ADOPTION OF MINUTES: Minutes of a Regular Council meeting held in the Council Chamber on Monday, December 17th, 1979, at 7:OO p.m. All the members of Council were present together with the Municipal Manager, the Assistant to the Manager, and the Municipal C1 erk. 1. In connection with the minutes of the Regular Council meeting of December loth, Alderman Bose stated that he had not seconded the motion on page 16 under Resolution X-454 dealing with the Indemnities By-law, as he is shown as opposed to the motion for third reading. The Mayor stated that this evening the Council wishes to recognize the former Mayors and Aldermen who had served on the Surrey Council during the last twenty-five years, which years are part of the Centennial years of Surrey which extend from 1879 to He stated that a Centennial plaque would be presented to each of those that were present and he was going to have the presentations made by the various members of Council.

Patterson, Councillor: and Alderman: Dr. John O-Brien-Bell, Alderman: He was to present a plaque to: Mr. T. G. Pearce, Councillor: S8 but Mr. Pearce was not present. 4. Dr. O'Brien-Bell then stated he had been asked by the Mayor to speak on behalf of all those who had received the plaques this evening. He stated he wished to extend thanks to the Council for these presentations and recognition of their service on the Council during the first Centennial years of Surrey. He also paid tribute to the Manager and the staff of the Surrey Municipality, stating that Surrey has the best senior staff in B.C., and even possibly in Canada, and they are responsible for advising Council in regard to their deliberations when they are governing the Municipality. He stated that all the persons appreciated receiving the plaques and the recognition granted them on this occasion. The Mayor thanked those that had come for the presentation this evening, despite the very inclement weather due to the heavy rainfall. He stated one or two had been missed who had been brought II

5 to his attention by Alderman Fomich and they will be recognized at the Volunteer Dinner next year. They had gone back twenty-five years on the recognition but there are some who had served prior to the twenty-five-year deadline who had been missed and would now be recognized. RES. NO. X-497 then Moved by Alderman Watkins Seconded by A1 derman Fomi ch That the Council meeting do now adjourn for a Public Hearing on several By-laws. The meeting adjourned at 7:40 p.m. and reconvened at 7:55 p.m. 2. Mr. Nizarali Sayani of 911 Fairway Drive, North Vancouver, had been advised of a proposed resolution under Section 873 concerning a fire damaged building at th Avenue. No one appeared in this regard. RES.NO.X-498 Moved by A1 derman Fomi ch Seconded by A1 derman Schrenk That the Council of The Corporation of the District of Surrey hereby declares that the fire damaged building located on Lot One (1) Block Six (6) of the East Half (E 1/2) of Section Twenty-three (23) Block Five (5) North Range Two (2) West P1 an Twenty Thousand Four Hundred Seventy-seven (20477) New Westminster District being Avenue, Surrey, is in so dilapidated and uncleanly a condition as to be offensive to the community. It is hereby ordered that the said fire damaged building be demolished, foundation removed or filled in with clean granular material if necessary, and all debris removed from the site by the owners or agent of the owners within thirty (30) days of service of this order upon them. It is further ordered that should the owners or agent of the owners fail to comply with the aforesaid order within the said period of thirty (30) days, the Engineering Department by their own workmen or contractors, may be instructed to enter on the land and demolish the fire damaged building and remove the debris from the site at the expense of the owner and the charges for so doing, if unpaid by the owner on the 31st day of December of any year, shall be added to and form part of the taxes payable in respect of that land as taxes in arrears. 3. D.S.W.Developments Ltd., c/o Wolstencroft Agencies Ltd., of 317 Columbia Street, New Westminster, B.C., had been advised of the proposed resolution under Section 873 concerning the dilapidated and fire damaged dwelling at King George Highway. The Clerk reported that he had been advised by the Permits and License Department that this site had been cleaned up satisfactorily and no resolution was required.

