The Bank will prior review the following ctracts: Works: All ctracts more than US$ 10.0 milli equivalent; Goods: All ctracts more than US$ 1.0 milli equivalent; N-Csulting Services: All ctracts more than US$ 1.0 milli equivalent; The PMU shall prior review the first ctract issued by each implementing agency, if the estimate of those ctracts are below the prior review threshold value. The Bank will cduct prior review for ly those ctract whose estimate falls in prior review threshold value. In additi, the justificatis for all ctracts to be issued LIB, single-source (>US$ 30,000) or direct ctracting (>US$ 30,000) basis will be subject to Banks prior review. These thresholds are for the initial 18 mths period and are based the procurement performance of the project, these thresholds will be modified. In additi, the Bank will carry out an annual ex post procurement review of the procurement falling below the prior review threshold mentied above. All ctracts below the specified prior review threshold value shall be subject to Procurement Review (PPR). The IA shall prepare a list of ctract and submit it to the Bank for cducting PPR. The PPR will be cducted annual basis. 2. Pre-qualificati. Not applicable 3. Reference to (if any) Project Operatial/Procurement Manual: Project Implementati Manual for World Bank Loan Project issued by Project Management Unit JTFRP, J&K, India All the ctracts issued under the project will follow the World Bank s Guidelines: Bank s Guidelines: Procurement under IBRD Loans and IDA Credits dated January 2011and revised in July 2014and Guidelines: Selecti and Employment of Csultants by World Bank Borrowers dated January 2011 and revised in July 2014, In case of any incsistency between the Procurement Manual or Government Procurement Procedures and the Bank Guidelines, the latter shall prevail. 4. Any Other Special Procurement Arrangements: The bid evaluati will be carried out as per agreed timeline in the Procurement Manual. Natial Competitive Bidding (NCB): Any ctract exceeding shopping threshold shall be procured using NCB method. The model bidding documents for NCB as agreed with the GoI Task Force (and as amended from time to time), shall be used for bidding. The following NCB provisis shall apply: i. Only the model bidding documents for NCB as agreed with the GoI Task Force (and as amended from time to time), shall be used for bidding. ii. Invitati to bid shall be advertised in at least e widely circulated natial daily newspaper (or a widely used website or electric portal with free natial and internatial access alg with an abridged versi of the said advertisement published in a widely circulated natial daily inter-alia giving the website/electric portal details from which the details of the invitati to bid can be downloaded), at least 30 days prior to the deadline for the submissi of bids. For smaller packages (lesser than US$1 milli for Works and US$

3 500,000 for Goods), advertisement in state newspapers will be accepted with at least 15 days given for submissi of bids; iii. No special preference will be accorded to any bidder either for price or for other terms and cditis when competing with foreign bidders, state-owned enterprises, small-scale enterprises or enterprise from any given State; iv. Except with the prior ccurrence of the Bank, there shall be no negotiati of price with the bidders, even with the lowest evaluated bidder; v. For prior review ctracts, extensi of bid validity shall not be allowed with reference to Ctracts subject to Bank prior review without the prior ccurrence of the Bank (i) for the first request for extensi if it is lger than four weeks; and (ii) for all subsequent requests for extensi irrespective of the period (such ccurrence will be csidered by Bank ly in cases of Force Majeure and circumstance beyd the ctrol of the Purchaser/Employer); vi. For prior review ctracts, re-bidding shall not be carried out with reference to Ctracts subject to Bank prior review without the prior ccurrence of the Bank; vii. The system of rejecting bids outside a pre-determined margin or bracket of prices shall not be used in the project; viii. Rates ctract entered into by Directorate General of Supplies and Disposal (DGS & D) will not be acceptable as a substitute for NCB procedures unless agreed with the Bank case to case basis. Such ctracts will be acceptable however, for any procurement under the Shopping procedure; ix. Two or three envelop system will not be used (expect when suing e-procurement system assessed and agreed by the Bank. Force Account: When ctractors/suppliers are unlikely to bid at reasable prices because of the locati and risk associated with the project or a certain government agency has exclusive rights in certain type of works/supply, borrowers may use their own government departments persnel and equipment or government owned cstructi unit may be the ly practical method, provided that the borrower has sufficient managerial capacity and possesses the required technical and financial ctrols to report to the Bank expenditure as per paragraph 3.9 of the Procurement Guidelines. Framework Agreements: DGS&D rate ctracts will be acceptable as framework agreement for procurement of Goods. State level rate ctracts will be examined by the Bank and if agreed, may also be used as framework agreements. Implementing agencies also have opti to set-up new framework agreements as per paragraph 3.6 of Guidelines. Use of government Institutis and Enterprise: Government owned enterprise or institutis in India may be hired for its unique and exceptial nature if their participati is csidered critical to the project implementati. In such cases, the cditis given in clauses 1.13 of Csultant Guidelines shall be satisfied and each case will be subject to prior review by the Bank. The works ctracts up to cumulative amount of 50 milli USD, would be directly executed by the J&K Projects Cstructi Corporati Ltd., which a Public Sector Undertaking. J&K Projects Cstructi Corporati Ltd. is executing projects of State as well as Central Government departments.
