2 Mr. Matheny read aloud Resolution No expressing the Board of Trustees' appreciation to vory Smith for his 13 years of exemplary service to the District from July 20, 1976 to his retirement effective July 1, A vote was taken on the adoption of this resolution later in the meeting. Mr. Matheny called upon Mr. George Sabre, who had requested to address the Board. Mr. Sabre read aloud a letter he had addressed to Chairman Thomas Matheny and the Board of Trustees, and Executive Director Frank Kriz and the executive staff (copy attached). Mr. Matheny called upon Mr. Steve Otten, who had requested to address the Board. Mr. Otten, an employee of MSD, addressed the Board and indicated that he had been there when the District needed him, that is, during the flood problem and the bond issue problem, but felt that the District was being unfair to him by granting only a 3-1/2 percent raise. Mr. Matheny called upon Mr. Tracy Jackson, who had requested to address the Board. Mr. Jackson addressed the Board and indicated that he was also an employee of the District and had been for five years. He did not consider the 3-1/2 percent a decent raise and he did not consider it a fair shake, especially in light of the fact that he had worked the polls and tried to obtain votes for MSD. Mr. Matheny called upon Mr. Ried Lowrie, who had requested to address the Board. Mr. Lowrie addressed the Board on the subject of the recent wage negotiations between Local 410 and the District. He felt that the MSD employees should not be compared to the other governmental units such as St. Louis City and County in that the employees of the District provide a unique service, that is quality service under less than pleasant working conditions. - 2
3 He further contended that the employees of the District should receive at least the wage package that their governmental counterparts are to receive. The City will have an earnings increase of 7 percent starting on July 1. He stated, "the District seems to be conducting a public relations campaign on the backs of the employees." He also felt that management should also make sacrifices, such as freezing of salary increases for those making $35,000 a year or more, and foregoing autoraobile allowance and mileage reiraburseraents. Mr. Matheny called upon Mr. James Dougherty, who had requested to address the Board. Mr. Dougherty addressed the Board and indicated that he was President of Local 410, which was the largest of the employee unions at MSD with 240 dues paying merabers. Based on a vote of to reject the wage increase, Mr. Dougherty felt that the wage increase was inadequate and he indicated that 30 people should not be allowed to dictate the raise of the majority. Mr. Matheny called upon Mr. Ken Johnson, Ms. Alice O'Brien and Mr. Joseph Schneider, who had requested to address the Board. Mr. Johnson provided a video tape of the erosion that four properties in Ferguson were experiencing adjacent to our pump station on Maline Creek. Also narrating the film was Ms. Alice O'Brien. Still photographs were also distributed to the Board members. Mr. Schneider addressed the Board and stated that he was also a resident experiencing erosion probleras and he indicated that he felt the cause of the erosion problems was due to MSD's installation of a 48 inch sewer across the three properties. When the sewer was installed the slope of the creek was change and the rocks removed. He requested that MSD address the erosion issue. Mr. Matheny called upon Doug Fletcher, the Mayor of the City of Ferguson, who had requested to address the Board. Mayor Fletcher addressed the Board regarding a jurisdictional problem faced by the residents of Maline Creek between the United States Army Corps of Engineers and the District. He explained that ultimately the Corps has a master plan for Maline Creek. However, this plan is currently unfunded. Consequently, residents are neither getting satisfaction from the Corps of
4 Engineers nor MSD regarding their complaints. Mayor Fletcher requests that MSD resolve the communications problems with the Corps so that the residents' complaints could be properly addressed rather than be shuffled between the two agencies. Mr. Matheny comraented that he was aware of both the erosion probleras and the communication probleras regarding the residents along Maline Creek. He noted that it is a very serious problem and was unsure as to what the final solution could be. He did feel that MSD should take the responsibility of answering, documenting and tracking the customers' complaints. Mr. Matheny called upon Ms. Betty Poe of Veteran Septic Tank Service, who had requested to address the Board. Ms. Poe addressed the Board and protested the rate increase from two cents to five cents included in proposed Ordinance No Mr. Matheny noted that this increase was in line with the surcharge that was voted on in Mr. Etwert indicated that this increase was based on two elections held in March and August of 1988 and was in line with the increase of the single faraily rate which went into effect in January He further noted that this was an equitable distribution of the charge. He stated that all plants will accept hauled waste and this, increase was necessary to keep the waste haulers' charge in line with the Clean Water construction increase. Ms. Poe indicated that this represented a tripling of the rate, especially burdensome to people not living within the District. Mr. Etwert pointed out that some sewer districts do not accept hauled waste and that hauled waste from other areas is being processed by the District's plants and hence fall under the District's rate increase for Clean Water. Mr. Matheny called upon Ms. Jo Ann Williams, Secretary-Treasurer for Local 410, who had requested to address the Board. Ms. Williaras addressed the Board and noted that Local 410 had a ratification vote concerning the pay ordinance that is up for adoption. Based on this vote. Local 410 did not feel that the pay increase was adequate, nor did they feel that their members had been given an opportunity for fair negotiations. She noted that Local 410 by merabership is theraajorityunion and that they would like to reopen or at least have the Board reconsider the current proposal.
