EDITOR: Lacie Barber, MLS Administrator C.E.O. REPORT Construction Update: The scheduled completion date for the building annex is January 15. This will allow us to hold our first Broker s Update in the new facility on January 16. BIC s are encouraged to pre-register for this exciting event. ISSUE 185 At the NAR Annual Convention held in Boston in early November, several key decisions were made, including a decision to offer a Healthcare Program for Associations. Now the task of finding an insurance company to Nick Sabatine, C.E.O. underwrite the program begins. Stay tuned for further updates on this huge member benefit. In the meantime, link to for information on other decisions. In addition, NAR rolled out its Commitment to Excellence Program (c2ex), focused on developing REALTOR skills in 11 different areas. To learn more, link to introducing-nars-commitment-to-excellence-program. House Measurements: Member appraisers have asked that agents request assistance if a property is difficult to measure. Inaccurate measurements have caused gaps between the listed price and the appraised value, which creates issues for both agents and consumers. New Agent Application Packets for 2019 have been sent to all BIC s with updated information regarding GGAR dues and MLS fees. Please note that as of January 1, 2019, the application fee for new agents is $500. Be sure to discuss this with your new recruits before sending them to GGAR No- Show Policy: We have had difficulty with no-shows at events after registrations. Many times, when food is being served or agreements are entered into based on minimum attendance, the association is left in a deficit position. Therefore, the Board of Directors has established a policy that if a member registers for an event but does not attend and gives no notice, the member will be charged a $25 fee. Thanks for understanding this necessary policy. Continued on Page 2

2 PAGE 2 C.E.O Report continued 48-Hour Rule: Remember that there is only a 48-hour window for listings to be put into MLS, starting at the time the owner signs the listing agreement. Properties can be shown as soon as the listing is taken. Entering the listing immediately upon receiving the seller s signature will provide maximum exposure. Entry into listings is prohibited without a confirmed appointment unless directed otherwise by the listing agency. Mediations: CEO Nick Sabatine will be offering to conduct mediations when both parties agree. The service will be free to members and will be conducted at the Association Office. It appears that SC is not the only state having difficulty with offer presentations as NAR made a change to its Code of Ethics Standard of Practice 1-7 to require the presentation of a written document certifying presentation to the seller when requested by the buyer or buyer s agent. This will not result in change in SC as LLR already requires this to be done when a seller rejects an offer without counter. In SC, the buyer or buyer s agent does not have to ask for the form it is mandatory in all transactions, including commercial. Download the required document at pol/rec/. Offer Rejection Form: LLR has reported a continuing problem with failure to use this mandatory Offer Rejection Form. Many feel that the rule can be ignored if using SCR Form 312. Due to this, SCR has an archived webinar at screaltors.org that will explain the use of both forms. The rule is simple: When an offer is presented to a seller, one of three documents must be returned to the buyer in a timely manner: Written Acceptance of Offer Written Counteroffer Rejection of Offer Form Using SCR form 312 (multiple offer form) does not relieve the member from the mandatory use of the LLR form. 312 is a multiple offer form used for highest and best requests and is not a counteroffer. Review the webinar to learn the ins and outs of the forms and greatly reduce your risk. No new forms have been provided this year by SCR, though the Form 310 Residential Purchase Agreement was amended to remove references to the return of earnest money. Disputed trust funds can only be disbursed by agreement of the parties or court order. Be sure that you never tell a buyer don t worry you will always be able to get your earnest money back. That is not what the form says and if the seller disputes the return of the earnest money, license law will instruct the escrow agent on how to handle this dispute. Take a class soon on contracts so that you will be able to use reasonable care and diligence in explaining these documents. 10 2018 GGAR Revitalization Awards PAGE 10 The 2018 Revitalization Awards were presented by Sherry Cantrell, 2018 Revitalization Committee Chair, at the GGAR Associate Luncheon on October 11, 2018 at the Poinsett Club. Revitalization is much more than remodeling. Revitalization awards are presented to individuals that took a chance, invested a substantial amount of time and money in a property in the Greater Greenville Area. This year 4 awards were presented: Residential, Commercial, Historical Restoration and Honorable Mention. The 2018 Residential Revitalization Award was presented to Mark Thoennes Builders for their work on 100 Old Augusta Road in Greenville. The 2018 Commercial Revitalization Award was presented to Westone Development LLC for their work at the WESTONE at 109 West Stone Avenue in Greenville. GGAR would like to extend a special thank you to all of the 2018 Revitalization Award recipients for their time and extraordinary work in our community and the Upstate. Prizes for winners were provided by On Q Financial, South State Bank, the Wyatt Institute of Real Estate, Peculiar Marketing, Uphill Strategies, and Blackstream/ Christie s International Real Estate. The 2018 Historical Restoration Revitalization Award was presented to James & Doug Carter of The Whiskey Hotel, a Carter company for their extensive transformation of 722 & 724 South Main Street in Greenville which is currently Husk Restaurant. The 2018 Honorable Mention Award goes to Greenville Drive Baseball at Fluor Field for revitalizing what was an old lumber yard into the catalyst for the West End District as family The properties were judged by Lorna Cardenes of DP3 Architects, Peggy Major (past committee members and real estate agent) and Keith Smith of Keith Smith Builders and 2017 Residential Revitalization Winner. 25 PAGE GGAR Realtor of the Year The 2018 Realtor of the Year was awarded by Mandy Chapman Crain to Matthew Thrift during the Associate Luncheon held at the Poinsett Club on October 11, Thrift was born and raised in Miramar, FL. He began his career in law enforcement and served with Pembroke Pines Police Department in Broward County Florida in 1995 until he relocated to Greenville in December He worked for the City of Greenville Police Department in 2002 and In October of 2006, Thrift became licensed in real estate and began his career as a Realtor with Joy Real Estate. He went on to work at Keller Williams Realty in 2007 where he spent 5.5 years concentrating on distressed homes and foreclosures. Thrift opened his own brokerage in 2012 with his concentration remaining focused on distressed homes and foreclosure sales. Thrift served on The Greater Greenville Association of Realtors (GGAR) MLS Committee and chaired the committee in his third year of participation. He was nominated in 2013 to serve on the GGAR Board of Directors and was elected Vice President of GGAR in 2014 and went on to serve as the President of GGAR for He is currently the 2018 Chair of the GGAR Grievance Committee. GGAR/MLS Events Thrift began working with Berkshire Hathaway Home Services C. Dan Joyner Realtors in October, He is currently the Broker in Charge of the Simpsonville and Greer locations. It is truly a pleasure and an honor to be working as a Realtor in the Upstate - Matthew Thrift South Carolina Realtor of the Year South Carolina REALTORS announced the selection of Fritzi Barbour as the 2018 South Carolina REALTOR of the Year at the Association s Board of Directors meeting on October 17, 2018 in Columbia. Barbour, Broker-in-Charge of C. Dan Joyner, REALTORS Pleasantburg Drive office, started her real estate career in Virginia in Since that time, Barbour has exhibited strong commitment to REALTOR organizations, specifically issues related to Professional Standards and Multiple Listing Service Policy. She has served as President of both the South Carolina REALTORS and the Greater Greenville Association of REALTORS, in addition to many other elected and appointed positions within those organizations. She is currently serving as 2018 Law and Policy Liaison, an appointment of the current National Association of REALTORS President. She was selected as the GGAR REALTOR of the Year in 2010 and VPAR Salesperson of the Year in 1991, both meaningful awards in her career, as they were the result of peer selection.
