1 The Council of the Municipal District of Foothills No. 31 met at the Foothills Administration Building, High River, Alberta, for a meeting on September 6, 2017 at 9:00 a.m. Present were Mayor L. Spilak, Deputy Mayor T. Mills, Councillors R. Percifield, D. Miller, R. Chase, S. Oel and J. Parker, Municipal Manager H. Riva Cambrin, Director of Planning H. Hemingway and Recording Secretary S. Barrett. Mayor Spilak called the meeting to order at 9:05 a.m. The M.D. s Deputy CAO and Director of Community Services R. Payne, Deputy Director of Operations for Public Works M. Gallant, Manager of Agricultural Services, Parks and Recreation J. Porter and Supervisor of Infrastructure J. Edgington were in attendance for a discussion period with Council. COUNCIL AGENDA Moved that Council approve the agenda for the Council meeting of September 6, ADDITIONS TO COUNCIL AGENDA Moved that Council approve the additions to the agenda for the Council meeting of September 6, DUST CONTROL SPOT TREATMENT APPLICATION 242 AVE WEST Moved that Council authorize one time application of Dust Control Spot Treatment along a portion of 242 Ave West, east of 1119 Drive West. ACRP ELIGIBLE PROJECTS Moved that Council accept the report prepared by AMEC Foster Wheeler outlining recommended projects to be completed through use of remaining ACRP funding. DARK SKY SIGNAGE Moved that Council authorize installation of Dark Sky signage within Municipal and Provincial Right of Ways as presented. The cost of signs is to be covered by the Dark Sky Country signage group and installation will be completed by the Public Works department of the M.D. of Foothills. ALBERTA LAW ENFORCEMENT TORCH RUN 2017 Moved that Council support use of Provincial Highways within the M.D. of Foothills for use during the Alberta Law Enforcement Torch Run event, which is an annual convoy in support of Special Olympics Alberta, scheduled for September 16, ATCO EPIC FUNDRAISER 2017 Moved that Council support use of Provincial Highways within the M.D. of Foothills for use during the ATCO Epic Fundraiser 2017 scheduled for September 14, BAKER HUGHES GRAN FONDO 2017 Moved that Council authorize use of Municipal Roads as requested for the Baker Hughes Gran Fondo 2017 scheduled for September 17, Council further requests that proof of approval from Alberta Transportation for use of Provincial Highways be submitted to the M.D. of Foothills, and that administration advise organizers of road conditions along that portion of Plummers Road being utilized for the event. ALBERTA SOUTH CENTRAL MUTUAL AID AGREEMENT BYLAW 66/2017 Bylaw 66/2017 was reintroduced into the meeting to authorize the M.D. of Foothills participation in the Alberta South Central Mutual Aid Agreement. Moved second reading THE BYLAW WAS PASSED FOR TWO READINGS Moved third reading THE BYLAW WAS PASSED 322 AVENUE WEST DUST CONTROL Moved that Council acknowledge the request for permanent dust control on a portion of 322 Avenue West and authorize administration to put that portion of road on the MRO Matrix for future consideration.

2 LADEROUTE SE W5M AMENDMENT K. Beunder, Agent, was in attendance for the public hearing in connection to the proposed amendment to the Country Residential District land use rules to allow for the future subdivision of one new /- acre lot from Plan , Block 1; Ptn. SE W5M. The /- acre parcel is accessed by way of an existing approach off of 1096 th Drive West. A common 30 x 30 meter access right of way at this location is proposed to provide access to both the new lot and balance parcel. Public Works has recommended that due to future maintenance concerns the access right of way not be surveyed out of the title, but rather that a driveway be divided between the two new titles. Improvements include a residence and accessory building, located within the proposed new lot. The property contains steep topography, natural grasslands and a stand of mature poplars. The purpose of the application is to provide separate title for the child of the landowner. The agent requested that the requirement for submission of a Geotechnical report for slope stability to address foundation and driveway design be deferred to the Development Permit stage. The public hearing was closed. RAND AND MOUSSADJI - NW W5M SITE SPECIFIC AMENDMENT S. Rand was in attendance for the public hearing in connection to the proposed Site Specific Amendment to the Country Residential land use rules to allow for the outdoor parking and storage of one Medium Duty Commercial Recycling Truck on Plan , Block 1, Lot 3; Ptn. NW W5M. Also in attendance were B. Brueckner and J. Schmaus. The /- acre Country Residential District lot contains steep topography, groves of dense spruce and poplar and a small pond. An internal driveway is the only improvement on the property. The current operation is run through