NTRODUCTON OF PROPOSED ORDNANCE NO VACATNG A PORTON OF A SEWER EASEMENT N "MARYVLLE CENTRE PLAT ONE", A SUBDVSON N ST. LOUS COUNTY, MSSOUR. Proposed Ordinance No was presented and read, vacating a portion of a sewer easement in "Maryville Centre Plat One", a subdivision in St. Louis County, Missouri. Mr. Butchko stated that there were no sewers located within the easement to be vacated and that the property owner had granted a new easement. LOUS, MSSOUR. Proposed Ordinance No was presented and read, appropriating $335, from the Mississippi River Operating Fund to be used for the construction of sanitary sewers, together with repayment of the cost of Engineering, Survey and nspection, and miscellaneous other costs incurred in connection with such construction project, in Mill Creek Relief-Nebraska nterceptor (S-2141, C-1065), in the City of St. Louis, Missouri. Mr. Butchko explained that this sanitary sewer project located in the City of St. Louis would be funded 55 percent by the State and 45 percent by MSD. He commented that this project would correct the problems occurring when the Mississippi River is at high level. Mr. Jones inquired as to the low bidder, and if there were any reasons why fewer bids are being received. Mr. Butchko responded that the low bid was $314,046.25, reflecting recent increased bids, and that the reduction in bidders is probably due to the construction industry's saturated market. Proposed Ordinance No was presented and read, confirming a contract with Bommarito Construction Company of St. Louis for the construction of sanitary sewers in Mill Creek Relief-Nebraska nterceptor (S-2141, C-1065), in the City of St. Louis, Missouri. Mr. Butchko stated that Bommarito Construction Company of St. Louis was the lowest'of 4 bidders at $314, The high bid was $600, and the District's estimate was $270, Motion made by Mr. Borghi, seconded by Mr. Ordinance No be introduced. Mr. Butchko explained that this sanitary sewer project would be funded 55 percent by the State and 45 percent by MSD. He stated that during high stages of the river this project would eliminate bypassing sewage directly to the river. He stated that as the bidding on this project had occurred approximately one year after the consulting engineer had prepared the estimate, the low bid was higher than anticipated. Luth & Sons, nc. was the lowest of 5 bidders at $52, The high bid was $182, and the District's estimate was $30,496,00. 5 NTRODUCTON OF PROPOSED ORDNANCE NO VACATNG PORTONS OF SEWER EASEMENTS N LOTS 5, 6, 7, 8, 9, AND 10 N LACLEDE ARPORT PARK, N THE CTY OF BERKELEY, ST. LOUS COUNTY, MSSOUR. Proposed Ordinance No was presented and read, vacating portions of sewer easements in Lots 5, 6, 7, 8, 9, and 10 in Laclede Airport Park, in the City of Berkeley, St. Louis County, Missouri. Mr. Butchko stated that there are no utilities in the easement to be vacated, and that the vacation had been requested as several lots are being combined into two lots. Motion made by Mr. Borghi, seconded by Mr. Shanahan, that proposed Ordinance No be introduced. NTRODUCTON OF PROPOSED ORDNANCE NO APPROPRATNG $13, FROM THE GENERAL FUND OF THE DSTRCT TO BE USED FOR THE CONSTRUCTON OF SANTARY SEWERS, TOGETHER WTH REPAYMENT OF EXPENSES NCURRED BY THE DSTRCT N CONNECTON WTH SUCH CONSTRUCTON.PROJECT KNOWN AS SUBDSTRCT NO. 599 (BARRETT WOODS DRVE), N ST. LOUS COUNTY, MSSOUR. Proposed Ordinance No was'presented and read, appropriating $13, from the General Fund of the District to be used for the construction of sanitary sewers, together with repayment of expenses incurred by the District in connection with such construction project known as Subdistrict No. 599 (Barrett Woods Drive), in St. Louis County, Missouri. Mr. Brady stated that this was a small private subdistrict consisting of two residences currently served by septic tanks. This sewer project will be funded totally by the property owners and the District will inspect the installation of the sewers and disburse the funds covering the cost. Motion made by Mr. Borghi, seconded by Mr, Jones, that proposed Ordinance No, be introduced.