6 4. Cosmo Zavaglia of th Street had been advised of a proposed resolution under Section 873 concerning a dilapidated dwelling at th Street. No one appeared in this regard. - RES. NO. X-499 Moved by A1 derman Fomi ch Seconded by Alderman Schrenk That the Council of The Corporation of the District of Surrey hereby declares that the dilapidated dwelling located on Lot Forty-Nine (49), Block Twenty-Two (22), Section Nine (9), Block Five (5) North, Range Two (2) West, Plan Twenty-Six Thousand Six Hundred One (26601), New Westminster District being Street, Surrey is in so dilapidated and uncleanly a condition as to be offensive to the community. It is hereby ordered that the said dilapidated dwelling be demolished, foundation removed or filled in with clean granular material if necessary, and all debris removed from the site by the owners or agent of the owners within thirty (30) days of service of this order upon them. Moved by A1 derman Fomi ch Seconded by Alderman Schrenk That the Council of The Corporation of the District of Surrey hereby declares that the dilapidated dwelling, shed, garage and lean-to located on Lot Four (4), Blocks Ten (10) and Eleven (11) of the North West Quarter (NW 1/4) of the South East Quarter (SE 1/4) of Section Thirty-three (33), Township Eight (8), P1 an Nineteen Thousand Seven Hundred Twenty-eight (19728) New Westminster District being Street, Surrey, B.C. are in so dilapidated and uncleanly a condition as to be offensive to the community. It is hereby ordered that the said dilapidated buildings be demolished, foundation removed or filled in with clean granular material if necessary, and all debris removed from the site by the owners or agent of the owners within thirty (30) days of service of this order upon them. Alderman McKitka said he would like to have a delegation heard from the Mud Bay Dyking Commission, to hear them in regard to a problem in their area. Dyking Commission be heard. Moved by A1 derman McKi tka Seconded by A1 derman Schrenk That the delegation from the Mud Bay Mr. Gil Van Keulen of th Avenue stated he was speaking on behalf of the Dyking Commission and he submitted a letter from the Chairman of the Mud Bay Dying Commission to Council for their infornation. They were requesting Council to approve of a paving of a short portion of 40th Avenue in the Mud Bay Dyking District. They stated that this portion of road is always in poor condition, as in the summertime it is a washboard and in the wintertime it is full of potholes and mud. They stated the present paving on 40th Avenue ends at 140th Street. They are requesting that the road allowance extending for one-quarter mile west from this point which follows the bend of the Nicomekl River be paved. He stated that thirty residents use the road and it serves an agricultural area. It has an adverse effect on the farm industry because of the condition of the road, particularly in wintertime. Mr. Kitzel, Chairman, stated that his house shakes continually as cars and trucks proceed over the road. The matter was dealt with later in the meeting. C. REPORTS OF VARIOUS COMMITTEES 1. PLANNING COMMITTEE: RES. NO. X-502 (a) Moved by A1 derman Schrenk Seconded by A1 derman Jacobs That the minutes of the meeting of December 11th be received. The recomnendations of these minutes were considered and dealt with as follows: 7.

8 RES. NO. X The Planning Committee dealt with an application from Sur-Del Builders Development Ltd., being Application 78-RZ-86(A), which deals with their plans for the second phase of Land Use Contract No. 572 which calls for a 37 unit compact housing project at 96th Avenue and 156th Street under a Development Agreement. Moved by A1 derman Schrenk Seconded by A1 derman Watki ns That the Development Agreement under Land Use Contract No. 572 be proceeded with and the Mayor and Clerk be authorized to execute the Development Agreement on completion. with Alderman Fomich against The Committee had dealt with an application from Springfield Development Corporation, being Appplication 79-RZ-135, which is a proposed 22 lot single family subdivision at the north west corner of 60th Avenue and 171A Street. The Committee Is recommendat ion was approved by Counci 1 as f 01 1 ows : Moved by A1 derman Wat k i ns Seconded by A1 derman Jacobs That Appl i cati on 79-RZ-135 be approved to proceed under Section 702 of the Municipal Act, subject to: I (a) meeting all the requirements of the Municipal Engineer; (b) providing a subdivision design to the satisfaction of the Municipal Planner; RES. NO. X-504 (c) dedication of five per cent of land for a tot lot; and (d) payment of development cost charges at subdivision stage. Such approval to be valid for six months from this date. with Alderman Bose against. Alderman Schrenk stated that she was also opposed to this type of development as we are getting a dedication of the five per cent of land for a tot lot but we cannot require the developer now to build it and the result is subdivisions will be ending up with an unkept tot lot in the middle of their subdivisions. The maintenance of these tot lots is now to be the responsibility of the Municipality and it costs between $5, and $7, per year to maintain them. 8.

