2 district Wo. 391 (Keim Homesites) of The Metropolitan St. Louis Sewer District. Mr. Sears showed on a wall map the location of the proposed subdistrict as being basically between Telegraph Road and Jefferson Barracks and south of Jeffersonian Dri-ve and. north of Franru Lane. He said this area had been annexed recently by Ord.inance Wo. 2374, and contained- 67 lots with 67 homes. The purpose of the subdistrict is to eliminate a sink hole which is causing problems by producing seepage through the bluffs along the Mississippi River. This would, remove- the sewage ;from the sink hole and carry it to existing District sewers. Mr. Sears showed on a wall map the location of the proposed subdistrict as being on both sides of East Concord, Road and lying west of Lind,bergh Boule-vard. A portion of it, too, was annexed, recently by Ordinance No The area is primarily on septic tanks which the sanitary sewer would relieve. 3 'Mr. Sears showed on a wall map the location of the proposed subdistrict as being in the western part of Kirkwood, slightly west of nterstate 244 and between Big Bend Road and the Frisco Railroad tracks. The purpose of the subdistrict is to eliminate two community septic tanks, and drain under the railroad to a gravity sewer. Proposed Ordinance Wo was presented and read, authorizing and directing the Executive Director to amend an Underground Gas Storage Easement Deed, dated March 31, Mr. Kaiser said there was an existing easement and. two leases on the Coldwater Creek treatment plant site when we acquired it (the subject of this and the next two ordinances.) These were for the storage of gas in the porous rock, lying'1000 feet or more below the surface. The Gas Corapany has apparently found that the gas has risen 30 or 40 feet, and it wishes to extend the easement and leases to reflect this change. The change is stated as including"the use of the Trenton limestone and its cap rock, the Maquoketa shale" instead of a certain number of feet.. This use in no way interferes with the District's use of the surface and subsurface treatment plant and.-sewer operations. There was considerable discussion including the question propounded by Mr. Concannon about insurance coverage in case of catastrophe. Mr. Kaiser said that he would have the Gas Company protect the District by''-,i'ts:rinsurance..coverage.. N SUBDSTRCT NO. 38O (PADDOCK CREEK) Proposed Ordinance No was presented and. read, transferring Forty-six Thousand Five Hundred Dollars from the General Fund of the District as a loan to the Operation, Maintenance, and. Construction mprovement Fund of Subdistrict No. 38O (Upper Paddock Creek), and providing for the repayment of said s-am; and further appropriating One Hundred Ten Thousand Dollars frora the Operation, Maintenance and Construction raproveraent Fund of Subdistrict No. 380 (Upper Paddock Creek) to be used for the construction of improvements of the channel of Subdistrict No. 38O (Upper Paddock Creek,) Mr. Mattei said that the Vickers Oil Company is adjacent to the portion of Upper Paddock Creek which still needs.improvement, and is contributing $54,500 toward that improvement. The District has been'le-vying a 10(/: ad valorem tax each year, and although it has made previous improvements with this sum, there is now the amount of $ remaining in the fund. We have taken bids to improve this part of the channel and need a total of $110,000 to award, the contract. He said he is thus asking the Board to lend $46,500 from the General Fund to this account in order to award the contract. This loan would be repaid as.soon as.the subdistrict receives income. Mr. Mattei said this is the lowest of seven bids at $99, The high bid was $173, and the District's estimate was $110, He recommended the awarding of the contract to Tarlton. R.-Parker - aye CONSDERATON OF PROPOSED ORDNANCE NO APPROPRATNG $ FROM THE UNAPPROPRATED SURPLUS OF THE GEWERAL FUND TO BE USED FOR DSTRCT'S SHARE OF' THE PHASE STUDY TO BE MADE BY EAST-WEST GATEWAY COORDNATNG COUNCL Proposed. 7 priating $ from the unappropriated surplus of the General Fund to be used for the District's share of the Phase - -Study to be made by the East-West Gateway Coordinating Council on abating the pollution of water within that part of St. Louis County outside the corporate limits of The Metropolitan St, Louis Sewer District. Mr. Enger said in May, 1970 the Board approved participation with St. Louis County to make a study of the remaining portion of the County outside the District. The total cost of the study which was to be made by E-W Gateway Coordinating Council was $170,000. One-half was to be paid by the Federal Water Pollution Control Adrainistration, now the Environmental Protective Agency, and the other" half by lo'cal'agencies. This $85,000 was agreed by the District and St. Louis County to be shared on an equal basis, with each giving $27,500 in cash and $15,000 in services. The study was divided into Phases and.. Phase was Grand Glaize-Fishpot and. adjacent south County areas, and Phase was to be the balance of the County. The District has expended $20,000 in cash and $5000 in services on Phase, leaving $7500 in cash and $10,000 in services for Phase. We have contributed $8000 of the $10,000 in services by this time for Phase, and so need $2000 more in services and $7500 in'cash. This ordinance is for the purpose of appropriating that $7500. St. Louis County has appropriated its share. There was a great deal of discussion about the study, its purport, timirig and, relationship to the proposal by- the Citizens for Clean County Water Coramittee for ari annexation election. Mr. Kaiser read Opinion No. 333 frora the Attorney General of Missouri, Mr. John C. Danforth, dated May 28, 1970 in which he answered, a question for State Representative Walsh "...Ts