2 TOWN OF CEDARBURG PLAN COMMISSION MINUTES October 15, 2014 TOWN OF CEDARBURG PLAN COMMISSION MEETING MINUTES October 15, 2014 Present: Also Present: Chairman David Valentine, Ralph Luedtke, Joe Rintelman, Dan Wundrock, Paul Waldo, Rick Goeckner, Edward Downey Jim Culotta, Town Administrator, Brad Hoeft, Town Attorney, Eric Ryer, Assistant Administrator 1. CALL TO ORDER/PLEDGE OF ALLEGIANCE Chairman Valentine called the regular meeting to order at 7:00 pm. The meeting began with the Pledge of Allegiance. 2. MINUTES OF PREVIOUS MEETING: a. Approval of August 20, 2014 Plan Commission Meeting Minutes* Commissioner Rintelman moved and Commissioner Luedtke seconded a motion to approve the minutes from August 20 th, The motion passed unanimously. 3. PUBLIC HEARING a. Public hearing to take comment on a conditional use permit application by Thomas Ward to operate an insurance office at the property located at 9316 Pioneer Road [SE ¼ of Section 32, 1 acre, zoned A-1 Agricultural] Thomas Ward has submitted a conditional use permit application that would allow him to move insurance activities into the building located at 9316 Pioneer Road. Mr. Ward plans to initially use the structure for internal meetings with agents. The plan would be to eventually use dividers and create work cubicles on the main floor. Thomas Ward, the applicant and owner of 9316 Pioneer Road, came forward and noted he hoped the application would be looked upon favorably by the Plan Commission. With no other comment from the public, Commissioner Waldo moved to close the public hearing. Commissioner Rintelman seconded, and the motion passed unanimously. b. Public hearing to take comment on a conditional use permit application by Richard Mechanic and Andrew Schultz to operate vehicle sales, repair, washing and garage at the property located at 2110 Washington Avenue [SE ¼ of Section 6, 1.83 acres, zoned B-1 Neighborhood Business district] Richard Mechanic was granted a conditional use permit (CUP) in 2013 to construct an addition on the existing building located at 2110 CTH NN and operate vehicle sales over the Internet, vehicle repair, washing and garage. As part of the addition, the existing building was renovated to match the addition. Richard Mechanic and Andrew Schultz have now submitted a CUP application to amend the 2013 CUP to allow for outdoor storage of no more than 10 vehicles for sale, as well as a new ground sign face to be mounted on the existing sign posts. With no comment from the public, Commissioner Luedtke moved to close the public hearing. Commissioner Rintelman seconded, and the motion passed unanimously. c. Public hearing to take comment on a conditional use permit application by John McHugh of Armadi Artisans & Craftsman LLC to operate a woodworking shop building cabinets and furniture at the property located at 9716 Pioneer Road [SE ¼ of Section 32, 2.2 acres, zoned B-3 Business] 1 2

3 TOWN OF CEDARBURG PLAN COMMISSION MINUTES October 15, 2014 John McHugh of Armadi Artisans & Craftsman LLC has submitted a conditional use permit application to operate custom cabinet and furniture manufacturing on the property located at 9716 Pioneer Road. The building was previously used for woodworking activities by Advanced Wood Design. Traffic to the site consists of a once-a-day delivery. With no comment from the public, Commissioner Waldo moved to close the public hearing. Commissioner Rintelman seconded, and the motion passed unanimously. Commissioner Rintelman then moved the Plan Commission take all items under new business before item #4a. Commissioner Luedtke seconded, and the motion passed unanimously. The Commission then moved to item #5a. 4. OLD BUSINESS a. Update on the Five Corners Master Plan* The Plan Commission discussed this item at their July and August meetings. At the July meeting, the Commission noted the original draft was completed in Since then, many things have changed and it may be wise to revisit the plan. The Commission felt the plan could best be addressed on a piece-by-piece basis. At the August Plan Commission meeting, the Commission discussed conducting a market analysis to see what types of development would best fit the Town, and directed staff to look into options and present ideas at a future meeting. At the current meeting, Administrator Culotta explained staff spoke with UW-Extension staff and unfortunately they communicated that the Town center did not meet their criteria to be able to complete a market analysis for the Town. They could, however, provide additional data to the Town that may be beneficial. The Plan Commission suggested several other possible contacts for this effort including the Southeastern Wisconsin Regional Planning Commission, GRAEF Engineering, and Ed Beimborn, a former Town Committee member that taught at UW-Milwaukee. Staff will continue to pursue avenues of gathering information and bring updates to the Plan Commission. The Commission then moved to item #6. 5. NEW BUSINESS a. Discussion and possible recommendation on a conditional use permit application by Thomas Ward to operate an insurance office at the property located at 9316 Pioneer Road [SE ¼ of Section 32, 1 acre, zoned A-1 Agricultural]* This item continues from #3a. Chairman Valentine noted the smaller size of the property, which limits the number and types of uses that could occur at this location. The Commission asked Mr. Ward if he had reviewed the CUP and if he had any questions; Mr. Ward noted he had reviewed the CUP and had no questions. Following discussion, Commissioner Rintelman moved that the Plan Commission recommend the Town Board approve the conditional use permit (as the conditions below are present): 1) Welfare. The establishment, maintenance or operation of the conditional use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare. 2) Compatible with adjacent land. The uses, values and enjoyment of other Town property in the neighborhood for purposes already permitted shall be in no foreseeable manner substantially impaired or diminished by the establishment, maintenance or operation of the conditional use. 3) Not impede surrounding property development and improvement. The establishment of the conditional use will not impede the normal and orderly development and improvement of the surrounding Town property for uses permitted in the district. 4) Adequate infrastructure. Adequate utilities, access roads, drainage and other necessary site improvements have been or are being provided. 5) Ingress and egress. Adequate measures have been or will be taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets. 6) Conform to zoning district regulations. The conditional use application shall conform to all 2 3

