Monday, July 18, 1977 Time: 7:OO P.M. r Minutes of a Regular Council meeting held in the Council Chamber on Monday, July 18, 1977, at 7:OO P.M. Those present were the Mayor, Aldermen Fomich, Watkins, Schrenk, Vogel, Jones, and Beale, Also present were the Municipal Manager and Deputy Clerk. A. ADOPTION OF MINUTES: 1. Seconded by Alderman Schrenk That the minutesof the Regular Council meeting of July 11th be adopted. RES. NO. N-97 - meeting 2. noted that under Resolution No. N-47 of the minutes of the Regular Council meecing of July 12th, the amount to be received from the Ministry of Municipal Affairs should read $43, RES. NO. N-98 That the minutes of the Regular Council of July 12th be adopted with the correction as noted. B. DELEGATIONS :. 1. Mr. G. Houlden of Chevron Canada Ltd. was present regarding Rezoning application no. 77RZ-56 to convert an existing service station at 7120 Scott Road to a self-serve unit. He felt that the demands made by the Engineering and Planning Departments were excessive in that the Engineering Departaent had requested $11, in lieu of street lights, sidewalks on both streets and an eight inch watermain. The Planning Department had asked for seventeen feet from the front of the property abutting Scott Road at an estimated value of $15, Mr. Houlden pointed out that they only wish to change thei.r method of merchandizing a product and in this particular instance, it involves the installation of an electrical console with its necessary wiring to the pumps in order to change to self-service operation. Zeference was made to the fact that the station was reconstructed six years ago and at that time, they had complied with all requirements including the dedication of the seven feet along 72 Avenue.
2 suggested that the items for which cash payment had been requested are local improvements that should be paid for with other property owners at the time of construction. He, therefore, requested that Council approve the application for rezoning without prerequisite demands on basis that the location is converting to a self-serve outlet on a designated main thoroughfare. - Mr. Houlden was thanked by the Mayor for his.submission. 2. RES. NO. N-99 Alderman Vogel stated that Mr. Brian Bignell and Dr. Olafson were present and wished to speak to Council in opposition to the proposed widening of 32 Avenue as an arterial street as covered under Item 7858 of the Manager's Report. heard at this time. Honourable William N. Vander Zalm, M.L.A. for Surrey, appeared before Council a little later in the meeting. He stated that he had made representation concerning the diversion to Zero Avenue and had supported the efforts of other M.L.A.'s for improve-.& ment to roads shared with adjacent Mufiicipalities. Also, recognized is the importance of Scott Road improvements and. realignment. He announced that during the next six or eight months, there will be an extensive highway construction programme carried on in the Municipality On September 15th, tenders will be called for widening King George Highway to four lanes from Fraser Highway to No. 10 Highway with curbs, gutters, islands and turn slots. At a later date, tenders will be called for widening the Fraser Highway from King George Highway to 152 Street. Honourable Vander Zalm had been requested to comment on the- request by the Handicapped Resource Centre at Avenue for a grant in lieu of taxes. He stated that the centre and the fixistry of Human who require assistance. C. REPORTS OF VARIOUS COPPIITTEES : 1. 3 meeting earlier in the day. - That the Treasurer be requested to obtain a Financial Report on theoperationof the Surrey Zoo for year ending June 30, 1977, including all receipts and expenditures such as feed, payroll and maintenance costs together with a projection of costs for the next twelve months. GREATER VANCOWER REGIONAL DISTRICT: (a) Moved by Alderman Jones That the minutes of the Special Planning Committee meeting of June 28th be receivcd. RES. NO. N FRASER VALLEY REGIONAL LIBRARY 'BOARD: (a) Moved by Alderman Fomich That the Circulation Report for June be received. RES. NO. N-102 'L 3. ADVISORY DESIGN PANEL: (a) be received. RES. NO. N-103 E. MAYOR'S REPORT : Moved by Alderman Fomich That the minutes of the meeting of June 22nd 1. The Mayor stated that he had no items on which to report at this time. 2. A letter had been received from the Handicapped Resource Centre requesting a grant in lieu of taxes on property at Avenue and was tabled to this meeting in order to permit the Manager to report on arrangements with the nine other group homes in the Lower Mainland. The Manager stated that in 1976, a grant had been provided to similar resource centres located in Delta, Burnaby, The District of Langley, and the City of Vancouver, however, no grants had been provided by Richrnond and New Westminster. Alderman Vogel pointed out that the Handicapped Resource Centre is not asking for a continuing grant, only that the property taxes be waived for one year due to the financial burden of construction costs.

