Absent: Alderman Higginbotham Staff Present:: Municipal Manager, Municipal Clerk, Assistant to the Manager, and Administrative Assistant. A. ADOPTION OF MINUTES: 1. Regular Council - October 6, 1986 RES.NO.F-237 Seconded by Alderman Easton That the minutes of the Regular Council meeting of October 6, 1986, be,adopted. 2. Council-in-Committee - October 6, 1986 RES.NO.F-238 (a) Moved by Alderman Schrenk Seconded by Alderman Huot That the minutes of the Council-in-Committee meeting of October 6, 1986, be received. Item C147 - By-law 8804 Council Initiative Rezoning of Properties at 2289/2297/2301/ 2315/2337/2347/2359 & 2377 King George Highway Rezoning from C-H to R-F(R) RES.NO.F-240 Seconded by Alderman Kerr That Resolutions No. F-196, F-197 & F-198 of the October 6, 1986, Regular Council minutes be resc:lnded and that "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1986, No. 8804" be filed. -~ with Aldermen Schrenk and Fomich against B. DELEGATIONS : 1. School District #36 SurrT Mr. Weinstein, Mr. Remalar, Ms. Handley and Ms. Cudmar were present to discuss the Adult Literary Program with Council. Mr. Weinstein thanked Council for their assistance in proclaiming the week of October 27, 1986, as "Literacy Week" in Surrey. Mr. Weinstein pointed out that a literacy and adult education program is needed in Surrey, as there are a number of residents that are functionally illiterate. In response to a question from Alderman Huot, Mr. Weinstein advised that some of the participants in this program have gone through the school system, while others are lacking in basic skills. In response to a question from Alderman Schrenk, Mr. Weinstein stated that Inwergarry School is now being used as an adult education centre. The school was previously an elementary school. Mr. Weinstein pointed out there is also an adult education program in Bridgeview. In response to a question from Alderman Fomich, Mr. Weinstein indicated that the adult education program has representation from all people; people who have gone tlhrough the school system, drop-outs and new Canadians. -2-

3 C. REPORTS OF VARIOUS COMMITTEES: 1. HERITAGE ADVISORY COMMITTEE - October 8, 1986 RES.NO.F-241 (a) Moved by Alderman McKinnon Seconded by Alderman Huot That the minutes of the Heritage Committee meeting of October 8, 19,86, be received. (b) The recommendations of these minutes were considered and dealt with as follows: Ami eda 1 e Sc hoc) 1 RECOMMENDATION That a letter be forwarded to School District #36 (Surrey) expressing appreciation for the upgrading recently undertaken by the School District and further, advise School District 36 that long range plans for upgrading to Anniedale School will be presented to the Board from the Heritage Advisory Committee. RECOMMENDATION That the Anniedale Pioneer School Committee be requested to submit a long range plan for restoration and maintenance of Anniedale School to the Heritage Advisory Committee. RECOMMENDATION That the Heritage Advisory Committee be recognized on the plaque. Harfman House RECOMMENDATION That approval be granted for the demolition of the existing house situated on the property site. RECOMMENDATION That a letter be forwarded to' the Provincial Archaeologist Branch of the Provincial Government enquiring as to whether follow-up has been undertaken with respect to their letter dated July 4, 1983 regarding the archeological site located on the Ha rf man property. -3-

4 Fireman's Heritage Committee ~ RECOMMENDATION That Chairman Webb invite Mr. McNally to the next Heritage Committee meeting in order to discuss their plans. RES.NO.F-242 Moved by Alderman McKinnon Seconded by Alderman Huot That the recommendations of the Heritage Advisory Committee minutes be adopted. 2. PLANNING COMMITTEE - Oct_ober 14, 1986 RES.NO.F-243 Seconded by Alderman Kerr That the minutes of the Planning Committee meeting of October 14, 1986, be received. (b) The recommendations of these minutes were considered and dealt with as follows: Mr. T.A. Bradfield Street Rezoning from R-F to R-F(R) To Restrict a Potential Duplex Property to Single--Family Uses ~ The applicant was requesting rezoning from R-F to R-F(R) of a.185-hectare (.45 acre) property located at Street in South Surrey, to restrict a potential duplex property to single-family uses. The Planning Committee recommended that Application be approved to proceed. Seconded by Alderman Kerr That Application be approved to proceed for rezoning from "Family Residential Zone (R-F)" to "Restricted Single Family Residential Zone (R-F(R))" under Section 963 of the Municipal Act