the expenditure of MSD funds for purposes outside of the District authorized, by law?" The Attorney General concluded that the District did have authority to spend money for planning and. services outside its boundaries when it was necessary for the function of the District. (Copy of Opinion No. 333 in Secretary-Treasurer's File.) : Additionally, Mr. Kaiser read from the minutes of the meeting of May 7, 1970 concerning the discussion at the time the Board approved the initial commitment. Survey' 1012, Township 47 North,.'Range 7 East, St. Louis County (Proposed. Fox Voods Subdivision, Highway 67 and Coldwater Creek.) Mr. Sears showed, on a wall map the location of. the Fox Woods Plat #1 Subdivision, ari.'existing 'lo-foot easement requested to be vacated and the new 10-foo- easement which he said, had been granted to the District. He said that the easement is for the Coldwater Creek fiownstream lift station's force main. The original grantor of the easement has sold to a developer who has requested, a re-alignment of the easement and. sewer so that he may make better use of -the property-. Mr. Sears said the new easement is just as satisfactory for our purposes as the old one. River Subdistrict to include an area of St. Louis County, Missouri which could be efficiently served by the sewer or drainage facilities of the District and the Mississippi River Subd.istrict. Mr. Fiorito showed on a wall map an area in St. Louis County between Ballas Road and nterstate 244, south of Clayton and north of Manchester, which had petitioned to annex to the District, t is to become the southern half of a subdivision called Ban Coeur Estates. He said sewers would flow into an existing District sewer, and that the petition had been filed by single owner of all of the land in question. Mr. Sears showed the location of the Black Jack-Dellwood Creek watershed and principal channel, on a wall map. He said that this area was in the north part of St. Louis County, bi-sected by Old and New Halls Ferry Roads, and extending somewhat north of Redman Avenue and south of Chambers Road. He said this was for the protection of the general public by establishing building and floodway reser'vation lines for these channels. Concannon - aye H, W, Lee, Jr, - aye PLAN APPROVAL - MARTGNEY SANTARY NTERCEPTOR The Executive Director presented, for approval engineering plans for the Martigney Sanitary nterceptor. The project consists of a built-inplace pumping station with two l400 GPM pumps and a mechanically cleaned, bar screen and grinder. The wastewater will be d.ischarged. through approximately 2230 feet of 16-inch force main. As part bf this project, it is necessary to construct approximately 5780 feet of relief interceptor sewer varying in size frora 8 to 27 inches in diaraeter. The systera will.require approximately 33 manholes and other structures. The project is being financed, by a 75% federal grant and a 15'^ state grant. Engineering for the project was done by Consoer, Townsend. and. Associates. approved. Mr, Lee said he had examined the plans and moved that they be Motion was seconded, by Mr. Concannon. Lane, Jr. - aye A, R, Parker - aye Mr, Mattei said that the District did a Pilot Plant Project Study with the engineering firm of Havens and Eraerson, The project was discontinued-, but we would be able to get $170,000 from the federal government on this project if we would file a report of our findings. t would cost $700 or $8000 to have this made by Havens and Emerson, but it would be economically feasible, and we recommend- the extension of their contract to provide this study. Motion made by Mr. Huntington, seconded by Mr. Concannon, that the Contract, E-223A, be reinstated for the purpose of making a composite report bf the Pilot Plant Study. Wo discussion. Parker - aye Mr. Mattei reported that under his emergency contract power, he had. let a' contract to R. E. Bro-wne & Associates, nc. for the repair of a sewer where the pavement had collapsed,, in the area of Leisure and Palm. Messrs. Huntington and Lee reported, to-the Board that they had found two candidates for appointment to the Civil Service Coramission. Each"gave a resume of these men's backgrounds and qualifications, and. it was the consensus of the Board that they should, be contacted. Mr. Kaiser reported, to the Board that the District was holding $300,000, guaranty for completion, from McCarthy Brothers, one of the contractors who built the Bissell Point Treatment Plant. The subcontractors are suffering from this retention, since the general contractor has not paid them completely. We are about ready to make a settlement with McCarthy on the principal amount, and, there remains - basically - a payment of interest. He requested the Board's permission to negotiate the amount of interest to be paid. t was the consensus of the Board that Mr. Kaiser should so negotiate and, report to the Board. 12

13 Mr. Kaiser requested permission to negotiate an engineering contract with Consoer Townsend and Associates to design the proposed Bonfils Treatment Plant. The Board, was in agreeraent that he should so negotiate and report back to it for approval. Mr. Mattei showed, on a -wall map the location of a tract of land, that the Maintenance Department was interested, in using for a new maintenance station. He explained the need, for a better location and at his request Chairraan Parker asked. Mr. O'Toole to view the site with Mr. Mattei. Mr. Parker read araeraofrom Chairman Grayson of the Citizens for Clean County Water Coramittee (copy in Secretary-Treasurer's File) requesting that the District appoint a liaison committee- to meet with its coraraittee. The Chairraan asked Messrs. Huntington and O'Toole if they would serve, adding that he himself would also serve.. He appointed Messrs.