9 3. The Committee had dealt with Application 79-RZ-138, which is a request for R-2 zoning for property on the south side of 64th Avenue and west of 132nd Street. The Committee had also dealt with Application 79-RZ-140, which is an application for R-2 zoning to allow 18 single family lot subdivision at th Avenue. The Committee had also dealt with Application 79-RZ-143, which is an application for R-2 zoning of property at th Avenue. The Committee had also dealt with Application 79-RZ-153, which is an application for R-2 zoning for a 30 lot single family subdivision in the South Newton area. The Committee had also dealt with Application 79-RZ-163, which is an application for R-2 zoning for an urban lot subdivision at th Avenue. All these applications were the subject of one recomnendation from the Planning Committee which was dealt with as follows: Moved by Alderman Schrenk Seconded by Alderman Watkins That the area in the south west quadrant which is contained within the Urban Growth Area boundary in the South Newton area, be rezoned to R-2 subject to: (a) the Official Regional Plan amendment; (b) the Planning Department preparing a control plan for this area; (c) that the properties inside the Urban Growth Area boundary contained in these five applications be approved for rezoning; and (d) that the properties outside the Urban Growth Area boundary contained in these applications remain as they are presently zoned. RES. NO. X-505 With the approval on the applications approved to be for a six months period. with Aldermen Bose and Campbell against. 4. The Committee had dealt with Application 79-RZ-159, which is an application for R-3 zoning to permit a 24 lot subdivision on the west side of 176th Street in the block.

X-506 The Committee recomnendation was dealt with as follows: Moved by Alderman Schrenk Seconded by A1 derman Fomi ch That Application 79-RZ-159 be approved to proceed for R-3 zoning under Section 702 of the Municipal Act subject to: (a) meeting all the requirements of the Municipal Engineer; (b) providing a subdivision plan to the satisfaction of the Municipal P? anner; (c) approval of the Ministry of Highways; (d) dedication of five per cent of land for a tot lot; and (e) payment of development cost charges at the subdivision stage. Such approval to be valid for six months from this date. with Alderman McKitka against. Alderman McKitka spoke against the retention/detention drainage system being employed by the Municipality. He stated the funds for this type of system should be spent on a storm sewer system. He stated that retention/detention system will become very expensive to the Municipality over the years to maintain. 5. The Committee had dealt with Appplication 79-RZ-161, which is an application to permit C4A zoning of an existing service station at 88th Avenue and King George Highway to allow the service station to go self-serve. The Committee recommendation was dealt with as follows: Moved by A1 derman Schrenk Seconded by A1 derman Jacobs That Application 79-RZ-161 be approved to proceed under Section 702 of the Municipal Act subject to: (a) approval of the Ministry of Highways;. Ip (b) submission of a site plan, building plan and landscaping plan to the satisfaction of the Planner; and RES. NO. X-507 (c) payment of development cost charges, if applicable, at the building permit stage. Such approval to be valid for six months from this date. I 10.