5 Such approval to be valid for six rnonths from this date. RES.NO.F-244 Alderman McKinnon left the meeting at 7:26 p.m. (2) Mitten Realty Ltd. and Mr. Stewart Bucholtz 6066, 6084, 6098, 6130 & Street Rezoning from R-F(R) to RT-1 To Permit Construction of 83 Townhouse Units The applicants were requesting rezoning from RS and R-F(R) to RT-1 of a 3.35-hectare (8.27 acre) property located at 6066, 6084, 6098, 6130 & Street in Cloverdale, to permit the construction of 83 townhouse units. The Planning Committee recommended that Application be approved to proceed. It WdS Seconded by Alderman Kerr That Application be approved to proceed for rezoning from "Suburban Residential (RS)" and "Restricted Single Family Residential Zone (R-F(R))" to "Townhouse Residential Zone (RT-1)" under Section 963 of the Xunicipal Act, subject to: 1. Submission of a satisfactory design; 2. Submission of a subdivision layout to the satisfaction of the Approving Officer; 3. Solution of the concerns expressed by the Municipal Engineer; and 4. 6 (3) Mrs. Ingrid Englebrecht 19112/42-60B Avenue and Street Rezoning from RS to R-F(R) To Permit a Subdivision into Single Family Lots _ ~ The applicant was requesting rezoning from RS to R-F(R) of a 3-lot site with a total of 2.06 hectares (5.09 acres) 1ocat.ed west of 192 Street, between 60 and 60B Avenues in Cloverdale, to permit a subdivision into single-family lots. The Planning Committee recommended that Application be tabled. RES.NO.F-246 Seconded by Alderman Kerr That Application for rezoning from "Suburban Residential (RS)" to "Restricted Single Family Residential Zone (R-F(R))" be tabled for a report from the Planning Department on driveway access. (4) Persopolis Development Corporation Street Rezoning from RS & R-F to R-F(R) To Permit a Subdivision into Approximately 40 Single Family Lots ~ _ The applicant was requesting rezoning from RS and R-F to R-F(H) of a 4.04 hectare (10.0 acre) property located at Street in South Surrey to permit subdivision into approximately 40 single family lot:;. The Planning Committee recommended that Application he approved to proceed. Seconded by Alderman Schrenk That Application be approved to proceed for rezoning from "Suburban Residential (RS)" and "Family Residential Zone (R-F) " to "Restricted Single Family Residential Zone (R-F(R))" under Section 963 of the Municipal Act, subject to: 1. Submission of a subdivision layout to the satisfaction of the Approving Officer; 2. Solution of the concerns expressed by the Municipal Engineer. McKague Street Rezoning from RS to R-F To Permit a Subdivision into Four Single Family Lots The applicant was requesting rezoning from RS to R-F of a.48-hectar.e (1.19 acre) property located at Street. in Fleetwood to permit a subdivision into four single-family lots. The Planning Committee recommended that Application be revised and approved to proceed. Seconded by Alderman Kerr That Application be revised and approved to proceed for rezoning from "Suburban Residential (RS)" to "Restricted Single Family Residential Zone (R-F(R))" under Section 963 of the Municipal Act, sub] ect to: 1. Approval from the Ministry of Transportation and Highways ; 2. Submission of a subdivision layout to the satisfaction of the Approving Officer; 3. Solution of the concerns expressed by the Municipal Engineer; and 4. Submission of a tree survey showing the trees to be preserved. Such approval to be valid for six months from this date. RES.NO.F-248 (6) Mr. Steve Gabor Avenue Rezoning from R-F(R) to R-F(C) To Permit Subdivision into Three Compact Housing Lots & Two R-F(R) The applicant was requesting rezoning from R-F(R) to R-F(C) of the south 17.5 metres (56.59 feet) of a.29-hectare (.72 acre) property located at Avenue in Newton, to permit subdivision into 3 compact housing lots and 2 R-F(R) lots

