Monday, May 4, 1987 Time: 7:15 p.m. Present: Mayor Ross, Alderman Schrenk, Alderman Watkins, Alderman Higginbotham, Alderman McKinnon, Alderman Huot, Alderman Easton, and Alderman Fomich. Absent: Alderman Kerr. Staff Present: Municipal Manager, Municipal Clerk, Assistant to the Manager, and Deputy Clerk A. ADOPTION OF MINUTES: 1. Regular Council - April 27, 1987 Alderman Higginbotham indicated that Resolution H-852 should be corrected to include reference to White Rock. RES.NO.H-856 Seconded by Alderman Schrenk That the minutes of the Regular Council meeting of April 27, 1987, be adopted as corrected. Alderman Watkins entered the meeting at 7:16 p.m. 2. Council-in-Committee - April 27, 1987 RES.NO.H-857 (a) Moved by Alderman Fomich Seconded by Alderman Huot That the minutes of the Council-in-Committee meeting of April 27, 1987, be received.

2 (b) That the recommendations of these minutes be adopted, except for the recommendations under items C58 and C61. Item C58 The recommendation under item C58 was adopted by Council on April 27, Item C61 M3S.NO.H-858 Moved by Alderman Schrenk That consideration of this item be tabled pending receipt of a report on the delegation to Council-in-Cornmittee. Car r i e d B. DELEGATIONS : 1. Tom Saunders Mr. Saunders was present regarding his retirement from the Municipality effective May 1, 1987, after 38 years of service. Mr. Saunders was presented with a certificate and thanked by the Council members. C. REPORTS OF VARIOUS COMMITTEES: 1. Planning Committee - April 28, 1987, 1987 RES.NO.H-859 (a) Seconded by Alderman Easton That the minutes of the Planning Committee meeting of April 28, 1987, be received. Alderman Fomich left the meeting at 7:20 p.m. Mayor Ross then recognized a delegation from the Lower Fraser Valley Exhibition Association. Mr. W. Senger presented Council with a poster for the 1987 Cloverdale Rodeo which will be held on May 16, 17 and 18,

3 (b) The recommendations of these minutes were considered and dealt with as follows: (1) Fleetwood Development Corp /15450/15470 Fraser Highway Rezoning from I-S and R-F to C-D To Permit Construction of a Commercial Store, A Convenience Store, and a Self-serve Gas Bar The applicant was requesting rezoning from Service Industrial Zone (I-S) and Family Residential Zone (R-F) to Comprehensive Development Zone (C-D) of a 0.33 hectare (0.82 acre) property located at the northwest corner of 88 Avenue and Fraser Highway in Fleetwood to permit the construction of a commercial store, a convenience store and a self-serve gas bar. Alderman Fomich returned to the meeting at 7:13 p.m. The Planning Committee recommended that Application be approved to proceed. Moved by Alderman McKinnon That Application or rezoning from "Service Industrial Zone (I-S)" and "Family Residential Zone (R-F)" to "Comprehensive Development Zone (C-D)" be denied. with Alderman Huot against. (2) Pacific Star Property Group Ltd A Avenue Rezoning from R-F to RM-2 To Permit Construction of a 16-Unit Condominium Complex The applicant was requesting rezoning from R-F to RM-2 of a.34-hectare (.a5 acre) property located at A Avenue in Cloverdale, to permit the construction of a 16-unit condominium complex. The Planning Committee recommended that Application be approved to proceed. That Application be approved to proceed for rezoning from "Family Residential Zone (R-F)" to "Multiple Residential Zone Two (RM-2)" under Section 963 of the Municipal Act, subject to: - 3 -

