Refer to Rule 20.3 (d) Permitted Activity Coditios Ameity Coditios Covered Footpaths All sites adjoiig specified pedestria eviromet streets 1 (as idicated i the Plaig Maps (Part C)) shall provide a permaet covered walkway over the public footpath adjacet to the site. Covered walkways shall: Provide cotiuity of cover, icludig (but ot limited to) cover across private vehicle access poits to the roadway, subject to provisio of clearaces i accordace with Rule (f). Esure that the safety ad coveiece of vehicle ad pedestria activity will ot be compromised. (d) Note: Covered walkways shall cover a miimum width of 2.5m of the public footpath, provided that where the full width of the footpath is less tha 3.0m the covered walkway shall be o closer tha 0.5m to the adjacet kerb. At other sites covered walkways shall be optioal. Support structures associated with the costructio of covered walkways, located withi the Road Zoe, will require the coset of Coucil to occupy the Road Zoe before a buildig coset is grated Vehicle-Pedestria Mix No activity o a site which adjois a public footpath alog a pedestria eviromet street 1 shall have direct vehicular access to that street other tha by a public service lae or a existig private access i the Commercial Busiess Zoe. 1 Special pedestria eviromet streets are idicated by symbols o the Plaig Maps (Part C). (ii) Notwithstadig Rule (i), ay lawfully established activity udergoig alteratios ad extesios such that the total cumulative icrease i osite vehicle parkig spaces that takes the total umber of parkig spaces lawfully provided o site beyod 25 calculated i accordace with Chapter 24 Trasportatio Activity ad Other Network Utility Rules, or ay umber specified by a previously grated resource coset for the site, does ot exceed - whichever is the greater 5 car park spaces, or 10% of the total car parkig spaces lawfully provided, to a maximum of 15 additioal spaces shall be deemed to be permitted i relatio to the provisio of osite vehicle parkig spaces subject to the umber, formatio ad layout of parkig, access, loadig ad maoeuvrig o the site beig i accordace with the provisios of this District Pla. This rule may be applied to a sigle occurrece or series of occurreces i relatio to ay site or activity provided that the total icrease i carparkig spaces as a result of applicatio of this rule shall ot exceed the greater of 5 carparkig spaces or 10% of the total carparkig spaces lawfully provided, to a maximum of 15 additioal spaces. Ay activity ivolvig the retail dispesig of vehicle fuels shall locate the dispesig uits or poits at least 10m from the mid-poit o the boudary of ay vehicle crossig o a public road. O all such sites frotage ladscapig comprisig a mix of trees, shrubs ad groudcover shall be provided cotiguous to, ad to a width of at least 2m measured from, the road frotage boudary, exclusive of vehicle accessways. Such ladscapig shall be geerally i accordace with the site desig, layout ad platig guidelies show o Appedix 20A: Streetscee Rule Pla ad Typical Cross-Sectios. Provided that Service Statios (referred to i Rule ) ad buildigs withi the Bayfair Shoppig Cetre, Royal Palm Beach Plaza ad Cetrepac (Pyes Pa) Commercial Busiess Zoes (referred to i Rule (e)) are ot subject to this Rule. For the purposes of this rule, ay permitted service statio shall be set back at least 1m from the road boudary of the site, ad provide frotage ladscapig cotiguous to, ad to a width of at least 1m from, the road boudary of the site, exclusive of permitted vehicle accessways For the purposes of this rule, vehicle accessways caot occupy more tha 50% of the legth of the road boudary of the site, except where a site has street frotage equal to the miimum vehicle access width required by the Pla (d) All ew buildigs ad site developmet i the Idustrial Busiess Zoe, other tha o those sites specified i Rule , shall pay a fiacial cotributio (Ladscapig Impact Fee) i respect of street ladscapig, as provided for i Rules 26.2(f) ad 26.2(g), before a buildig coset or subdivisio coset is issued (e) All buildigs withi the Bayfair Shoppig Cetre, Royal Palm Beach Plaza ad Cetrepac (Pyes Pa) Commercial Busiess Zoes shall be set back at least 10m from ay boudary, icludig where that boudary is a road boudary (f) O those sites specified i Rule (e), frotage ladscapig comprisig a mix of trees, shrubs ad groudcover shall be provided cotiguous to, ad to a width of at least 5m measured from, the road boudary, exclusive of permitted vehicle accessways. 