8 The Planning Committee recommended that Application be approved to proceed. That Application be approved to proceed for rezoning from "Restricted Single Family Residential Zone (R-F(R))'I to "Compact Family Residential Zone (R-F(C))" under Section 963 of the Municipal Act, sub j ec t to1 : 1. Approval from the Ministry of Transportation and Highways ; 2. Submission of a subdivision layout to the satisfaction of the Approv.ing Officer; 3. Closure of lane by way of lane exchange: 4. Incorporation of lane into R-F(C) subdivision; 5. Removal of access from 64 Avenue: and 6. Removal of restrictive covenant from subject properties. Such approval to be valid for six months from this date. RES.NO.F-249 with Aldermen Easton and Fomich against. RES.NO.F-250 Seconded by Alderman Easton That the Regular Council meeting do now adjourn to a Public Hearing on several by-laws. The Regular Council meeting adjourned at 7:35 p.m. and reconvened at 8:50 p.m., with all members of Council present except Alderman Higginbotham. The Regular Council meeting then recessed for a short break at 8:50 p.m. and reconvened at 9:lO p.m., with Alderman Fomich taking hi; seat as indicated in the minutes

Anderson Street Rezoning from RS to R-F(R) To Permit a Subdivision into Four or Six Lots ~ The applicant is requesting rezoning from RS to R-F(R) of a hectare (1.02 acre) property located at the northeast corner of llla Avenue and 152 Street in Fraser Heights, to perm:.t subdivision into four or six lots (depending on the future road pattern of this area). The Planning Committee recommended that Application be tabled. RES.NO.F-251 That Application for rezoning from "Suburban Residential (RS)" to "Restricted Single Family Residential Zone (R-F(R))" be tabled for a report on the proposed North Slope Connector Road and the registration of a Restrictive Covenant. (8) Whalley & District Senior Citizens Housing Society Old Yale Road Amendment to Land Use Contract 6 To Permit an Addition to the Kinsmen Place Lodge ~ The applicants were requesting an,amendment to Land Use Contract No. 6 to permit a 5,000+ sq.ft. addition to the Kinsmen Place Lodge, a senior citizens' high-rise building located at Old Yale Road in Whalley. Seconded by Alderman Kerr That Application be approved to proceed under Section 963 of the Municipal Act to amend Land Use Contract No. 6 as follows: 1. Schedule "B" is amended as follows: Minimum rear yard setback to read: "19 feet" instead of "35 feet"; Site coverage to read: "approximately 23 percent" instead of "approximately 16.8 percent"; - 9 -

Schedule "Bl" is amended as follows: Floor space ratio to read: "0.91" instead of "0.83"; Building floor area to read: "55,500 square feet" instead of "50,630 square feet"; The following sentence to be added to this Schedule: "Amendments: as shown on drawings No. A-1 to A-6, which are attached hereto and form part of this contract 'I : and that approval to proceed on this rezoning application be subject to submission of a satisfactory design. Rl2S.NO.F-252 (9) Mr. I?. Vanderzalm Avenue Rezoning from A-3 to A-2 To Permit the Processing of Soil for Potted Plants ~ The applicant was requesting rezoning from A-3 to A-2 of a.4069-hectare (1-acre) property located at AyJenue in South Surrey, to permit the processing of soil for potted plants. The Planning Committee recommended that this application not be apeiroved. Seconded by A.lderman Watkins That Application for rezoning from "Agricultural Zone Three (A-3)" to "Intensive Agricultural Zone (A-2)" be denied. Before this motion was put: Mayor Ross stepped down from the Chair and Acting Mayor Easton assumed the Chair at 9:11 p.m. Alderman Fomich returned to the meeting at 9:12 p.m. Alderman Schrenk questioned whether or not the use proposed by the applicant could be permitted in the existing zoning. Mayor Ross spoke against the denial recommendation. Mayor Ross noted that this is an intensi,ve nursery-use site and the proposal could employ up to 30 people. Mayor Ross pointed out that the land is not being taken out of the Agricultural Land Reserve and this is a good use for the site

11 Alderman McKinnon stated that the proposal is not permitted under the by-law. The applicant had indicated he would be constructing a 10,000 square foot building which would be next to the Serpentine Fen. The A--2 Zone will be abrogated, if this application is approved. Alderman Watkins indicated that approval of this application would see a 10,000 square foot warehouse being constructed next to the Serpentine Fen. Alderman Watkins spoke against the rezoning application. Alderman Huot indicated there are good points to both sides of the argument on this application. Alderman Huot indicated he personally supports Mayor Ross's position. Alderman Huot indicated there may he another way the applicant can achieve the use without A-2 zoning. Alderman Huot concluded by stating that he basically supports this application. Mayor Ross stated he is in favour of this use on the site. The ::oil and gravel uses are conducive to a nursery business. Alderman Kerr spoke in support of the application, pointing out it is a good use for the property. Moved by Alde rman Huot That Application for rezoning from "Agricultural Zone Three (A-3)" to "Intensive Agricultural Zone (A-2)" be denied. Before this motion was put: RES.NO.F-253 Moved by Alderman Kerr Seconded by Mayor Ross That Application be tabled for one week to determine whether or not the proposed use woul5 be permitted in the A-3 Zone. with,alderman McKinnon against. Mayor Ross assumed the Chair at 9:23 p.m