4 1. Approval from the Ministry of Transportation and Highways ; 2. Submission of a satisfactory design; 3. Solution of the concerns expressed by the Municipal Engineer; and 4. Submission of a building permit application in accordance with the approved drawings. RES.NO.H-861 Such approval to be valid for six months from this date. (3) Mr. N. Mundi Fraser Highway Rezoning from RS to C-H To Permit Development of a Car Dealership The applicants were requesting rezoning from RS (Suburban Residential) to C-H (Highway Commercial Zone) to permit the development of a car dealership. The Planning Committee recommended that Application not be approved. RES.NO.H-862 That Application for rezoning from "Suburban Residential (RS)" to "Highway Commercial Zone (C-H)" be tabled at the request of the applicant. (4) Mr. S. Chivers Twin Developments Ltd Avenue and A Street Rezoning from R-F and C-H to C-C To Permit Construction of Two Pedestrian-Oriented Commercial Buildings The applicants were requesting rezoning from Highway Commercial Zone (C-H) and Family Residential Zone (R-F) to Core Commercial Zone C-C of a.18-hectare (.45-acre) property located at 104 Avenue and 136A Street in Whalley, to permit the construction of two pedestrian-oriented commercial buildings. The Planning Committee recommended that Application be approved to proceed. -4-

5 Seconded by Alderman Schrenk That Application be approved to proceed for rezoning from "Family Residential Zone (R-F)" and "Highway Commercial Zone (C-H)" to "Core Commercial Zone (C-C)" under Section 963 of the Municipal Act, subject to: 1. Approval from the Ministry of Transportation and Highways ; 2. Submission of a satisfactory design; and 3. Solution of the concerns expressed by the Municipal Engineer. Such approval to be valid for six months from this date. Chivers Twin Developmen"- Ltd Avenue To Relax the F.mt and Side Yards for the Highway Commercial Zone (C-H) The applicants are requesting a development variance permit to relax the required front and side yards for the Highway Commercial Zone (C-H). recommended that Council pass the following resolutions: 1. A resolution authorizing the Planning and Development Services Department to prepare a development variance permit to vary building setbacks; and 2. EMS Holdings Ltd Street Rezoning from RS to R-F(R) To Permit Subdivision into Two Single-Family Lots The applicant was requesting rezoning from RS to R-F(R) of a.13 hectare (.31 acre) property located at Street in Newton to permit a subdivision into 2 single family lots. The Planning Committee recommended that Application not be approved. RES.NO.H-867 Seconded by Alderman McKinnon That Application or rezoning from "Suburban Residential (RS)" to "Restricted Single Family Residential Zone (R-F(R))" be denied. Mr. & Mrs. F. Drofenik Abbey Drive To Waive Requirement of Subdivision By-law 8830 that the RS Zone must be Provided with Adequate Municipal Water Supply, and Waive the Minimum Lot Depth Requirement The applicants were present concerning their development variance permit application to waive the requirement of the Subdivision By-law that the RS Zone must be provided with adequate Municipal water supply, and waive the minimum lot depth requirement

7 The Planning Committee recommended that Development Variance Permit Application not be approved. RES.NO.H-868 That Application be denied. (8) Bosa Bros. Const. Ltd Avenue To Relax Zoning By-law No. 5942, Part XXIII, RT-1, Section L.3, Building Exterior, to Permit the Construction of Six and Eight Townhouse Units Per Common Building The applicants were requesting a relaxation of Zoning By-law No. 5942, Part XXIII, RT-1, Section L.3, Building Exterior, to permit the construction of six and eight townhouse units per common building. The Planning Committee recommended that Council pass the following resolutions: 1. A resolution authorizing the Planning and Development Services Department to draft a development variance permit document; and 2. 8 (9) Norond Development Ltd Avenue Rezoning from RS to R-F(R) To Permit Subdivision into 41 Single Family Lots The applicant was requesting rezoning from RS to R-F(R) of a 3.48-hectare (8.6 acre) property located on the northwest corner of 72 Avenue and 124 Street in Newton, to permit a subdivision of 41 single-family lots. The Planning Committee recommended that Application be approved to proceed. That Application be approved to proceed for rezoning from "Suburban Residential (RS)" to "Restricted Single Family Residential Zone (R-F(R)" under Section 963 of the Municipal Act, subject to: 1. Solution of the concerns regarding frontage road on 72 Avenue expressed by the Municipal Engineer. Such approval to be valid for six months from this date. RES.NO.H-870 Alderman Watkins returned to the meeting at 9:55 p.m. (10) Mr. George Tsakumis Graphic Square Design Ltd Avenue Rezoning from R-F to C-H The applicant was requesting rezoning from Family Residential Zone (R-F) to Highway Commercial Zone (C-H) of the above two residential lots for the purpose of providing parking for his commercial buildings on 152 Street, as well as space for a future building. The Planning Committee recommended that Council's approval to proceed be amended to the following: that Avenue and A Avenue be rezoned from Family Residential Zone (R-F) to Retail Commercial Zone One (C-R(l)), subject to: 1. A restrictive covenant being registered against the subject properties limiting the permitted uses to parking only, until they can be developed with the adjacent properties; -8-