Alderman Schrenk suggested that a By-law to regulate the operation of discotheques be introduced as soon as possible. G. MANAGER'S REPORT: 1. The Manager's Report under date of July 18th was considered and dealt with as follows: Item 7855 The Manager submitted copies of correspondence and excerpts from the minutes of The City of North Vancouver Council meetings concerning possible development of the Provincial property west of Lonsdale Avenue on the waterfront as a park. RES. NO. N-134 That the. information be received. - RES. Moved by Alderman Vogel Thzt Council, af ter reviewing the documents received,go on record as supporting the application by The City of North Vancouver for a waterfront park. This motion was lost on a tie vote with the Mayor, Alderman Schrenk and Alderman Jones against. RES. NO. N-135 Item 7856 The Manager submitted a report which had been prepared by the Chief Inspector on the complaint 3y Mr. & Mrc. Su5telny of Avenue that their property does not drain effectively. reported that the property is too low to drain to the ditch on 9lA Avenue, being the road on which the property fronts and it is not possible to permit drainage to the rear through the adjacent commercial property as this property is too high to enable the drain tile system on Mr. Subtelny's property to be picked up. The Engineering Department has advised that sewer works will shortly be carried out in this locality, and top soil could be provided to raise the property. Moved by Alderman Vogel Seconded by Alderman Schrenk That soil be provided, when possible to improve the drainage on this lot. NO. N-136
10 Item 7857 The Manager reported on the delegation of Mr. T. Clarke of A Street requesting that the lane north of 72 Avenue between 130 Street and 131 Street, be blocked to traffic at the c east end. This had been dealt with by the Traffic Committee on May 27th, and the recommendation of the Traffic Committee that no action be taken, was adopted by Council. This recommendation that the lane be not blocked to traffic, was made as there would not be sufficient space for vehicles including trucks to turn around when using the lane and also since the lane provides access to properties facing on 72 Avenue. this matter. RES. NO. N-137 Moved by Alderman Jones Seconded by Alderman Schrenk That no further action be taken on Carried with Alderman Watkins against. Item 7858 The Manager submitted a petition dated June 29th signed by property owners on 32 Avenue protesting the proposal to eventually widen 32 Avenue to thirty-six feet east of King George Highway. Seconded by Alderman Schrenk That a decision by Council concerning the request be tabled for one week and referred to Council-in-Committee with the Englneer being present. RES. NO. N-138 W Item 7859 The Manager raported on accidsntswhich had occurred in the Fraser Heights district. Be stated that the R.C.M.P. have only two accidents recorded in These include an accident on March 14th involving a school bus and a truck, at which tine there was $ damage and during May, when a private vehicle left the road and went into the bush. RES. NO. N-139 Alderman Fomich returned to the Seconded by Alderman Schrenk That the information be received. Eeeting at this point. Item 7860 The Manager submitted a report prepared by the Engineer on tenders which had been received on improvements and sidewalk on 60 Avenue and 176 Street, adjacent to the Fair Grounds.
11 The works to be included under this Contract were listed in detail together with revised project costs based on the lowest tender. Work is scheduled to be compieted on September 2nd in order to have fences and landscaping in place prior to the Surrey Fall Fair activities. Seconded by 'Alderman Jones That the Contract be awarded to the low bidder, Jack Cewe Ltd., in the amount of $73, and that the Mayor and Clerk be authorized to sign this Contract for Project RES. NO. N-140 Item 7861 The Manager submitted a report prepared by the Engineer on tenders received for construction of the Port Kells Sanitary Sewer on 104 Avenue from 176 Street to 161 Street. Tenders had been received from eight contractors with the low bid submitted by Goodbrand Construction Ltd., in the amount of $661, The construction estimate on this project prepared by the Consultants was $640, A budget summary to date for the 1977 Sanitary Sewer Programme was also provided. Moved by Alderman Fomich That the tender for construction of the Port Kells Sanitary Sewers under Project 4469, Part 9, be awarded to Goodbrand Construction Ltd., in the amount of $661, and the Mayor and Clerk be authorized to execute t5e Contract. w RES. NO. N-141 Iten 786U The Manager submitted a report on tenders which had been received on several local improvements projects under Contract MS Three contractors had bid on the work which includes projects for paving and installation of concrete curbs. Moved by Alderman Jones That the tender for Contract MS be awarded to Jack Cewe Ltd. in the amount of $159, and that the Mayor and the Clerk be authorized to sign the Contract. RES. NO. N-142 Item The Manager submitted a detailed report prepared by the Engineer on courses of action which the Municipality may pursue with regard to the refusal of Globe Excavations Ltd. to execute a Contract for Project 4469 under Contract MS This Contract had been awarded to Globe Excavations Ltd. in the amount of $311, on July 6, Their Solicitor has written to advise that Globe Excavations Ltd. does not intend to sign any contract to complete the job. i I