Butler Avenue Rezoning from RS to R-F(R) To Permit a Subdivision into Single Family Lots 56 a The applicant was requesting rezoning from RS to R-F(R) of a.40-hectare (.99 acre) property located at the southwest corner of 112 Avenue and 153A Street in Fraser Heights, to perm:lt subsdivision into single-family lots. The Planning Committee recommended that Application be approved to proceed. Seconded by Alderman Fomich That Application be approved to proceed for rezoning from "Suburban Residential (RS)" to "Restricted Single Family Residential Zone (R-F(R))" under Section 96#3 of the Municipal Act, subject to: 1. Approval from the Ministry of Transportation and Highways; and 2. Submission of a subdivision layout to the satisfaction of the Approving Officer. Such approval to be valid for six months from this date. RES.NO.F-254 (11) Mr. Gaetano DeSchiavi Avenue Rezoning from RS to R-H(G) To Permit Subdivision into Ten Hal -Acre, Gross Density Lots -~ The applicants were requesting rezoning from "Suburban Residential (RS)" to "Half-Acre Residential - Gross Density Zone (R-H(,G))" of a 1.99-hectare (4.93-acre) property located at: Avenue in South Surrey, to permit subdivision into ten half-acre, gross density lots. The Planning Committee recommended that Application be approved to proceed. That Application be approved to proceed for rezoning from "Suburban Residential (RS)" to "Half-Acre Residential - Gross Density Zone (R-H(G))" under Section 963 of the Municipal Act, subject to:

13 1. Input from the Federal/Provinc:ial Fisheries; 2. Submission of a subdivision layout to the satisfaction of the Approving Officer; 3. Solution of the concerns expressed by the Municipal Eng i ne e r ; 4. Submission of a tree survey showing the trees to be preserved; and 5. Dedication of metres along 24 Avenue for the widening of this road to arterial standards. Such approval to be valid for six months from this date. RES.NO.F-255 (12) Progressive Construction Ltd. 8517,' Street Rezoning from RS to R-F(R) To Permit Subdivision into Approx. 30 Single-Family Lots The applicants were requesting rezoning from Suburban Residential (RS) to Restricted Single Family Residential Zone (R-F(R)) of a 3.03-hectare (7.5-acre) property located on the west side of 144 Street in the 8500 Block in the Fleezwood Area, to permit subdivision into approximately 30 s ingle-family lots. The Planning Committee recommended that this application be tabled. Mattu Street Rezoning from RS to R-F(R) To Permit Subdivision into Single-Family Lots ~ The applicants were requesting rezoning from Suburban Residential (RS) to Restricted Single Family Residential Zone (R-F(R)) of a 1.99-hectare (4.93-acre) property located on the west side of 144 Street in the 8900 Block in the Fleetwood Area, to permit subdivision into single-family lots. The Planning Committee recommended that this application be tabled. Alderman Kerr returned to' the meeting at 9:28 p.m. (16) Mr. Anter Pamma 8776 & Street Rezoning from RS to C-L & R-F(R) To Permit a Local Convenience Store and The Subdivision of the Site into 17 Single Family Residential Lots _ ~ The applicant was requesting rezoning from RS Suburban Residential to R-F(R) Restricted Single Family Residential Zone of a 1.61-hectare (3.99-acre) sited at the southeast corner of 88 Avenue and 140 Street. The applicants also wish to rezone from RS to C-L Local Commercial Zone a 0.13-hectare (0.31-acre) portion located within the site described above, right at the corner of 88 Avenue and 140 Street. The Planning Committee recommended that Application he approved to proceed. Seconded by Alderman Kerr That Application be approved to proceed for rezoning from "Suburban Residential (RS)" to "Local Commercial Zone (C-L)" and "Restricted Single Family Residential Zone (R-F(R))" under Section 963 of the Municipal Act, subject to: 1. Input. from the Federal/Provincial Fisheries;