Discussion and possible recommendation on a conditional use permit application by Richard Mechanic and Andrew Schultz to operate vehicle sales, repair, washing and garage at the property located at 2110 Washington Avenue [SE ¼ of Section 6, 1.83 acres, zoned B-1 Neighborhood Business district]* This item continues from item #3b. Commissioner Rintelman noted the original CUP granted to Mr. Mechanic was for Internet vehicle sales only, and asked how the business would change under the amended permit. Mr. Mechanic noted he and Mr. Schultz feel their sales would increase with a presence of vehicles in their lot. They noted despite the vehicle display outdoors, there would be no additional lot lighting. The Commission discussed the fact that the lot has two access points off of Washington Avenue, and that Ozaukee County has asked that the northwestern access be closed off. The applicants noted they would be alright with closing the northwestern access; staff will notify the County, and add a condition to the CUP regarding this issue. The applicant also noted they will purchase Town issued carts for refuse. Staff confirmed there was no comment received from the public. Following discussion, Commissioner Rintelman moved that the Plan Commission recommend the Town Board approve the amended conditional use permit (as the conditions below are present): 1) Welfare. Attorney Hoeft clarified that Ozaukee County would work with the applicant to close the northwest entrance. c. Discussion and possible recommendation on a conditional use permit application by John McHugh of Armadi Artisans & Craftsman LLC to operate a woodworking shop building cabinets and furniture at the property located at 9716 Pioneer Road [SE ¼ of Section 32, 2.2 acres, zoned B-3 Business]* This continues from item #3c. The Commission was in favor of the application. Mr. McHugh noted they had almost 40 employees last year and would hope to increase that number. However, most of the employees are in the field and only a limited number would work onsite. Following discussion, Commissioner Rintelman moved that the Plan Commission recommend the Town Board approve the conditional use permit (as the conditions below are present): 3 4

Discussion and possible recommendation on an architectural and site plan review for a 8,960 square foot pole building located at Western Avenue [Petitioner: Dale Lueders, NE ¼ Sec. 31, zoned A-1 Agricultural, acres]* Dale Lueders would like to construct an 8,960 square foot metal outbuilding on his property located at Western Avenue. The building would consist of one long span measuring 70 x 128. A principal building of this size is allowed on his acre lot, as there is no limit on the size of agricultural buildings on A-1 on lots greater than 8 acres. Section of the Code explains that new buildings greater than 1,500 square feet are required to go before the Plan Commission and Town Board for architectural and site plan review. Chairman Valentine noted additional land was added to this parcel recently (and rezoned) to make room for a new outbuilding while meeting setbacks. This would also allow for the storage of equipment indoors as opposed to outdoors. The Plan Commission and Town Board must review the following findings in order to approve site plans for any individual building, being newly constructed, that is greater than 1,500 square feet: (1) The proposed use(s) conforms to the uses permitted. (2) The dimensional arrangement of buildings and structures conforms to the required area, yard, setback, and height restrictions of this chapter. (3) The proposed on-site buildings, structures, and entryways are situated and designed to minimize adverse effects upon owners and occupants of adjacent and surrounding properties by providing for adequate design of ingress/egress, interior/exterior traffic flow, stormwater drainage, erosion, grading, lighting, and parking, as specified by this chapter or any other codes or laws. (4) Consideration should be given to preserving the natural features of the landscape where they can enhance the development on the site, or where they furnish a barrier or buffer between the project and adjoining properties used for dissimilar purposes or where they assist in preserving the general safety, health, welfare, and appearance of the neighborhood. 4 5

6 TOWN OF CEDARBURG PLAN COMMISSION MINUTES October 15, 2014 (5) Adverse effects of the proposed development and activities upon adjoining residents or owners are minimized by appropriate screening, fencing, or landscaping, as provided or required in this chapter. Commissioner Rintelman then moved the Plan Commission recommend the Town Board approve the architectural review and site plan given that all the above findings are present. Commissioner Downey seconded, and the motion then passed unanimously. The Commission then moved to item #4a. 6. ADJOURNMENT Commissioner Waldo moved to adjourn the meeting.