Lee, Jr, - aye NTRODUCTON OF PROPOSED ORDNANCE NO APPROPRATNG $54,883,20 FROM THE OPERATON, MANTENANCE AND CONSTRUCTON MPROVEMENT FUND OF SUBDSTRCT NO. 449 (MERAMEC RVER BASN - M.S.D. SOUTHWEST) FOR THE ACQUSTON OF A CERTAN PARCEL OF REAL PROP.ERTY N ST. LOUS COUNTY, MSSOUR FOR THE CONSTRUCTON OF THE VANCE ROAD PUMP STATON (PART OF FEDERAL PROJECT NO. C ). Proposed Ordinance No was presented and read, appropriating $54, from the Operation, Maintenance and Construction mprovement Fund of Subdistrict No. 449 (Meramec River Basin - M.S.D. Southwest) for the acquisition of a certain parcel of real property in St. Louis County, Missouri for the construction of the Vance Road Pump Station (part of Federal Project No. C ). Mr. Etwert stated that this appropriation is necessary to acquire certain real property by condemnation for the Vance Road Pump Station. He stated that the court had acknowledged the District's right and had awarded $49, for the property. Motion made by Mr. Shanahan, seconded by Mr. Borghi, that proposed Ordinance No be introduced. NTRODUCTON OF PROPOSED ORDNANCE NO MAKNG A SUPPLEMENTAL APPROPRATON OF $25, FROM THE MSSSSPP RVER CONSTRUCTON FUND FOR CONTRACT E-289 (ENGNEERNG SERVCES TO PREPARE A COMPREHENSVE SOLDS MANAGEMENT PLAN FOR ALL OF THE ASH, GRT AND SCREENNGS, AND OTHER RESDUAL SOLDS GENERATED BY THE WASTEWATER TREATMENT FACLTES OF THE DSTRCT.), FEDERAL PRQJECT Proposed Ordinance No was presented and read, making a supplemental appropriation of $25, from the Mississippi River Construction Fund, of which $2, is to be used to pay the District's ten percent share; a grant of $18, has been received from the Environmental Protection Agency, and $3, has been reserved by the Missouri Department of Natural Resources for Contract E-289 (Engineering services to prepare a comprehensive solids management plan for all of the ash, grit and screenings, and other residual solids generated by the wastewater treatment facilities of the District.), Federal Project C
7 Mr. Etwert stated that this supplemental appropriation, approved by the Board's Engineering Committee, was for the completion of an engineering study to prepare a management plan for all residual solids generated by the District's treatment facilities. M, F, Shanahan - aye H, W, Lee, Jr. - aye NTRODUCTON AND ADOPTON OF PROPOSED ORDNANCE NO, APPROPRATNG $310,000,00 FROM THE GENERAL FUND OF THE DSTRCT FOR THE PURCHASE OF ALL REAL PROPERTY, SEWAGE TREATMENT FACLTES, PUMP- STATONS, MPROVEMENTS AND EASEMENT RGHTS, ALL PERSONAL PROPERTY, ALL FRANCHSE AND CONTRACT RGHTS, AND ALL ACCOUNTS RECEVABLE OF RVERSDE SEWER COMPANY, NC, A MSSOUR CORPORATON, AND DRECTNG THE REPAYMENT OF SUCH FUNDS TO THE GENERAL FUND OF THE DSTRCT. Proposed Ordinance No, was presented and read, appropriating $310, from the General Fund of the District for the
8 purchase of all real property, sewage treatment facilities, pump stations, improvements and easement rights, all personal property, all franchise and contract rights, and all accounts receivable of Riverside Sewer Company, nc., a Missouri Corporation, and directing the repayment of such funds to the General Fund of the District. Mr. Kaiser stated that his comments relate to proposed Ordinances and providing for the purchase of the assets of Riverside Sewer Company serving the City of Fenton. He pointed out that this privately owned sewer company had been in bankruptcy and that MSD had been operating the treatment facilities for the City of Fenton since He stated that the facilities would be purchased by MSD for $310, Mr. Kaiser then introduced the Mayor of Fenton. Mr. Joe Morgan, and the Attorney for Fenton, Mr. Tom Utterbach, Mayor Morgan and Mr. Utterbach expressed their appreciation to the Board and to Mr, Kaiser for MSD's assistance in resolving this problem for the City of Fenton. Mr. Lee thanked the gentlemen from Fenton for their comments, and Mr. Kaiser stated that it would be necessary to introduce and adopt the ordinances at this meeting, in order that the deadline of June 30 could be met. Motion made by Mr. Borghi, seconded by Mr. Jones, for unanimous consent of all members present for introduction and final voting on proposed Ordinance No at this meeting. M. Proposed Ordinance No was presented and read, providing revenue for improvements, and for local matching funds for State and Federal grants, and providing revenue for the bperation and general purposes in the Riverside Service Area of The Metropolitan St. Louis Sewer District; providing a schedule of Contribution in Aid of Construction (CAC) fees to be collected for the connection directly or indirectly of any building or other facility to the sanitary sewer system and treatment facilities of the Riverside Service Area; and providing a schedule of service charges to be collected from all of the real property, whether public or private, served directly or indirectly by the public sewer systems and facilities of the Riverside Service Area

The Chairman declared proposed Ordinance No adopted, and it was assigned Ordinance No ADOPTON OF RESOLUTON NO COMENDNG GREGORY P, BOYER FOR HS SERVCE TO THE DSTRCT. Resolution No was presented and read, commending Gregory P. Boyer for his service to the District, Mr. Hagel announced that Mr, Boyer had resigned from MSD to accept another position and that this Resolution commended Mr. Boyer for his service to the District.