The Committee had dealt with Application 79-RZ-166, which is a proposed single family subdivision of 41 lots and a multiple housing project of 45 apartments and 42 townhouse units on the south side of 100th Avenue in the block. This would be a density of 15 units per acre. The zoning would be to R-2 and RM-2. The Committee recommendations were dealt with as follows: RES. NO. X- 508 (a) Moved by A1 derman Schrenk Seconded by Alderman Buckley That Application 79-RZ-166 be tabled to the next Planning Committee meeting and that a report be brought forward to the Planning Committee members on how the Municipality can effectively control recreational standards and designs. X -509 (b) Moved by Alderman Schrenk Seconded by A1 derman Buckl ey That the Chairman of the Planning Committee and the Municipal Planner approach the Administration to ascertain the most expedient way of adopting the proposed Residential By-laws. mm 7. The Committee had dealt with Application 79-RZ-147, which is a submission by Dayhu Investments Ltd. dealing with a proposed major development project including high rise apartments, offices, service comnercial, and restaurants at the south east corner of 80th Avenue and Scott Road. They were requesting CD Comprehensive development zoning of this area. The Committee recommendation was dealt with as follows: RES. NO. X-5 10 Moved by A1 derman Schrenk Seconded by A1 derman Buckl ey That the developer be informed that Application 79-RZ-147 is an ideal project and the Municipality approve of that use of the land but does not intend to rezone it until there is more development on the adjacent land or until Phase I is sufficient to justify an extension. 8. The Committee had dealt with a letter from Mr. and Mrs. W. Munroe of th Street whereby they wished to subdivide their property into two lots, each of which would be 50 x 100 feet in size. The Committee recommendation was dealt with as follows: 11.

X-5 11 Moved by A1 derman Schrenk Seconded by A1 derman Campbell That Mr. and Mrs. Munroe be advised - that there is no legal mechanism at Council's disposal to relax the Subdivision By-law to the extent required to implement this request. 9. The Committee had dealt with a letter from Mr. J. Klaizner of th Avenue, who was requesting that his property be subdivided into two duplex lots. 12. R ES. NO. X RES. NO. X-5 13 RES. NO. X-514 R ES. NO. X-5 15 (a) Moved by A1 derman Schrenk Seconded by Alderman Buckley That Mr. J. Klaizner of th Avenue be informed to make an application for subdivision under the Subdivision By-law and his request will be at the discretion of the Approving Off i cer. with Aldermen Bose and Fomich agai nst. (b) Moved by A1 derman Schrenk Seconded by A1 derman Wat k i ns That the Municipal Planner bring in a recomnendation on how to amend the By-laws to resolve - this problem. with Aldermen Bose and Fomich against. 10. The Committee had dealt with letters from the Newton Community Ratepayers' Association dealing with planning in their area and also the letter that had been written by the Panorama Ridge Ratepayers' Planning Committee dealing with urban zoning south of 64th Avenue. (a) Moved by A1 derman Schrenk Seconded by Alderman Campbell That the Secretary of the Newton Ratepayers' Associ ati on be thanked for her letter and advised that Council has not made any appointment to that Committee. Carr i ed (b) That the letter from the Newton Ratepayers' Association be received and forwarded on to the Panorama Ridge Planning Committee for their information. 11. The Committee had dealt with a lengthy report from the Planner dealing with the delegation in July of this year which had requested that their area, bounded by 84th Avenue, 88th Avenue and 140th Street and 144th Street, be considered for industrial development. I

