use rules within the /- acre portion of Plan on NE W4M be approved, subject to the following conditions: This approval permits a five year compliance deadline for completion of conditions, from the date of this decision, unless otherwise specified; This approval allows for the following uses on the property: Daily Public Agriculture Uses & Events up to a maximum of 250 participants / spectators per use/event; Up to 10 Rodeo s per year with a maximum of 2,000 participants / spectators, this is considered a Special Agriculture Event approved under this permit; Guy Weadick event with a maximum of 8,000 participants over four days, this is considered a Special Agriculture Event; Horse Boarding up to 40 horses maximum Stall rental for both indoor and outdoor; Two yearly Tractor Pull / Car Show events with a maximum of 1,000 participants/spectators; Pancake Breakfast for 200 people; Two yearly Model T events with a maximum of 1,000 participants/spectators; Temporary Camping (minor) for Agriculture Events only; Old Country Fair, 2-day event with approximately 500 people per day; This approval allows for a 30 x 40 office trailer that must meet the following Must be placed in the location as shown on the site plan; The office trailer must get all Safety Code Permits, before being moved onto the property, being building, plumbing, gas, septic and electrical and all applicable inspections. Safety Codes may require engineering specific to the use and occupancy and fire suppression; The applicants must obtain a Roadside Development Permit from Alberta Transportation and provide proof to the Development Officer of the M.D. of Foothills; This approval allows for a 14 x 30 shed that must meet the following Must be placed in the location as shown on the site plan; The shed must get all Safety Code Permits, before being moved onto the property, being building, plumbing, gas, septic, and electrical (if applicable) and must receive all inspections. Safety Codes may require engineering specific to the use and occupancy;

3 The applicants must obtain a Roadside Development Permit from Alberta Transportation and provide proof to the Development Officer of the M.D. of Foothills; This approval allows for Camping, Minor, that must meet the following A site plan must be submitted showing the camping area and number of camping sites, size of each space and laneways. This must be designed in accordance with enough room for emergency vehicles to be able to access; Camping is only permitted as an accessory use to the agriculture events occurring on the site; No services are permitted for the camping (i.e. electricity, water and dumping waste). This permit does not include provisions for large special events, which is more than 250 people, such as, but not limited to, concerts, dances, fundraisers, etc. and anything not specifically mentioned as being approved in condition #2 of this permit approval; The applicants must submit an Emergency Response Plan for approval to our Director of Emergency Management, Clayton Terletski, to include all uses approved under this permit, this must be done within 6 months of the date of this decision; As the current buildings received their permits back when they were built, they are not required to be brought into conformance with today s building codes, they are currently considered non-conforming to the property. However, should any alterations occur within the buildings they will be required to have them engineered and brought into code with today s Building Codes and will require all applicable Safety Code Permits; The applicants must comply with the Dark Sky Bylaw; Hours of operation for all activity on site, both indoors and outdoors: 8:00 AM 10:00 PM for daily arena and grounds use, 7 days a week; 8:00 AM 2:00 AM for Special Events and the Senior Pro Rodeo on Friday and Saturday; 8:00 AM 3:00 AM for Guy Weadick Days on Friday and Saturday; With any alcohol served on site, the applicants must obtain a liquor license from the Liquor Control Board; All applicable permits and regulations of Alberta Health must be obtained and adhered to, including for all concessions, the restaurant and temporary food services. Under the Health Authority the applicants must ensure that they have enough public washrooms / port-a-potties available for each use and event on site. The applicants must also ensure that they have potable water and any well water will be required to be tested; All temporary food trucks for any events are required to have both Alberta Health approvals and a Fire Inspection by the M.D. of Foothills Fire Chief; In order to use well water for any purpose, the applicants must have a valid water license and proof is required to be submitted to the Development Officer of the M.D. of Foothills. Should a water license not exist, the applicants will be required to either obtain one or alternatively use a cistern; A manure management plan is required to be submitted to the Development Officer of the M.D. of Foothills; An overall operating business license is required annually; A fire inspection of all buildings must be conducted as per our Municipal Fire Chief; A parking plan is required for all uses as noted in Condition #2 and should be designed in accordance with Section 9.19 of the Land Use Bylaw; This permit does not contemplate signage, any future signage both for the Ag Society or for any other purpose falls under the current approval, Development Permit 17D 035, or alternatively must be applied through additional Development Permits; If hauling soils off and on the property, the applicants must ensure that road use agreements are in place with the M.D. of Foothills Public Works Department; The Applicant agrees to indemnify and hold harmless the MD of Foothills from any and all third party claims, demands, or actions for which the Applicant is legally responsible, including those arising out of negligence or wilful acts by the Applicant or the Applicant s employees or agents. In addition, the Applicant will carry insurance to cover general liability including bodily injury and property damage to a third party.

