Golden, secretary. Journal of the January 19, 1967 meeting (454th) was read. Motion made by Mr. Lane, seconded by Mr. Huntington, that same be approved as read. CONSDERATOW OF RESOLUTON WO. 915 DECLARWG WECESSTY OF MPROVEMEWT W' SUBDSTRCT WO. 302 (HAZELWOOD ACRES) Resolution Wo. 915 was presented and read, declaring necessity of improvement in Subdistrict Wo. 302 (Hazelwood Acres.) Mr. Sears said this proposed subdistrict is south of Highway 66, west of Graham Road. t is proposed to build sanitary sewer lines at the rear of the lots which would require shorter house connections. An alternative is to construct a single line in the middle of the street, which is cheaper, but would necessitate longer house connections. Both proposals will be presented to the people for their consideration. We feel that the cost to each individual will prove to be less if two lines are built, but the matter will be studied after the residents' comments are received. Mr. Ramacciotti asked if this subdistrict is in the Coldwater Creek area. Mr. Sears said that it was.

2 Mr. Ramacciotti said that as all the Trustees knew, he owned property in the Coldwater Creek subdistrict, but felt that since he was one of the two city members, it was important that he vote rather than hold up the project, Mr, Kinsey asked if this subject subdistrict was close to his property, Mr. Ramacciotti said that it was not. Motion made by Mr. Lane, seconded by Mr. Huntington, that Resolution Wo. 915 be adopted. Poll taken: F. W. Huntington - F, L. Ramacciotti - M. M. Kinsey - A. R. Parker - F. J. Lane, Jr, - CONSDERATON OF PROPOSED ORDNANCE NO, VACATWG PORTOWS OF AN EASEMEWT W THE CTY OF LADUE (W LOTS 6 & 7 OF LOG CABW ESTATES SUBDVSOW Proposed Ordinance Wo, was presented and read, vacating portions of a sewer easement in the City of Ladue, St. Louis County, Missouri. Mr. Clardy indicated the location of the sewer easement on the wall map. He said the request resulted from the resubdivision of the area, which made the easement lie well within the new Lot 7. There is a sewer in an existing easement and Engineering Department feels we have no need for the subject easement and recommends its vacation. Motion made by Mr. Ramacciotti, seconded by Mr. Huntington, for unanimous consent of all members present for introducti on and final 'voting on proposed Ordinance No at this meeting. Poll taken: F. 3 B COWSDERATOW OF PROPOSED ORDWANCE WO VACATNG AN,, EASEMEW.T N THE CTY OF WEBSTER GROVES (LOT, BLOCK 11 OF OLD ORCHARD PARK SUBDVSOW) Proposed Ordinance Wo, was presented and read, vacating a portion of sewer easement in the City of Webster Groves, St. Louis County, Missouri, With the aid of a wall map, Mr, Clardy showed the location of the old easement and the two new easements which had been granted. He said; there was no sewer in the easement proposed to be' vacated, and the Engineering Department had no objection to the vacation. Motion made by Mr, Huntington, seconded, by Mr, Lane, for unanimous consent of all members present for introduction and final voting on proposed Ordinance Wo, at this meeting. CYR ROAD) ^ Proposed. Ordinance Wo was presented and. read, repealing Ordinance Wo. l499 adopted June 9? and enacting a new Ordinance in lieu thereof on the same subject; authorizing and directing The Executive Director to grant to Union Electric Company the right to install, maintain and use overhead, electrical wires and overhanging crossarms and appurtenances along, over, through, and across certain properties in which the District has various rights, titles and interests lying in the City of St. Louis and St. Louis County, Missouri, together with the tanporary right to install, maintain and use a tower and appurtenances in part of such property, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. Mr. Clardy pointed out on a wall map the areas along and across the Moline Creek where Union Electric Company wanted authority to cross District property with their overhead lines.

4 n addition to the overhead encroachment, the Union Electric Company is asking for the-temporary right to build and maintain a tower on the right of way. There had been a mutual misunderstanding between the District and the Electric Company and the tower is now under construction in a portion of the right of way which it is-planned will be a part of the improved channel. The Electric Company requests that it be allowed to use the tower until such time as the District constructs the channel improvement and it will then remove the tower at its cost. The Engineering Department states that there is no objection to the tower's location as far as the present stream is concerned, and it would be perfectly satisfactory to wait until the channel is improved for the tower's removal. n response to a question rom Mr. Huntington, Mr. Clardy said the ordinance provided that Union Electric Company will remove it at its expense. Motion made by Mr. Huntington, seconded by Mr. Ramacciotti, for unanimous consent of all members present for introduction and. final voting on proposed Ordinance Wo, at this meeting. Parker - COWSDERATOW OF RESOLUTOW WO. 916 AUTHORZWG FLNG AN APPLCATON WTH THE FEDERAL WATER POLLUTON COWTROL ADMWSTRATOW, FOR A GRANT UNDER THE WATER POLLUTOW COWTROL ACT OF FUNDS TO AD EN DEFRAYWG THE COST OF COW- STRUCTWG A SAWTARY WTERCEPTOR SEWER W SUBDSTRCT WO. 235 (DES PERES BRAWCH OF SUGAR CREEK) Resolution Wo. 916 was presented and read, authorizing filing an application with the Federal Water Pollution Control Administration, for a grant under the Water Pollution Control Act of funds to aid in defraying the cost of constructing a sanitary 'interceptor sewer in Subdistrict Wo. 235 (Des Peres Branch of Sugar Creek.)