the home office located within the applicant s dwelling in Hawk s Landing, however, a restrictive covenant does not allow for the business related vehicle to be parked on site. The vehicle is described as a Medium Duty Commercial Recycling Truck that will be picked up in the morning and returned to the site at the end of the workday. A parking pad and prefabricated awning carport will be constructed on site and will be naturally screened by existing vegetation. S. Rand responded to letters submitted in opposition to the application, stating that the recycling business is operated from his current residence and not from the subject property. Only the truck associated with the business will be parked on site, and no recycling materials or garbage will be stored on the property. Any residual remnants found in the truck would be minimal and would not be an attractant to wildlife or pests. The location of the previous approach has been reclaimed and reseeded. Hours of operation will be adhered to in order to limit disturbance to area landowners. E. Brueckner spoke in opposition to the application. Letters of opposition were submitted from J. Thomson and E. Brueckner. The public hearing was closed. Moved that the application for a Site Specific Amendment of the Country Residential land use rules to allow for the outdoor parking and storage of one Medium Duty Commercial Recycling Truck on Plan , Block 1, Lot 3; Ptn. NW W5M be refused. In their consideration of the criteria noted within Policy 3 in the Residential Section of the MDP2010 Council is of the opinion that the application does not adequately address the intent of the Residential policy with respect to the cumulative effects of the development. LADEROUTE SE W5M AMENDMENT BYLAW 69/2017 Bylaw 69/2017 was introduced into the meeting to authorize an amendment to the Country Residential District land use rules to allow for the future subdivision of one new /- acre lot from Plan , Block 1; Ptn. SE W5M. In their consideration of the criteria noted in the Residential Section of the MDP2010, specifically with respect to directing additional Country Residential development to lands already zoned Country Residential, minimize the fragmentation and conversion of agriculture land, and efficiently use existing and new infrastructure, utility systems, and services; Council is of the opinion that further fragmentation of the subject lands would not be detrimental to the agricultural nature of the area or the uses of the neighbouring properties, and would functionally link with adjacent lands.

3 The /- acre balance parcel will be designated as Country Residential A District to ensure that all the recommendations and restrictions as outlined in slope stability testing for building envelope and driveway design, high water table testing for foundation and septic system design, and septic disposal evaluation, each provided as conditions of subdivision approval are complied with to the satisfaction of the Public Works Department, as conditions of the development permit. A completion certificate by a Professional Engineer verifying that all aspects of the noted reports have been met, and a $5,000 deposit as a pre-release condition to ensure compliance of all conditions of the development permit will be required. Prior to further consideration, the applicant will be required to submit the following: Proof of adequate water supply to be provided in accordance with the Provincial Water Act; Applicant to fully execute and comply with all requirements as outlined within a Development Agreement for the purposes of payment of the community sustainability fee and required municipal improvements to the satisfaction of MD Council and Public Works; The applicant to provide Slope Stability Testing in order to identify suitable building envelop for the 10 +/- acre balance parcel; The applicant to provide Slope Stability Testing for Foundation and Driveway designs, High Water Table Testing for Foundation and Septic System Design and Septic Disposal Evaluation to the satisfaction of the Public Works Department, as conditions of Subdivision Approval; Submission of a revised site plan demonstrating a common approach with a driveway that is shared between the two properties; Final redesignation lot fees to be submitted; Submission of an executed subdivision application and the necessary fees. Moved first reading THE BYLAW WAS PASSED FOR ONE READING LUNCH Moved that Council adjourn for lunch. ELECTION WORKERS FEES AND EXPENSES Moved that Council set the fee schedule for election workers during the 2017 Election as presented. RED DEER LAKE CHURCH 2017 ELECTION Moved that Council approve support in the amount of $250 to the Red Deer Lake Church for use of their facility during the 2017 Election. BILLS AND ACCOUNTS AUGUST 30, 2017 Moved that the following