5 She objected to the loss of the twenty days full pay for a Workers' Compensation injury, acknowledging the fact that the current policy is above what is required by the Workers' Compensation law, but also noted that the conditions in which the employees work most other people could not tolerate. She noted that the District controls every aspect frora injury to recovery of the eraployees. f the District has experienced cost overruns then they should look to their charges from their health providers and addressing their safety program. She asked the Board to at least consider the same wage increase package that the City and the St. Louis Zoo have offered their employees, that is, 4 percent, and noted that 5 percent is not considered unreasonable. She concluded by indicating that the employees of the District are the District's public relations campaign. They are very good representatives of the District. Mr. Matheny called upon Mr. Lois L. Smith, President of the West Elm Place Corporation, who had requested to address the Board. Mr. Smith addressed the Board and indicated that he is the owner of the largest privately owned sewer company in the State of Missouri, the West Elm Place Corporation, and he also represented other private sewer corapanies throughout the State. He was concerned about the lack of advance notice frora the District in increasing the waste hauling rate frora two cents to five cents. Had the District notified the haulers at an earlier point in time they could have compensated for this rate by either allocating the charge to the customer or placing it in their cost to the Public Service Commission. He requested that the District gradually increase the rate rather than a sudden three cent increase. Mr. Schraid gave his report on the status of theraajorconstruction projects, priraarily the Clean Water Capital raprovement project, and indicated that this project had been approved by the voters in August of 1988 and was composed of three areas, the Bissell Point Secondary Treatraent Facility which will constitute approximately 58 percent of the cost, the Bissell Overflow Regulation System which will constitute 34 percent, and other sraall projects which corapose approximately 8 percent. As of June 1, approximately 1/4 or $112 Million of cost has been completed or under construction. Approxiraately 38 percent of the Bissell Point Secondary Treatraent Plant is under construction and 5 percent of the Overflow Regulation Systera has been corapleted or is under construction. n general, Mr. Schmid noted, on the positive side the District has stayed on schedule and has been generally in compliance with the Consent Decree. The Final Clarifiers, Secondary Treatment Operating Center and the
6 Effluent Pump Station have been started on time. The Woodside Trails Facility has been eliminated and the Baumgartner Facility upgraded. On the negative side, the Sludge Disposal Facility started 21 days late. A penalty of $5,250 has been placed in escrow. Also on the negative side recent rains have impacted construction as has the bricklayers' strike which started on June 1. Frora a cost perspective on the positive side, 16 bids have been under the engineering estiraate by a total of approximately $11 Million. Three, however, were over the estimate by $10.4 Million, the largest of which was the $10.2 overage for the Sludge Disposal Facility. Few change orders have been processed to date. Of the five completed projects, approximately $700,000 has been returned to the Trust Fund. The Trust Fund has earned $3.1 Million in interest, $43.9 Million in Federal and State grants, with another $23 Million in anticipated grants. Between the interest and the grants, it is anticipated that the tirae which the surcharge is to be levied will be shortened by 6 to 18 months depending on circumstances. Unfortunately, a letter has been received from the State which could threaten the receipt of future grant monies unless the District can show how it will handle cost increases required to run these facilities. The District, due to good bids, has also added a turbine generator which will save approximately $150,000 a year in power costs. Mr. Schmid summarized the cost aspect by indicating that the large over budget amount was due to the Sludge Disposal project. The District has been or will be able to compensate for some of this overage, but about $5 Million reraains to be caught up for the project to be on the positive side. He also noted that ash removal costs have increased from an estimate of $150,000 to $400,000 and