13 A petition had been submitted at that time indicating approval of the property owners for industrial zoning. The Committee recommendation was dealt with as follows: RES.NO.X-516 Moved by A1 derman Schrenk Seconded by A1 derman Wat k i ns That the proposal presented in the report of the Director of Planning be presented to the residents who made the submission to the Planning Committee, for discussion, and following that presentation the residents who made the proposal should call a public information meeting with the surrounding residents to discuss this plan. with Aldermen Jacobs, Fomich and McKitka against. w RES. NO. X-517 RES. NO. X The Committee had dealt with a report from the Deputy Planner dealing with the Cloverdale Local Area Planning Committee. The Deputy Planner had requested that this Committee be extended through to December 1980 and that there be no change in membership. Moved by Alderman Schrenk Seconded by Alderman Watkins That the present Cloverdale Local Area Planning Committee be continued until June 30th, then Moved by A1 derman Schrenk Seconded by A1 derman Campbell That Alderman Bose be Council representative on the Cloverdale Local Area Planning Committee. 13. The Planning Committee had received a report from the Director of Planning on the approval procedure for neighbourhood pub applications. The Committee had approved of this procedure. "'Approval Procedure for Neighbourhood Pub Applications': The following is a step by step process for the approval of a Neighbourhood Public House: 1. The proponent will first approach the Municipality through the Planning Department, to establish whether or not the property is suitably zoned or could be rezoned for a neighbourhood pub. This enquiry shall be in written form. 13.

14 2. The Planning Department will report to the Planning Committee indicating whether or not the site is - suitable for a neighbourhood pub. Council, by resolution, will either give the application "Approval in principle" or reject it. 3. On approval by Council, the Planning Department shall issue a letter of "pre-clearance" to the applicant so that he may then approach the Liquor Control Branch. (a) If rejected by Council, a letter of rejection shall be sent by the Planning Department. 4. The proponent shall apply to the Liquor Control Branch at: Liquor Control and Licensing Branch # Willingdon Avenue Burnaby, B.C. V5C 5T1 for preliminary approval. The letter from the Municipality shall be accompanied by a certificate of ownership, or a lease or option to purchase the property involved. This preliminary approval will be either granted or refused by the General Manager. (a) If preliminary approval by the General Manager is received, the applicant will be required to make a survey of the adjoining neighbours The survey is to be made by an independent surveyor and a copy sent to the Liquor Control and Licensing Branch, the Applicant, and the Surrey Planning Department. The survey will then be presented to Council, so that Council can determine if the application will proceed to the By-law stage. If Council does not approve the application, a Rezoning By-law will not be introduced if rezoning is required. 6. Should the property require rezoning, an application shall now be made to the Municipality for rezoning. 7. The Planning Department will introduce a Zoning By-law to Council. 8. Following Public Hearing, if considered acceptable, Council will grant final approval to the Zoning By-law. 9. The Municipality will then advise the Liquor Control Board that the rezoning has had final approval. 14.

A letter will be received by the Municipality from the General Manager of the Liquor Control and Licensing Branch if he gives his approval subsequent to the receipt of the survey result and rezoning approval." X-519 Moved by A1 derman Schrenk Seconded by Alderman Watkins That the above information sheet dealing with Approval Procedure for a Neighbourhood Public House be approved for distribution to the public. 14. NO.X-527 A letter from the Fraser Valley Regional Library Board was received dealing with the grant they had received from the Community Recreation Facilities Fund in regard to their new headquarters building. The Board proposes to establish a reserve fund to be used to finance the purchase of 25 per cent of the new books needed for expanding Branch Libraries in any one year. This would have the effect of spreading the tax reduction over several years by spending a part of it each year, as needed, to buy books for the expanding Branch Libraries. The Board was asking whether or not the Council wished to receive the full tax reduction for 1980 or approve of the establishment of a reserve fund as indicated above. Surrey's share of this recreation grant in one sum would be $45,151.OO. E. MAYOR'S REPORT: The Mayor reported that the Lower Mainland area has suffered from very heavy rains over the last few days. He referred to the report that had been received from the Municipal Engineer under today's date in this regard. He stated that some areas are suffering flooding and some roads are cl osed. The report indicated that crews were called out shortly after 2:30 a.m., on the morning of December 17th, in response to flooding calls. By 8:OO a.m. over 210 employees and some 100 vehicles were responding to a deluge of calls. At noon, over 600 calls had been received by the Engineering Department. Basement flooding and plugged culverts were most in evidence. W Three-and-a-half inches of rain fell overnight, with three-quarters of an inch coming between 8:30 a.m. and noon. The precipitation is in excess of the five-year return storm. 17.