EFTs ; ; pre-authorized payments Aug 23 & 29; totaling $29, be approved for payment: EFT McAsphalt Industries Limited $79, Aug-17 AltaGas Ltd. $35, MINUTES AUGUST 30, 2017 Moved that Council adopt the minutes, as circulated, of its August 30, 2017 Council meeting. SHERBUT SE W5M REDESIGNATION S. Sherbut and agents R. Blabi and J. Karsten were in attendance for the public hearing in connection to the proposed redesignation of the /- acre parcel from Country Residential to Service District to allow for a boutique wedding facility, guest suites and a chapel to operate on Plan , Block 1; Ptn. SE W5M. Also in attendance were C. and C. Windsor, C. Fisher, L. Palmer, A. Burton, K. Ernst, S. and J. Leavens, T. Palmer, J. Wolfe, C. McLeod, E. Curzon and A. Alger. Access to the subject property is provided by way of an approach off of 242 nd Ave West and crosses a CP Rail line. The entrance is gated and the entire property is fenced. A Bed and Breakfast facility to accommodate no more than eight guests was approved in 1998 and a small chapel was later constructed to accommodate small weddings. The current application is to bring the chapel into compliance and expand the operation to allow for the construction and operation of a 4,700 sq. ft. event facility, three to five guest cabins and the existing chapel. The chapel and event facility will accommodate up to 150 guests and will operate primarily on the weekends, with approximately 75 cars attending the property during each event. S. Sherbut submitted that the existing chapel was constructed utilizing infrastructure that was existing on the property. The chapel provides a venue for small weddings,

4 the proposed building will be used as an event barn to accommodate receptions and small group events, and the guest cabins will provide bed and breakfast accommodations. Noise will be mitigated by limiting activities after 11:00 p.m., prohibiting use of motorize ATVs, and not allowing parties such as stags or bachelorettes. The cabins may be placed further north on the property to mitigate disturbances. No open fire pits will be permitted, and the grounds are well groomed to reduce risk of wild fire. The development will not have a negative effect on surrounding property values. The property is securely fenced and while groomed trails existing through the treed portion of the property, they are rarely used. Agent R. Blabi submitted a site plan depicting existing and proposed improvements to the site, and presented information demonstrating that the noise levels detectable from the site will not create a disturbance to area neighbours. Discussions with CP Rail indicated that the number of expected vehicle trips are not significant enough to consider alterations to the crossing. Water and wastewater will be trucked in and out. J. Wolfe, K. Earnst, J. Leavens, T. Palmer and C. Windsor spoke in opposition to the application, citing traffic safety concerns pertaining to both the adjacent railroad tracks, use of alcohol at events and condition of surrounding roads, availability of water and the health of the aquifer, the size and frequency of events and increased noise disturbances, fire hazards, and security as reasons for concern. Letters of opposition to the application were submitted by J. Danforth, L. and T. Palmer, L. and S. Brandon, R. and D. Poffenroth, J. Wolfe and J. Genereux, K. Ernst, J. and S. Leavens, D. and A. Burton, M. Holcroft, T. and C. Fisher, G. and L. Ketler One letter of support was received from D. and P. Fream. The public hearing was closed. BYLAW 70/2017 Bylaw 70/2017 was introduced into the meeting to authorize the redesignation of the /- acre parcel from Country Residential District to Direct Control District to allow for the use of an existing chapel for small wedding events on Plan , Block 1; Ptn. SE W5M. Prior to further consideration the following will be required: Approval by Council of the draft Direct Control District to allow for the event facility as a discretionary use; Final Fees; Development Permit Application and Applicable Application Fees. Moved first reading THE BYLAW WAS PASSED FOR ONE READING DOVELL SE W4M WAIVE 6 MONTH APPLICATION REQUIREMENT Moved that Council approve the request received from the landowner to waive the six month waiting period required before making application for recently refused development on Plan , Block 2, Lot 17; Ptn. SE W4M ALBERTA LTD. - SW W5M CONSIDERATION OF ENTRY FEATURES AND LANDSCAPING PLANS Moved that Council approve the entry features and proposed landscaping of the culde-sacs and park space within the road rights of way within parcels identified as SW W5M; and Plan , Lot 1; Plan , Block 3, Lot 12 MR; and Plan , Block 4, Lot 16MR, all within SW W5M, as presented. RECESS Moved that Council recess to sit as the Subdivision Approving Authority. BERTRAND