Kopeschny, Administrative Assistant A. ADOPTION OF MINUTES B. CORPORATE REPORTS Land Use Applications COMMERCIAL/INDUSTRIAL CLOVERDALE Highway No. 10, Surrey, B.C. W.A.E. Hick & Associates Ltd./Panorama Village Shopping Centre Inc. Inc. No Liquor Permit To allow the development of a neighbourhood pub The General Manager of Planning & Development submitted a report concerning a liquor permit on property located at Highway No. 10. The applicant, Panorama Village Shopping Centre Inc., has applied for a "D" class liquor license in order to allow the operation of an 85-seat (65 indoor and 20 outdoor) neighbourhood brew pub. The square metre (1,400 square foot) pub and the 347 square metre (3,741 square feet) adjoining restaurant will be located in the Panorama Shopping Centre complex now currently under construction.

2 It was Moved by Councillor Caissie Seconded by Councillor Steele That: 1. A date for Public Hearing be set to solicit opinions from area residents regarding the proposed neighbourhood pub. 2. Staff be instructed to prepare a Resolution for Council's consideration after the Public Hearing. The Resolution will indicate whether Council, after due consideration of the results of the Public Hearing, is in favour of the neighbourhood pub, and if so, recommend to the Liquor Control & Licensing Branch (LCLB), any specific licensing conditions suggested by Council. RES.R Carried Gerry Olma, representative of Panorama Village Shopping Centre Inc. was present on behalf of the applicant to answer questions from Council. Councillor Watts entered the meeting at 4:09 p.m. It was Moved by Councillor Villeneuve Seconded by Councillor Steele That a Public Hearing for Liquor Permit Application be set for Monday, October 19,1998 at the City Hall at 7:00 p.m. RES.R Carried NEWTON A Avenue Ken Hoschka, Sunrise Poultry/High Noon Investment Corporation Development Permit Application To construct a 1,271 sq. m (13,681 sq. ft.) addition to the existing Sunrise Poultry processing plant. Development Permit on property located at A Avenue. The applicant is requesting a development permit to construct a 1,271 square metre (13,681 square feet) addition to the existing Sunrise Poultry processing plant. Seconded by Councillor Eddington That Development Permit No be postponed until the end of the meeting. RES.R Carried SURREY CITY CENTRE/WHALLEY King George Highway Frederick Sly/Cambridge Shopping Centres Limited Inc. No A

3 Development Permit To add an entry and outdoor patio for a new Ricky's restaurant at Surrey Place Mall. Development Permit on property located at King George Highway. The applicant is proposing to add an exterior entry and an outdoor patio along the east side of Surrey Place Mall for a new Ricky's restaurant. Staff from the Planning and Development Department submitted photographs illustrating the proposed project of the applicant who was not in attendance. It was Moved by Councillor Villeneuve Seconded by Councillor Hunt That Council approve the attached Development Permit No (Appendix IV), authorize the Mayor and Clerk to sign the Development Permit, and authorize the transfer of the Permit to the heirs, administrators, executors, successors and assigns of the title of the land within the terms of the Permit. RES.R Carried RESIDENTIAL/INSTITUTIONAL NEWTON A Street and Avenue Tom Hassell/Scott Congregation of Jehovah's Witnesses Rezoning/Development Variance Permit From RA and RF to PA-1 To accommodate the existing church use and an associated residence. The General Manager of Planning & Development submitted a report concerning an application for rezoning from RA and RF to PA-1 property located at A Street and Avenue. The applicant is proposing to rezone a 0.54-hectare (1.33-acre) property to accommodate an existing church use and an associated residence. The applicant was in attendance to answer questions from Council. Seconded by Councillor Steele That: 1. A By-law be introduced to rezone the property from "One-Acre Residential Zone (RA)" and "Single Family Residential Zone (RF)" (By-law No ) to "Assembly Hall 1 Zone (PA-1)" (By-law No ) and a date for Public Hearing be set.

4 2. Council approve Development Variance Permit , varying the following, to proceed to Public Notification: (a) side yard on flanking street from 7.5 m to 7.3 m (for existing building). 3. Council instruct staff to resolve the following issue prior to final adoption: (a) ensure that all engineering requirements and issues including restrictive covenants, and rights-of-way where necessary, are addressed to the satisfaction of the General Manager, Engineering; and (b) submission of a landscaping plan and tree survey with security to the satisfaction of the Landscape Architect. (c) amend the Newton Local Area Plan to redesignate the land from Urban Residential to Institutional. RES.R Carried Seconded by Councillor Higginbotham That "Surrey Zoning By-law, 1993, No , Amendment By-law, 1998, No " pass its first reading. RES.R Carried The said By-law was then read for the second time. Seconded by Councillor Higginbotham That "Surrey Zoning By-law, 1993, No , Amendment By-law, 1998, No " pass its second reading. RES.R Carried It was then Moved by Councillor Hunt Seconded by Councillor Higginbotham That the Public Hearing on "Surrey Zoning By-law, 1993, No , Amendment By-law, 1998, No " be held at the City Hall on October 19, 1998, at 7:00 p.m. RES.R Carried SOUTH SURREY Marine Drive Jerry Zaleschuk Development Variance Permit To relax the west side yard minimum setback from 1.8 m (6 ft.) to 0.73 m (2.4 ft.) to retain an existing single family dwelling. Development Variance Permit on property located at Marine Drive.