4 The applicants would need to enter into an easement agreement with the Town of High River to allow for an additional egress on the south side of the property; Issuance of a development permit by the municipality does not relieve the applicant of the responsibility of complying with all other relevant municipal bylaws or requirements, nor excuse violation of any provincial or federal regulation or act which may affect the use of the lands or any associated buildings; It is the applicants responsibility to provide notification to the Development Authority upon completion of the development; The applicant shall be responsible for payment of any professional costs including legal fees that may be incurred by the Municipal District with respect to the development approved on this permit. OKOTOKS AG SOCIETY NW W4M DEVELOPMENT PERMIT 17D 205 Moved that Development Permit 17D 205 for operation of the Okotoks Agricultural Society under the Direct Control District #32 land use rules within the /- acre portion of Plan , Block 11, Lot 1; Ptn. NW W4M be approved, subject to the following conditions: This approval permits a five year compliance deadline for completion of conditions, from the date of this decision, unless otherwise specified; This approval allows for the following uses on the property: Daily Public Agriculture Uses & Events up to a maximum of 250 participants / spectators per event; Up to 2 Rodeo s per year with a maximum of 1,500 participants / spectators that will include Beer Garden with tent set up, this is considered a Special Agriculture Event; Calgary Stampede Team Cattle Penning Qualifier once a year with a maximum of 500 participants / spectators, this is considered a Special Agriculture Event; Horse Boarding up to 20 horses maximum; Dog Agility up to 20 people and no more than 20 dogs; Motorcycle Rodeo once a year with no more than 200 participants / spectators; Mini Moto Practice indoors with no more than 10 participants/spectators; Up to 5 Equipment and Vehicle Auctions / Sales a year with no more than people; One Fall Fair / Sportsman Show a year with no more than 1,000 people; Farmers Markets with no more than 500 people; One Craft & Critter Market with no more than 200 people; No more than 5 car shows a year with no more than 200 people; Pilates, Fitness and Yoga Studios with no more than 20 people per group; Agriculture Retail Store to be operated in the existing building; Concession; Tack Sales; Temporary Camping (minor) for Agriculture Events only; Rental of existing single family dwelling; This approval allows for a new 100 stall barn that must meet the following The barn must meet the minimum setback distances as outlined within the District; The barn must get all Safety Code Permits being building, plumbing, gas, septic and electrical and all applicable inspections. LETTER OF CONCERN LANDOWNER SAFETY AND ENJOYMENT OF PROPERTY Moved that Council acknowledge the letter received from D. Hanson regarding landowner safety and enjoyment of personal property as it pertains to use of firearms on surrounding lands and refer the matter to administration for further research.

6 LUNCH Moved that Council adjourn for lunch. MINUTES JANUARY 17, 2018 Moved that Council adopt the minutes, as circulated, of its January 17, 2018 Council meeting. RECESS Moved that Council recess to sit as the Subdivision Approving Authority ALBERTA LTD. SW W4M REQUEST FOR SUBDIVISION Moved that the Subdivision Approving Authority postpone their decision as it pertains to this application to February 7 th, NLC EQUIPMENT & REAL ESTATE INC. SE W4M REQUEST FOR SUBDIVISION Moved that the Subdivision Approving Authority postpone their decision as it pertains to this application to a future meeting. CORMACK NW W5M REQUEST FOR BOUNDARY ADJUSTMENT Moved that the Boundary Adjustment whereby the boundaries of the existing 40 acre parcel identified as Plan , Block 1; Ptn. NW W5M be moved from the North West corner of the quarter section to the North East corner of the quarter section, and whereby /- acres from that parcel be consolidated into NW W5M, resulting in one /- acre parcel (Plan , Block 1; Ptn. NW W5M) and one /- acre parcel (NW W5M) has been evaluated in terms of Section 654 of the Municipal Government Act and Section 7 of the Subdivision and Development Regulation and therefore it is recommended that the application be approved as per the tentative plan for the following reasons: The application is consistent with Section 7 of the Subdivision and Development Regulations; The subject land has the appropriate land use designation. Further, in accordance with Sections 654 and 655 of the Municipal Government Act, the application be approved subject to the following conditions: Boundary adjustment and consolidation to be effected by Plan of Survey, pursuant to Section 657 of the Municipal Government Act, or such other means satisfactory to the Registrar of the South Alberta Land Titles District; It is the applicant s responsibility to provide a Real Property Report or an as built drawing signed and sealed by an Alberta Land Surveyor, certifying the location of the water wells and the adjacent municipal road(s) within the boundaries of the new and balance parcel and that the site plan is surveyed according to municipal setback requirements; Execution of an agreement for acquisition of 5.18 metres of land for road widening, more or less, parallel to the north and west boundaries of the subject lands. Agreement to be registered by way of caveat concurrently with the Plan of Survey to the satisfaction of Council and the Municipal Engineer; All accesses to be located and culverts and approaches to be installed to the satisfaction of the municipality s public works department; Landowners are to provide all utility easements and agreements to the satisfaction of the MD and the utility companies; Landowners are to pay all arrears of taxes on the existing parcels prior to finalization of the subdivision; Landowners are to pay final subdivision lot fees; ADJOURN Moved that the meeting of the Subdivision Approving Authority adjourn and that Council continue with its regular agenda COMMITTEE APPOINTMENTS AGRICULTURAL SERVICE BOARD

ARMAA ASSESSMENT YEAR MODIFIERS (AYM) FOR WELLS AND PIPELINE ASSESSMENT Moved that Council acknowledge the letter received from the Alberta Rural Municipal Administrators Association concerning the Minister of Municipal Affair s decision to deny a proposed adjustment to Assessment Year Modifiers for wells and pipeline assessments. REQUEST TO RENAME ROAD 243 rd AVENUE EAST Moved that Council deny the request received from the Honorary Consulate of the Republic of Serbia Calgary, to rename 243 rd Avenue East as Nikola Tesla Avenue East. XPLORNET COMMUNICATIONS INC. SW W5M COMMUNICATIONS TOWER Moved that Council support the installation of one 29.9m self-support tower on the lands legally described as Plan , Block 2, Lot 5; SW W5M. This support is based upon design and location as have been identified within the formal proposal - file AB1302 and is contingent upon lighting requirements. Council implores the determining authority to ensure that lighting on the tower is avoided if at all possible, in an effort to ensure the least amount of disturbance to area residents.