9 2. Provision of parking for expansion of existing commercial facilities, to meet the requirements of the Zoning By-law; and 3. Submission of a layout, to the satisfaction of the Design Review Committee. That Council's approval to proceed be amended to the following: that Avenue and A Avenue be rezoned from "Family Residential Zone (R-F)" to "Retail Commercial Zone One (C-R(l))", subject to: 1. RES.NO.H-871 (11) Dominion Construction Development Permit To Permit the Use of Vinyl Siding and Exposed Gutters in the Fraser Glen Development A representative of Dominion Construction was present concerning their application to amend Development Permit No , to permit the use of vinyl siding and exposed gutters in an enclave of 27 lots within the Fraser Glen Development. The Planning Committee recommended that Council pass the following resolutions: 1. The Planning and Development Services Department be authorized to prepare a modified version of the amending Development Permit No ; and 2. The Mayor and Clerk be authorized to sign Development Permit No

(12) Progressive Construction Ltd Street Rezoning Application The Acting Chairman read a letter from Progressive Construction Ltd. requesting that as the land to be acquired for park and school purposes does not impact on the first phase of the proposed subdivision nor the continuation of the rezoning process, that the rezoning application be allowed to proceed without the resolution of the school and park acquisition issue prior to introduction of the rezoning by-law. RES.NO.H-873 That this letter be referred to the Municipal Solicitor and Property Department for their comments, and the reports be referred back to the Planning Committee for consideration. (13) Plancan Avenue Rezoning from I-G & P-R to R-F(M) The Economic Development Director was present to comment on the rezoning application of Lougheed Industrial Development Ltd. to permit the development of a mobile home park for seniors. RES.NO.H-874 Seconded by Alderman Fomich That Application for rezoning from "General Industrial Zone (I-G)" and "Recreation Zone (P-R)" to "Mobile Home Residential Zone (R-F(M))" be denied. with Alderman Schrenk against