16 Submission of a subdivision layout to the satisfaction of the Approving Officer; and Solution of the concerns expressed by the Municipal Engineer. Toews & Associates 3050 King George Highway To Amend Development Permit To Permit Completion of an Auto Mall Facility The applicant was requesting an amendment to Development Permit No , to permit the completion of an auto mall facility at 3050 King George Highway in South Surrey. The Planning Committee recommended that Development Permit Application be approved to proceed. Seconded by Alderman Kerr That: 1. The Planning Department be authorized to draft Development Permit No , subject to: (a) Submission of a coordinated sign proposal for all the signs to be constructed on the site; and (b) Submission and approval of a landscape plan. 2, That the Mayor and Clerk be authorized to sign the Development Permit. 17 (18) Mr. & Mrs. C. Smailes A Street To Subdivide One Lot and To Relax Sanitary Sewer Requirement The applicant was requesting a Development Permit to delete the requirement of the subdivision by-law that land to be subdivided in the R-1 Zone must connect to Municipal sanitzary sewer. The nearest sanitary sewer is located at 125A Street and 52 Avenue, approximately 600 metres south of the site. The Planning Committee recommended that Development Variance Permit Application be approved to proceed. Seconded by A:lderman Schrenk That: 1. The Planning Department be authorized to prepare Development Variance Permit No ; and 2. That the Mayor and Clerk be authorized to sign the Development Variance Permit. RES.NO.F-263 (19) Mr. 13. Cooper and Mr. F. Somers Street Pre-Clearance for a Neighbourhood 'Pub ~ The applicants were requesting pre-clearance for a proposed 65-seat neighbourhood pub at Street in Gu i 1 df o rd. The Planning Committee recommended that this application be approved. RES.NO.F-264 Seconded by Alderman Kerr That Application for pre-clearance of a neighbourhood pub, to be located at Street, be approved. with,alderman Easton against

Beasley Street To Permit a Senior Citizens Apartment Rezoning from RS to RM The applicant was requesting rezoning from RS to RM-2 of a.87-hectare property (2.17 acre property) located at Street in East Cloverdale, to permit the construction of a 43-unit senior citizens' apartment. The Planning Committee recommended that this application be approved. Seconded by Alderman Schrenk That Application be approved to proceed for rezoning from "Suburban Residential (RS)" to "Personal Care Institutional Zone (P-P)" to permit a persona1 care facility which conta-ins a combination of self--contained and care units, sublject to: Apprcwal from the Ministry of Transportation and Highways ; Input from the Federal/Provincial Fisheries: Issuance of a Development Variance Permit to relax the minimum site area requirements and to permit a single footprint building; Reduction in the size of the building; Solut.ion of the concerns expressed by the Municipal Engineer; and Submi.ssion of a tree survey and a tree preservation plan. Such approval to be valid for six months from this date. RES.NO.F-265 (21) George Oballa & Joe Di Tosto Street To Permit C-H Uses in an Existing Building Rezoning from C-R(l) to C-H ~ The applicants were requesting rezoning from Retail Commercial Zone One (C-R(l)) to Highway Commercial Zone (C-H) of a.ll-hectare (.28-acre) property located at Street in Whalley, to permit the use of an existing building for Highway Commercial uses

(22) Mr. Ed Klassen Rezoning from RS to C-H To Permit the Construction of a Car Dealership Street ~ _ The applicant was requesting rezoning from RS (Suburban Residential) to C-H (Highway Commercial Zone) of a 1.36-hectare (3.37-acre) portion of a property located at Street in Newton. The purpose of this application is to permit the construction and operation of a car dealership. The Planning Committee recommended that Application be approved to proceed. That Application be approved to proceed for rezoning from "Suburban Residential (RS)" to "Highway Commercial Zone (C-H)" under Section 963 of the Municipal Act, subject to: 1. Amendment of the Official Community Plan (1985) to increase the depth of the commercial designation fronting 120 Street: 2. Amendment of the Newton Plan to reflect the boundary adjustment in the Official Cornmunity Plan and to change the designation of the area from Commercial to Highway Commercial; 3. Approval from the Ministry of Transportation and Highways :

The Municipal Manager stated that discussions were held with Dr. Meekison c:oncerning septic field approval. Dr. Meekison agrees that testing of soil for septic fields depends on the weather and soil c:onditions and indicated that the Boundary Health Unit always corisiders the soil and weather conditions. Dr. Meekison has advised that the decision of the Boundary Union Board of Health can be appealed.