6 Part B - Maagemet Rules (Ameded as at 15/09/2009) Tauraga District Pla Coservatio, Recreatio A, Recreatio B or Recreatio ad Leisure C Zoe, or is idetified as a proposed Esplaade Reserve, the commo boudary (that beig the zoe boudary) shall be feced with a 1.8m-high scree wall or closeboarded wood fece costructed of permaet materials Note: Visual Ameity - Sigs See also Rule Permitted Setback Itrusios The maximum height ad area of ay sig shall be: (d) Buildigs, structures ad activities (other tha vehicle parkig ad maoeuvrig but ot vehicle loadig) o a site i a Busiess Zoe adjoiig a site i a No-Busiess Zoe (except the Road Zoe), or a site idetified as a proposed Esplaade Reserve, shall be set back at least 5m from the zoe boudary or idetified proposed Esplaade Reserve boudary. This rule shall exclude basemet areas located etirely below groud level. Special Provisios for Parto Road (orth) Commercial Busiess Zoe Ladscapig comprisig a mix of trees, shrubs ad groud cover shall be provided cotiguous to, ad to a width of at least 2m measured from, the zoe boudary (see Appedix 20C: Papamoa Busiess Zoes - Parto Road (North) Structure Pla). Special Provisios for Courtey Road Commerical Busiess Zoe Ladscapig comprisig a mix of trees, shrubs ad groudcover shall be provided cotiguous to, ad to a width of at least 3m measured from, the zoe boudary (see Appedix 20M: Courtey Road Busiess Zoe Structure Pla). Utility rooms such as kitches, bathrooms ad storage areas are ot habitable rooms uder this rule. For the purpose of this rule, oise received shall be measured at the exteral boudaries of ay habitable room i commo occupacy that forms part of a residetial activity Costructio oise from the site shall meet the limits recommeded i, ad shall be measured ad assessed i accordace with NZS6803:1999 (f) (g) (h) Acoustics Costructio Noise or ay supersedig codes of practice or/ stadards. O-site parkig, access ad maoeuvrig areas for a activity required by rules i Chapter 24 Trasportatio Activity ad Other Network Utility Rules shall be sealed to esure that dust is ot geerated by traffic movemets Developmet Itesity ad Scale Residetial Activities The maximum developmet itesity for Residetial Activities (except shared accommodatio) o a Commercial Busiess Zoe site shall be: 1 idepedet dwellig per 50m 2 of site area Visitor accommodatio ad Shared accommodatio The maximum developmet itesity for visitor accommodatio ad shared accommodatio o a Commercial Busiess Zoe site shall be: (i) 1 self-cotaied visitor accommodatio uit per 50m 2 of site area (ii) Where visitor accommodatio is ot self-cotaied the maximum gross floor area (GFA) of habitable rooms shall be 65m 2 per 100m 2 of site area. (iii) Shared accommodatio shall be limited to a maximum of 8 permaet residets per site Cohesive Busiess Developmet Residetial, educatio ad visitor accommodatio activities i the Commercial Busiess Zoe shall ot be located at street level uless (for a diagrammatic explaatio of this rule see Appedix 20K:) (i) O Pedestria Eviromet Streets the activity is separated from the street frotage by retail ad/or office space extedig to a depth from the street frotage of 15m or 50% of the depth of the site, whichever is the lesser, except that provisio may be made for pedestria access to the street comprisig ot more tha 25% of the street frotage of the site.