11 (14) Artisonn Industries Ltd Street Development Agreement Application To Permit Construction of a Commercial Development This application had been referred by Regular Council to consider providing parking on 152 Street as well as a painted median. The Municipal Engineer recommended that widening the Avenue section of 152 Street to four through lanes plus a raised centre median should proceed, with on-street parking prohibited. RES.NO.H-875 Moved by Alderman Watkins Seconded by Alderman McKinnon That this matter be tabled. D. REPORTS OF VARIOUS BOARDS: There were no reports submitted. E. MAYOR'S REPORT: Mayor Ross read the following proclamation: RODEO MONTH WHEREAS WHEREAS WHEREAS The sport of rodeo forms part of Canadians' national heritage; and The sport of rodeo has evolved from cowboys working with cattle and horses; and The Cloverdale Rodeo is celebrating its 42nd Anniversary in the Municipality on May 16th, 17th and 18th, 1987; NOW, THEREFORE, I, Don A. The Acting Municipal Manager's Report under date of May 4, 1987, was considered and dealt with as follows: Item No. R132 - Kelly Evans - Regarding Her Experience With the SEA ( ) The Acting Municipal Manager submitted a report from the Chief Inspector regarding a complaint registered by Mrs. Kelly Evans concerning her experience with the SEA. The Acting Municipal Manager was recommending that the information be received. RES.NO.H-912 Seconded by Alderman Easton That the report be received and a copy be forwarded to Kelly Evans. Item No. R133 - Hours of Operation of Construction Equipment ( / ) The Acting Municipal Manager submitted a report from the Chief Inspector regarding hours of operation of construction equipment. The Acting Municipal Manager commented that of late there have been several complaints of excavation equipment moving very late at night or very early in the morning (probably caused by the current boom in residential construction). The Acting Municipal Manager concurred with the Chief Inspector's recommendation that no changes be made to the Noise or Highways and Traffic By-laws with reference to the movement and operation of construction equipment. Item No. R134 - Riverside Shopping Centre Requesting Permission to Add a Home Brew Operation to Pop Shoppe Store at Ave. ( (1-12) The Acting Municipal Manager submitted a report from the Chief Inspector regarding Riverside Shopping Centre's request for permission to add a home brew operation to the Pop Shoppe store at Avenue. The Acting Municipal Manager commented that based on our current by-laws, we cannot approve Mr. Cooke's request. This report is being sent to the Director of Planning as an example of the overlap between commercial and industrial business activity in order that he can consider it as part of the review of the Zoning by-law. Item No. R135 - Submission of Port Mann Landfill Operating Plan to Minister of Environment ( ) The Acting Municipal Manager submitted a report from the Municipal Engineer regarding the submission of the Port Mann Landfill operating plan to the Minister of Environment for his approval. The report noted the following highlights of the plan: 1. Limits of Fill The expansion of the landfill encompasses raising the present level of the landfill from the current elevation of 20 metres to a final elevation of 35 metres and filling between the present fill area and the hillside. The top of the landfill will be inclined to a slight crown for drainage of the surface

26 2. Leachate Collection The proposed method of leachate collection consists of an impermeable barrier and collection system running along the toe of the landfill. The study estimates that such a system will intercept in excess of 90% of the leachate generated by the landfill. Initially, the leachate will be pumped to the regional trunk sewer and conveyed to the treatment plant. In the future, depending on leachate quality, pre-treatment may be provided before discharge to the sewer. 3. Landfill Gas Collection Presently, gas is collected by gravel vents. The operating plan proposes these be discontinued and in their place perforated pipes be installed at 50 metre spacings in alternate 3 metre thick layers of refuse. In addition, a granular layer would be placed to prevent any migration of gas into the hillside. A vacuum system will be installed, as an initial phase of the works, and connected to the perforated pipes to draw gas out of the landfill and pass it to a flare stack. The gas will be burned at this stack, thereby preventing any odour problems. 4. Drainage Storm water from the two ravines that are dammed by the landfill will be conveyed through the landfill via two storm sewers. 5. Entrance Works A drop-off depot will be constructed near the gate to collect all refuse from small vehicles into containers, which will later be taken to the landfill face. This avoids the need for these small vehicles to go into the landfill to unload. The drop-off depot will also have bins or storage areas for recycling paper, glass, tires, and metals. 6. Final Closure When the landfill has been filled to produce a final elevation of 35 metres, it will be covered with a one-metre thick layer of clay to seal the top surface. Grass cover will then be established over the surface of the landfill. 7. Life of the Landfill Based on the proposed final elevation of 35m, the fill volume available is estimated to be sufficient to provide for Surrey's waste for between 8 and 9 years (from the start of 1987) depending on the density of compaction achieved

The Director of Planning and Development Services commented that in recent times, a number of proposals have been made to develop townhouses or other forms of standard multi-family residences under the provisions of the P-P or P-P(2) zones. The realization by applicants, once they were well into the process, that these zones were not appropriate for the intended uses has resulted in considerable confusion and frustration for them. The proposed amendment to the intent section of the P-P and P-P(2) zones should prevent the recurrence of these situations.