NW W4M REQUEST FOR SUBDIVISION Moved that the subdivision of one new 3.9 +/- acre lot from Plan , Lot 1; Ptn. NW W4M has been evaluated in terms of Section 654 of the Municipal Government Act and Section 7 of the Subdivision and Development Regulation and therefore it is recommended that the application be approved as per the tentative plan for the following reasons: The application is consistent with Section 7 of the Subdivision and Development Regulations; The subject land has the appropriate land use designation. Further, in accordance with Sections 654 and 655 of the Municipal Government Act, the application be approved subject to the following conditions: Subdivision to be effected by Plan of Survey, pursuant to Section 657 of the Municipal Government Act, or such other means satisfactory to the Registrar of the South Alberta Land Titles District;

5 It is the applicant s responsibility to provide a Real Property Report or an as built drawing signed and sealed by an Alberta Land Surveyor, certifying the location of the adjacent municipal road(s), water well(s) within the boundaries of the appropriate properties and that the site plan is surveyed according to municipal setback requirements; Completion of all pre-release conditions as noted in the executed Municipal Development Agreement to the satisfaction of the Municipality. These conditions include: Payment of the Community Sustainability Fee; All accesses to be located and culverts and approaches to be installed to current Municipal subdivision road standards to the satisfaction of the Public Works Department; Landowners are to provide all utility easements and agreements to the satisfaction of the Municipality and the utility companies; Landowners are to pay all arrears of taxes on the existing parcel prior to finalization of the subdivision; Public Reserve: to be provided by way of cash in lieu of land based on $37, per acre on account of 10% of the subject parcel; Submission of final subdivision fees. BELL/KAYDAR ENTERPRISES INC. SW W4M REQUEST FOR BOUNDARY ADJUSTMENT Moved that the Boundary Adjustment whereby /- acres from Plan , Block A, Lot 2; Ptn. SW W4M be consolidated into Plan , Block A, Lot 1; Ptn. SW W4M, resulting in one /- acre Agricultural District lot (Plan , Block A, Lot 2) and one /- acre Agricultural lot (Plan , Block A, Lot 1) has been evaluated in terms of Section 654 of the Municipal Government Act and Section 7 of the Subdivision and Development Regulation and therefore it is recommended that the application be approved as per the tentative plan for the following reasons: The application is consistent with Section 7 of the Subdivision and Development Regulations; The subject land has the appropriate land use designation. Further, in accordance with Sections 654 and 655 of the Municipal Government Act, the application be approved subject to the following conditions: Subdivision for the purposes of a Boundary Adjustment to be effected by Plan of Survey, pursuant to Section 657 of the Municipal Government Act, or such other means satisfactory to the Registrar of the South Alberta Land Titles District; All accesses to be located and culverts and approaches to be installed to current Municipal subdivision road standards to the satisfaction of the Public Works Department; Landowners are to provide all utility easements and agreements to the satisfaction of the Municipality and the utility companies; Landowners are to pay all arrears of taxes on the existing parcels prior to finalization of the subdivision; Public Reserve: In accordance with Section 663(b) of the Municipal Government Act, public reserve dedication may not be required on lands to be subdivided into lots of 16.0 hectares or more in size and are to be used only for agricultural purposes; It is the applicant s responsibility to provide a Real Property Report or an as built drawing signed and sealed by an Alberta Land Surveyor, certifying the location of the adjacent municipal road(s) and water wells within the boundaries of the appropriate parcel and that the site plan is surveyed according to municipal setback requirements; Submission of final subdivision fees; EDWARDS SW W4M REQUEST FOR SUBDIVISION Moved that the subdivision of two new /- and /- acre Country Residential parcels from SW W4M Plan , Block 10, Lot 1; Ptn. SW W4M be refused. In consideration of Strategies 4.4 and 4.5 of the South Saskatchewan Regional Plan, Council is of the opinion that the proposal does not support reasonable or exemplary protection provisions for wetlands and riparian lands. Council is further of the opinion that the proposal does not adequately address the criteria as provided in Section 7 of the Subdivision and Development Regulations nor does it provide appropriate access to a road as further provided within Section 9 of the Regulations.