18 The report indicated that several roads were closed, due to flooding, and severe erosion had occurred at various locations. A map of the flooding and erosion areas was shown for the information of the Council. The Mayor stated that the crews will be working around the clock to try to cope with the situation. He pointed out that the system is designed for a one-in-five-year storm and this is severe enough to be at least a one- i n-ten-year storm. Alderman McKitka stated that he had received many calls and sandbags had been provided to residents to help combat the flooding situation and he stated that many basements were flooded. - Alderman Watkins pointed out that we should be using the Provincial Emergency Program Funds to get pumps and bags, to have on hand for such emergencies. The Engineer stated he has written to the City of White Rock, asking if they are budgeting any funds for improvements to this intersection in 1980 so that the entire intersection can be done at one time. If they do not have any funds, the construction will be terminated at the centre of 16th Avenue. The cost of work on the White Rock side is estimated to be $19,

The Manager submitted a lengthy report from the Engineer, dealing with the interchange at 192nd Street and No. 1 Highway. Former Mayor Vogel had evidently requested an interchange be constructed at this intersection and a letter from the Minister of Highways has now been received in this regard. m The Engineer stated that the Minister was reluctant to have an interchange at 192nd Street due to its close proximity to the 200th Street interchange in Langley. The Municipal Engineer feels that we should consider directional ramps at 192nd Street. The Minister had also stated that the construction of an interchange at 192nd Street would not be sufficient by itself, but extending the North Perimeter Road into Port Kells area and constructing the 96th Avenue overpass off Highway No. 1 would also be considered. The Engineer stated that they are presently participating in a joint study of the "Surrey Major Road Network" with staff of the Transportation Planning Branch to identify future road needs. The Minister had also asked to know what roadworks the Municipality has intended to provide access into Port Kells. The Engineer advised that the following roadworks had been completed to serve the industrial area of Port Kells, namely: - a structural overlay of 192nd Street and Harvey Road from Harvey Road overpass to 96th Avenue; - 192nd Street had been widened to four travel lanes north of 96th Avenue, and - 96th Avenue had been given a structural overlay east of 192nd Street. 26.

27 Engineering is also proposing two-lane reconstruction of 96th Avenue from 182nd Street to 192nd Street, in The Engineer stated that he intended to establish a future roadwork network, a fiscal plan in support of a recornended road construction program and ensure protection of needed right-of-ways. He strongly recomnended that the Minister be requested to have his Planning staff study the traffic impact of the Port Kells industrial area to determine the demand for directional ramps at 192nd Street. The Engineer also recommended that prior to completion of this traffic impact study, the Ministry of Highways be requested to protect the availability of the right-of-way required to construct these directional ramps. X-564 Item 9881 The Manager submitted his report to Council dealing with the Crescent Beach Comfort Station, with particular reference to a letter received from the Crescent Beach Property Owners' Assocation under date of December 3rd. He also submitted a report from the Parks and Recreation Administrator giving his comments on their letter of December 3rd, for the information of Countil. The Manager commented on each of the items in the letter from the Crescent Beach Property Owners' Association and stated as f 011 ows: The location of the building has been set to best reflect the improvements carried out to Beecher Street to open up a vista towards the sea, and to provide access to the building from the direction of the highest use. It would be hazardous to have parking between the building and the beach front. He stated that the balance of the lot between the facility and the adjacent house to be a park-like setting has been taken care of He stated that the choice of materials should be left to the Architect. The proposed second floor of the building is commensurate with the existing profile of the buildings along the street, and would provide an excellent location for a Senior Citizens facility. The Lifeguard Station is a request from the Parks and Recreation Department, and would best be left to them. The R.C.M.P. constable. office will be made to accommodate an office for one 5.