still climbing. He also noted additionally that several Overflow Regulations System projects have encountered hazardous waste, priraarily Mill Creek, which is a Consent Decree project, and discussions are under way with the owner of the adjacent land. Another site tributary to the Ferry and Gingrass sewers showed signs of hazardous waste infiltration. This section is to be rehabilitated by March 1993 and it is hoped that it will proceed quicker than that of the Mill Creek sewer. Mr. Schraid noted that in late December of 1988 the District adopted an Owner Controlled nsurance Program at the Bissell Point Plant. This program it is estimated will save the District at least $10 Million, with the possibility of saving an additional $3 Million due to favorable claims experience. However, the experience to date has not been favorable, primarily due to one section of the project. t is hoped that an increased safety effort could correct this situation in the future. Mr. Schraid showed various photographic slides detailing the construction status of the Bissell Point Secondary Treatment Facility, Effluent Purap Station, the Employees Building, and the Sludge Disposal and Dewatering Facility. Mr. Schmid indicated that the Overflow Regulation System is designed to eliminate dry weather discharges at high river stages. Ms. Roberts questioned what hazards the employees faced with respect to toxic waste seepage at Mill Creek and what can be done to correct this issue. Mr. Schmid indicated that an EPA Super Fund site is above the Mill
7 Creek Sewer. Negotiations are under way with both the present and prior owners of that property. Mill Creek is a Consent Decree project and a major tributary handling approximately 50 million gallons a day. t is hoped that an interim solution can be reached to allow rehabilitation of the sewer. He indicated that because of hazardous waste no penalties have been levied to date. Ms. Roberts again questioned how hazardous this situation was to our employees. Mr. Koeper indicated that the seepage is in the very lower reaches of Mill Creek and that MSD has not been in that sewer since the discovery of the seepage. Mr. Rains indicated that the tests showed that the dioxin levels were above the tolerable limits, requiring skin protection only. An employee noted that water test results and dioxin lists were not provided to employees by their supervisors. Mr. Koeper noted that the dioxin lists were based on Super Fund sites that were established through preliminary testing. Many of these sites have been retested and are no longer consider hazardous. Mr. Schmid concluded his discussion by providing the status of the various aspects of the rehabilitation project and minor projects which have been previously discussed. Ms. Roberts indicated that she was interested on how this project was projecting against budget, particularly in light of the big shock that was received over the sludge disposal renovation and asked if the District was sure about its current budget to avoid future surprises. Mr. Schraid indicated that he was comfortable with the current budget, because of the lack of other projects being completed in the coramunity, creating a great amount of competition for our bids. He also noted the biggest push will be in this next year, approximately $130 Million. Mr. Schmid also noted that the sludge disposal renovation was our most difficult project, because we were working inside the existing treatment plant. Ms. Roberts complimented the effort on accountability raade by the District with respect to the Clean Water projects. Ms. Roberts requested raore information about the ongoing review of contracts to assure that weraaintainthe quality and econoray that we are striving for. Mr. Schmid indicated that the District uses a procedure called peer review where one firm does the project, that is, designs the project, and the other firm does a completely independent review and, additionally, construction individuals examine the plans for constructability. This is called a constructability review. Between these three reviews we try to catch raost of the probleras before they go out for bid. Ms. Roberts coraraented that she hoped before long we can assure people that there will be a sunseting of the surcharges earlier than anticipated. Ms. Patterson thanked Ms. Roberts and indicated that the District will not relax and will continue to strive to meet her high expectations. Ms. Patterson also noted that the District would do everything within its power to try to sunset this as soon as possible.