6 In consideration of the criteria noted within Policy 3 in the Residential Section of the MDP2010, Council is of the opinion that the application does not adequately address the intent of the Residential policy with respect to the environmental impact, the suitability of the land for residential uses and the cumulative effects of the development. Further, in consideration of Policies 1, 3.8 and 11 of the Residential Section and Policy 2 of the Transportation Section of the MDP2010, the proposal does not demonstrate an appropriate access management strategy which meets current Municipal standards, nor does it functionally link the proposal to the adjoining lands. Additionally, Council is of the opinion that the application does not adequately address Objectives 1, 6, 7 and 11 of the Environmental Conservation and Open Space Section with specific regards to the suitability of the lands for development and the impacts of the development on wetlands and water courses within the Plan area. In consideration of the requirements of Section 9.1 Access to Property within the Municipalities Land Use Bylaw, Council is of the opinion that an appropriate access management strategy has not been provided to the satisfaction of Municipal policy. In consideration of Section 633 of the Municipal Government Act, Policy 7.2 of the Implementation, Review and Amendment Section, Policy 4.0 (a) and (b) of the Land Use Strategy section and Policy 4.2 of the Agricultural Land Use Policy section, all of the Deer Creek Area Structure Plan, the proposed subdivision is not contemplated within the Plan Area of the ASP and the proposal does not have the appropriate amendment in place to allow for the additional development. Further, in consideration of Policy 4.3 of the Country Residential Land Use section of the Deer Creek Area Structure Plan, the balance lot would exceed the maximum lot size as set out in the Area Structure Plan. Additionally, in consideration of Policy 4.3(d) of the Country Residential Land Use section and Policy of the Internal Road Network section of the Deer Creek Area Structure Plan, Council is of the opinion that the proposal does not demonstrate an appropriate access management strategy which meets current Municipal standards. KEINTZ FARM SE W5M REQUEST FOR TIME EXTENSION Moved that Council has no objection to the time extension as requested and the landowners therefore have until September 28, 2018 to comply with all conditions of subdivision approval as originally set forth on September 28, PIDGEON N W5M REQUEST FOR BOUNDARY ADJUSTMENT Moved that the Boundary Adjustment whereby /- acres from Plan , Block 4, Lot 2; Ptn. N W5M be consolidated into Plan , Block A; Ptn. N W5M, resulting in one /- acre lot (Plan , Block 4, Lot 2) and one /- acre lot (Plan , Block A) has been evaluated in terms of Section 654 of the Municipal Government Act and Section 7 of the Subdivision and Development Regulation and therefore it is recommended that the application be approved as per the tentative plan for the following reasons: The application is consistent with Section 7 of the Subdivision and Development Regulations; The subject land has the appropriate land use designation. Further, in accordance with Sections 654 and 655 of the Municipal Government Act, the application be approved subject to the following conditions: Boundary adjustment and consolidation to be effected by Plan of Survey, pursuant to Section 657 of the Municipal Government Act, or such other means satisfactory to the Registrar of the South Alberta Land Titles District; It is the applicant s responsibility to provide a Real Property Report or an as built drawing signed and sealed by an Alberta Land Surveyor, certifying the location of the water wells and the adjacent municipal road(s) within the boundaries of the adjusted parcels and that the site plan is surveyed according to municipal setback requirements; All accesses to be located and culverts and approaches to be installed to the satisfaction of the municipality s public works department; Landowners are to provide all utility easements and agreements to the satisfaction of the MD and the utility companies;

7 Landowners are to pay all arrears of taxes on the existing parcels prior to finalization of the subdivision; Landowners are to pay final subdivision lot fees; ADJOURN Moved that the meeting of the Subdivision Approving Authority adjourn and that Council continue with its regular agenda FOOTHILLS COUNTRY HOSPICE VEGAS NIGHTS GALA Moved that Council acknowledge the request received from the Foothills Country Hospice to provide support to their Vegas Nights Gala scheduled for October 28, COUNTY OF STETTLER NO. 6 REQUEST FOR SUPPORT Moved that Council acknowledge the letter received from the County of Stettler No. 6 and issue a letter of support to their position regarding required action by the Provincial Government to the long outstanding issue of uncollectable School Tax Requisitions and Seniors Housing Requisitions. GAS TAX FUND (GTF) FUNDED PROJECT Moved that Council acknowledge the letter received from the Honorable Shaye Anderson, Minister of Municipal Affairs, announcing approval of qualified funding under the Provincial Gas Tax Fund (GTF) for the M.D. of Foothills Project # Water Supply Upgrade. MSI CAPITAL FUNDING PROJECTS Moved that Council acknowledge the letters received from the Honorable Shaye Anderson, Minister of Municipal Affairs, announcing funding of Municipal projects including Grader Purchase, Public Works Equipment Purchases and Paving Program under the Provincial MSI Capital Funding Projects program. COMMUNAL VS. INDIVIDUAL WATER SERVICING Moved that Council table their discussions regarding Communal vs. Individual Water Servicing and authorize administration to request further investigation into Communal vs. Individual Waste Water servicing for concurrent review. DIABETES CANADA CLOTHESLINE BINS PRIDDIS Moved that Council deny the request to place Clothesline Bins at the Hamlet of Priddis post office box site, and work with Diabetes Canada to determine a suitable location for the bins. ROTHNEY ASTROPHYSICAL OBSERVATORY OPEN HOUSE Moved that Council approve support in the amount of $600 to the Rothney Astrophysical Observatory Open House scheduled for September 15, Administration will make application for this funding through FCSS. IN CAMERA Moved that Council go In Camera at 4:04 p.m. to discuss personnel issues. OUT OF CAMERA Moved that Council go Out of Camera at 4:39 p.m. ADJOURN Moved that Council adjourn at 4:39 p.m.