12 explained that Goodbrand Construction Ltd. had submitted the second lowest tender which is still open for acceptance in the amount of $417, A delay in the project until later In the year or until next year would mean that the entire Port Kells Sanitary Sewer system would not be connet: or utilized by any of the indusries in Port Kells until these laterals a rd built. The Municipal Solicitor is investigating the situation with regard to the bonding company involved in the Gl'obe Excavations Ltd. tender. Moved by Alderman Fomich That the tender under Project 4469, Part 8" for construction of Port Kells Sanitary Sewers on 98 Avenue and 192 Street, be awarded to Goodbrand Construction Ltd. in the amount of $417, and that the Mayor and Clerk be authorized to sign the Contract. The Manager had reported on June 27th under Item 7823 on a request by the Crescent Beach Yacht Club to erect a clubhouse on Municipal property adjacent to the mouth of the Nicomekl River west of the railway. The following motion which hac? been nade in connection with Item 7348 of the Manager's Report at the ReguIar Council on July 12th, had been tabled pending discussion in Council-in-Committee: H. CLERK'S RePORT That development policies and impost fees do not apply when a service station is changing to a self-serve station zone. Letter from Mr. Charles Agar of Avenue received advising residents are opposed to a proposed horticulture development on 34 Avenue. Reply of Clerk also to be received. Letter from L. Farrell of Inuk Investments Inc. received regarding their gross density project now complete at Avenue and inviting Council to view it. Letter from Shinerama received requesting permission to solicit-funds in Surrey on September 21. Letter to Mayor from Constable Calhoun of R.C.M.P. received regarding complaint of A. Lawrenty of Avenue re vandalism. Letter of appreciation for Honour Award received from Vi Caneron. Letter from Columbian received regarding proposed advertising programme re Council agenda. Letter from Noma Kitt of A Street complaining about Welcome Guest Lodge at Avenue. - RES. Moved by Alderman Vogel That the above correspondence be received. NO. N-148 (13)
14 In regard t6 Item 5, Alderman Fomich and Alderman Jones each commented favourably on the innovative development which has allowed the ravine and creek areas to be retained in their natural state as public land in perpetuity. suggested that other similar developyents should be considered by Council in the future. iuj In regard to Item 6, it was - That permission be granted to the B.C.I.T. Student Association to hold their Shinerama fund drive to aid cystic fibros:., research on September 21, RES. NO. N-149 Carried In regard to Item 7, it was - That the letter be referred to the Manager to provide a report tc; Council on the cost of the items requested by the R.C.M.P a RES. NO. N-150 Further, in connection with this item, the Mayor complimented the members of the R.C.M.P. in the manner izl which the complaint had been resolved. In regard to Item 9, it was - -- Moved by Alderman Watkins Seconded by Alderman Vogel That the Clerk respond to the proposal in an effort to obtain costs and learn what problems would be involved in fullfilling the request, This motion was not put as Moved by Alderman Jones That the matter be referred to the Finance Committee for consideration when further information has been obtained by the Municipal Clerk. RES. NO. N-151 Carried with the Mayor, Alderman Fomich and Alderman Watkins against. 15 J. ANY OTHER COMPETENT BUSINESS: 1. Alderman Fomich stated that further action is required by Council since a request had been made that a financial statement be provided on the operation of the Surrey Zoo. c Moved by Alderman Fomich That Council authorize a further two week extension on the insurance on the Surrey Zoo past August 1, 1977, pending a decision following receipt of the financial statement. RES. NO. N-153 Carried with Alderman Jones against. 2. Alderman Schrenk requested clarification by the Manager on policy concerning garbage collection and charges for property owners over 65, as well as the service provided to mobile homes and trailer courts. The Manager, in reply, stated that the negotiation of lower rates had been agreed to between the individuals and the contractors and contractors are prepared to make individual arrangements. Any property owners over 65 can write to the Manager or the Municipal Collector advising that they do not require garbage collection service. The Manager also outlined the procedures to be followed in connection with garbage collection service for commercial operations including condominium and mobile home parks Alderman Vogel outlined the work carried out by the Panorama Ridge Planning Committee to which he had been appointed as Chairman in He stated that the Committee had held regular meetings to June 23, 1977, and had interviewed representatives from the Parks & Recreation Department, School Board, B. C. Hydro and Power Authority and others and had brought forward final recornendations which had been reviewed with the Executive of the Colebrook Panorama Ridge Ratepayers' Association. K. ADJOURNMENT Alderman Vogel mentioned that although Council had adopted three of the four recommendations presented by the Committee, it had been unfortunate that the Chairman of the Planning Committee had pur. forward a motion which nullified the recommendations of the Committee and confused their intent. Alderman Vogel stated that due to this action, he was unable to continue as Chairman of the Panorama Ridge Planning Committee and was officially submitting his resignation. '- The resignation of Alderman Vogel was accepted by the Mayor. Moved by Alderman Fomich That the Regular Council meeting do - now adjourn until 7:OO P.M. on Monday, July 25, 1977, RES. NO.