5 The applicant is requesting a variance to the Zoning By-law No to relax the west side yard minimum setback from 1.8 metres (6 feet) to 0.73 metre (2.4 feet) in order to retain an existing dwelling after the property is subdivided into two lots. Mr. J. Zaleschuk, the applicant, was present to answer questions from Council. It was Moved by Councillor Villeneuve Seconded by Councillor Hunt That Council: 1. Approve Development Variance Permit , varying the following, to proceed to Public Notification: (a) In Section F Yards and Setbacks of Part 16 "Single Family Residential Zone (RF)" the west side yard minimum setback for the principal building is relaxed from 1.8 metres (6 feet) to 0.73 metre (2.4 feet). 2. Instruct staff to resolve the following issues prior to approval: (b) registration of a Section 219 Restrictive Covenant for a 2.87 metre (9.4 ft.) "no build" strip on the eastern portion of proposed Lot No. 1 to ensure spatial and fire separation between the new dwelling on Lot 1 and the existing dwelling on Lot 2. RES.R Carried Councillor Eddington requested clarification from the Engineering Department on Development Variance Permit No SURREY CITY CENTRE/WHALLEY Street Yashpal Parmar Development Variance Permit To vary lot depth, setback and works and services requirements to accommodate a 2-lot single family subdivision. Development Variance Permit on property located at Street. The applicant is requesting variances: 1. To vary the lot depth in the "Single Family Residential Zone (RF)" from 28 metres (90 ft.) to 26.5 metres (87 ft.) 2. To relax the front yard setback for the existing single family dwelling in the "Single Family Residential Zone (RF)" from 7.5 metres (25 ft.) to 7.0 metres (23 ft.);

6 3. To vary Zoning By-law No to increase the number of risers that can be included in a set of stairs that encroaches into the building setback area from three (3) to six (6); and 4. To vary Subdivision and Development By-law No to relax the works and servicing requirements for road works, underground wiring and street lighting. Yashpal Parmar, applicant, was present to answer questions from Council. Seconded by Councillor Watts That Council: 1. Approve Development Variance Permit No , varying the following, to proceed to Public Notification: (a) The Zoning By-law, 1993, No is varied as follows: RES.R Carried i. Part 16 Single Family Residential Zone (RF) is varied as follows: a. by reducing the lot depth from 28 metres (90 ft.) to 26.5 metres (87.5 ft.) for proposed Lots 1 and 2; and b. by reducing the front yard setback requirements from 7.5 metres (25 ft.) to 7.0 metres (23 ft.) for the existing dwelling on proposed Lot 1; and ii. Part 4 General Provisions is varied by increasing the number of risers that may encroach into the building setback area for the existing dwelling on proposed Lot 1 from three (3) risers to six (6) risers. Seconded by Councillor Watts That (b) Surrey Subdivision & Development By-law, 1986, No is varied as follows: RES.R i. Section 24(a) is varied by allowing the existing street lighting on hydro poles rather than requiring ornamental street lighting; and ii. Section 24(a) is varied by permitting overhead hydro/telephone wiring rather than underground. Carried with Councillor Eddington against. Seconded by Councillor Watts That the following variance be denied:

7 2. To vary Section 24(a) of Surrey Subdivision & Development By-law, 1986, No by relaxing the requirements for road works along the frontage of the property. Development Permit on property located at A Avenue. The applicant is requesting a development permit to construct a 1,271 square metre (13,681 square feet) addition to the existing Sunrise Poultry processing plant. It was Moved by Councillor Eddington Seconded by Councillor Higginbotham That Development Permit No be postponed until the applicant comes forward at the next Regular Council - Land Use meeting. RES.R Defeated on a tie vote with the Mayor and Councillors Steele, Watts, and Hunt against. Seconded by Councillor Watts That Council: 1. Authorize staff to draft Development Permit in accordance with the attached drawings (Appendix III). 2. Instruct staff to resolve the following issue prior to approval: (a) ensure that all engineering requirements and issues including restrictive covenants, and rights-of-way where necessary, are addressed to the satisfaction of the General Manager, Engineering.
