13 Staff Report Zoning and Land Regulation Committee Public Hearing: March 19, 2013 Petition: Rezone Zoning Amendment: Town/sect: A-1EX Exclusive Agriculture Blooming Grove District to C-2 Commercial Section 2 District Acres:5.0 Survey Req. No Reason: Compliance for future garden center / mini-warehouse uses Applicant Robert R Gersbach Location: 3487 County Highway T DESCRIPTION: The applicant would like to amend the zoning on his 5-acre property in order for it to be used for commercial purposes. The stated use is to be a garden center along with mini-warehouses. No specific development plan has been presented. OBSERVATIONS: The property is located approximately ½ mile northeast of the Interstate 94/90 interchange. The majority of the neighboring properties are used for agricultural purposes (crops). There is an existing single-family residence on the property, as well as, the property to the east. No active commercial activity exists in the area. The property is adjacent to the City of Madison and is within the City of Madison Urban Service Area. The property consists of entirely of Class II soils. TOWN PLAN: The 2000 Town Plan designates this area as a Rural Residential Area. However, adjacent parcels are zoned for commercial purposes: LC-1, C-1, and C-2 with limitations. CITY OF MADISON PLAN: The City of Madison comprehensive plan notes the 90/94 corridor to be used for a Commercial Employment area. The City of Madison Planning Department expressed concerns with the development of this property given that it is in the urban service area. The City of Madison Planning Department requested that the project be filed until a specific proposal is presented. See attached letter. DANE COUNTY HIGHWAY: County Highway T is a controlled access highway. Access to the property is restricted to a joint drive easement located on the property to the east. A permit will need to be obtained from Dane County Highway for a change of use of the access point. RESOURCE PROTECTION AREA: The property is outside the resource protection area. STAFF: Staff suggests that a development plan be presented to the Committee prior to rendering a decision of the zoning change. Staff suggests that the land uses be limited to ones that will be compatible with future development of the area. It is suggested to deed restrict the property to prohibit billboards. TOWN: Approved with no conditions. 3/19 ZLR Action: Motion by Hendrick / Bollig to postpone until the work meeting; motion carried, 3-0. YGP: 1-0. Staff Update: No additional information has been presented on the proposed project. Staff is concerned that the proposal conflicts with the current Town Plan (rural residential); the proposed commercial development of this property is premature for the area; and the unplanned development may cause conflicts with the orderly development of the area.

19 March 8, 2013 Robert Gersbach 4727 Yahara Drive McFarland, WI Room 116, City-County Building, Madison, Wisconsin Fax (608) RE: Zoning Change for 3487 County Highway T Housing & Economic Development (608) , Rm. 362 Planning (608) , Rm. 116 Records & Support (608) , Rm. 116 Zoning (608) , Rm. 116 Dear Mr. Gersbach: Dane County Zoning Division conducted an initial review of the proposed rezoning of your property. To prepare for the ZLR Committee meeting, it is suggested that some thought be put into the following items: Development plan for the site: The ZLR Committee may require a site development plan for the property to evaluate the compatibility of the project with the surrounding area or neighborhood plans. It is suggested that the site plan be prepared to show proposed buildings, parking area, and storm water management location. Limits on Land Uses: The ZLR Committee will be concerned that the permitted land uses on the property may or may not be compatible with the future plans for the area. Enclosed is a list of land used permitted in the C-2 Commercial Zoning District. Please designate the land uses you feel are compatible with the area and with future development of the area. Access to the Property: County Highway T is a controlled access highway. Access to your property is limited to an access easement on the adjacent property. Please contact Dane County Highway Department to ensure that the access may be used for commercial purposes and if any improvement will be needed for commercial development of the area. City of Madison Planning: Your property is located adjacent to the City of Madison and is within the City of Madison Urban Service Area. The ZLR Committee will be interested in how your development will complement the City of Madison s neighborhood plan for the area. It is suggested to contact the City of Madison Planning Department to discuss your development plans with them. If you have any further questions or concerns, please feel free to contact me. Respectfully, Roger Lane Dane County Zoning Administrator

If allowed, she suggested limiting the use of the property as well as the outdoor display of items. RESOURCE PROTECTION AREA: The property is located outside the resource protection area. STAFF: Staff suggests deed restricting the land uses specifically to small engine sales and repair with repairs being conducted inside the dwelling(garage). Staff also suggests limiting outdoor display/storage to (revised) pieces of equipment; and a deed restriction to be placed on the property to prohibit billboard signs. TOWN: Zoning: Approved limiting land uses to small engine and lawn/garden sales and repair and the installation of a fence along the west side of the property. CUP: Approved with no conditions. 3/19 ZLR Action: Motion by Hendrick / Bollig to postpone the zoning petition and the conditional use permit; motion carried, 3-0. YGP: 1-0.