5 Mr. Mattei said this Resolution authorizes him to file with the Federal Water Pollution Control Administration of the Department of the nterior a request for a 30% grant for sewer construction for the Des Peres^ Branch of Sugar Creek. We had requested a 50^ grant from the Housing and Urban Development.Division, which was rejected. After some discussion by the Board members and the staff, motion was made by Mr, Huntington, seconded by Mr. Lane, that -Resolution Wo. 916 be adopted. Motion passed - 5 s, no-nays. Poll taken: F. W. Lane, Jr. - PLAN APPROVAL - LEMAY SEWAGE TREATMENT PLANT, ASH SLURRY PPELNES, CONTRACT PA-27B - MSSSSPP RVER SUBDSTRCT The Executive Director presented for approval engineering plans for the Lemay ^e-wage Treatment Plant, Ash Slurry Pipelines, Contract PA-27B, Mississippi River Subdistrict. Mr. Kinsey said this is a relatively small job consisting of 7100 lineal feet of six-inch Ash Slurry Pipelines including fittings, couplings, ties, thrust blocks, supports, and appurtenances, laid in two parallel lines in a common trench to transport ash from the Lemay Sludge Disposal Building to the proposed Ash Lagoons, They were designed by Consoer-Townsend and reviewed by Sverdrup & Parcel and Associates, Mr. Kinsey said he had reviewed the plans and made a motion that they be approved. Motion seconded, by Mr. Ramacciotti. Poll taken: F. W, Huntington - F. L. Ramacciotti - M. M. Kinsey - ' A. R. Parker - - Mr. Kaiser said that the District needed to cross three lines of the Phillips Pipe Line Company with the Ash Lagoon Entrance Road to the Lemay Sewage Treatment Plant. The Phillips Company had previously wanted the pipe to be encased in concrete, insisted that they do the job themselves, and that the District pay the $ cost. We did not feel this was desirable and after considerable study and consultation with the Phillips engineers they agreed that since the pipe lines were covered by five feet of dirt, there

6 is no real expectation of damage, but they want us to agree to pay for any damage to the pipe occasioned by the road; they want us to repair the road, if damaged, and hold the Phillips Company harmless if there should be any claims arising o.-ut of personal ihjuries or damages to property as a result of our road construction maintenance and use. 1^ Motion made by Mr. Lane, seconded by Mr. Huntington, that the Executive Director be authorized to sign an agreement with the Phillips Pipe Line Company to pay any damages done to their pipe line by the construction and existence of an entrance road to the Ash Lagoon for the Lemay Sewage Treatment plant and to hold the Phillips Pipe Line Company harmless if there should be any claims arising out of personal injury or damages to property as a result of our road construction, maintenance and use, > Poll taken: F. Parker Mr. Mattei said that the McCarthy Bros, Construction have an approximate $8,000,000 contract for the Bissell Point Sewage Treatment Plant, 'Sludge' Disposal Facilities, Contract PA-6. n their proposal for this contract, under Major tems of Equipment (Part Wo. 4l (a) Lime Feeders and Lime Slakers) B.. F. has been specified, Mr.' Flick sent to the Executive Director a memo requesting Wallace & Tiernan (Part Wo. 4l (b) Lime Feeders and Lime Slakers) be accepted by the District in lieu of B.. F, for an additional $1000 to McCarthy's base bid, if approved by Havens & Emerson, They did so and agreed with Mr. Flick, Mr. Mattei said it was his recommendation that the District permit McCarthy Bros, to use the Wallace & Tiernan equipment at a cost of $1000. He added that Mr. Flick is the one vrho will be responsible for the use of the equipment. n reply to questions by Messrs. to approval by Sverdrup & Parcel and Havens i Mr. Mattei said they had all approved. Parker and Huntington as Emerson and our own engineers, Mr. Ramacciotti moved that the Executive Director be authorized to make a change order calling for the use of Wallace & Tiernan Lime Seeders and Lime Slakers (item B) rather than the B.. F. Lime Slakers and Lime Feeders (item A) in the Bissell Point Sewage Treatment Plant, Sludge Disposal Facilities, at a cost not to exceed $ Motion seconded by Mr, Huntington.

7 Poll taken: F. W. Huntington - M, M. Kinsey - F. L. Ramacciotti A, R. Parker Mr, Mattei requested the Board's permission to add six additional positions for sewer construction and maintenance laborers at $223 bi-weekly. They are needed to maintain the River des Peres. All that is needed is authorization to establish the positions. Mr, McLaughlin has enough money, in his salary account. We have been trying to get construction laborers in the top labor class, and we now find some available. Mr, -Ramacciotti asked if this is necessary to increase the efficiency, Mr, Mattei said that it was. Motion made by Mr. Ramacciotti, seconded by Mr, Lane, that six positions be authorized, in positions numbered through in the Maintenance Department, Sewer Construction-Maintenance Laborers, Grade 11, Poll taken: F. W. Huntington - F. L, Ramacciotti - M. M. Kinsey - A. R. Parker - F. J, Lane, Jr, - The Board and staff discussed the money market and its relationship to the Mississippi River Subdistrict financing.
